2 Vacant Hme Prgram Plicy Guidelines 1. Statement f Purpse: The restratin and prtectin f Deadwd s histric buildings and structures are a primary part f the City s gal t preserve and maintain Deadwd s histric integrity. The expense f such restratin and prtectin prjects may discurage prperty wners frm having the wrk cmpleted r may result in lwer quality f craftsmanship. The purpse f this prgram is t assist and encurage prperty wners t use quality materials and craftsmanship by repairing first, where pssible, and replacing, nly if necessary. 2. Objective: The City f Deadwd is a Natinal Histric Landmark and is listed n the Natinal and Suth Dakta State Registers f Histric Places. Maintaining these designatins is critical t the ecnmic success f the City and quality f life f its residents. The bjective f the prgram is t stimulate the quality restratin and prtectin f buildings and structures that cntribute t the histric integrity f the City f Deadwd. 3. Eligibility: T be eligible fr the Vacant Hme Prgram, the applicant and prject must meet the fllwing criteria: a. The prject must exist as part f a residential prperty within the Deadwd City Limits. Mbile hmes and manufactured structures are nt eligible fr this prgram; b. The prperty must be vacant tw (2) years prir t the date f purchase by Owner. The Owner must apply fr funding frm this prgram within three (3) mnths f purchase. A prject must als meet ne f the fllwing: The prject must affect a prperty listed n the City f Deadwd s 1993 Histric Sites Inventry as an histric prperty in the Deadwd Natinal Histric Landmark District. Prperties nt listed n the inventry must be eligible fr the Natinal Register f Histric Places as defined in the Natinal Park Service s Natinal Register Bulletin 15: Hw t Apply the Natinal Register Criteria fr Evaluatin. The prject must affect individual life safety and structural deficiencies as determined by the City f Deadwd s Building Inspectr and applicable life safety cdes. Determinatin f individual life safety issues and structural deficiencies is based upn the cdes adpted by the City f Deadwd under Chapter and by additinal verificatin btained thrugh ther means available t the City. The City f Deadwd s Histric Preservatin Officer and Building Inspectr determine a prject s eligibility. All eligible applicatins are subject t the review f the Deadwd Histric Preservatin Cmmissin. 4. Definitin and Examples: Histric Preservatin Prject Definitin Prjects which are intended t preserve r prtect histric prperties r prperties eligible fr histric status. Examples f Life Safety Prjects Upgrade substandard electrical systems Replace substandard heating system Lead based paint abatement Asbests remval Install access ramps and drs Mld remval Installatin f building insulatin / weather prfing 5. Prgram Requirements: Repair / replace damaged sidewalks / steps / handrails a. All prperties must meet the Revlving Lan Fund s eligibility requirements. b. All persns receiving financing must cnfrm t applicable federal and lcal regulatins gverning the use f specific lan funds. c. All lan applicants must present evidence f their ability t repay the lan and prvide adequate cllateral. d. Lan apprval is cntingent upn apprval f the prject by the Deadwd Histric Preservatin Cmmissin. e. All prjects will be perfrmed pursuant t the requirements f the cdes adpted by the City f Deadwd under Chapter f. All prjects will be perfrmed pursuant t the Secretary f the Interir s Standards fr the Treatment f Histric Prperties and the Secretary f the Interir s Guidelines fr the Rehabilitatin f Histric Buildings. g. The prperty must meet Minimum Prperty Standards adpted by the City f Deadwd; therefre, the City Building Inspectr will inspect the prperty every tw years fr cmpliance. If the prperty is nt within cmpliance, the City Building Inspectr will ntify the hmewner f the deficiency and will prvide a reasnable time frame t crrect the deficiency. If the deficiency has nt been crrected after three ntificatins the lan will be cnsidered t be in default and the Deadwd Histric Preservatin Cmmissin will take legal actin. 6. Lan Cnditins: LOAN AMOUNT INTEREST RATE TERM PAYMENT AMOUNT SECURITY $10,000 maximum 0% 1 10 years N Payments due 1,2 Frgivable ver term f lan Lan Agreement 1 All Deadwd Histric Preservatin lan prgrams will include the fllwing fees: Credit Reprt, Recrding Fee, 1% Lan Originatin Fee, Settlement Fee and a Title Reprt Fee. These fees are cllected frm applicant/wner at lan clsing. All lan fees will be disclsed n a Gd Faith Estimate by NeighbrWrks in accrdance with the Real Estate Settlement and Prcedures Act. 2 Failure t cmplete wrk as apprved in a timely fashin and/r failure t maintain prperty up t City f Deadwd s Minimum Maintenance Standards may cause lan t be payable in full at that time and nt frgiven. Prperty Owners must prvide prf f ability t repay lan. Varius dcuments will be requested by NeighbrWrks t cmplete a lan applicatin. Adpted 06/24/15

Additinal frgivable lan cnsideratins: a. At the end f each full year, 10% f the lan amunt will be frgiven. b. If the wner desires t sell the prperty befre the end f the lan term, the remaining unfrgiven prtin f the lan will be due in full. c. The wner must have addressed any additinal preservatin issues beynd the riginal wrk, meet Deadwd Minimum Maintenance Standards, and satisfy all lan cnditins befre lan can be transferred r frgiven. 7. Frms and Technical Assistance: a. Lans - Lan applicatin frms and lan technical assistance are available at the NeighbrWrks Office, 795 Upper Main Street in Deadwd. Telephne: (605) b. Prject Apprval r Certificate f Apprpriateness The applicatins are available at the Histric Preservatin Office lcated at Deadwd City Hall, 108 Sherman Street in Deadwd. (605) This frm is als available nline at: under Permits, Licenses & Frms tab, then under Histric Preservatin heading. This frm must be cmpleted and given t the Histric Preservatin Officer wh will present it t the Histric Preservatin Cmmissin fr cnsideratin. [N wrk can start until Histric Preservatin Cmmissin apprval and the wner/applicant has an apprved City f Deadwd Building Permit.] c. City f Deadwd Building Permit A City f Deadwd (Residential r Cmmercial) Building Permit must be acquired frm the City f Deadwd Building Inspectr lcated at 67 Dunlp Avenue, in Deadwd. 5 Vacant Hme Prgram Administrative Prcedures 1. Applicatin The Applicant/Prperty Owner/Owner s Representative (Owner) btains frm Histric Preservatin Office, NeighbrWrks r City f Deadwd Website: Vacant Hme Prgram Applicatin frm Applicatin fr Prject Apprval r Certificate f Apprpriateness frm if exterir wrk is perfrmed The Owner submits cmpleted cpies f the abve frms with signatures t Histric Preservatin Office. A discussin between the Owner and the Histric Preservatin Officer is recmmended t clarify requirements and expectatins f this prgram. This can greatly streamline the prcess. 2. Determinatin f Eligibility The Histric Preservatin Officer and/r City Building Inspectr cnduct an n-site inspectin f prperty t determine eligibility. Phtgraphs are taken fr dcumentatin. A needs assessment will be dne by the Histric Preservatin Officer. The Histric Preservatin Officer will prepare a written HP Staff Reprt fr use by the Histric Preservatin Cmmittee (HPC). If a lan is invlved, the Histric Preservatin Officer cmmunicates with NeighbrWrks abut the cnclusins drawn in the HP Staff Reprt. 3. Lan Applicatin Histric Preservatin Officer verifies the hme vacancy perid and the date f purchase. The Owner makes an appintment with NeighbrWrks t determine the Owner s financial eligibility. Owner is respnsible fr any csts exceeding the lan amunt r any csts that are nt permitted under the Prgram. Owner is respnsible t pay fr all clsing csts. NeighbrWrks prepares Lan dcuments fr which the Owner must prvide: Cst Estimate / qute fr entire prject. Infrmatin t verify Owner s financial ability t repay. NeighbrWrks prvides Owner with: Wrksheet shwing Owner s financial respnsibility. Letter f Understanding stating Owner s share f csts. Owner must sign this dcument. Clsing Dcuments (i.e. mrtgages and settlement statements) Prmissry nte (i.e. assignments n cntract fr deed, persnal guarantees, etc.) Owner must sign this dcument. NeighbrWrks presents lan request t Histric Preservatin Lan Cmmittee fr recmmendatin t apprve r deny lan. Adpted 06/24/15

Histric Preservatin Cmmissin Prject Apprval Deadwd Histric Preservatin Cmmissin Vacant Hme Prgram Administrative Prcedures Page 2 f 3 Based n HP Staff Reprt, the Histric Preservatin Cmmissin (HPC) apprves r denies the Applicatin fr Prject Apprval r Certificate f Apprpriateness. Based n recmmendatins frm the HP Lan Cmmittee, HPC apprves r denies the applicatin fr lan. If lan is apprved, the agreements and any ther necessary dcuments are recrded. A Ntice t Prceed is issued t the Owner and/r Cntractr and the City f Deadwd by NeighbrWrks, in the case where a Cnstructin Lan is invlved. 5. Prject Beginning and Ending The Owner is encuraged t enter int a cntract with a City f Deadwd licensed Cntractr fr the prject. The Owner r Cntractr btains a City f Deadwd Building Permit. A Ntice t Prceed frm either the Histric Preservatin Officer r NeighbrWrks must be btained befre applying fr a City f Deadwd Building Permit. Where Prgressive Payments are invlved: The Owner is respnsible fr making arrangements fr delayed payments r prgress payments t the Cntractr / Material Supplier. Owner must be aware that payments frm the City f Deadwd may require up t 30 days r mre befre payments are made due t the City s apprval prcess. Prgressive payments are made subject t payment withhlding t ensure prject cmpletin is accmplished. All final r prgressive payments are fr materials and/r cntractr s csts nly, supprted by verifiable invices. Owner s time is nt reimbursable. N prepayments fr materials are permitted. The Histric Preservatin Officer and/r Building Inspectr inspect the wrk in prgress. The Histric Preservatin Officer and Building Inspectr cnduct a final inspectin after the cmpletin f the entire prject. 6. Expenditure Disbursement After the Building Inspectr has reviewed the wrk and/r materials and has cnsulted with the Histric Preservatin Officer, the Building Inspectr authrizes NeighbrWrks t apprve inviced amunt (less any withhlding). NeighbrWrks initially apprves invices. At a HPC meeting, the HPC apprves the disbursement which is added t the City f Deadwd Cmmissin s bill list fr City (final) apprval. Upn City apprval, the City Finance Office issues checks fr the disbursement t the Histric Preservatin Office. Owner r Cntractr pick-up disbursement check frm the Histric Preservatin ffice and, if Cntractr is invlved, the Cntractr must sign lien waivers befre final payment is made. 7. Cntinued Administratin f Lans NeighbrWrks reviews all lan accunts nce a mnth. Adpted 06/24/15

The HP Lan Cmmittee prvides recmmendatin t HPC either t wrk with wner, r make lan immediately payable. 8. Satisfactin f 10 year Lan After terms and cnditins f the lan are cmpleted, NeighbrWrks prepares a satisfactin f mrtgage fr the lan funds. HPC signs the satisfactin f mrtgage. NeighbrWrks cllects frm the Owner the recrding fees fr the satisfactin f mrtgage dcuments. NeighbrWrks delivers the satisfactin f mrtgage t the Register f Deeds. NeighbrWrks clses the Owner's lan accunt. NeighbrWrks frwards the lan dcuments t the HP Office. The HP Office retains the lan dcuments fr at least seven (7) years. Adpted 06/24/15
