1 Apprved by Academic Affairs Cuncil, June 24, 2014 Intellectual Prperty Plicy Purpse Statement This plicy is intended t supprt faculty, staff, and students in identifying and prtecting intellectual prperty, defining the rights and respnsibilities f all invlved, administering intellectual prperty matters, and establishing supprt ffices t prvide the required assistance. It als stipulates hw incme generated fr the University shuld be distributed. Sutheastern Luisiana University recgnizes that research and schlarship shuld be encuraged withut regard t ptential gain frm licensing fees, ryalties, r ther such incme; hwever, the University als recgnizes that patentable inventins and discveries may arise frm faculty, staff, and student research. The plicies gverning the administratin f such inventins shuld prvide adequate recgnitin and incentive t inventrs and at the same time ensure that the University will share in the rights pertaining t inventins in which it has an equity. Any incmes accruing t the University shall be used in the furtherance f the University s academic missin. Objectives Cnsistent with the plicies f the University f Luisiana System, Sutheastern Luisiana University s Intellectual Prperty Plicy has the fllwing bjectives: 1. T encurage research and schlarship as creative academic endeavrs while recgnizing that cmmercially valuable intellectual prperties may result frm such endeavrs; 2. T delineate prcedures t encurage creatrs t reprt discveries with brad cmmercial ptential and public benefit and t assist them, while at the same time safeguarding the interests f all cncerned parties; 3. T make intellectual prperty develped in the curse f academic research available t the public under cnditins that will prmte its effective and timely use and develpment; 4. T ptimize the envirnment and incentives fr research and schlarly activity Intellectual Prperty Plicy - 1

Cmpliance with UL System Intellectual Prperty Plicy The Intellectual Prperty Plicy f Sutheastern Luisiana University is subject t the requirements set frth in the mst recent versin f the UL System Intellectual Prperty Plicy, 1a%20Intellectual%20Prperty%2010_23_2012.pdf, currently in effect. Sutheastern s Intellectual Prperty plicy, including attachments and hyperlinks, cnstitutes the entire understanding and agreement with respect t the subject matter heref and supersedes all prir representatins and understandings, whether ral r written. Sutheastern s plicy is cnsistent with the UL System plicy gverning Intellectual Prperty. Prvisins set frth in the institutin s plicy are prvided t supplement and clarify, nt replace the System plicy, except in circumstances where a waiver frm the UL System IP Plicy has been btained by Sutheastern. Any incnsistency shall be reslved by giving precedence t the mst recent versin f the UL System IP plicy currently in effect. Management f Intellectual Prperty 1. Acknwledgement f Institutinal Authrity The President f Sutheastern Luisiana University has the ultimate authrity fr the stewardship f intellectual prperty apprpriate t the University s rle, scpe, and missin. 2. Intellectual Prperty Cmmittee The Intellectual Prperty Cmmittee shall have the fllwing respnsibilities: Devise, subject t apprval by the prper authrities, institutinal intellectual prperty plicies, and advise the Prvst n the implementatin f thse plicies, and the status and cnduct f the University s technlgy transfer effrts. Serve as advcate t the University s persnnel fr the institutin s technlgy transfer effrts. Recmmend t the Prvst the equitable distributin f incme frm the develpment and marketing f thse intellectual prperty rights in which the University has a vested interest. Serve as the University s Intellectual Prperty Advcate (IPA) Intellectual Prperty Cmmittee Membership and Selectin The cmmittee shall cnsist f nine vting members. The Prvst shall appint three administratrs (department head r abve) and ne unclassified staff member. The Prvst shall appint five faculty Intellectual Prperty Plicy - 2

Intellectual Prperty Cmmittee Prcedures All decisins shall be made by a majrity vte f the members present, prvided that a qurum is present. Cmmittee members shall maintain cnfidentiality f the specific issues brught befre it. Failure t respect that cnfidentiality shall result in immediate dismissal frm the Cmmittee. By a majrity vte, the Cmmittee shall elect its chair each year. The Cmmittee shall meet at least nce each fall and spring semester. The Cmmittee shall attach the fllwing disclaimer t all plicy recmmendatins that it makes: The abve recmmendatin by the Intellectual Prperty Cmmittee represents ur decisin based n the infrmatin available at the time the decisin was made. Any changes in the infrmatin, regardless f the recmmendatin, shuld be reprted t the IP Cmmittee. We reserve the right t change ur decisin based n any new infrmatin. Plicy Administratin 1. Creatr(s) shall use the Intellectual Prperty Disclsure Frm (see Appendix) t reprt intellectual prperty required t be disclsed. One cpy f the frm is t be sent t the Prvst and ne cpy is t be sent t the chair f the Intellectual Prperty Cmmittee. All frms submitted t the Prvst will be retained in a permanent file in the Prvst s ffice r ther lcatin designated by the Prvst. 2. All revenues r equity frm applicable intellectual prperty will be cllected and distributed by the Cntrller s Office, which shall maintain recrds f all related incme and expense. 3. The University s share f net revenues (which is nrmally 60% f net revenue) frm applicable intellectual prperty shall be apprtined as fllws: the University shall receive 50% the Cllege shall receive 25% the Department where the wrk was accmplished shall receive 25% Intellectual Prperty Advcate (IPA) The respnsibilities f the IPA shall be t: 1. Make such recmmendatins as are deemed apprpriate t encurage disclsures and ensure prmpt and effective handling, evaluatin, and management f intellectual prperty pprtunities while prtecting the interests f the University, the University f Luisiana System, and the public. Dispute Reslutin Prcedure Shuld a Creatr disagree with an interpretatin f the Plicy r with a decisin made regarding Intellectual Prperty, the prcedure is t ntify his r her direct supervisr. The supervisr will then direct the grievance t the apprpriate vice president (thrugh nrmal chains f cmmand). The vice president may chse t cnvene the Intellectual Prperty Cmmittee and present all f the materials related t the grievance fr their cnsideratin. The Cmmittee will present a recmmendatin t the vice president. The vice president will cnsider the recmmendatin frm the Cmmittee, the materials presented by the Creatr f the Intellectual Prperty, as well as any ther recmmendatins frm supervisrs thrugh the chain f cmmand.
