16 FEMA s Role - Levees FEMA s role is mapping levee-related flood risk and accredits levees for mapping purposes only. FEMA only accredits levees based on the certification documentation provided by the community or other interested party FEMA does not own, operate, maintain, inspect, or certify levees or flood control systems 15

18 FEMA Identification of Levees To be shown as providing a reduced risk of flooding from the Base Flood Event (1% Annual Chance Event) on the updated FEMA Flood Insurance Rate Maps (FIRM)s New or Improved Levees Letter of Map Revision (LOMR) Existing Levees Provisionally Accredited Levee (PAL) process Must be previously shown as providing protection Levees (LOMR or PAL) must meet requirements of 44 CFR to be shown as accredited and providing a reduced risk. 17
19 Levee Accreditation Once FEMA receives levee certification package from a community, levee owner: FEMA performs a completeness review FEMA accredits levees based on certification submittal findings received FEMA reviews against 44 CFR FEMA accreditation review checklist is included in February 2018 Levee Guidance 18
20 Levee Certification Certification documentation should: Document that levee or flood control system meets Federal design, construction, maintenance, and operations standards to provide protection from a flood of 1% annual chance or greater Standards are outlined in 44 CFR Be based on investigations and review of the current levee condition by a registered professional FEMA Flood Insurance Rate Maps (FIRMs) are based on current conditions and reflect the existing risk. 19

23 The PAL Process Provisionally Accredited Levee (PAL) designation will be given to those levees that FEMA believes can provide the level of protection but for which data verifying this is not readily available Community must sign an agreement to provide FEMA with levee certification by the end of a two year period The documentation must show that the levee meets standards set forth in FEMA s Code of Federal Regulations (Part 65.10) Preliminary maps will be issued with area behind levees shown as a Zone X (shaded) and PAL annotation will be added At the end of the two year period, if the levee can be certified, FEMA will show it on the map as providing protection) 22

25 Analysis and Mapping Procedure for Non- Accredited Levee Systems Interactive stakeholder engagement throughout the analysis and mapping process: FEMA will engage community officials and decision makers in a collaborative discussion A suite of analysis and mapping procedures of the hazard associated with levees will be reviewed with the interested parties Intention is to recognize of the uncertainty associated with hazard identification behind levees New Development Allows communities to split a levee system into distinct reaches that are analyzed based on the attributes of the specific reach 24
26 Analysis and Mapping Procedure for Non- Accredited Levee Systems Sound Reach Method Description A continuous section of a levee system that has been designed, constructed, and maintained to withstand the flood hazards posed by a 1 percent annual chance flood, in accordance with the standards in 44CFR65.10 of the NFIP regulations. Freeboard Deficient Applied if levee or floodwall height is at least equal to 1 percent annual chance flood but otherwise is unable to meet freeboard standards. Must meet all other design criteria related to foundation stability, settlement, embankment protections and closure structures. Operation and Maintenance Plans, including documented inspection, are also required. Overtopping Approach Applied when the BFE is above the top of levee or floodwall for a reach and it can be demonstrated that the 1 percent-annual-chance flood will not cause structural failure of the levee. Requires development of an unsteady hydraulic model to allow overtopping of the levee. Structural-Based Inundation Natural Valley In levee reaches where the BFE is above the top of levee or floodwall and there is a known structural deficiency or a lack of data to support one of the other procedures mentioned above, the Structural-Based Inundation Procedure may be used. This method involves defining the inundation extents resulting from breaches along the levee reach during the 1-percent-annual-chance flood. Can be applied to all non-accredited levee reaches to determine the Special Flood Hazard Area (SFHA) or to determine the Zone D extents when freeboard deficient, sound reach, overtopping, or structural-based inundation procedures are implemented. 25

40 Accreditation/Non-Accreditation of Levees Coordinate/invite USACE to any public meeting regarding levee system Internal Core Team meeting before engaging community for consistent message Allow USACE time at meeting to discuss any concerns with community if needed If levee is ineligible in USACE program, coordinate if any unacceptable items would align with accreditation requirements 39
41 Accreditation/Non-Accreditation of Levees 44 CFR 65.10(e) Certification Requirements: Data submitted to support that a given levee system complies with the structural requirements set forth in paragraph 44 CFR 65.10(b)(1-7) of this section must be certified by a professional engineer. In lieu of these structural requirements, a Federal agency with responsibility for levee design may certify that the levee has been adequately designed and constructed to provide protection against the base flood. 40
42 Accreditation/Non-Accreditation of Levees FEMA Levee Guidance February 2018 Section Certification Requirements (Permits and Other State and Local Requirements) The submittal must adequately address all applicable Federal, State, and local laws regulations and requirements, including, but not limited to, Federal, State, and local floodplain management laws, environmental laws, and permit requirements. This can be verified through communication with the requestor. A record of these communications must be kept on file for future reference. 41
43 Long Term Risk Awareness of Levees FEMA Levee Guidance February 2018 Section Expiration of Data Certification or Endorsement A certifying engineer or Federal Agency may choose to place an expiration date on the use of data and documentation for accreditation of a levee system. At no time shall a levee system with an expired certification of data be remapped as accredited without an updated documentation and a certification of data by a Registered Professional Engineer or endorsement from a Federal Agency. 42
44 Long Term Risk Awareness for Levees FEMA Levee Guidance February 2018 Section Noted Structural or Maintenance Deficiencies FEMA reserves the right to re-evaluate the accreditation status of a levee system if structural or maintenance deficiencies are noted that may cause concern over the validity of the current flood hazard noted on the FIRM. This re-evaluation of the levee status on the FIRMs may be triggered based on inspection reports of State or Federal agencies or performance of the levee system in the context of a 1-percent-annual-chance flood event or less. 43
