1 CREW / CPA WORKING GUIDELINES These revised wrking guidelines becme effective as f 1 March Any deviatin frm the fllwing agreements must be agreed upn in writing prir t bking cnfirmatin. These wrking guidelines apply t all crew. GENERAL Crew means all crew wh are cntracted frm time t time by the prducer. This des nt include persnnel subcntracted by suppliers (i.e. - caterers, set builders, stunt cmpanies, etc.) The Prducer(s) means a persn, r bdy f persns wh are CPA members and wh are cntracted t prduce cmmercials, r a representative nminated by the Prductin Cmpany. SPECIFIC DEFINITIONS AND RATES OF PAY Call Time Call time means the call time stipulated by the prducer in which the technician is required and bliged t be n set r any specific place. If the set/lcatin is within 40km s f the prductin ffice, r htel if n an away sht, then call time will be the time the crew member is required n set regardless f wn r prvided transprt. If the lcatin is further than 40km s away frm the prductin ffice, then call time will be the time the crew member is required t be at the prductin ffice, htel r vehicle cllectin pint. If the lcatin is further than 40kms frm the prductin ffice r htel, transprt will be prvided by prductin. Crew wh d nt utilize the prvided transprt must make their wn way, at their wn expense, t the lcatin. If a specific crew member s call time n lcatin is later than the departure time f the prvided transprt, then that crew member s travelling expense will be remunerated. Call and wrap time fr designated drivers will be taken frm the time f vehicle cllectin pint t vehicle return pint, regardless f distance t and frm lcatin. Wrap Wrap means the end f a shting sessin, technical wrap r return t base if the lcatin is further than 40 km s frm base, as called by the prducer. Wrap is wrap and payment fr any additinal wrk thereafter needs t be negtiated befre time sheets are signed. Wrking Hurs

2 Wrking hurs per standard day, premium day, split shift day r night sht and t which n vertime applies, shall be 10 hurs including meals. Only after the specified hurs are wrked, will vertime apply. Prducers will d their best t achieve a minimum f a 10 hur turnarund perid between wrap and call time f the same sht, it being acknwledged that a turnarund f less than 10 hurs is the exceptin and nt the nrm. If turnarund time is less than 10 hurs, the prductin cmpany will be penalized fr the crrupted hurs. Crew shall nt be bked n a day sht which falls n the day immediately fllwing a night sht. In the event f an early call n the day fllwing a sht, crew members shall have the right t request t be released prir t the end f the shting day prvided that they make this request befre 17H00. This shall nt be applicable if the prductin cmpany has given prir ntice f an extended day. Overtime Overtime at time and a half r duble time is payable n a standard day. The fllwing crew members are excluded frm vertime: runners, trainees and junir assistants in all departments, all prductin staff and chapernes. Crew members will be paid vertime as fllws: 1st 4 hurs x 1.5, thereafter x 2 (refer clause fr exceptins). Overtime will be charged fr in quarter hur increments i.e. Wrap called after the quarter hur will be runded up and wrap called up t the quarter hur will be runded dwn. Shuld the last day f sht wrap after 24h00, a penalty f triple time will be incurred fr every additinal hur (r part theref) regardless f whether r nt an extended day has been called. Prductin will limit the hurs wrked by Prductin Assistants t a maximum f 14 hurs per day. On sht days pr-rata vertime will be paid fr hurs in excess f 14, shuld the Prductin Assistant agree t wrk these hurs. Standard Day Standard Day shall mean a day sht f 10 cnsecutive hurs and applicable vertime hurs. Call time fr a standard day cannt be earlier than 03h30. Agents shuld be ntified well in advance, with a minimum f 3 days advanced warning, if call time is any time befre 04h00 n the first shting day. Shuld sufficient advanced warning nt be given, crew may be replaced. Premium Day Premium Day shall mean any Sunday, Public Hliday r first night f a night sht. Premium days will be paid at 1.5 x the standard daily rate - this applies t all crew. A night sht n a premium day will nly be paid at time and a half. Overtime rates shall be calculated at premium day rates in respect f premium days. (i.e. 1.5 x time and a half fr the first 4 hurs, and 2 x time and a half fr the hurs thereafter)

3 A premium rate will be paid fr all shting days after 6 cnsecutive sht days, until a day f rest is prvided. Sundays and Public Hlidays will be paid at nrmal premium rates. Public Hliday Public Hliday shall mean the fllwing Public Hlidays as defined in the Public Hlidays Act 36 f 1994, namely New Year s Day, Human Rights Day, Gd Friday, Family Day, Freedm Day, Wrker s Day, Yuth Day, Natinal Wmen s Day, Heritage Day, Day f Recnciliatin, Christmas Day and Day f Gd Will. A Public Hliday shall als mean any ther Public Hliday deemed as such by Gvernment shuld the fficial Public Hliday fall n a Sunday. Split Shift Split Shift shall mean a day/night called as such by the prducer in which a minimum time ut f 4 hrs is called. Time Out is the ttal rest time called by the prducer t create a split shift day and shall nt be less than 4 hurs. This 4 hur perid is frm wrap t call time back n set if set is within a 40km radius frm base, r frm wrap time t call time back at base if the set is further than 40kms frm base. The prducer must infrm the crew/crew agents f the split shift n cnfirmatin f the bking. The prducer has the ptin t call a split shift day. The minimum payment will be fr a standard day. If standard day wrking hurs are exceeded, the nrmal vertime structure applies. If a split shift day is called n a premium day, then premium rates shall be paid. Call time n a split shift day may nt be later than 08h00 fr the first shift r later than 16h00 fr the secnd shift. A day may nt be classified as a split shift if crew are nt permitted t leave set during the hurs between filming i.e. the crew must be able t g hme, t base, htel r tented camp during the break. Travel Day Travel Day shall mean a day called as such by the prducer and in which the travel time is nt greater than standard day hurs (i.e. 10 hurs). Fr a travel day, half f the standard day rate shall apply t all crew (refer fr the exceptin). A standard day rate is paid even if travel ccurs n a premium day. If mre than 10 hurs are traveled, payment fr thse hurs traveled ver 10 hurs will be n a pr rata basis calculated at standard day rates, regardless f what day the travel ccurs. (e.g. travel f 12 hurs = half day f 5 hurs plus 2 hurs pr rata = 7 hurs). Fr a travel day, designated drivers shall be paid a half day rate if they wrk (drive) fr less than 5 hurs. If designated drivers drive fr lnger than 5 hurs then a full day rate shall apply. If travel ccurs n a premium day, a premium day rate will be applicable n the same basis. If 10 hurs f travel are exceeded then the nrmal vertime structure will apply. Travel hurs shuld nt exceed the reasnable time required t reach a specific destinatin. Gear Check

4 Gear Check means a day called as such by the prducer in which the hurs wrked d nt exceed 5 hurs. If less than half (half being 5 hurs excluding a meal break) f standard day hurs are wrked n a gear check day, then half the standard day rate shall apply. If mre than 5 but less than 10 hurs are wrked, payment will be n a pr rata basis calculated at standard daily rates. On a premium day, premium rates will apply. If mre than 10 hurs are wrked, nrmal vertime rates will apply Pre-light Pre-light means a day called as such by the prducer and in which n filming is undertaken and the hurs wrked d nt exceed 5 hurs. If less than half (half being 5 hurs excluding a meal break) f standard day hurs are wrked n a pre-light day, then half the standard day rate shall apply. If mre than 5 but less than 10 hurs are wrked, payment will be n a pr rata basis calculated at standard daily rates. On a premium day, premium rates will apply. If mre than 10 hurs are wrked, nrmal vertime rates will apply. Pre-rig / De-rig Pre-rig / De-rig means a day called as such by the prducer and in which n filming is undertaken and the hurs wrked d nt exceed 5 hurs. If less than half (half being 5 hurs excluding a meal break) f standard day hurs are wrked n a pre-rig / de-rig day, then half the standard day rate shall apply. If mre than 5 but less than 10 hurs are wrked, payment will be n a pr rata basis calculated at standard daily rates. On a premium day, premium rates will apply. If riggers are utilized n a sht t help filming crew, then nrmal day rates and vertime rates apply. If mre than 10 hurs are wrked, nrmal vertime rates will apply. Technical Recce Technical Recce means a day called as such by the prducer and in which the hurs wrked d nt exceed 5 hurs. Technical Recce s (5 hurs) will be charged at half day rates. If mre than 5 hurs but less than 10 hurs are wrked, payment will be n a pr rata basis calculated at standard daily rates. On a premium day, premium rates will apply. If mre than 10 hurs are wrked, nrmal vertime rates will apply If the prductin cmpany is prepared t wait fr cnfirmatin f a Recce 24 hrs befre it is due t ccur, nly an hurly pr rata rate will be charged (i.e. n wrk has been lst by the crew member). Night Sht Night Sht means a sht in respect f which call time is 15h00 r later. If a sht is called between 12h00 and 15h00, but cntinues after 24h00, it will revert t being deemed a night sht. The prducer must infrm the crew / crew agents f a night sht at the time f cnfirmatin f the bking. The first night f a night sht will be the same as premium day rates i.e. time and a half fr the first night f a night sht. Weather Day

5 Weather Day means a day which ccurs if the scheduled sht is nt cmpleted due t the weather. The weather day may be added n t the end f the scheduled shting perid, r may be bked as an additinal day at such time as scheduled by the prducer. Extended Day Extended Day means a standard day sht f mre than 14 hurs. Prducers are t infrm crew/agents 3 wrking days prir t the first sht day when an extended day is planned. If a sht cntinues beynd the prescribed time, crew will stay, but shuld be permitted t leave the set at a reasnable time befre the cmmencement f their next call. Crew bked fr an extended day must either directly r via their agents infrm bth prducers cncerned. Day Off Day Off is where a minimum f 24 hurs rest is given. Turnarund Turnarund n any given sht will be paid fr all hurs less than 10 hurs given frm wrap/technical wrap r return t base, t call time n the fllwing day f the same sht. Payment fr this will be calculated as fllws: the hurs erded will be charged as a penalty at an hurly rate fr the first 2 hurs, duble hurly rate fr the next 2 hurs and triple the hurly rate thereafter. E.g.- Rate f R500 per day / 6 hurs rest given. There is a 2 (tw) hur penalty at R per hur and a 2 (tw) hur penalty at R per hur. Ttal penalty fr 4 hurs f turnarund = R Turnarund may be charged by all crew, including technical and art department. Turnarund may be charged by all crew n the day immediately preceding the first sht day f a sht, whether this day is a prep day, pre-rig day, a pre-light day r a Recce day. This turnarund is nly payable if cleared with the prducer prir t turnarund hurs being wrked. Turnarund may nt be charged n any ther prep day. Addendum Addendum means the addendum t the wrking cnditins, which sets standardized rates fr per diems, mileage, travel expenses and telephne, as may be amended frm time t time, and as specified by SA Revenue Services (SARS). PAYMENT Crew will be paid within twenty (20) days f submissin f an invice, but is subject t negtiatin with the crew agents. Interest n late payments may be charged by the crew agent cncerned, subject t the agent s discretin and business terms as stated n an invice. Payments will nly be made nce any utstanding flats, if applicable, have been recnciled with the prducer. In the event f any queries, the prducer may nly withhld payment fr an individual crew member and nt the entire agent s statement fr any given prductin. Shuld a crew member invice a prductin cmpany directly and nt thrugh an agent, incme tax will be deducted by the prducer at the rate as specified

6 by SARS, unless the prducer is prvided with a specific written directive frm SARS addressed t the prducer. CANCELLATION Cancellatin means either the cancellatin f a cnfirmed sht day r the cancellatin f a cnfirmed crew member. Remuneratin fr cancellatin within 5 wrking days (Mnday-Saturday) f cmmencement f a cnfirmed sht day shall be paid at the fllwing rate: 100% fr days 1 and 2 50% fr days 3 t 5 25% fr days 6 t 7 The prducer shall nly be entitled t cnfirm the crew bking nce the client has cnfirmed the jb and nt befre. Cnfirmatin f a crew member via r fax is binding and subject t penalty fees fr cancellatin. Crew bking sheets shuld always be signed by the prductin staff n cnfirmatin f the jb, and returned t the agent. Shuld a prductin cmpany cnfirm a crew member n a 24hr cnfirm r release ntice and subsequently cancel such a bking, cancellatin will be charged fr days frfeited by the crew member based n the fllwing payment structure: 100% fr days 1 t 3 50% fr days 4 t 6 25% fr days 7 t 10 The crew member will nt be eligible fr a cancellatin fee if the jb is cancelled by the prductin cmpany 21 cnsecutive days prir t cmmencement f sht and visa versa, the prductin cmpany will nt be eligible fr a cancellatin fee if the jb is cancelled by the crew member 21 cnsecutive days prir t cmmencement f sht. If 24 hurs cnfirm r release ntice is issued within 48 hurs f cmmencement f the sht (e.g. prep r sht) then the issued agent r prductin cmpany must prvide their cnfirmatin/denial within 5 hurs. Cancellatin will be paid regardless f which party gives ntice f 24 hurs. Clauses 4.2 and 4.4 d nt apply fr the days that the crew member is cnfirmed n anther prductin during the perid f cancellatin. Shuld a cnfirmed crew member cancel themselves ff a sht directly r thrugh an agent, the cancellatin csts payable t the prductin cmpany, unless therwise negtiated with the prducer, will be the same as in clause 4.4. If a sht n a Sunday r a Public Hliday is cancelled, then cancellatin will be paid at a standard day rate. If a night sht is cancelled then the premium day rate will apply. POSTPONEMENT Pstpnement f a sht means the pstpnement f a cnfirmed sht t a later date as advised by the prducer. If a cnfirmed crew member is nt available fr the new sht dates, standard cancellatin fees as per clauses 4.2, 4.4 and 4.5 will apply. STANDBY Shuld a crew member be put n standby n any given day, a half day rate will becme payable t that crew member if he/she is nt released by 10h00 n the day f standby. MEALS There will be a maximum f 6 hurs between meals. If a call time is befre 07h30, breakfast will be prvided. This als applies t Recce and pre-light days. The six hurs is calculated frm cmpletin f the previus meal. The perid f time allcated fr meals shuld nt be less than half an hur.

7 Meals are t be prvided during a split shift if fd is unavailable nearby t the studi/lcatin where the split shift is called. An evening meal shuld be prvided n an extended day i.e. 6 hurs after lunch. INSURANCE Crew are all respnsible fr their wn health and medical insurances. Regular 6-mnth check ups will help in the event f a claim with an insurance cmpany. Crew persnal insurance shuld als include insurance against injury r lss f earnings. Equipment, persnal belngings and vehicles wned by individual crew members t be used either fr persnal use r within their prfessinal capacity is the respnsibility f that particular crew member. If insurance is t be charged, it must be negtiated up-frnt with the prducer as sme prductin cmpanies carry their wn insurance n such items. SPECIAL NOTES N less than 6 hurs rest shuld ever be given t crew members. N crew member shall wrk withut having had 6 hurs rest. Bkings with crew agents will be taken as pencil bkings until cnfirmed. If cnfirmatin has nt been given within 2 weeks (10 wrking days) f the bking, the bking will autmatically fall away. If the bking is cnfirmed and then cancelled, the bking fee fr each crew member will be charged. N crew member can be duble-bked and cnfirmed n tw cncurrent prductins withut the written permissin given by bth prducers prir t cnfirmatin f the secnd bking. If a crew member s vehicle is hired at the request f prductin, the crew member will be paid per kilmeter at a rate as specified by SARS (refer addendum clause 4). This rate is inclusive f fuel. It is the respnsibility f each crew member t understand and acknwledge the CPA/Crew Wrking cnditins and becme familiar with all revisins which may ccur. It is the respnsibility f each crew member t read the terms and cnditins at the end f every call sheet f each prductin cmpany. All crew must be familiar with the crew cde f cnduct. Crew rate increases will be implemented nce a year and will take effect n 1st September annually. All junir crew nt eligible fr vertime will cmplete prductin time sheets that must be handed t prductin and frwarded t respective agents fr mnitring purpses.
