2 THE UN CONVENTION ON THE RIGHTS OF THE CHILD AND STATE PARTIES The current status f signing and ratificatin t the UNCRC Signing: Initial signature alne t the treaty is nt sufficient t cmmit a cuntry t the treaty s cnditins. Ratificatin (By legislative bdy r executive bdy): A cuntry agrees t be bund by the internatinal law. What des it mean when a State ratified the UNCRC? State Party develps a natinal legal framewrk in which t implement the treaty standards. State Party creates and implement natinal plicies and practices cncern with legal prtectin that will guarantee children the rights enumerated in the instruments. State Party cmmits resurces t the maximum extent pssible t implement children s rights. State Party prmtes the understanding f the UNCRC State Party has t submit the 2 years reprt (2 years after the ratificatin) and 5 years peridic reprt t the UN Cmmittee n CRC. 2

3 REPORT FROM STATE PARTY Art.44 f the UNCRC 1. States Parties undertake t submit t the Cmmittee, thrugh the Secretary-General f the United Natins, reprts n the measures they have adpted which give effect t the rights recgnized herein and n the prgress made n the enjyment f thse rights: (a) Within tw years f the entry int frce f the Cnventin fr the State Party cncerned; (b) Thereafter every five years. 2.Reprts made under the present article shall indicate factrs and difficulties, if any, affecting the degree f fulfillment f the bligatins under the present Cnventin. Reprts shall als cntain sufficient infrmatin t prvide the Cmmittee with a cmprehensive understanding f the implementatin f the Cnventin in the cuntry cncerned. 3.A State Party which has submitted a cmprehensive initial reprt t the Cmmittee need nt, in its subsequent reprts submitted in accrdance with paragraph 1 (b) f the present article, repeat basic infrmatin previusly prvided. 4.The Cmmittee may request frm States Parties further infrmatin relevant t the implementatin f the Cnventin. 5.The Cmmittee shall submit t the General Assembly, thrugh the Ecnmic and Scial Cuncil, every tw years, reprts n its activities. 6. States Parties shall make their reprts widely available t the public in their wn cuntries. 3

6 HOW TO REPORT (Develp a reprting prcess) TIMING f submissin is critical: (Mapping the deadlines f the reprts). The Cmmittee needs t receive up-t-date infrmatin at the time f the review. What yu can d? If yu knw yur State has submitted its reprt t the Cmmittee, cntact the Child Rights Cnnect t ask abut the timeline fr the submissin f the NGO reprt. Use the feedback given t infrm the develpment f yur reprt preparatin. If there is cnsiderable delay, cntinue t mnitr and cllect data s the Cmmittee receives up-t-date infrmatin. Develp the prcess f preparing the reprt frmat and cntent f reprt as well as human and financial resurces (Frmat and cntent f the reprt can be discussed during mnthly meeting f the calitin/grups f NGOs but human and financial resurces must be allcated as lng term plan) 6

Cnduct field wrks t interview yuth grups, children, village chiefs, villagers, NGO, dnrs, UN Agencies, Gvernment fficials at central and prvincial levels. Cnduct FGD with cmmunity peple including children. 9

Organize cnsultatin wrkshps with members f the calitin/netwrk and ther relevant rganizatins, including grups f children and yuth wh actively prvided feedback n the draft reprt and gave valuable inputs. Re-edit the secnd fact-finding reprt and shrten t fit the reprting guidelines, and present t the calitin/netwrk fr a final review. 10

12 HOW TO DEVELOP THE REPORT (NGO wrking in partnership) Identify key nn-gvernmental stakehlders and develp/strengthen a calitin: Independent NGOs (internatinal, natinal and lcal) Other nn-gvernmental stakehlders (e.g. academia and children) Ensure brad representatin frm different regins f the cuntry Ensure representatin f different thematic areas NGOCRC in 1994 t develp initial reprt t the Cmmittee n CRC. 12
