1 Special Event Street Clsure Plicy Adpted by the City Cuncil n: 9/14/2016 Purpse: The City f Mntpelier is prud t hst events that have public benefit t ur cmmunity. This plicy utlines the prcess and requirements fr requesting a Street Clsure r thse seeking t hld a parade/march. Permissin t use public streets, sidewalks and parking lts is a privilege which is granted at the sle discretin f the City Cuncil. Prviding event pprtunities in a safe and manageable manner is a gal f the City Cuncil and f City staff. Public streets & highways serve a vital rle as the primary transprtatin link fr prperty access, cmmerce and are a necessity t cnnect different parts f twn and beynd whether peple chse t bike, walk r travel in an autmbile. Clsure f streets fr even shrt time perids can be perceived as an incnvenience fr sme r an insurmuntable barrier t thse wh may be prevented frm freely cming r ging t and frm their hmes r businesses. All needs f the citizens must be cnsidered when a street clsure is cntemplated. Street clsures will nly be apprved if the City Cuncil determines that the public benefit frm the prpsed event exceeds the public benefit derived frm the transprtatin use f the rad, street r highway, Peple wh are directly affected by an event r street clsure need adequate ntice f bth the event itself and the public prcess fr cnsidering the clsure r event at a City Cuncil meeting. Definitins: A special event is defined as a race, parade, festival, pen street initiative, r event that utilizes public prperty in the city (such as a street, parking lt r park), is temprary, and requires apprval by City Staff and the City Cuncil. This includes full street clsures, full r partial parking lt clsures, r use f public facilities in a manner substantially different than their nrmal public use fr an extended perid f time. The Event Spnsr is an individual wh has primary respnsibility fr the Event fr which the Street Clsure is requested. This individual shall be n-site the day f the event. Exceptins: Annual street clsures will take place fr the first Saturday in May (MayFest), the Gvernr s Crprate Cup, and the July 3 rd festivities. These events will be 1

Prcess: Spnsrs f a special event in the dwntwn shall submit a Street Clsure Permit Applicatin n later than 45 calendar days befre an event. Spnsrs f a new special event utside f the dwntwn shall submit an applicatin n later than 30 calendar days prir t the planned event. If the event has been held successfully in the past, event spnsrs shall submit an applicatin n later than 7 days prir t the last scheduled City Cuncil meeting befre the event date. Applicatin frms will be available n the City s website ( and at the City Manager s ffice. All Permit Applicatins will be psted publicly n a dedicated city webpage ( t ntify and infrm the public. 2. Permit applicatins submitted n a timely basis will have n fee. Applicatins fr dwntwn events submitted late (less than 45 days) will be assessed a $50 fee if there is still time t prperly prcess them. There will be n late fee fr ther events. Applicatins submitted withut sufficient time t review and cnduct a public hearing will nt be accepted. The City Manager shall make the final determinatin whether an applicatin can be prcessed. 3. If the street clsure request is fr State, Main, Langdn, Elm Streets r adjacent parking lts, the City will prvide public ntificatin f bth the prpsed clsure and the date the Cuncil will cnsider this request. The City ntice fr dwntwn will be prvided t abutters thrugh t businesses, direct mail t residential addresses, psting n the city website, and scial media sites. 2

3 Special Event Street Clsure Plicy Adpted by the City Cuncil n: 9/14/ If any ther street clsure is requested, the Event Spnsr shall use best effrts t ntify abutting prperty wners, residents, and businesses f bth the prpsed clsure date and the date the Cuncil will cnsider the request. If the street clsing is fr ther than dwntwn but the City is a partner r participant, the City will assist with ntice by preparing mailings and psting publicly. 5. Event Spnsr ntice may include a cmbinatin f scial media ntices, written acknwledgements frm neighbrs, leafletting r direct mail. In advance f the Cuncil meeting the Event Spnsr will be required t certify hw they made reasnable attempts t ntify abutting residents, businesses, and prperty wners. In the event that the Cuncil determines that ntice was insufficient the Cuncil shall deny the permit. 6. Permit Applicatins must be reviewed and apprved by the Plice Department, Public Wrks, the Fire Department, City Manager s Office and Mntpelier Alive (if event is within the designated dwntwn). During this review perid, the Event Spnsr may be cntacted t answer questins r make additinal arrangements in the interest f public safety r public cnvenience. 7. Fllwing the staff review, the request will be placed n a City Cuncil agenda, nt later than 9 days in advance f the event, fr apprval cnsideratin. It is the expectatin that the Event Spnsr will be present at this City Cuncil meeting. 8. Apprved permits will be ed t the Event Spnsr and the date f the event will be psted n the City-wide calendar at Cnditins fr the Temprary Use f Streets: 1. The Event Spnsr shall pst signage n any affected parking meters the night befre an apprved Street clsure, r if n parking meters, signs will be placed n a stake r pst f sufficient quantity and placed in suitable lcatins t prvide visual ntice. 2. Barricades must be placed n State, Main, r Elm by a member f the Mntpelier Plice Department r Department f Public Wrks. Barricades and signs shall be placed n ther streets by city persnnel r crdinated by city persnnel with the event spnsr. 3. Streets that are allwed t be clsed in the Dwntwn include: 3

Langdn Street Elm Street between State and Schl Main St (State Rute 12) fr city spnsred parade rute nly, and nt fr extended events. Parking Spaces n Main may be clsed fr events. 4. City Ordinance Article VIII Sectin Drinking in Public Place is in effect unless ther permits are btained by Divisin f Liqur Cntrl 5. Permit requests must be received by the City Manager s Office in a timely fashin as utlined abve. 6. Events must be pen t the public. Prtins f an event may be clsed ff t meet Department f Liqur Cntrl requirements. 7. N fee may be charged fr entrance t an event n a public street, parking lt r prperty. 8. Parades will fllw pre-designated and apprved rutes. Parades alng nndesignated rutes will be assessed the full cst t the city fr supprting the event. 9. General liability insurance fr Special Events in the dwntwn must be btained by the Event Spnsr. Neighbrhd events will nt require insurance. Insurance requirement fr ther events will be determined n a case by case basis. 10. The temprary use f a public street shall nt unnecessarily bstruct r bar public access nt the street. Sidewalks shall remain pen at all times fr pedestrian use unless specifically nted in the Permit Applicatin. 11. During Special Events, there must be a plan in place t ensure public safety vehicles culd have access t the Street in the event f an emergency. 12. The Event Spnsr shall crdinate public safety needs with Mntpelier staff. This includes sharing with them a plan fr the physical use f the space t ensure passage f emergency vehicles is pssible at all times. Imprtant cntacts are as fllws: 4

The City f Mntpelier may clse dwn an event and cancel a street clsure if public safety needs are nt met. Additinally, if such a vilatin ccurs, the City may refuse a future Street Clsure permit t the Event Spnsr fr a perid f tw years. 14. The City f Mntpelier may clse dwn an event in prgress and/r cancel a street clsure if weather cnditins create (r are predicted t create) a public hazard, if an unsafe incident ccurs which places attendees f the event at risk r fr any ther public safety r emergency reasn. 15. Sme events may require a variance frm this City s nise rdinance. Apprval f a street clsure permit des nt cnstitute apprval f a nise variance. Such a variance may be requested simultaneusly but shall be cnsidered separately frm the street clsure permit. 5
