1 TERMS OF REFERENCE LONG TERM INSITUTIONAL AND TECHNICAL CAPACITY SUPPORT TO THE MINISTRY OF EAST AFRICAN COOPERATION (MEAC); TANZANIA a) Backgrund 1.1 EAC integratin The East African Cperatin (MEAC) Treaty sets ut a bld visin fr the eventual unificatin f the East African Cmmunity Partner States and underscres the cmmitment t c-peratin in Trade Liberalizatin and Develpment; Investment and Industrial Develpment; in Standardizatin, Quality Assurance, Metrlgy and Testing; Mnetary and Financial C- Operatin; Infrastructure and Services; the Develpment f Human Resurces, Science and Technlgy; Free Mvement f Persns, Labur, Services, Right f Establishment and Residence; Agriculture and Fd Security; Envirnment and Natural Resurces Management; Turism and Wildlife Management; Health, Scial and Cultural Activities and in Enhancing the Rle f Wmen in Sci- Ecnmic Develpment. The entry pint f the East African Cmmunity integratin prcess is the Custms Unin which entered int frce in 2005 and launched by the three riginal Partner States: the Republic f Kenya, the United Republic f Tanzania and the Republic f Uganda. The Republic f Rwanda and Burundi started implementing EAC Custms Unin n 1st July The Prtcl n the Establishment f the East African Cmmunity Cmmn Market which was signed by the Heads f State n Nvember, 20, 2009, and entered int frce n July 1 st, The Partner States have embarked n negtiatins fr the establishment f the East African Mnetary Unin set t cme int frce in 2012, t be fllwed by a plitical Federatin as their ultimate gal. 1.2 Challenges While the existence f numerus reginal instruments, plicies, strategies and plans t facilitate the implementatin f the EAC Custms Unin, Cmmn Market, is cnsidered psitive, the slw pace f implementatin and lw levels f resurce mbilisatin t supprt this prcess remain key cncerns. Als, translating such agreements at natinal level, fr example, amending natinal regulatins and laws in rder t cmply with EAC cmmitments (as detailed in prtcls, etc.) is cmplex and resurce intensive. If nt well managed, it culd impse prhibitive cmpliance csts fr prducers and service prviders. Anther key challenge fr Tanzania especially, is the lw level f knwledge and understanding f benefits frm EAC integratin fr Tanzania by the general public and mre specifically pprtunities fr businesses. The Ministry f East African Cperatin as the lead Ministry n East African integratin has a key rle t play in ensuring that these challenges are addressed. 1.3 Rle f MEAC in Tanzania Tanzania established the Ministry f East African Cperatin (MEAC) in 2006 thrugh the Presidential instrument fllwing a decisin by Heads f State f the East African Cmmunity t Versin 1.1, December 13, 2011 TMEA 1

2 establish Ministries slely respnsible fr EAC Affairs t accelerate the regin s integratin prcess. MEAC crdinates Tanzania s integratin int the EAC with the missin t ensure effective participatin f Tanzania in building a prsperus EAC while safeguarding the natinal interest. Its cre functins are summarized belw: I. T facilitate, crdinate and mnitr the implementatin f East African Cmmunity Treaty and Prtcls; II. T implement measures twards pverty eradicatin, prvide plicy directin and technical guidance t stakehlders in Tanzania; III. T crdinate and facilitate the implementatin f the EAC Prjects and Prgrammes; IV. T facilitate the negtiatins f East African Cmmn Market, Mnetary Unin and ultimately Plitical Federatin; V. T enhance public and private sectrs participatin in frmulatin f plicies, prgrammes and strategies; VI. T enhance perfrmance and human resurces develpment fr efficient and effective delivery f services; VII. T crdinate gvernment agencies which falls under the Ministry; VIII. T create Public awareness n EAC affairs; IX. T Harmnize and ratinalize the EAC integratin prcess with ther Reginal ecnmic gruping such as SADC and COMESA; and X. T efficiently and accuntably utilize public resurces MEAC has a key rle t play in crdinatin f integratin especially with respect t implementing EAC Treaty, prtcls, decisins, plicies, strategies and legislatin. Hwever, mst f the wrk f implementatin takes place in sectr Ministries. As such, MEAC s strategic plan identifies a key bjective f crdinating and guiding the implementing institutins as t their bligatins and the integratin milestnes that they shuld meet. 1.4 TradeMark East Africa Assistance t the Ministry f East African Cperatin During the establishment f TradeMark East Africa (TMEA) Tanzania cuntry prgramme, fasttrack cnsultancy supprt was prvided between July 2010 and June 2011 in the areas f reginal integratin plicy and strategy develpment, cmmunicatins, M&E and human resurce develpment. Specific activities undertaken during the fast track include: develping Tanzania s Cmmn Market Implementatin Strategy (CMIS) initiated wrk twards develpment f a Natinal Integratin Plicy (NIP) a survey f stakehlder perceptins n EAC integratin; develpment f a cmmunicatins strategy; prductin f cmmunicatin prducts including billbards; design and pilting f the web-based East Africa Mnitring System (EAMS) t track and evaluate EAC decisins and ther cmmitments, including training f MEAC staff, and; training needs assessment f MEAC and develpment f a training plan fr rganisatinal strengthening including leadership training. 3 The Fast Track prgram was delivered thrugh shrt-term inputs frm senir advisers wrking with cunterparts in the ministry in specified areas. Its utputs prvide a strng fundatin fr develping and rlling ut lng term supprt t MEAC as utlined in this TR. b) Objective TMEA is selecting a service prvider t manage and implement a package f supprt fr reginal ecnmic integratin t the Ministry f East African Cperatin, MEAC, and ther ministries, department and agencies (MDAs) in Tanzania, thrugh lng- and shrt-term technical assistance and t manage financial aid n behalf f the Ministry. c) Recipient The Ministry f East African Cperatin in Tanzania is the recipient f this supprt. d) Scpe The service prvider will: prvide required technical and management supprt fr the implementatin f the prgramme; be respnsible fr surcing, cntracting and managing all TA inputs (including thse required t prvide advice and versight f the financial aid cmpnent and will be accuntable t TMEA fr the financial aid disbursed; based n agreed utcmes and areas f supprt fr MEAC and ther MDAs, develp an actin plan t implement shrt- and lng-term technical assistance prgram in identified pririty areas; agree with MEAC and TMEA the desired utcmes, develp and agree a mnitring and evaluatin plan t assess prgress twards achieving agreed utcmes frm the baseline situatin; Oversight and quality cntrl f wrk f all advisry and cnsultant inputs specified in these TR t ensure prmpt and efficient delivery; management f a pl f additinal shrt-term experts, available fr call-dwn t prvide expert input in specific areas related t EAC initiatives as my be required; In this regard a list f list f shrt term cnsultants will be required; prvide technical guidance n reginal integratin issues including implementatin f the Cmmn Market Implementatin Strategy; prvide advisry and technical input fr the establishment f a Think-tank t spearhead plicy and analytical wrk in MEAC; lead and crdinate the preparatin f quarterly wrk-plans and mnthly prgress reprts fr technical assistance prvided; develp and implement a M&E plan fr MEAC s plicies, strategies, plans and prgrammes; Versin 1.1, December 13, 2011 TMEA 3

4 rganize and facilitate training and capacity building activities fr MEAC and ther MDAs staff; prvide technical and advisry inputs t supprt implementatin f the cmmunicatin strategy, and; ensure that verall prgram utputs are delivered timely and f high quality. e) Methdlgy The service prvider will prvide a shrt- t lng-term TA, including staffing 1 supprt fr the establishment f the think-tank; MEAC will be the implementing partner respnsible fr managing the wrk, with assistance frm the shrt- and lng-term technical advisers. All advisers will have reprting lines t a team leader, wh will be respnsible fr crdinating all the TA and financial aid, writing reprts, and quality assuring the verall prject. The TA team will cnsist f the fllwing: a lng-term full-time Senir Reginal Integratin adviser and team leader. a lng-term full-time Mnitring and Evaluatin adviser shrt -term East African Cmmunity Decisins M&E Systems adviser Lng-term Cmmunicatins Adviser shrt-term cnsultants in specialized areas t be surced as needed; MEAC will wrk clsely with its partner MDAs, e.g. the Ministries f trade, labur; hme affairs, justice, finance, and educatin as well as Attrney General s Chamber, and Bank f Tanzania, respnsible fr negtiating and implementing reginal integratin in Tanzania. Prvisin is als made fr key MDAs t benefit frm TMEA supprt thrugh this prgram fr example, thrugh assistance t mainstream EAC integratin int their strategic plans and budgets, review f laws, and capacity building (including training) and implementatin f EAMS and preparatin f reprts. Wrking with MEAC and TMEA, the service prvider will establish pririty MDAs that will receive technical supprt fr agreed pririty areas. f) Outcmes and Deliverables The service prvider will supprt MEAC t implement the fllwing: a) Natinal Integratin plicy and Implementatin f Cmmn Market strategy Develp and implement Natinal Integratin Plicy and Strategy Rll ut implementatin f the CMIS; Develp and peratinalise institutinal mechanisms fr engaging MDAs, business and civil sciety n EAC integratin, implementatin and fllw-up 1 Three Tanzanian natinals will be recruited nce the prgram has started t be part f the supprt prgram and later integrated int MEAC as staff. 5 Facilitate dialgue with key stakehlders n key plicies and strategies; Supprt MEAC and ther MDAs in mainstreaming EAC integratin issues int plicies, plans and budgets; Prvide legal assistance n harmnizing natinal laws t cmply with EAC laws, etc; b) Lng-term capacity develpment fr MEAC and MDAs Undertake cmprehensive capacity needs assessment; Based n capacity needs assessment, implement a staff training (MEAC and ther MDAs) including leadership training prgram; Establish a Think-tank in MEAC t spearhead research and plicy analysis n reginal integratin with specific reginal integratin expertise; Undertake and/r cmmissin and supervise research and plicy analytical wrk including impact assessments n pririty areas t be agreed upn with MEAC ; Supprt the ministry t hst public dialgue events t disseminate results f studies and analysis ; c) Establish and implement plans and systems fr mnitring and evaluatin f reginal integratin Operatinalise EAMS in MEAC and install and rll it ut in key MDAs; Training n EAMS fr bth MEAC and MDAs staff; Develp, implement and institutinalise a mnitring and evaluatin plan fr MEAC including mnitring f reginal integratin; Prvide advisry supprt and staff training n mnitring and evaluatin; Cnduct natinal surveys n awareness and perceptins n EAC ; Establish key baseline data fr mnitring f reginal integratin; Supprt and advice n the preparatin f peridic mnitring and evaluatin reprts d) Imprve ICT, knwledge and cmmunicatin systems; Prcure and install equipment t facilitate full implementatin f EAMS; Prcure equipment t enhance capacity f the cmmunicatins team and verall cmmunicatin wrk within the Ministry; Establish ne stp resurce centre; e) Enhance knwledge and awareness n EAC integratin. Rll ut implementatin f the Cmmunicatin strategy and its actin plan; Advice MEAC and wrk with staff t develp cmmunicatins tl; Prductin f publicity materials Training f staff t imprve their capacity in delivering the cmmunicatins strategy; Establish systems t mnitr results; Cmmissin perceptin surveys t assess awareness levels n reginal integratin in the EAC regin fr Tanzania; Supprt public relatins initiatives, public dialgue, awareness and utreach events. 6 MEAC is nt yet in a psitin t directly manage financial aid. TradeMark Tanzania will prvide a grant t MEAC t be managed by the service prvider. The service prvider will be hused in the MEAC headquarters in Dar-es-Salaam, but will need their wn ICT equipment (i.e. cmputers, mbile telephnes, etc.). Any lcal transprtatin will be the respnsibility f the service prvider. Wrk will primarily take place in the MEAC headquarters in Dar-es-salaam. Hwever Advisers may be required t travel frm time t time. g) Reprting The Lng-term TAs shuld be fully integrated int MEAC s reprting structure. The service prvider will be respnsible fr reprting t the Permanent Secretary (PS), and departmental heads as determined by the MEAC. Written reprts shuld be submitted t PS MEAC and the TMEA Tanzania Cuntry Directr. During the assignment, the prject team will adhere t the fllwing reprting schedule: An inceptin reprt within the first 3 weeks f the start f activities, that utlines the baseline situatin in the Ministry f EAC and sets ut the first 12 mnth frward wrk plan (that includes utcmes, utputs and activities); Shrt mnthly and lnger quarterly prgress reprts utlining activities cnducted and any adjustments t the wrk plan and evidence f achievement f shrter term and lnger term utcmes; Within 1 mnth f the cmmencement, an annual wrk plan shuld be submitted and at 12 mnths intervals thereafter fr the remainder f the assignment; Detailed annual prject perfrmance reprt in TMEA s frmat. A final reprt submitted n later than 4 weeks befre the finalisatin f activities, utlining the activities cnducted and recmmendatins fr the nging develpment f MEAC n the negtiatin and management f EAC integratin, as well as the cntinuing implementatin f the Cmmn Market Prtcl. h) Timeframe Implementatin is scheduled t begin in December 2011 and t end in December An annual review will be carried ut at the end f the year t assess perfrmance. i) Crdinatin The technical assistance will be crdinated between the Permanent Secretary f MEAC r her designated representative and TMEA Tanzania Cuntry Directr. TMEA and MEAC senir managers will cnvene crdinatin meetings at least quarterly t discuss prgress. The Task Manager fr this prject is TMEA Tanzania Cuntry Directr. TMEA s prcurement team in Nairbi will be respnsible fr issuing and managing the cntract. The selected service prvider will meet the TMEA team regularly during implementatin, t review prgress and make suggestins n the way frward. Versin 1.1, December 13, 2011 TMEA 6

7 j) Requirements; The Lng Term Advisers shuld have a relevant pstgraduate qualificatin and have a strng backgrund in reginal integratin, trade plicy, trade facilitatin and develpment, with at least 10 years prfessinal experience. Previus experience with East and Suthern Africa, including Tanzania, is desirable. In additin, the experts shuld be experienced leading technical assistance and institutinal develpment prgrammes within the trade sectr in develping cuntries; be fully cmputer literate, and have fluent written and spken English and excellent reprt writing skills. 8 Annex 1: Detailed Terms f Reference fr TAs a) Senir Reginal Integratin Adviser 1 Objective The Senir Reginal Integratin (SRI) Adviser will be advising Ministry f East African Cperatin (MEAC) t build up the lng-term capacity f MEAC t lead, manage and crdinate East African integratin, frm negtiatins t implementatin. The SRI Adviser will d this thrugh, fr instance, supprting the develpment and rll ut f RI plicies and strategies, develping high quality evidence-based analysis, facilitating the implementatin f institutinal framewrks fr crdinatin and cnsultatin, as well as assisting in the establishment f a RI/EAC Think Tank (TT) in MEAC. Fr instance, MEAC requires high-quality analysis n EAC integratin issues, including n hw t maximise the benefits and minimise the csts f EAC integratin. In additin, crdinatin and engagement mechanisms acrss key stakehlders, as well as ways in which t fster pen and infrmed debate, needs t be imprved. The Adviser will als wrk with the EAC Secretariat and ther EAC institutins, particularly t help ensure that they are meeting the needs f Tanzania. 2) Main duties and respnsibilities The SRI Adviser will wrk clsely with all technical divisins (especially the Ecnmic Infrastructure and Scial Supprt Services Divisin and Trade, Investment and Prductive Sectrs Divisin) as well as the Plicy and Planning Divisin, with verall guidance frm the Permanent Secretary (PS) and Deputy Permanent Secretary (DPS) f MEAC. The SRI Adviser will prvide high quality timely advice t the PS, DPS and Minister when requested. In additin, the SRI Adviser will manage a team f cadre f RI experts (t be hired) supprting the varius functins highlighted belw (as well as ther tasks requested by MEAC). In cllabratin with Senir MEAC fficials, the SRI Adviser, as TMEA Team Leader, will manage the team f shrt- t lng-term technical assistance funded by TradeMark East Africa Tanzania (e.g. Mnitring and Evaluatin (M&E) Adviser; Mnitring and Evaluatin Systems Adviser and Cmmunicatins Adviser; etc.). The SRI Adviser will prvide prfessinal advisry input and quality versight acrss the TMEA-funded activities. 9 Prvide supprt t the rll ut and implementatin f Tanzania s Cmmn Market Implementatin Strategy (CMIS) Supprt the develpment and rll ut f Tanzania s Natinal Integratin Plicy (NIP) and ensure that Tanzania s Natinal Integratin is in line with the CMIS Supprt MDAs in develping detailed actin plans fr implementatin f the CMIS and mainstreaming EAC integratin in MDAs plicies, strategies, plans, prgrammes and budgets Design and manage strategic cnsultatins and wrkshps t mainstream EAC integratin Update Tanzania s radmap fr reginal integratin, building n the CMIS matrices b) Institutinal framewrk Building n the High-level Task Frce (HLTF) institutinal arrangements, assist MEAC in implementing the prpsed institutinal framewrk (as utlined in the CMIS) fr facilitating systematic plitical and technical engagement and crdinatin with MDAs and the private sectr n EAC integratin; Ensure the institutinal framewrk results in mre effective implementatin f EAC cmmitments, including thse detailed in the CMIS; Wrk in cnjunctin with staff and technical assistants respnsible fr M&E t ensure the institutinal framewrk cmplements and reinfrces the M&E functins (e.g. using the institutinal framewrk as a mechanism by which t gather infrmatin and reprt n prgress); Supprt MEAC t strengthen linkages and netwrks acrss gvernment and with the private sectr ; Assist in identifying and building the capacity f ptential champins n EAC integratin thrugh netwrk building; Wrking clsely with PS/DPS, liaise with central gvernment ministries t garner increased engagement and supprt fr EAC integratin at the highest level f gvernment; Assist MEAC t mnitr and fllw up EAC institutinal refrms n behalf f Tanzania and advise MEAC n EAC institutinal refrm; Prvide capacity building supprt t appinted EAC fcal pints acrss gvernment, including the develpment f clear TRs and expanded membership (e.g. private sectr, civil sciety and lcal gvernment); Assist in setting up an EAC Resurce Centre at the Ministry. c) Creatin f MEAC Think Tank n RI/EAC integratin Facilitate MEAC in develping and peratinalising a Think tank (TT) n RI/EAC integratin in MEAC;, The Adviser is expected t deliver, in cllabratin with the TT team, a number f functins f the TT, as well as assist in managing the TT. The SRI Adviser will first advise n the prpsed set-up f the TT, wrking in clse cllabratin with senir fficials t ensure these are apprpriate and effective. 10 Prvide rapid, accurate plicy briefings fr MEAC n a call dwn basis in respnse t requirements identified in light f upcming EAC meetings and negtiatins, etc.; Prepare high-quality evidence-based analysis, including impact assessments (i.e. csts and benefits) f RI/EAC integratin; Prepare negtiatin briefs and psitin papers and facilitate intensive briefing sessins fr Tanzania s negtiatin teams; Prvide technical advice and supprt t MEAC cmmunicatins staff n hw t present key messages t different audiences (e.g. parliamentarians, private sectr, civil sciety, ministers, senir gvernment fficials, general public, etc.); Develp TRs fr cmmissined research, managing and quality assuring the prductin f quality research prducts; d) Training Prvide technical guidance n the develpment and rll ut f the training prgramme; Deliver elements f the training prgramme where apprpriate; On-the-jb mentring and training t MEAC staff; e) TMEA Team Leader respnsibilities As TMEA Team Leader, the SRI Adviser will als: Crdinate all TMEA-funded MEAC technical assistance, respnsible fr ensuring effective capacity building verall Facilitate the design and implementatin f TMEA-funded MEAC activities, in line with the TMEA Tanzania Business Plan and Tanzania s strategies, plicies, etc n RI/EAC integratin Crdinate the develpment f a capacity building plan including mentring etc. t ensure sustainability Ensure that all advisrs are wrking with the MEAC t gather baseline infrmatin, and evidence f prgress twards the achievement f shrter and lnger term utcmes. 3) Reprting The adviser will reprt t the PS and/r DPS f MEAC. Within tw weeks f cmmencing the assignment, the adviser will prduce a wrk plan n activities t be undertaken fr the duratin f the cnsultancy which will be validated by MEAC management within ne week. Reprting will take place against the deliverables defined in the wrk plan. Brief mnthly reprts and lnger quarterly reprts will be submitted t MEAC. The adviser will meet with the PS and/r DPS at least nce a mnth t fficially reprt prgress and necessary fllw-up. As TMEA Team Leader, the SRI Adviser will als reprt t the TMEA Cuntry Directr fr cntractual and crdinatin purpses and prvide quarterly prgress and planning reprts fr all MEAC-related TMEA supprt, as set ut in the TMEA Tanzania business plan. 11 4) Duratin and lcatin The adviser will be emplyed n cnsultancy basis fr tw years with pssibility f extensin. The adviser is expected t be based in Dar es Salaam, Tanzania, with sme travel within the EAC regin, particularly the EAC Secretariat in Arusha. 5) Qualificatins/Prfile The adviser will have the fllwing qualificatins/prfile: Experienced specialist in reginal integratin, at bth plicy and research levels, with a thrugh understanding f the EAC and/r ther reginal ecnmic cmmunities; A Masters degree in ecnmics, trade r related discipline; Prven track recrd f relevant experience (minimum f 10 years; ideally 15 years+) ideally in a develping cuntry gvernment; Excellent team leader experience; Extensive experience in East Africa including Tanzania; Mentring and transfer f knw-hw skills and prven recrd f delivering successful capacity building and training; Gd cmmunicatin skills, relatinship-building skills, and accustmed t building netwrks and crdinatin mechanisms acrss institutins; Experience in rganizatinal and prject planning; Mtivatinal and dynamic with the ability t generate enthusiasm fr wrk prgramme implementatin; Prficient in Kiswahili ( an added advantage); Versin 1.1, December 13, 2011 TMEA 11

12 b) Mnitring and Evaluatin Adviser 1 Objective The Mnitring and Evaluatin (M&E) Adviser will be respnsible fr guiding develpment f the verall M&E strategy and the implementatin f effective mnitring and related activities within MEAC in rder t prvide regular M&E reprting f reginal integratin. He/she will als wrk clsely with ther relevant Ministries, Departments and Agencies (MDAs) negtiating and prject TAs, implementing and mnitring East African integratin, as well as the East African Cmmunity (EAC) Secretariat. 2 Recipient The primary recipient is the Ministry f East African Cperatin (MEAC) Tanzania but the wrk will als supprt secndary recipients namely key Tanzanian MDAs critical fr East African integratin. 3 Main duties and deliverables The M&E Adviser will wrk clsely with the Plicy and Planning Divisin and cllabratively with all technical divisins t peratinalise M&E functins and activities within MEAC and relevant key MDAs. 14 c) East African Cmmunity Mnitring System (EAMS) Adviser 1 Objective The East African Cmmunity Mnitring System (EAMS) Adviser will be respnsible fr the full implementatin f EAMS acrss MECA and MDAs thrugh planning and verseeing EAMS applicatin, deplyment and rllut, as well as training and backup supprt during its implementatin, in Tanzania. He/she will als wrk clsely with MEAC and ther relevant Ministries, Departments and Agencies (MDAs) negtiating, implementing and mnitring East African integratin, as well as the East African Cmmunity (EAC) Secretariat. 2 Main duties and deliverables The EAMS Adviser will wrk clsely with the Infrmatin and Cmmunicatin Technlgy Unit (ICTU), Infrmatin, Educatin and Cmmunicatin Unit (IECU) and the Plicy and Planning Divisin, and cllabratively with all technical divisins, as well as the TMEA-funded Mnitring and Evaluatin (M&E) Adviser.
