1 LIVINGSTON COUNTY LIVINGSTON COUNTY, MICHIGAN RESOLUTION # APPROVED: MAY 1, PURPOSE: I. POLICY Livingstn Cunty places the highest value n the safety and health f its emplyees and the well-being f its citizenry. Livingstn Cunty acknwledges that the safe peratin f mtr vehicles by municipal emplyees is essential t ensuring that safety and well-being, and its gal is t ensure that all individuals wh are granted the privilege f driving a municipal vehicle are safe and prperly licensed peratrs. Livingstn Cunty has full authrity t determine wh shall drive a vehicle, t establish vehicle peratr standards, and t revke the right t drive fr failure t meet the standards. This plicy defines the minimum standards fr all municipal emplyees. Nthing herein shall limit individual departments frm setting higher standards that may be needed t meet their particular needs. 2. RESPONSIBILITIES: Livingstn Cunty safe driver prgram depends n the participatin and cperatin f emplyees at all levels f the rganizatin. The specific respnsibilities f the emplyees are identified belw. DEPARTMENT DIRECTORS/ELECTED OFFICIALS Ensure that all emplyees are infrmed f this plicy. Ensure the safe maintenance and peratin f all municipal vehicles. Ensure that all vehicle peratrs are trained in the safe peratin f all assigned mtr vehicles. Enfrce municipal-wide departmental vehicle perating standards and prcedures. Ensure that all assigned vehicles are inspected fr safe peratin befre use. Ensure that thrugh and timely accident investigatins are cnducted and reprted. Identify all emplyees wh perate a vehicle n the jb and include thse emplyees in the municipality s Driving Recrd Subscriptin Service frm the State f Michigan. Ensure that any individual departmental plicies that define hw unsafe vehicle peratrs will be disciplined are cnsistent with the verall intent f this plicy. 2 SUPERVISORS Ensure the safe peratin f assigned municipal vehicles Administer and enfrce all municipal-wide and departmental plicies and prcedures regarding vehicle peratin NOTE: Any Supervisr wh fails t reprt the infrmatin utlined herein will be subject t apprpriate disciplinary actin, up t and including discharge. EMPLOYEES Safely perate their assigned municipal vehicles. Maintain a valid driver s license (crrect license/endrsement fr the type f vehicle driven). Advise the duty supervisr immediately f the lss f a valid driver s license by suspensin, revcatin, r expiratin, including being issued a Breath, Bld, Urine Test Reprt Temprary Driving Permit. Failure t cmply may result in discipline up t and including dismissal. Perfrm safety checks f vehicles at the beginning f each wrk shift as described in the unit wrk rules. Prmptly reprt t an n-duty supervisr any vehicle safety defect fund during inspectin. Failure t reprt safety defect fund during inspectin may result in discipline up t and including emplyee dismissal. Maintain an assigned municipal vehicle s cab, bed, and/r bdy in a clean and safe cnditin. Prperly use furnished seat belts and/r ther vehicle safety restraints. COUNTY ADMINISTRATORS Establish and maintain the Driving Recrd Subscriptin Service t mnitr emplyee driving recrds (currently maintained by Carpl). In cperatin with ther departments, ensure that all emplyees wh perate vehicles have a valid driver s license fr the vehicle types driven. Reprt driving recrd activity t emplyees departments fr review f plicy cmpliance (currently Carpl reprts driving recrd activity t Human Resurces and the affected department head). Prvide cnsultatin and training t the departments as needed. 3. STANDARDS AND PROCEDURES: All individuals wh perate Municipal vehicles, wh perate persnal vehicles n emplyer-related basis, wh receive payment related t vehicle expenses, and/r are required t drive as a necessary part f their jb must pssess and maintain a valid driver s license. 3 including being issued a Breath, Bld, Urine Test Reprt Temprary Driving Permit. Such ntificatin must take place immediately upn reprting fr wrk after receipt f the citatin. Individuals are prhibited frm perating a municipal vehicle r persnal vehicle n business when their driving ability has been impaired fr any reasn, including but nt limited t the ingestin f drugs, medicatin, r alchl beverages; physical impairment r restrictins; r ther situatins/cnditins within the individual s cntrl. Any illegal use f cntrlled substances is strictly prhibited. N emplyee shall knwingly perate a vehicle fund t be in vilatin f a state safety cde r the laws f the State f Michigan All emplyees shall use seatbelts r ther safety restraints prvided whenever they are perating r riding in a vehicle Only thse emplyees wh are determined t be safe peratrs will be allwed t drive a vehicle n behalf f the municipality. 4. CORRECTIVE ACTION, INCLUDING DISCIPLINE: Each department is encuraged t develp and implement a plan fr reviewing vehicle accidents and administering apprpriate crrective actin. The fllwing are minimum standards which shuld be included in departmental plans: The gal f crrective actin is t ensure that emplyees wh are entrusted with the peratin f vehicles are safe drivers. Awareness and knwledge thrugh training are the keys t safe driving. Whenever pssible, training shuld be a first step in a crrective actin prgram. Discipline up t and including discharge may als be an apprpriate frm f crrective actin, depending n the infractin. An unacceptable mtr vehicle driving recrd is ne indicatin that an emplyee may nt be a safe driver. The administratin will identify emplyees wh develp unacceptable driving recrds and ntify the apprpriate department. Departments are encuraged t immediately enrll these emplyees in municipal-spnsred driver s training prgrams, r cnsult with the Human Resurces department abut ther apprpriate training pprtunities, r ther crrective actins, depending n the infractin. Accidents invlving statinary bjects are the mst frequent and preventable type f vehicular accident. Preventable accidents invlving statinary bjects may result in disciplinary actin up t and including dismissal. Invlvement in a preventable accident shall be cnsidered unsatisfactry jb perfrmance, which may result in disciplinary actin up t and including discharge. 4 Failure t cmply with any part f this plicy shall be cnsidered unsatisfactry jb perfrmance, which may result in disciplinary actin up t and including discharge. 5. INSPECTIONS: All vehicles shall be safety-checked at the beginning f each shift by the assigned vehicle peratr t ensure safe perating cnditin accrding t unit wrk rules. Reprt vehicle deficiencies accrding t department plicies Each department shall be respnsible fr ensuring that quarterly safety inspectins f all assigned vehicles ccur and are prperly dcumented. 6. DEFINITIONS: Driving Recrd Subscriptin Service: A prgram prvided by the Michigan Department f State by which a driving recrd can be autmatically prduced and sent t an enrlled municipality when a cnvictin is psted t an emplyee s driving recrd. Preventable Accident: Any vehicle accident in which the driver/peratr failed t d everything he/she reasnably culd have dne t prevent the accident. Vehicle Accident: Any ccurrence invlving a cunty-wned, rented, leased, r travel-reimbursed mtr vehicle r trailer which results in a death, persnal injury r prperty damage. Emplyee: Any regular full-time r part-time r temprary full-time r part-time emplyee, elected fficials, vlunteers, r any ther persn wh has reasn t perate a municipal vehicle. Municipal Vehicle: Any municipal-wned, rented, leased, r travel-reimbursed mtr vehicle r trailer, including persnal vehicles, used by an emplyee fr municipal business. 7. APPLICANT/EMPLOYEE SCREENING GUIDE Cnvictin f law vilatins r civil infractins may serve as a basis fr disqualificatin r discipline. The applicant s/emplyee s ttal recrd will be evaluated; the applicant/emplyee must have at least tw years f dcumented driving experience. The pattern f law vilatins, the seriusness, the surrunding circumstances, and the number and recency f vilatins will be cnsidered. Fr example, multiple cnvictins fr the same ffense can be disqualifying, as they indicate a pattern f inadequate respnsibility and disregard fr law and rder, which may affect safety. 5 (i.e. imprper plates, expired plates) r civil infractins may indicate an inability t fllw rules and a disregard fr the law. Fr purpses f determining disqualifying vilatins, the Cunty may cnsider nly thse ffenses fllwed by a cnvictin (frfeited bnd, jailed, fined, rdered t attend traffic schl). Fr purpses f establishing time frames fr disqualificatin, the Cunty may use the date f the actual vilatin. Here are disqualifying guidelines: The circumstances nted belw will be cause fr autmatic disqualificatin f an applicant and discipline f an emplyee: (1) Cnvictin f a driving-related felny (2) Lss f driving privilege thrugh suspensin r revcatin f license due t an unsatisfactry driving recrd as defined by the Michigan Department f State. EXCEPTION: Applicatins frm thse wh maintain a driving recrd free f license suspensin r revcatin and mving vilatin cnvictin(s) in the five (5) years previus t making applicatin t the municipality may be accepted. (3) An at-fault accident resulting in a fatality (an at-fault accident is defined as ne in which the applicant has been fined, sued, and received an adverse judgment, applicant s insurance cmpany settled fr damages t ther party, r applicant settled ut f curt r therwise was determined t be liable). (4) Accumulated six (6) pints r mre n the driving recrd. (5) Cnvicted f any alchl/drug related ffense. (6) Cnvicted f driving while license was suspended r revked. Fr new applicants, in the year prir t applicatin, the fllwing circumstances will be cause fr autmatic disqualificatin: (7) Accumulated mre than three (3) pints n the driving recrd. 8.
