3 Grss Ticket Revenues (fr events with admissin ticket sales) If and where applicable, Grss ticket revenues is defined as all mnies received by the tenant frm the sale f admissin tickets t the event. Admissins Tax (fr events with admissin ticket sales) When applicable, a 10 percent City f Hamptn admissins tax n grss ticket revenues will be cllected frm events with admissin ticket sale. The landlrd will deduct this tax frm grss ticket revenues and remit same t the city. Services and Facilities Included in Building Rental Fees In cnsideratin fr the building rental fees, the tenant shall have the use f the basic areas inside the facility, as rental plicy allws, including the fllwing: Included fr every rental Nrmal supply f water and electricity. Heat r air cnditining. Limited n-site public parking. Nrmal janitrial services. Related Services and Facilities Nt Included in Building Rental Fees Event-related staffing which includes, but nt limited t, event staff, security persnnel, and peratin persnnel, supplemental t the equipment and persnnel included in the Building Rental Fees. All event-related staffing must be prvided by the landlrd at tenant s expense (see Event-Related Charges and Rates, pg. 5). Nte: The Hamptn Cliseum/Hamptn Arts Cmmissin shall have the ultimate authrity in determining the number, type and lcatins f all event-related persnnel deemed necessary fr the event. Office facilities including equipment and Kitchen. Other event-related labr, equipment and special services (see Event-Related Charges and Rates, pg. 5). Event related marketing. Damages and additinal cleaning fees. Hld Prcedure Date(s) will be held n a tentative basis upn request frm a prspective tenant and subsequent cnfirmatin in writing by Hamptn Cliseum/Hamptn Arts Cmmissin. A tentative date will be held fr a maximum f 10 days withut recnfirmatin. All hlds will be cnsidered tentative and, therefre, subject t cancellatin until a frmal Rental Agreement has been executed by the parties and the apprpriate depsit delivered t and accepted by Hamptn Cliseum/Hamptn Arts Cmmissin. Shuld a tentative reservatin be challenged by anther party, the party with the first hld will be required t immediately execute a Rental Agreement and prvide the necessary depsit. T challenge a tentative hld by anther party, the challenging party must request the date(s) in writing and frward the necessary depsit. (Nte: The previus reservatin will nt be challenged until the depsit is received.) Shuld the first reservatin be canceled, a Rental Agreement will be issued t the challenging party. Shuld the party with the previus reservatin execute a Rental Agreement; the depsit will be returned t the challenging party. The Charles H. Taylr Arts Center Rental Infrmatin Page 3 f 5
4 Depsit A nn-refundable and nn-interest bearing advance depsit is required with the signed Rental Agreement. The Hamptn Cliseum/Hamptn Arts Cmmissin reserves the right t require an additinal depsit t cver anticipated event-related expenses. Payment must be made by cash r credit card r cashier s check and payable t Hamptn Arts. Insurance Each tenant may be required t purchase a cmprehensive liability insurance plicy prviding cverage f up t $1,000,000 fr any ne accident r ccurrence, $1,000,000 fr any ne persn injured in any accident r ccurrence, and $2,000,000 fr prperty damage liability. The Hamptn Arts Cmmissin, City f Hamptn, VA and The Hamptn Arts Fundatin must be named as additinal insured n the insurance certificate. A certified cpy f the insurance plicy cntaining apprpriate cverage will be required 45 days prir t the event. Actual insurance requirements will be determined by Hamptn Cliseum/Hamptn Arts Cmmissin management based n the size and nature f the event, and may include waiving all r part f the insurance requirements. Flr Plans Flr plans must be submitted at least 60 days prir t the mve-in f the event fr apprval. Fd and Beverage Service Hamptn Cliseum/Hamptn Arts Cmmissin and/r its designated cncessinaire, retains the exclusive right t perate all fd and beverage cncessins, f any nature in The Charles H. Taylr Arts Center, and further, t retain all revenues derived there frm. Suvenir, Nvelty and Merchandise Sales If event-related suvenirs, nvelties, and prgrams are sld during an event, the tenant shall remit t Hamptn Cliseum/Hamptn Arts Cmmissin a cmmissin fee equivalent t 20 percent f grss revenue after deductin f all applicable state and lcal sales taxes.
