1 Alchl Plicy The University requires that event spnsrs and student grups wishing t ffer alchlic beverages at their prgrams and events perate within state and lcal laws as prvided by the Department f Alchl and Beverage Cntrl (ABC). It is the plicy f the University t maintain a drug-free wrkplace and campus. The wrkplace and campus are presumed t include all Stanfrd premises where the activities f the University are cnducted. The unlawful manufacture, distributin, dispensatin, pssessin and/r use f cntrlled substances, r the unlawful pssessin, use, r distributin f alchl is prhibited n the Stanfrd campus, in the wrkplace, r as part f any f the University's activities. Cmpliance is the respnsibility f the Cnference Organizers and each cnference participant/staff member. THE PURPOSE OF ACQUIRING A LICENSE State and cunty authrities (i.e., the ABC) prvide authrizatin licenses t serve alchl in accrdance with any and all applicable state and lcal laws, rdinances and regulatins, including University plicies and prcedures. The service f alchl n campus fcuses n beer, wine, and champagne. When a Cnference Organizer btains this license, the ABC is prviding special event authrizatin t serve alchl in an area r venue n campus that is therwise unlicensed t serve alchl n a regular basis. The license is in additin t the regular license that a beverage cmpany r caterer may already have. The license yu are btaining grants permissin nt nly fr the service f alchl but fr the caterer/beverage cmpany t serve in facilities r venues n the campus where alchl is nt nrmally served. Frm infrmatin received frm Alchl Beverage Cntrl supervisrs, a catering r beverage cmpany license DOES NOT necessarily preclude the Cnference Organizer frm needing t btain a license t serve alchl at a Stanfrd campus event. If an event serving alchl is being held at multiple lcatins, at varius times, r n multiple days, permissin t serve is required fr EACH lcatin. WHEN A LICENSE IS REQUIRED If ANY f the fllwing cnditins listed belw exists, the Cnference Organizer MUST btain a license: A registratin r attendance fee is being charged fr the event and alchl will be served at any pint during the event. 2 Alchl Plicy WHEN A LICENSE IS NOT REQUIRED N license r permit shall be required fr serving alchlic beverages where all the fllwing cnditins prevail: There is n sale f any alchlic beverages. The premises are nt pen t the general public during the time alchlic beverages are served, cnsumed r therwise dispsed f. The premises are nt maintained fr the purpse f keeping, serving, cnsuming r therwise dispsing f alchlic beverages. Obtained frm: ABC Act and Related Statutes: Effective Frm Chapter 3, Article 3. Rights and Obligatins f Licensees Please Nte: At certain times and the discretin f the Office f Special Events & Prtcl and the Department f Public Safety, an alchl license may be required. IMPORTANT LIABILITY INSURANCE INFORMATION Catering cmpanies servicing alchl are required t prvide prf f insurance cverage in the frm f a certificate f insurance. ALCOHOL IN RESIDENCES OR DINING HALLS Yuth Prgrams in Residences: Alchl is nt t be cnsumed, served, r stred in yuth prgram buildings, even when staff members are the nly individuals present in the building. Adult Prgrams in Residences: If alchl will be served in the residence, the Cnference Organizer is respnsible fr having the license available n the premises. Stanfrd Cnferences and Stanfrd University will nt take respnsibility fr alchl that is lst, misplaced, r stlen under any circumstances. All alchl and alchl service must be served, mnitred, pened, and dispsed f by yur staff members wh are ver 21 years f age. Yur prgram must prperly secure all leftver alchlic beverages. Lcked meeting rms r ther cmmn areas are nt cnsidered secure, given that many peple have keys and access t these areas. Adult Prgrams in Dining Halls: If yur prgram wishes t serve alchl during their meal service in the dining hall, please cntact yur Cnference Accunt Crdinatr at least 2 mnths prir t yur prgram s arrival n campus. Stanfrd Student Prgrams: Prgrams fr new r returning Stanfrd students are bund by the same rules gverning the academic year. Stanfrd student prgrams shuld cntact the Office f Student Activities at (650) if they wish t serve alchl at their event. SERVING ALCOHOL IN OTHER UNIVERSITY LOCATIONS Outdr Lcatins: Requests fr event use f utdr campus lcatins must be made by cmpleting and submitting an Event Space Request Frm t yur Cnference Accunt Crdinatr. 3 Alchl Plicy as utlined in this dcument. There is a mandatry charge fr delivery and pick-up f trash cans/recycling bins and clean-up after yur event. If yur grup des nt dispse f items prperly, yur cnference will pay increased charges, as labr is charged n an hurly basis. Tresidder Unin: Any alchl served at Tresidder Unin must be arranged thrugh Stanfrd Catering and served by Best Beverages Catering. Yu cannt bring yur wn alchl r fd t this lcatin. Faculty Club: Any alchl served at the Faculty Club must be prvided and served by the Faculty Club. In rder t use the Faculty Club, yu must make arrangements thrugh a Faculty Club member. Classrms and Auditriums: Fd and beverages (including alchlic beverages) cannt be served inside classrms r auditriums. Self-service f alchl is nt allwed in any lcatin n the campus. Once it has been determined that the event needs a license t serve alchl, please the fllwing infrmatin abut the event t the cntact(s) listed abve. This persn shuld be a lead member f the Stanfrd spnsring grup and ver the age f 21 years STEP TWO REVIEW AND APPROVAL OF REQUEST Office f Special Events & Prtcl (OSEP) will review the request fr a license and if apprved, send a cnfirmatin t the requestr and an t the Stanfrd Department f Public Safety cnfirming apprval. At this pint, the Stanfrd Department f Public Safety will then generate a frmal letter f apprval addressed t the Santa Clara Cunty Office f Alchlic Beverage Cntrl. The Department f Public Safety will ntify the cntact persn indicated in the initial request when an apprval letter is ready t be picked up frm their ffices at: 711 Serra Street, phne: (Please allw fr a minimum f five (5) business days fr the letter t be prepared.) PLEASE NOTE: The letter given t yu by the Department f Public Safety DOES NOT cnstitute permissin t serve alchl at yur event. 5 Alchl Plicy STEP THREE MEETING WITH THE ABC, FEES, & FINAL PAPERWORK The Santa Clara Cunty Alchl Beverage Cntrl (ABC) is lcated at: 100 Pase de San Antni, Rm 119 San Jse, CA Phne: *Yu can apply by mail days befre the event with a cashier s check r mney rder but it may take lnger t apprve yur request.* The ABC is lcated between 2nd and 3rd Streets in dwntwn San Jse in the State f Califrnia Building. The ABC advises that yu t cntact the ffice befre ging there t ensure that yu have all the necessary dcumentatin and knw the apprpriate fees that will be required. Yu will need t cmplete a Daily License Authrizatin (Frm ABC 221), als knwn as a special event daily license. PLEASE NOTE: A Stanfrd representative must be present and have the license n hand fr the full duratin f an event where alchl is being served. Fr Internal prgrams, this shuld be the Stanfrd Cnference Organizer. Fr External prgrams, this shuld be yur Stanfrd Spnsr. If yu dn t have a Stanfrd representative wh can be present fr the full length f yur event, yu can request staffing and handling f the license frm Stanfrd Cnferences. If necessary, please discuss this ptin with yur Cnference Accunt Manager/Crdinatr. Imprtant Jurisdictin Ntice: Only the ABC Offices in Santa Clara Cunty are acknwledged apprvers fr alchlic beverage licenses granted fr events at Stanfrd. A permit btained frm the San Francisc r San Mate Cunty ABC ffices will nt be recgnized as prviding legal authrizatin as Stanfrd is in the Cunty f Santa Clara. Alchl Plicy Page 5 f 7

6 Alchl Plicy OTHER POLICIES AND GUIDELINES In reviewing whether a license t serve alchl will be granted, the histry f a grup r event will be cnsidered. Vilatin f campus plicies and rules may result in cancellatin f the event and further disciplinary actins. Alchl is nt permitted t be served unless Equally Attractive Nn-Alchlic Beverages (EANAB's) and fd is made available and are easily accessible thrughut the event. SERVING GUIDELINES Only persns ver the age f 21 years may serve alchl t attendees. Self-service f alchl IS NOT permitted. If there will be attendees at the event wh are under the age f 21 years, the Cnference Organizer must have a plan in place t ensure that these guests will nt be served alchl, e.g., ID cards must be shwn upn entering the venue and wristbands must be distributed. Anyne wh lks t be under the influence f alchl and unable t exercise care fr ne s wn safety r that f thers shuld nt be served alchl and the Department f Public Safety may be ntified if there are further questins r cncerns. If immediate assistance is needed r an emergency ccurs, call 911. Other specific requirements may need t be in place as well. Please cntact the Department f Public Safety if yu have any questins at CIVIL LIABILITY AND YOUR RESPONSIBILITY AS A CONFERENCE ORGANIZER While the law regarding civil liability is cmplex, please nte that under certain circumstances, Cnference Organizers, bartenders, r ther rganizing members f the event culd be held legally liable fr the cnsequences f serving alchl t underage drinkers, r t bviusly intxicated persns. As the Cnference Organizer, yu and/r yur rganizatin r department culd ptentially be fund persnally liable fr damages t the injured persn(s). Sme f the damages yu and/r yur rganizatin r department culd be liable fr include, but are nt necessarily limited t: bdily injuries, lss f wages due t the injuries and pain, and suffering assciated with the injuries. It is the respnsibility f the Cnference Organizer and their rganizatin r department t cmply with the alchl plicies and permits, and t infrm thse staff members wh participate in the event f these plicies and prcedures. 7 Alchl Plicy OTHER REFERENCES TO CALIFORNIA LAW* AND UNIVERSITY POLICIES It is illegal fr persns under the age f 21 t have any cntainer f alchl in any public place r any place in public (CA Business and Prfessins Cde 25662). Every persn wh sells, furnishes, gives, r causes t be sld/furnish r given away any alchlic beverage t any persn under 21, is guilty f a misdemeanr (CA Civil Cde Sectin 25658(a)). T be under the influence f alchl in a public place and unable t exercise care fr ne s wn safety r that f thers is guilty f a misdemeanr (CA Penal Cde 647(f)). It is illegal fr persns t perate a mtr vehicle while under the influence f alchl r ther intxicants r with a bld level f.08% r higher (CA Civil Cde Sectin 23152).
