2 Rental and Additinal Fees When renting the facility the Renter will have use f tables and chairs. This des nt include linens. In additin t rental fees, Cache Valley Center fr the Arts ( CacheArts ) reserves the right t hire, at the Renter s expense, any additinal persnnel it deems necessary. Such persnnel may include security, sund and lighting technicians and additinal staff t assist during the event. Security will be prvided by CacheArts at Renter s expense at $75 minimum fr up t five hurs at Cachearts discretin based n the type f event. Events exceeding the 5 hurs will be required t purchase anther 5 hurs at the afrementined $75 price Payment Schedule Events are cnfirmed with a reservatin depsit f 50% f the Rental fee, all f the $600 Damage & Cleaning fee and the Rental Cntract signed by bth the Renter and Reservatinists. The remaining balance is due TWO WEEKS prir t the scheduled event. The Set-up sheet is als due at the time f the final payment. Depsits will be refunded within tw weeks after the scheduled event if n prblems arise and/r there are n additinal charges. If any part f the depsit is kept an explanatin will be sent. Cancellatin Plicy A refund will be given if cancellatin is dne 90 days prir t event, hwever a $25 administratin fee will be charged fr the cancellatin. If cancellatin is dne 60 days prir t event a 20% refund will be given. If cancellatin is dne less than 60 days prir t event n refund will be given. If Renter fails t hld the event at the time agreed, CacheArts will retain the cllected fees. Cancellatin must be dne in writing. Decratins All decratins and linens must be supplied by the Renter. Initial: Decratins NOT allwed in the building r n the grunds are as fllws: bubbles, sand, straw, hay, glitter, silly string, sequins, cnfetti, rice and birdseed. Initial: Candles r flames f any kind are nt allwed. Initial: Smke, haze, r fg machines are nt allwed. Initial: Only Masking and Painter s tape may be used t affix decratins t walls, mirrrs, windws, railings and white chairs. Nails, push-pins, and sticky putty/glues are nt allwed. Initial: Standing n the white chairs is NOT permitted. Initial: Installatin f special platfrms, scafflding r rigging r ther apparatus requires the apprval f CacheArts. Parking There is n designated Cache Valley Center fr the Arts parking. Parking is available n the street and in varius public parking lts within ne-tw blcks f the facility. When parking n the street, please refer t all psted signs. All the lts west f Cache Valley Center fr the Arts are private parking lts and are strictly enfrced by their wners. CacheArts has n cntrl ver them and vilatrs may be bted, twed r fined. CacheArts will prvide the Renter with a parking map t distribute t guests; it s then the Renter s respnsibility t infrm guests f their parking ptins. 2 f 5

3 Lad-in, Lad-ut, Clean-up, Overtime and Damage Fees Renter must make arrangements with CacheArts fr temprary lad-in and lad-ut parking n the sidewalk r in handicap parking f the Bullen Center s Suth entrance. Renter must mve vehicles frm these areas immediately fllwing lad-in r lad-ut. Scheduled lad-in times prir t rental blck will be billed n an hurly basis, minimum f $75 per hur. If activity r clean-up ges beynd the Renter s alltted time, CacheArts will charge $100 per hur fr building maintenance services. Building will be clsed and lcked at midnight. Building maintenance staff are the nly persns allwed t mve r remve any items belnging t the facility, i.e. tables, chairs, grand pian etc. Initial: N fd r drink may be set-up n any carpeted areas. Initial: Carbnated funtain beverage machines are permitted in the facility with prir apprval frm the facilities manager. Initial: Unless prir arrangements have been made, clean-up shuld be cmpleted by the Renter immediately fllwing the activity. The Renter will be held respnsible fr the behavir f their guests and all their vendrs. If the facility des nt meet the psted clean-up requirements the Renter may lse a prtin, r all, f the Damage & Cleaning fee. CacheArts will nt be held respnsible fr any items left behind by the Renter. Gverning Law and Indemnificatin Renter agrees t cmply with all laws, rdinances and rules f the City f Lgan, State f Utah and the United States applicable t the use f the premises and t pay any taxes r fees that may be impsed by law in cnnectins with the use and ccupancy f the facilities. Renter indemnifies CacheArts against and hlds CacheArts harmless frm all liabilities, expenses, and lsses, including attrney s fees, incurred by CacheArts as a result f (a) failure by the Renter t perfrm any cvenant required t be perfrmed by it hereunder; (b) any accident, injury r damage which shall happen in r arund the designated premises resulting frm Renter s use f the premises, r any equipment related theret, except fr such accident, injury r damage which results frm the sle negligence f CacheArts, its agents r emplyees; (c) failure f Renter t cmply with any requirements f any gvernmental authrity; and (d) failure f Renter t btain apprpriate cpyright and perfrmance rights frm the license hlder. Renter further agrees t waive all claims against CacheArts n accunt f any lss, damage r injury frm whatever cause which may ccur t it r its prperty in the use and ccupancy f the premises, the giving f this waiver being ne f the cnsideratins upn which this Renter Agreement is granted. Other Plicies Renter agrees it will nt admit a larger number f persns than can safely be accmmdated in the facility. If capacity is reached, CacheArts reserves the right t turn away guests until capacity is belw restrictins, as stated n the Bullen Center Specificatins page. Children must be prperly supervised at all time. Fr n reasn shuld any child r grup f children be left unsupervised. If these cnditins are nt met, children and their parents may be asked t leave, the event may be terminated r a prtin/all f the Damage & Cleaning fee may be withheld. Initial: CacheArts reserves the right t remve, r cause t be ejected frm the premises, any bjectinable persn r persns. Renter must cmply with the directin f security and/r CacheArts persnnel. If Renter des nt cmply, Renter and Renter s party will be escrted frm the building by security and the event may be terminated. 3 f 5

4 The facility is a smke-free and alchl-free envirnment. The un-lawful pssessin r use f cntrlled substances is prhibited n the premises. Initial: Renter warrants and represents that it has btained the apprpriate perfrmance licenses necessary fr its prpsed use f the facilities fr the specified dates and times and agrees that CacheArts has n respnsibility t cnfirm such perfrmance licenses. Renter agrees t prvide all advertising and prmtin at its wn cst fr the events cvered by agreement, unless the Renter has requested services frm CacheArts, such as use f the marquee, which will be charged back t the Renter. The Renter shall be permitted t distribute free prgrams t patrns, but shall nt sell prgrams, nvelties, r suvenirs unless it has the apprval frm CacheArts. If amplified music is used fr the event, sund restrictins will be in place during the time f an Ellen Eccles Theatre perfrmance. Sund levels will then be set and determined at the sle discretin f the CacheArts staff. Initial: Renter shall nt assign r transfer this Agreement r sublet any prtin withut written cnsent f CacheArts. Any misrepresentatin f the purpses fr renting the Bullen Center will be cause fr legal actin, including all csts assciated with r resulting frm any vilatin f this agreement by Renter, including attrney csts. Regulatins/Prvisins Renter understands that CacheArts manages the Bullen Center and the ancillary facilities whse principal address is 43 Suth Main Street, Lgan, Utah, and which are wned by the City f Lgan. The City f Lgan ( City ) is a plitical subdivisin f the State f Utah and is subject t the Utah Gvernmental Immunity Act (the Act ); Sectin et seq., Utah Cde Ann. (1953, as amended). Nthing in the Agreement shall be cnstrued as a waiver f any rights r defense therwise applicable t the City under the Act, including the prvisins f Sectin regarding limitatins f judgments.
