3 SECTION E: Terms & Cnditins General 1. Vdacm Fibre is an ptical fibre service ffering data, vice and cntent t cnsumer custmers. 2. The Vdacm Fibre terms and cnditins as detailed herein are subject t change frm time t time. 3. The Vdacm Fibre terms and cnditins are available at hme/fibre. 4. The Vdacm Fibre service is subject t: Vdacm s Standard terms and cnditins Vdacm s Acceptable Usage Plicy Additinal specific service r device terms and cnditins mentined belw. 5. Where there is any cnflict between any ther terms and cnditins mentined and the Vdacm Fibre specific terms and cnditins, the last mentined shall prevail. Prvisin f Services 6. Vdacm can nly ffer and prvide the Vdacm Fibre service where there is a Vdacm fibre netwrk presence. 7. The Vdacm Fibre service will nly be available in selected urban areas. 8. The prvisin f the Vdacm Fibre service is subject t credit vetting and the successful cnclusin f a Vdacm Fibre cntract. 9. The Vdacm Fibre service is nly available n a 24-mnth cntract. 10. Vdacm des nt warrant an uninterrupted Vdacm Fibre service and des nt ffer a quality f service r an uptime guarantee. 11. Vdacm endeavr t maintain the Vdacm fibre netwrk and the Vdacm Fibre service at the best f its ability. 12. The custmer may nt resell the Vdacm Fibre service. 13. Vdacm will terminate any custmer s Vdacm Fibre service if it is fund that the custmer resells the service. Cmmencement and Duratin 14. The Vdacm Fibre service cntract start date will be the custmer accunt activatin date. 15. The Vdacm Fibre service cntract shall remain in frce fr the initial perid as defined by the cntract perid (i.e. 24 mnths) where after it shall cntinue n a mnth t mnth basis. 16. The custmer can renew r cancel the cntract after the initial Vdacm Fibre service cntract perid. 17. Any Vdacm Fibre service migratin, due t discntinuatin f a Vdacm Fibre service ffer and ptins available t custmers, will be cmmunicated t the custmer prir t the end f the Vdacm Fibre service cntract initial perid. 18. Any Vdacm Fibre service cntract that includes free r discunted custmer equipment can nly be renewed r cancelled after the initial perid withut any penalty. 19. When a Vdacm Fibre service cntract is terminated befre the initial perid, an early cancellatin penalty will apply, equivalent t 75 percent f the remaining subscriptin due fr the initial perid. Charges and tariffs -* Installatins 20. Vdacm will appint an apprved installer t install the Vdacm Fibre service at custmer premises. 21. The apprved installer will require reasnable access t the custmer s premises. 22. The apprved installer will install the Vdacm Fibre service in accrdance with the detailed installatin guidelines fr a standard installatin as per the Vdacm Fibre Service Schedule. 23. The detailed installatin guidelines will include the maximum installatin specificatins that will be included in a standard installatin. 24. If the Vdacm Fibre service installatin exceeds the standard installatin specificatins, then any additinal installatin expenses will be fr the custmer s accunt. 25. Any additinal installatin expenses will be settled directly with the apprved installer. 26. If the custmer des nt wish t prceed with the installatin due t
4 additinal installatin expenses, the installatin and service cntract will be cancelled. 27. The custmer undertakes t maintain the installatin, including all equipment, prvided in gd rder including envirnmental cnsideratins as detailed in the Vdacm Fibre Service Schedule 28. The custmer may nt mve r alter the Vdacm Fibre service installatin and must ntify Vdacm if there is a need t mve r alter the installatin. 29. Only a Vdacm apprved installer may mve r alter a Vdacm Fibre service installatin. Custmer Equipment 30. The fllwing equipment related t the Vdacm Fibre service will be installed at the custmer s premises: An ptical netwrk terminal (ONT) that frms part f the Vdacm fibre netwrk A Custmer Premises Equipment (CPE) with WiFi capability, mre cmmnly knwn as a ruter An ptinal LTE / 3G mdem fr GSM backup An ptinal telephnic device if vice services are included in the Vdacm Fibre services An ptinal Uninterrupted Pwer Supply (UPS) (please refer t specific UPS terms and cnditins) Optinal WiFi extenders t bst the ruter s WiFi signal. 31. The ONT at all times remains the prperty f Vdacm. 32. All custmer equipment (excluding the ONT) will frm part f the Vdacm Fibre service cntract. 33. The Vdacm Fibre service charge will nt be discunted if the custmer elects t use their wn custmer equipment. 34. After the Vdacm Fibre service cntract initial perid, all custmer equipment (excluding the ONT) becmes the prperty f the custmer. 35. A tw year warranty will apply t all custmer equipment prvided by Vdacm. 36. If custmer equipment is swapped ut by an apprved installer as part f fault management, the warranty f the replacement custmer equipment will be valid fr the balance f the Vdacm Fibre service cntract initial perid. 37. The custmer gives Vdacm permissin t use the ruter fr additinal SSID s t enable supplementary services. 38. Any use f a custmer s ruter fr additinal SSID s will be at n charge t the custmer and will nt impact the custmer s service. Service interruptins 39. Vdacm will endeavr t minimize interruptins ccurrences t the Vdacm Fibre service and the length theref. 40. In the case f a service interruptin in the Vdacm Fibre service, Vdacm will deply technical teams t address any netwrk faults. 41. If a custmer detects a service interruptin in the Vdacm Fibre service, the custmer has t ntify Vdacm custmer care f the interruptin. 42. If the service disruptin in the Vdacm Fibre service is traced t a custmer installatin r custmer equipment, then Vdacm will endeavr t rectify the fault remtely, failing which a service team will be dispatched t the custmer s premises t address the fault. Liability 43. Vdacm accepts n liability fr any lss r damage t the prperty r equipment f the custmer arising ut f the prvisin, installatin r maintenance f Vdacm s Fibre service including the custmers use f the custmer equipment. 44. Vdacm accepts n liability fr any lss r damage arising ut f the use f the Vdacm Fibre service, including lss r damage due t using the Internet and / r transferring files and cntent. FUP 45. All Vdacm Fibre Sft-capped and Uncapped packages are subject t a Fair Usage Plicy (FUP). Nn payment 46. Services will be suspended in the event f nn-payment. 47. A recnnectin feewill be applied as per the credit management prcess.
5 Terminatin & Cancellatins 48. Cancellatins within the cntract perid will carry a penalty equivalent t 75 percent f the remaining cntract tariffs due fr the 24 mnth perid. 49. Any penalties applicable t custmer equipment will be included in the last invice. 50. Vdacm will als infrm custmers 90 days in advance f the initial cntract end perid. Upgrades and Migratins 51. The Custmer can migrate t any ther Vdacm Fibre service ffer n request. 52. An adjusted subscriptin will be applicable as per standard migratin rules. 53. N penalties will apply when upgrading r fr an upward migratin. 54. Dwnward migratins will attract a nceff fee. Re-lcatin Services 55. If the custmer wishes t mve the lcatin f the Vdacm Fibre service frm ne gegraphical lcatin t anther and wishes t retain Vdacm Fibre service (i.e. physical address change) the fllwing will apply: A relcatin fee Mves will be allwed subject t a feasibility study n whether a Vdacm Fibre service can be prvisined at the new lcatin. Any additinal cst relating t the prvisining f the Vdacm Fibre service at new lcatin will be charged t the custmer with prir apprval. If the Vdacm Fibre service cannt be prvisined at the ther gegraphical lcatin, the Vdacm Fibre cntract will be cancelled and the custmer will be charged a cancellatin fee LTE / 3G back up 56. Custmer shall have the ptin at an additinal mnthly fee t have installed LTE / 3G backup service. 57. The LTE / 3G back-up service shall ensure that in the event f any Vdacm Fibre unavailability that the internet cnnectivity is nt lst by virtue f the cnnectivity being switched frm a Vdacm fibre netwrk t GSM cnnectivity 58.
