As the Cmmunity is in the earliest stages f Develpment, n Reserve Study has yet been cnducted. This will be frthcming as Cmmn Areas and Recreatinal Facilities are develped. The White Hall Bard f Directrs is currently in the prcess f develping the fllwing: Initial Rules and Regulatins fr the Fundatin Cvenant Enfrcement Prcedures Rules fr the Inspectin f Bks and Recrds Our recrds indicate that the referenced prperty is currently wned by HUD. As f the date f this letter, Blck Twnes Lt 32 has $ wed t the White Hall Fundatin, Inc. including assessments and late charges. During a recent inspectin it was nted that the rear dr windw was brken. This is a vilatin as per the Declaratin f Cvenants Cnditins and Restrictins fr White Hall Fundatin, Inc., Article XIV, Sectin 5 regarding Unsightly and Unkempt Cnditins. This is t be crrected prir t the sale r the vilatin will transfer with the deed. Pursuant t the Prperty Owners Assciatin Act, Sectin E, if settlement des nt ccur within 45 days f the delivery f the disclsure packet, r funds are nt cllected at settlement and disbursed t the assciatin r the cmmn interest cmmunity manager, all fees, including thse csts that wuld have therwise been the respnsibility f the purchaser r settlement agent shall be (i) assessed within ne year after delivery f the disclsure packet against the lt wner, (ii) the persnal bligatin f the lt wner, and (iii) an assessment against the lt and cllectible as any ther assessment in accrdance with the prvisins f the declaratin and f the Cde f Virginia. The seller may pay the assciatin by check r certified funds. The assciatin shall pay the cmmn interest cmmunity manager the amunt due frm the lt wner within 30 days after invice. Upn clsing n this prperty, the purchaser becmes subject t a per mnth assessment (billed quarterly) and may be subject t any special assessments impsed against the lt by the Fundatin. The assessment fr 2013 is $44 per mnth, cllected quarterly, with payment f $132 fur times a year n the 1st f January, April, July and Octber. A prratin f this assessment, if applicable, is due at clsing f the hme. In additin, the twn hmes at White Hall are als subject t an assessment, fr and in cnsideratin f, landscaping services t be prvided t the individual lt wners n behalf f the Fundatin, in the amunt f $30 per mnth fr 2013, cllected quarterly, with payment f $90 fur times a year n the 1st f January, April, July and Octber. A prratin f these assessments, if applicable, is due at clsing f the hme. In additin t the assessment, fr 2013 there is a Capital Cntributin fee f $ paid at clsing f the hme.
4 The base and neighbrhd assessments are subject t change yearly as defined in the Dcuments. Special assessments may be deemed as prvided in the Dcuments. As f the date f this letter, the Fundatin des nt anticipate any special assessments fr the year The timely payment f assessments prvides the resident full rights and privileges with respect t all cmmn area use and cntributes t the maintenance f the White Hall cmmn areas. The assessment includes trash remval service fr individual hmes nce a week. The hmewner will be respnsible fr calling the cntractr and setting up this service. Payment fr the service will be made by the Fundatin. T setup trash remval service, cntact Bay Dispsal at , and select the ptin fr Custmer Service. Other than thse utlined in this mem, there are n ther Fundatin fees fr which the hmewner will be liable, except thse which may be attached t ptinal special events and recreatin activity classes, wrkshps, etc. The Fundatin als reserves the right t charge, in accrdance with law, fr resale disclsure packages and any ther requested dcuments. The Assessments are exclusive f the real estate taxes and utility usage fees fr which residents are liable. Please nte that the Fundatin des nt maintain prperty cverage fr the individual lts. It is the respnsibility f each wner t btain insurance cvering their hme, t als include persnal prperty cntained therein, and persnal liability. Yu are urged t cnsult with yur insurance agent. SIGNS: Accrding t Article III, Lt Develpment Standards, Sectin f the White Hall Design Standards, the fllwing restrictins are placed n the right f the lt wner t place a sign n their lt: Except as nted belw, all signs n lts in White Hall, as well as lead-in signs and builder s r realtr s signs, shall be based n templates apprved by the WHDC, and must be apprved as t placement. During initial huse cnstructin, nly ne cnstructin sign will be permitted per lt, fr the identificatin f the builder, architect, sub-cntractrs and/r suppliers. Fr Sale signs, ther than thse psted by the Declarant, shall be limited t ne sign per lt and placed in the center f the frnt yard nly. Rear yard signs are nt permitted. N lead-in signs are permitted.: REAL ESTATE SIGNS: Real estate signs fr resale f a hme may nt exceed 4 square feet and may be placed in the frnt yard. SECURITY SIGNS: Signs indicating security systems are permitted in frnt f the hme in landscape beds near the frnt dr, nt at the street. Security signs may nt exceed a maximum f 10.5" x 8" in size. CAMPAIGN SIGNS: Campaign signage may be n the Owner s lt and may nt exceed 6 square feet and may nt stand higher than 5' frm the grund. Only ne electin sign (ttal) may be displayed per hme in accrdance with natinal, federal, lcal r cmmunity electins. The sign may be displayed n mre than 2 mnths prir t r 7 days fllwing any electin.
5 INITIAL FOR SALE SIGNS/CONSTRUCTION SIGNS: Initial Fr Sale/cnstructin signs are signs placed by the riginal builder fr the first sale f the hme. Cnstructin signs and initial Fr Sale signs are addressed in Sectin and FLAGS AND FLAGPOLES: Article III, Lt Develpment Standards, Sectin Flags and Flagples, f the White Hall Design Standards utlines the guidelines fr the display f any type f flag r flagple in the Cmmunity: N flag r flagple f any size, shape, r frm, temprary r permanent, shall be permitted n the exterir f any prtin f a lt (as described in the Declaratin) r imprvement theren, except as prvided herein: FLAGS MOUNTED ON HOUSES: The WHDC and/r MC may grant written apprval fr a reasnable and aesthetic huse munted ple r ples, which are attached t and extend frm the facade f the unit. One huse munted ple may be attached t and extend frm the façade by the frnt dr f a unit withut the prir written apprval f the WHDC r MC as lng as the ple des nt exceed 6' in length and the flag displayed n the ple des nt exceed 4' x 6'. VERTICAL FLAGPOLES: Permanent and/r temprary vertical flagples are nt permitted in frnt yards. Permanent and/r temprary flag ple nt exceeding 15' in height, may be permitted in rear yards directly behind the mass f the huse and n clser than 20' t any prperty line. Written apprval frm the WHDC and/r MC is required. Flags munted n mailbxes, ther psts, etc. are permitted n a temprary basis nly under the guidelines prvided in Sectin (e) fr hliday decratins. Flags munted in this way may nt impede pedestrian walkways r radways. Small mailbx flags n larger than 12" x 18" are permitted t be displayed year rund. Outside f this stated apprved guideline, the display f any flag r the installatin f any necessary supprting structure(s) fr any flag n r within the Prperties, including n the exterir f any Lt (as described in the Declaratin) r any imprvement theren within White Hall, is hereby expressly prhibited withut prir written apprval f the WHDC r the MC. Fr the purpse f this sectin, any flag r flagple r necessary supprting structure fr any flag n any prtin f a Lt (as described in the Declaratin) is deemed an exterir alteratin r mdificatin f existing imprvements as cntemplated by Article XIII f the Declaratin. FINAL COMPLIANCE: A Certificate f Cmpliance is a written dcument frm the WHDC, certifying that the builder has met all f the requirements under the Declaratin and the Standards. It is the respnsibility f the builder t request a Certificate f Cmpliance within 15 days f cmpleting cnstructin. If the WHDC identifies any items nt cmpleted in accrdance with the Standards and/r Declaratin, the builder must cmplete repair f these items within 30 days and request anther inspectin. IN THE EVENT THAT THE SUBSEQUENT OWNER CLOSES ON THE LOT PRIOR TO RECEIPT OF A CERTIFICATE OF COMPLIANCE, IT BECOMES THE SOLE RESPONSIBILITY OF THE NEW OWNER TO ENSURE COMPLIANCE WITH THE STANDARDS AND/OR DECLARATION. PLEASE NOTE: A CERTIFICATE OF COMPLIANCE IS DIFFERENT FROM A CERTIFICATE OF OCCUPANCY. A CERTIFICATE OF COMPLIANCE IS ISSUED BY THE WHDC, WHILE THE CERTIFICATE OF OCCUPANCY IS ISSUED BY THE COUNTY.
