3 OVERVIEW This guide discusses the apprval prcess fr residential cnstructin r recnstructin fr a ne r tw lt infill prject in the city f Philadelphia. As this guide makes clear, while yu will need t btain zning and building permits frm the Department f Licenses and Inspectins (L&I) in rder t btain these permits, the Water Department, Planning Cmmissin, Streets Department and, at times, several ther departments and bards may als need t apprve and sign ff n yur site plans. Zning Bard f Adjustment (ZBA) Administratin ffice is lcated in the Municipal Services Building, 11 th Flr: handles appeals in zning matters and determines whether t grants variances, certificates, and special use permits. 4 In rder t cmplete the permitting prcess, yu may need t physically visit each f the ffices listed abve. The applicant alne is respnsible fr physically carrying the plans t each agency cunter. Each agency will keep recrds f its interactin with yu, but yu are the nly ne wh understands and must keep track f where yu are in the prcess, and what each agency said r requires. At the time that yu are prvided with yur permits, they must be picked up frm the cunter in persn, and the permit fee must be paid at that time. Fees are listed in the Administrative Cde at Timeframes. The Administrative Cde Sectin A says nly that The cde fficial shall grant r deny a building permit applicatin in whle r in part r request further infrmatin, within 30 business days f the filing date fr cmmercial cnstructin and 15 business days fr residential cnstructin. Reasns fr a denial shall be in writing and sent t the applicant. When agreed t by the cde fficial and the permit applicant in writing, the deadline fr actin shall be extended by the number f days specified in the agreement. Exceptin: The deadline fr actin n permits fr structures that have been designated as histric r are lcated in an histric district is extended by the amunt f time the applicatin is under review by the Histrical Cmmissin. All timeframes prvided fr a step in this prcess are estimates based upn the experience f building industry members in the city. 4

5 Primary Permits Required Fr a One r Tw Lt Infill Prject 1. Zning Permit: A permit granted pursuant t the Zning Cde t allw develpment r use f a specific prject n a specific site under the terms f the permit. Required prir t btaining building permit. 2. Use Registratin Permit: A use registratin permit is required fr every new use cmmenced n any land r in any structure except fr use as a single-family dwelling r place f wrship. 3. Fundatin Permit: An ptinal permit fr the cnstructin f a fundatin befre the cnstructin dcuments fr the entire structure have been submitted. T btain a fundatin permit, the zning permit fr the entire structure must be issued and the Water Department must apprve access t water and sewer. The applicant prceeds at his r her wn risk withut a guarantee that a building permit will be issued. The fundatin may be included with the building permit fr the structure. 4. Building Permit: A building permit is required t cnstruct, mdify, r demlish a structure. It is als needed where repair t a structure invlves the cutting away f any wall r partitin, the remval r cutting f any structural beam r lad bearing supprt r the remval r change f any required means f egress. (Administrative Cde A ) T btain a building permit fr new cnstructin r additins 2000 square feet r larger, yu must prvide a getechnical study cnfirming the bearing capacity and integrity f the subsil. Electric, Plumbing and Sewer, HVAC, and Fire Suppressin permits are required prir t cnstructin f systems. Certificate f Occupancy, included within the Building Permit, indicates cmpliance with permits and cnstructin dcuments. Certificate must be btained prir t ccupancy f a newly erected building, an additin t a building r a change frm ne ccupancy grup t anther. The exceptin is where, in a nn-residential building, grss building area is less than 2,000 square feet per flr, r there is n substantial increase in live lads r ccupant lads in the areas changed r added. 6 Prerequisite Apprvals Required t Obtain Permits: Philadelphia allws cncurrent review with all agencies s several agencies may review yur plans simultaneusly. Prerequisite apprvals typically cme in the frm f a letter r a stamp n the site plan. Apprvals n the site plan are nt transferable t an altered r new plan. If yu change the site plan in any manner that impacts the building ftprint, cnfiguratin f the building at any level, reduce pen area, change parking cnfiguratin, add rf decks r fences r use f the lt such as the number f units r building height, each agency must reapprve the plan t ensure that the changes still satisfy all necessary regulatins. If the ZBA grants a variance but requires changes t the plans r if the applicant requests changes t plans, their variance may satisfy the requirements f L&I but may nt satisfy the requirements f the ther develpment review agencies. Accelerated Plan Reviews and Fees: L&I prvides an ptinal service that is available fr applicants wh need cmplex plans reviewed mre rapidly than is custmary. Zning Permit: Accelerated time fr a set f cmplex plans is typically tw t three (2-3) weeks. If yur applicatin is deficient fr whatever reasn, the review clck restarts upn submissin f the prper infrmatin. Actual examiner time spent reviewing the dcument is typically fur (4) hurs. Additinal hurs fr a cmplex plan. Reviews cst $ fr up t fur (4) hurs, plus $ fr each additinal hur. These fees are in additin t the zning and/r use permit fees. Building Permit: Review time fr a set f cmplex plans is typically thirty (30) business days. Accelerated plan reviews can be accmplished in three (3) days r less. The cst fr an accelerated review is $540 fr up t fur (4) hurs f review time, and $135 per hur fr each additinal hur. These fees are in additin t the building permit fees. Accelerated review des nt include Water Department review and apprval. 6

7 ZONING AND/OR USE REGISTRATION PERMIT Philadelphia s Zning Cde is available nline at A building permit must be btained within ne (1) year frm the date f issuance f the zning permit if the permit is granted as a matter f right, r n later than tw (2) years frm the ZBA decisin date. Then the zning permit will remain valid until cnstructin is cmpleted. In cases where n cnstructin r interir alteratins are invlved and a use registratin permit has been issued, the use permit becmes invalid shuld the use fr which the zning permit was issued nt start within three (3) mnths frm the date f issuance. The Permit Services Divisin f Licenses and Inspectins is pen frm 8:00 AM t 3:00 PM fr zning permit applicatins with the exceptin f the last Wednesday f the mnth, when it clses at nn. The Zning Unit can be reached by phne at FIRST STEPS IN OBTAINING A ZONING PERMIT Defining the Zning fr a Parcel: Prir t beginning the prcess, yu must knw hw the parcel is zned. Currently, yu must visit Licenses and Inspectins, and they will check a series f maps in their back ffice t determine all zning designatins and verlays that apply t yur prperty. The zning map n des nt shw recent amendments r verlays that are critical in defining the zning f a parcel. In the very near future, we plan t have nline a detailed electrnic zning map that will permit yu t view all zning designatins and verlay znes that impact yur parcel. Prving Yur Ownership Interest: T begin the prcess, yu will need either a deed, a current lease, authrizatin letter frm the wner f the prperty granting permissin t file a Zning and/r Use Registratin Permit applicatin, an agreement f sale r a receipt frm the sheriff (if the prperty was purchased frm sheriff s sale within the last year.) The deed can be btained at the Department f Recrds, lcated in City Hall, Rm 154. Yu must have prf f wnership f the prperty prir t r cncurrently with City Cuncil apprval fr streets if this step is required. 7

8 Creating Yur Plt Plan: The plt plan shws t scale, the dimensins f the lt, the fully dimensined size and lcatin f all new cnstructin and all existing structures n the site, distances frm lt lines, the established street grades and the prpsed finished grades, impervius surface cverage and as applicable, fld hazard areas, fldways, strmwater management cntrls, envirnmental cntrls and design fld elevatins; and it shall be drawn in accrdance with an accurate bundary line survey. The plt plan may have t be sealed by a prfessinal surveyr. In additin, all drawings submitted t the Streets Department fr review and apprval must include a site plan drawn t scale with dimensins f the legal right f way with curb lines and prperty lines, all existing street furniture including hydrants, streetlight ples, manhles, dimensins f right f ways bth prpsed and existing, all driveway curb cuts, prpsed and existing, and a minimum f tw phtgraphs detailing existing cnditins at the site. Adequate blank space fr all necessary seals f apprval must be prvided n the plan. We recmmend that yu use the Streets Department Develper s Checklist. Special Cnditin Pre-requisite Apprvals fr Zning Permit 1. Planning Cmmissin Apprval Needed: * If prperty requires relcatin f lt lines (i.e. lts will be mre than fifty (50) feet per side) * If prperty lcated within the Wissahickn Watershed, Fld Plain, r Special Cntrl District r is greater than 15,000 square feet 2. Water Department Apprval Needed: * If prperty is within fifty (50) feet f a water and drainage right-f-way * If creating 15,000 square feet f earth disturbance (Nte: If creating mre than ne (1) acre f earth disturbance, the issuance f a NPDES permit frm PA DEP is required befre a city building permit can be issued.) 3. Streets Department Apprval Needed: * If there are any encrachments, curb cuts, fences r undergrund wires n, ver r under the public ftway 8

9 Streets Department Apprvals Needed t Obtain Zning Permit: Apprvals required fr wrk invlving garages, curb cuts, parking layuts and structures in the public walkway. (Municipal Services Building 9th Flr, Rm 940; , 5503) 1. Obtain Bard f Revisin f Taxes fficial address: If yu are creating a new lt (via cnslidatin r divisin int tw lts), the applicant is required t g t the Bard f Revisin and Taxes (BRT) t btain addresses fr each f the new buildings and lts. BRT must enter these new addresses int their database befre L&I can issue zning permits can be issued t erect anything n the newly created lt(s) r fr anything ther than the subdivisin fr the prperty. If the prject is funded with federal husing mney (Cmmunity Develpment Blck Grant), the Planning Cmmissin must prvide an envirnmental clearance. 2. Submit site plan t Streets Department Highways Divisin. Leave ne set f plans, and have ten sets stamped and signed fr crdinatin with ther review agencies. Highway Divisin will apprve curb cuts and any ther encrachment int the right f way. 3. Submit site plan t Streets Department Traffic Divisin. Fr tw r mre parking spaces, leave ne set f plans, and have ten sets stamped and signed fr crdinatin with ther review agencies. 9

10 Licenses and Inspectins Obtaining Yur Zning Permit r Refusal All applicatins must be prepared in ink r typewritten. Even if yu knw that yur plan will nt be apprved early n in the prcess, yu must still cmplete the applicatin prcess. The fllwing infrmatin must be shwn n the zning applicatin frm: Lcatin f Prperty: Prvide the BRT assigned address f the riginal parcel. Explain any alteratin r cnstructin. Fr example, cnstruct a ne-stry additin, 12' x 12', t the rear f the existing structure. Prvide the height in feet and stries f the new building r the existing building and prpsed additins alng with an elevatin plan. List the present use f the existing building. Detail f demlitin (if applicable). List the prpsed use f the existing building and f the additin (if any) r the prpsed use f the new building. Prvide the name, address, and telephne number f the wner(s), architect, engineer, and the name f the persn filing the applicatin. If yu are nt the wner f the prperty listed n the cmpleted applicatin, yu must als submit a signed lease r letter frm the wner f the prperty that authrizes yu t file the applicatin. All cntracted parties invlved in the prject must be prperly licensed. If the wner/develper is in the prcess f btaining apprvals and wants t make a nte r adjustment f a detail n the plan s that a review examiner can mre easily prcess the applicatin, a letter frm the architect r engineer apprving the change is needed. In additin t the applicatin, yu must submit six (6) sets f the plt plan and shall include, withut limitatin, scale; metes and bunds f prperty; all streets, alleys, r driveways brdering the prperty; curb lines and their distances frm lt lines; exterir dimensins f buildings and structures frm lt lines and/r existing and prpsed dimensins f ther buildings and structures n the same lt; lcatin and dimensins f all driveways and curb cuts, if applicable; name and address f prperty wner and signature f applicatin) and a letter f wnership. This prcess takes apprximately three t six (3-6) weeks unless accelerated applicatin is filed, and yu pay fr accelerated review. Nte that if yu are prpsing signs as part f yur cmpleted applicatin, yu must als submit three (3) phtgraphs shwing the subject prperty and a rendering with dimensins f the sign face. This must be included n the six (6) cpies f the plt plan and shw the lcatin, sizes and descriptin f all existing and prpsed signs. Where the prpsed cnstructin is unable t meet the particular and specific requirements as utlined in the Zning Cde, yu will need t wait fr a ntice f refusal frm L&I s that yu can begin prcess t seek variance. This prcess takes apprximately three t six (3-6) weeks unless accelerated applicatin is filed, and yu pay fr accelerated review. 10

11 FEES Fees fr zning reviews are due upn applicatin. The csts as f June 2006 are as fllws: 1. Filing Fee fr each applicatin (nn-refundable) Zning Permit applicatins fr One and Tw Family Dwellings $25.00 Zning Permit applicatins fr all ther Occupancies $ (Fee is per structure r divided lt) 2. Fr example, the minimum price charged by the Streets Department fr an initial plan review is $ After L&I cmpletes its review f yur zning/use applicatin, yu will be issued ne f the fllwing: (1) Zning Permit; (2) Use Registratin Permit; (3) Certificatin f Permit Nt Required; (4) Ntice f Refusal; r (5) Ntice f Referral. 11

12 APPEALING TO THE ZONING BOARD OF ADJUSTMENT If L&I issues a Ntice f Refusal, yu may appeal that decisin t the ZBA. The ZBA is authrized t hear and decide appeals in zning matters in accrdance with prvisins f Sectin f the Philadelphia Hme Rule Charter and the Zning Cde. All zning matters are appealed t the ZBA. The appeal must be filed within 30 days f the date f the Ntice f Refusal r Ntice f Referral. All appeals cnsidered by the ZBA shall be heard in public at such times and lcatins scheduled The appeals prcess may take three t fur (3-4) mnths. Yu have the ability t pay fr an accelerated hearing, t allw a hearing t ccur in three t six (3-6) weeks. by the ZBA. Administrative Cde A The ZBA will ntify yu f the date f yur hearing. Hearing dates are als available at This means that the appeals prcess may take three t fur (3-4) mnths. Yu have the ability t pay fr an accelerated hearing, t allw a hearing t ccur in three t six (3-6) weeks. If yu are an entity ther than an individual, (i.e. a crpratin, partnership r limited liability cmpany), then yu must be represented by an attrney at any hearing befre the ZBA. Prir t yur hearing, it is recmmended that yu cntact the City Cuncilpersn in whse district yur prperty is lcated in rder t advise the Cuncilpersn f yur prject and t btain the names and cntact infrmatin f the neighbrhd rganizatins in that district. Similarly, the ZBA expects applicants t meet with the neighbrhd rganizatin in advance f yur scheduled hearing and will cntinue yur case unless and until yu have dne s. Ntice Requirements Prir t Zning Bard f Adjustment Hearing: (1) Display range zning psters prvided by L&I fr 12 cnsecutive days immediately befre the public hearing (including the day f the hearing) in plain view n each side f the prperty facing a street s that it can be read withut ging nt the prperty; (2) Take phtgraphs f the prperty, including the zning psters, entire rear and frnt view and (3) Meet with neighbrhd rganizatins and btain letters f supprt. The Philadelphia Cde, Title 14, Sectin 1805(8) prvides that any party may appear befre the ZBA. The ZBA traditinally grants wide latitude t permit citizens, businesses, and civic assciatins the pprtunity t be heard by the ZBA and fr their cncerns t be cnsidered as part f any decisin. Typically, the ZBA requires that applicants meet with neighbrs and civic assciatins in an attempt t reach an agreement with respect t any issues. In the event that an agreement is achieved, the ZBA may incrprate that agreement int the decisin in the frm f a prvis r a cnditin t any grant f zning relief. When the ZBA reaches a decisin, yu will be ntified in writing. If the ZBA rules in favr f a variance r certificate, pick up the Ntice f Decisin issued by the ZBA and take it t the Zning Unit f L&I. This Ntice is necessary in rder t prcess the zning/use permit. A Ntice f Decisin by the ZBA expires ne (1) year frm issuance. In ther wrds, yu must btain yur Zning/Use Permit within ne (1) year f the ZBA s Ntice f Decisin r start all ver again. 12

13 Appealing a Zning Bard f Adjustment Decisin: Yu may appeal a decisin f the ZBA t the Curt f Cmmn Pleas within thirty (30) days f the date f the Ntice f Decisin. The legal standard is whether the ZBA abused its discretin r acted in cntradictin f the law. The City f Philadelphia will represent the ZBA in curt. Cmmunity rganizatins r individuals living in the city may seek t appeal L&I s granting f a permit; may appeal t ZBA; and t Curt f Cmmn Pleas. Appeal perids extend thirty (30) days frm the ZBA hearing if there was ne, and if nt, thirty (30) days frm the time the plaintiff knew r the curt determines that the plaintiff shuld have knwn f the decisin. The develper r cmmunity rganizatin may appeal the decisin f the Curt f Cmmn Pleas t the Cmmnwealth Curt. FEES Fees fr zning appeals are due upn applicatin. As f June, 2006, the fllwing schedule f fees is applicable: Administrative Review.$ Appeal f refusal/referral (fr prperties cntaining ne- r tw-family dwellings)..$ Appeal f refusal/referral (fr any prperty besides ne- r tw-family dwellings)...$ Accelerated ZBA hearing...$

14 TO OBTAIN A FOUNDATION PERMIT T begin laying the fundatin prir t all apprvals necessary fr building permit issuance. Administrative Cde Sectin A permits yu t cnstruct the fundatin f a building nly with this permit. It is useful fr situatins where cnstructin must cmmence, but building plans fr the structure have nt been cmpleted. Once yu have btained yur Zning apprval, Licenses and Inspectins can issue a fundatin permit nce the Water Department apprves access t water and sewer and a search f the Pennsylvania Natural Diversity Inventry (PNDI) results in n ptential impacts with rare endangered r threatened species. The fee is $100 fr this permit and an apprved zning permit is required. In additin, the building wner must sign and submit a letter stating that the wner assumes full respnsibility fr remving r altering the fundatins shuld this be necessary after the full set f plans are reviewed. Nte: Where the fundatins are fr City- wned buildings, the Art Cmmissin must be invlved at this stage. Where health care facilities, the Pennsylvania Health Department must be cnsulted. TO OBTAIN A BUILDING PERMIT Building permits are required fr new cnstructin, repairs, alteratins, demlitins, additins t a structure, installatin f fundatins fr tanks and equipment, cnstructin r demlitin f ducts, sprinkler systems, r standpipe system. Wrk cvered by the building permit must begin within six (6) mnths f the issued date, and the permit will remain in frce until cmpletin f the wrk, prvided there is n stppage f wrk fr a perid exceeding six (6) mnths. Fr additinal infrmatin cncerning the building permit prcess in the City f Philadelphia cntact the Department f Licenses and Inspectins at r PermitServices@phila.gv All tax abatements must be applied fr within sixty (60) days f building permit apprval. The Permit Services Divisin f L&I is pen fr building permit applicatins and review Mnday t Friday frm 8:00 AM t 3:00 PM except n the last Wednesday f the mnth when it clses at nn. 14

15 Submit Building Permit Applicatin. Applicatins must be prepared in ink r typewritten and submitted t L&I. The fllwing infrmatin must be shwn n the applicatin: Lcatin f Prperty: Prvide the BRT assigned address fr the riginal parcel. Descriptive lcatins such as Nrtheast Crner r Suthwest Crner f... will nt be accepted. This must be an exact address. Descriptin f the prpsed alteratin r cnstructin. The names, addresses and phne numbers f the wner, architect, engineer and cntractr (if any), the name f the persn filing the applicatin, and the Business Privilege License Number fr each (except wner). The signature f the applicant Philadelphia Business Privilege License. (Infrmatin cncerning where t purchase the licenses can be btained by cntacting ) Alteratins where the cst f the wrk exceeds $50,000 must submit an Asbests Inspectin Reprt The Internatinal Energy Cnservatin Cde requires a certificate f cmpliance and dcumentatin shwing cmpliance with this cde fr all building permits fr new cnstructin, additins, and alteratins. Fr certain prjects, Special Inspectins f building elements are required. These elements include sprayed-n fireprfing, cmpacted fill, piles; EIFS, cncrete and pre-cast cncrete prducts, welding, and steel framing. See Philadelphia Building Cde Chapter 17 fr additinal details. When Special Inspectins are required, the registered design prfessinal shall prvide a Special Inspectins Statement that includes a list f inspectins t be made and the names f the individuals, firms and apprved agencies intended t be retained fr cnducting such inspectins. Three Sets f architectural plans, structural plans and mechanical plans must be submitted fr new cnstructin, additins r where there is: Cnstructin f partitins An increase in the number f ccupants as calculated by the Building Cde A change in the means r size f egress Any wrk invlving structural members Any new wall penings New cnstructin f, r alteratins t, ductwrk; and/r New cnstructin f, r alteratins t, sprinkler systems and standpipe systems 15

16 Plans must include the fllwing infrmatin: Lcatin f prperty: BRT assigned address Name, address and telephne number f persn wh prepared plans Name and address f the wner f the prperty Scale used (except fr extreme cases this shuld be either 1/4 = l r 1/8 = l ) Legend distinguishing existing and new cnstructin and materials Seal f an architect r engineer registered in Pennsylvania fr all new cnstructin and additins (except grund flr additins less than 120 square feet. t ne r tw family dwellings), structural alteratins, and fr all nn-structural alteratins where the cst f cnstructin exceeds $15,000 Building Cde data (i.e. Type f Cnstructin, Use Grup, Fire Suppressin infrmatin, flr areas, etc.) shwn n the cver sheet Architectural Plans must als include: Plan f each flr indicating the lcatin, size and usage f each rm, clsets, shafts, windws, drs, exits, thickness and material f partitins and firewalls, lcatin f emergency lighting, dimensins and any ther necessary infrmatin. If within staff s jurisdictin, apprval received within a few days f submissin. When the scpe f wrk exceeds the staff s jurisdictin, the Architectural Cmmittee and the Histrical Cmmissin review it. The Cmmissin als reviews plans fr cnstructin f new buildings within a histric district. Average review time varies depending n hearing schedule but can be up t three (3) mnths. The permit must be displayed n the cnstructin site and the set f apprved plans returned t yu must be available at the cnstructin site. As stated n the building permit, yu must ntify the apprpriate District ffice 24 hurs prir t beginning wrk and must schedule all required inspectins. Fast Frm nline trade permits are available frm L&I fr rf cverings, windw replacement, interir demlitin, relcatin f sprinkler heads, relcatin f HVAC diffusers, siding and stucc, warm air installatins, and prch flr replacement. Where grundwater must be pumped t build, yu must btain a grundwater discharge permit frm the Water Department, Industrial Waste Unit. The certificate f ccupancy must include a statement that the structure has been inspected fr cmpliance with the applicable cde requirements fr the ccupancy and divisin f ccupancy and the use fr which the prpsed ccupancy is classified and shall specify the fllwing: The address f the building and census tract. The lcatin within the building if fr part f a building. The editin f the cde under which the permit was issued. The use(s) and Occupancy Grup(s) in accrdance with the Building Cde. The type f cnstructin as defined by the Building Cde. If and where an autmatic sprinkler system is prvided and whether it is required. If a standpipe system is prvided and whether it is required. Any variances r special cnditins. The applicatin, permit and plan numbers. The date f the final inspectin. The name and address f the wner. The printed name and signature f the cde fficial. 2. When a Certificate f Occupancy is required, the Certificate is held in the District ffice pending cmpliance t applicable cdes verified by the respnsible inspectrs. Inspectins are perfrmed ut f the L & I District field ffice. The District ffice must be ntified upn cmpletin f wrk s that a final inspectin can be made and the Certificate f Occupancy issued. This final inspectin will result in apprval by the building inspectr and the District supervisr if all wrk is in cmpliance with the applicable cdes. 19
