2 Use Plicy Agreement Effective 2/7/2017 The rental f the Augusta Train Dept Facility is subject t the fllwing prvisins: A. RESERVATION PAYMENT a. Reservatins will be made n a first cme first serve basis. Reservatins will nly be cnfirmed when the written applicatin and rental & depsit fee have been returned. b. Damage/Cleaning Depsit: A $200 depsit (cash r check) is required at time f reservatin fr the facility. This depsit shall be held until after the Lessee s event. If Lessee finds any damage upn his r her arrival, Lessee shall call ne f the cntact numbers shwn at the bttm f this agreement. c. Payments can be made using cash r check. Checks must be written t the City f Augusta. Failure t pay the rental fee will be reasn enugh t deny the use f the facility by the grup r rganizatin. d. All fees charged shall be payable in advance. Separate payments fr the damage/cleaning depsit and the rental fee are required. Fee fr scheduled activities will be refunded if the activity is cancelled and seven (7) days ntice is given in writing ( is acceptable). e. Lessee shall be respnsible fr all csts f replacement r repair caused by any and all damage t the Dept and cntents theref. f. If Lessee is fund t be ccupying the Dept utside f the space and/r time paid fr n the reservatin frm, the depsit mney will be frfeited by the Lessee. g. USAGE OF BUILDING a. The use f the facility must be cnfined t that stated in the event descriptin abve. b. The Lessee signing the agreement fr the use f the facility will be respnsible fr all persns entering the facility which they are using regardless f whether r nt all thse entering are members f the grup which has been permitted t use the facility. Only the specific sectin f the facility mentined in the agreement is t be used by the grup. This includes the receptin area, kitchen, and restrms. c. Use f tbacc and illegal drugs is prhibited. Disrderly cnduct is prhibited. A permit is required t cnsume alchl inside the building. Permit requests are available thrugh City Hall and ten (10) wrking days shuld be allwed fr applicatin prcessing. There is a $25.00 applicatin fee. d. All grups must bserve all psted regulatins in the rental facility.

3 e. The Fire Department has the right t walk-thrugh the building at any pint during the event t check the ccupancy and ensure cmpliance with the fire cde. f. The Lessee signing this agreement agrees t be the respnsible party. C. ALCOHOL POLICY; TEMPORARY PERMIT a. The City Manager r his designee must apprve all events at which alchlic r malt beverages will be served. b. The City Manager r his designee has the authrity t make special regulatins fr any such event, which may be mre restrictive than thse included in the riginal cntract. c. Any caterer charging a fee fr alchlic r malt beverages must be licensed with the State f Kansas and apprved by the City Manager r his designee. d. The lessee will be respnsible fr prviding adequate supervisin fr the dispensing and serving f alchlic beverages t guests attending the event. e. All guests attending an event serving alchlic beverages must be 21 years f age except: 1. If an individual is emplyed fr the event t perfrm a service i.e. entertainment, catering, etc. 2. If an individual is accmpanied by a parent, legal guardian r ther relative ver the age f 21. f. The City Manager has the authrity t deviate frm the administrative plicy. g. Any vilatin f the plicy will result in the immediate terminatin f the event. D. FACILITY TOUR; ACCEPTANCE a. A tur must be scheduled prir t the rental date. Call r t arrange fr an appintment. (Please nte, the tur requirement can be waived if yu have been n a facility tur f the Dept in the last 365 days). Lessee shall receive and accept the Dept in its cnditin at the time the Lessee cmmences use f the Dept, which cnditin the Lessee has examined and hereby apprves. Lessee assumes all risks f, and City shall nt be liable fr, injury t persns and damage t prperty resulting frm the cnditin f the Dept. E. SUPERVISION F. CLEAN UP a. Any and all events with minrs in attendance must prvide adequate supervisin fr all underage attendees. The City reserves the right t refuse use f the facility by any grups nt in cmpliance with this regulatin if they feel it is in the City s best interest t d s. a. The Lessee is respnsible t leave the facility in the same cnditin it was fund. This includes remval f all trash and recyclables t utside cntainers, wiping dwn tables and chairs, and sweeping the flrs. b. Renter is respnsible fr cleanup f ANY & ALL spills r accidents. c. City has cntracted with the Augusta Chamber f Cmmerce Directr t inspect the premises t City s satisfactin after the lessee s use. Any damage r excessive cleanup needs, nted by the inspectr, t the Dept building and/r grunds will result in a lss f depsit. The lessee shall be ntified f the additinal fee t be assessed if damage is abve depsit amunt. It is the respnsibility f the lessee t ensure that the caterer prvides prper cleanup. In the event f n detected damage r excessive cleanup, the Depsit shall be returned r securely shredded at n expense t the Lessee.

4 G. KEYS a. An entrance key is available fr Dept renters. When the event is ver, cleanup has taken place, lights are ff, and all drs are securely lcked, return the key t the drp bx n the nrth side f the Dept building. b. Please return the key within 48 hurs. Failure t return the facility key will result in lss f depsit. H. DECORATIONS: The fllwing plicies apply t all decratins: I. LICENSE a. NO nails, tape, tacks, r staples are allwed n the Dept walls. Blue Painters tape is an acceptable adherent. b. NO glitter, cnfetti, hay, and straw are allwed t be used fr decrating within the facility. Candles and smking are prhibited. c. NO items which may cause damage t the facility flr r grass are permitted. d. Buncy huses are strictly prhibited. e. Failure t cmply with any f the afrementined decratin rules will result in a lss f all facility usage privileges. a. The City hereby grants a revcable nn-exclusive license t Lessee t use, nly fr the purpses and manner set frth in the reservatin frm, herein, and as apprved by the City, the Dept fr the perid set frth in the reservatin frm. This may be revked by the City at any time, fr any reasn in the City s sle discretin, including, but nt limited t Lessee s failure t pay rentals and fees due hereunder, Lessee s breach f any term f this Agreement r reservatin frm, scheduling cnflicts, illegal r alleged illegal activity at the Dept, r vilatin f any City rules with respect t use f the Dept. In the event the City revkes this license prir t Lessee s use f the Dept and nt as a result f Lessee s breach f its bligatins under this Agreement r the reservatin frm, City shall refund the rental and usage fees paid by the Lessee. Such refund will be Lessee s sle remedy fr such revcatin. J. LIABILITY & INDEMNITY a. The Lessee fr itself, its agents, emplyees, representatives, assigns, guests, invitees and thers using the Dept and adjacent premises under this Agreement shall waive any claim(s) whatsever against the City f Augusta, any department theref, its Gverning Bdy and its Representatives (cllectively Indemnitees ), fr any lss, injury r damage during the time the Dept r adjacent premises are used and ccupied by said Lessee. Lessee shall indemnify, defend, and hld the Indemnitees harmless frm any and all damages, lsses, csts, claims, liabilities r expenses (including attrney fees and expenses), (cllectively, Lsses ) arising ut f r relating t Lessee s r Lessee s agents, emplyees, representatives, assigns, guests, invitees and thers using the Dept, use f the Dept and/r any ccurrence at r n the Dept during Lessee s use theref t the extent such Lsses were nt caused by the acts r missins r Indemnitees. The Indemnitees shall nt be liable t the Lessee, its agents, emplyees, representatives, assigns, guests, invitees r thers using the Dept fr any cnsequential r incidental damages arising r resulting frm the perfrmance r breach f this Agreement r licensing f the Dept t the Lessee. K. RULES & REGULATIONS a. Rules and regulatins are subject t change at the City s discretin. b. Lessee agrees that it, and its agents, emplyees, representatives, assigns, guests, and invitees shall cmply with all such rules and regulatins at all times. c. The Lessee must be at least 21 years f age.

City f Augusta is hereby authrized and granted the authrity t refuse the use f the Dept r any part theref, t Lessee r any agent, emplyee, representative, assign, guest, r invitee f Lessee when such use wuld be cntrary t sund public plicy, r where, in the City s sle pinin, such use wuld be bjectinable t the public. 6 Lessee Reminders General Plicies Parking in designated parking areas nly. Overflw parking is available n State St. and in the public parking lt half a blck suth f the Dept. Use f illegal drugs, smking, and/r gambling is nt permitted at the Dept. A permit is required t cnsume alchl inside the building. Only thse rms specified n the agreement will be available fr use.
