The UltraONE Driver Rewards Club Prgram (the Prgram ) is a prgram where members can earn and btain pints ( UltraONE Pints ) which are redeemable fr varius benefits, merchandise and prizes. These Official Rules ( Official Rules ) gvern the Prgram which is spnsred by TA Operating LLC ( TA ) d/b/a TravelCenters f America ( TravelCenters ) and Petr Stpping Centers ( Petr ). Yu may enrll ne time nly in the Prgram by (a) calling ( ), (b) cmpleting an enrllment frm at an UltraONE Redemptin Center kisk (a Kisk ), r (c) at Yu must use the name printed n yur cmmercial driver s license ( CDL ) when registering and have the fllwing infrmatin crrectly recrded in the Prgram database: name, street address r P.O. Bx, apartment number, city, state r prvince, ZIP r Pstal Cde, telephne and/r cell phne number including area cde, date f birth and a pin cde. Prviding fictitius, incrrect r false infrmatin may result in terminatin f yur accunt and frfeiture f all existing UltraONE Pints, shwer credits and any ther benefits. 2. TA will mail an UltraONE Club membership card ( Card ) t yu upn cmpletin f yur enrllment. 3. By using and/r enrlling and by prviding yur individual infrmatin, yu agree t abide by the current Prgram Official Rules, which are subject t change frm time t time and can be fund at (the Web Site ). Further, yu cnsent t TA s cllectin, use and disclsure f yur infrmatin in cnnectin with the Prgram and in accrdance with the privacy plicy n 4. TA, in its sle discretin, will reslve all questins r disputes regarding the Prgram, including but nt limited t eligibility questins and the prvisin f benefits. TA reserves the right t terminate, mdify, revise, r change the Prgram and the Official Rules, in whle r part, at any time with r withut ntice. Changes may revise, fr example, rules fr earning r using UltraONE Pints, cntinued availability f Prgram awards, expiratin dates, prgram partners and the features f special ffers. Changes may result in a reductin in the value f UltraONE Pints r Certificates (as such term is hereafter defined) already accumulated, and may als result in frfeiture f unused UltraONE Pints, Certificates r shwer credits. 5. Further, TA and its partners have the right t change, limit, mdify r cancel rewards and reward levels at any time with r withut ntice t members. That includes, but is nt limited t: increasing r decreasing levels r number f UltraONE Pints received fr every galln (r equivalent) f diesel fuel purchased, increasing r decreasing levels r number f UltraONE Pints received per amunt spent at all participating TravelCenters truck service centers r Petr:Lube Shps r required fr a reward, changing the types f rewards, adding blackut dates, limiting availability fr a reward at any participating Lcatin (as such term is defined belw) and changing lcatins served by TA. In the event that any f these cnditins ccur, members may nt be able t btain certain rewards. Yu shuld check the latest Official Rules at the Web Site. 6. UltraONE Pints, Certificates r awards are nt redeemable fr cash, and may nt be transferred, purchased, sld, r bartered. 7. Yu must take prper care t prtect yur accunt and accunt infrmatin. This includes but is nt limited t regularly checking transactins, keeping the Card in a safe place at all times, nt sharing the Card, pin number r any accunt infrmatin with thers, prperly exiting a Kisk when finished using it, and keeping Certificates in a secure place. If yu suspect suspicius activity n yur accunt please cntact custmer service immediately at Please nte that fr security reasns, UltraONE custmer service is nt permitted t prvide accunt numbers ver the phne. Pin numbers will be prvided ver the phne nly with a valid accunt number and ther verificatin infrmatin. Eligibility 1. Any individual TravelCenters r Petr custmer 18 years f age r lder with a CDL is eligible fr membership in the Prgram. Crpratins r ther entities are nt eligible fr membership. Emplyees f TA r its affiliates are nt eligible fr membership at any level f the Prgram and may nt pssess a Card fr any reasn. Drivers wh are members f the Prgram may nt belng t anther club spnsred by TA. 2. TA reserves the right t determine eligibility in the Prgram. TA reserves the right t disqualify anyne and terminate any member fr any reasn, including but nt limited t any actins meant t abuse the Prgram, circumvent the Official Rules, r utilize the Prgram in a manner incnsistent with the rules, terms, cnditins, r intent f the Prgram r any prtin f the Prgram. 3. A member wishing t earn r redeem UltraONE Pints r ther Prgram rewards r benefits must have a Card in his r her name. This includes but is nt limited t team drivers including husband and wife teams wh must each have a separate Card. Membership Levels 1. There are tw Prgram membership levels Standard and UltraONE Platinum. All members start ut at the Standard level. If yur accunt is in gd standing and yu earn at least twenty thusand (20,000) UltraONE Pints during the current calendar year, yu are eligible fr an UltraONE Platinum level membership. Once UltraONE Platinum level status is achieved by earning twenty thusand (20,000) UltraONE Pints, a member must earn at least ten thusand (10,000) UltraONE Pints each calendar year thereafter in rder t maintain UltraONE Platinum level status. UltraONE Pints 1

2 issued fr any reasn ther than fr a qualifying purchase at a Lcatin (e.g. UltraONE Pints awarded as a prize) are nt cnsidered earned. 2. UltraONE Platinum level membership is determined by TA in its sle discretin. Members will be ntified via a Kisk and will be required t verify their cntact infrmatin. Once the infrmatin is verified, an UltraONE Platinum card will be mailed and UltraONE Platinum benefits will be activated. Yur UltraONE membership accunt will be updated t UltraONE Platinum status and any UltraONE Pints and shwers yu have earned will remain n yur accunt. Until the new Card is received, the existing Card can be used. Once the new Card is received, the ld Card shuld be destryed. In rder t maintain UltraONE Platinum level membership, yu must qualify (i.e. earn the requisite number f UltraONE Pints) each calendar year. Otherwise, membership status may be reduced. If membership status is reduced, yur UltraONE Platinum card will expire n the last day f the applicable calendar year and a new Standard level Card will be sent t yu. Yu shuld cntinue t use the UltraONE Platinum card until yur new Standard card arrives. In this instance, n UltraONE Platinum benefits will be ffered, yu will simply be using an UltraONE Platinum level Card. Use f the UltraONE Platinum level Card alne des nt imply, entitle r guarantee the hlder t any additinal privileges, benefits r ther rewards. Earning UltraONE Pints 1. Members earn UltraONE Pints at participating TravelCenters and Petr lcatins (each a Lcatin and cllectively the Lcatins ). Yur Card must be active and presented fr all purchases in rder t receive UltraONE Pints. UltraONE Pints will nt be issued fr purchases made if the Card is nt present and active, and n credit fr purchases will be awarded if the Card is presented r activated after the purchase. When paying fr fuel at the pump, the Card must be swiped at the apprpriate time at the pump in rder t earn UltraONE Pints. 2. UltraONE Pints are earned as fllws: Diesel Fuel: One (1) UltraONE Pint fr every galln (r equivalent) purchased. UltraONE Platinum level members earn ne (1) additinal UltraONE pint fr every galln purchased in excess f ne hundred thirty (130) gallns in a single fill. TA Truck Service Shps r Petr:Lube Shps: One (1) UltraONE Pint per dllar spent (UltraONE Platinum level members earn tw (2) UltraONE Pints per dllar spent), except fr purchases made n a Natinal Tire Accunt. Wrk rders that include new tires r retread tires purchased n a Natinal Tire Accunt earn tw hundred (200) UltraONE Pints per tire purchased; n ther prducts r services purchased n a Natinal Tire Accunt wrk rder qualify fr UltraONE Pints. In cases where additinal UltraONE Pints are being ffered t members, UltraONE Platinum members will receive the better f the tw ffers, but nt bth. Fr example, if TravelCenters r Petr ffers members five (5) UltraONE Pints fr every dllar spent in the TA Truck Service Shps r Petr:Lube Shps, then UltraONE Platinum level members will earn five (5) UltraONE Pints instead f the standard tw (2) UltraONE Pints. 3. UltraONE Pints earned in the Prgram can be cnverted int redemptin certificates (each a Certificate ) which can be used t purchase specific prducts r services at the Lcatins r twards the purchase f eligible prducts r services at the Lcatins. See Kisks and ther psted lcatins fr details. 4. Yu nly earn UltraONE Pints fr purchases/transactins that yu make and pay fr. Yu may nt share Cards, have UltraONE Pints allcated t ther members, transfer awards/benefits, r receive UltraONE Pints r any rewards frm ther members. By participating, yu agree nt t attempt t gain r accept UltraONE Pints frm purchases made by ther members. UltraONE Pints are nt redeemable fr cash. TA reserves the right t reduce r eliminate UltraONE Pint balances at its sle discretin due t imprper use f the Prgram. TA further reserves the right t cancel and restrict future membership in the Prgram due t imprper use f the Prgram. TA s emplyees are prhibited frm issuing UltraONE Pints fr purchases nt made and paid fr by the member. 5. UltraONE Pints will nt be issued fr purchases f beer, tbacc, alchl, gift certificates, labr fr tires installed n a Natinal Tire Accunt, used tires purchased n a Natinal Tire Accunt, r n Freightliner r Delc warranty repair wrk. UltraONE Pints will nt be issued n the amunt f any discunts, gratuities, sales tax n items purchased r fr any purchases made using Certificates. 6. A member must cntact custmer service at within twenty-fur (24) hurs f swiping a Card if he/she believes that UltraONE Pints were nt prperly issued t his/her accunt after making a qualified purchased. UltraONE Pints will nt be added t an accunt if a member fails t cntact custmer service within such time perid. Expiratin f UltraONE Pints 1. UltraONE Pints, any available shwer credits (as discussed belw), special ffers, and any ther rewards f any type existing in a member s accunt will autmatically expire if n activity is recrded n a Card fr a perid f six (6) cnsecutive mnths and the Card status will be set t inactive. Activity is defined as a Certificate being printed r UltraONE Pints being added via a qualifying purchase.in rder t earn and redeem pints a Card must be active. A Card can be reactivated by cntacting UltraONE tll-free at The fllwing limitatins n earning UltraONE Pints apply t all members: Members will earn UltraONE Pints n nly tw (2) diesel fuel purchases per day Members will earn UltraONE Pints n nly three (3) truck service shp transactins per day 2

3 UltraONE Pints will nt be awarded fr any transactins in excess f these per day transactin limits. Redeeming UltraONE Pints 1. UltraONE Pints and ther rewards can be redeemed at Kisks lcated at all Lcatins. UltraONE Pints are redeemed by scanning r swiping yur Card, entering yur pin cde r yur birthday (MMDDYYYY) and chsing a redemptin award. After selecting the award, a Certificate is printed. Certificates cannt be prduced by any ther methd. Certificates and ther rewards have n cash value. UltraONE Pints can als be redeemed using the TruckSmart mbile app fr purchases f shwers and Interstate Speedzne WiFi (TA s netwrk f WiFi htspt lcatins). In additin, UltraONE Pints can be used t pay, in full r in part, fr merchandise made available fr purchase thrugh the Web Site ( Web Site Purchases ). 2. Certificates can be prduced at Kisks in 100-pint increments, prvided that there are enugh UltraONE Pints in the accunt t cver the amunt requested. 3. A valid cmmercial driver s license and crrespnding Card MUST be presented when redeeming $25 r mre in rewards r Certificates f any type. Additinally, TA reserves the right t request, and members shall be required t present, a valid cmmercial driver s license and crrespnding Card when redeeming rewards r Certificates f less than $25. In either case, the name n the cmmercial driver s license must match the name n the rewards r Certificate and crrespnding Card. TA reserves the right t deny and keep rewards r Certificates that are presented but d nt match the name n the cmmercial driver s license and Card. 4. Certificates and rewards printed at TravelCenters lcatins in Canada must be redeemed at TravelCenters lcatins in Canada. Certificates and rewards printed at Lcatins in the United States must be redeemed at Lcatins in the United States. 5. TA is nt respnsible fr any lst r stlen Certificates r rewards. UltraONE Pints and ther rewards cannt be credited back t an accunt if they are lst r stlen. Once a Certificate r reward is printed, it will nt be credited back t the accunt under any circumstances. 6. Certificates are valid fr thirty (30) days frm the date f issuance, after which time a Certificate expires and all value theren is frfeited. 7. Certificates cannt be redeemed fr diesel fuel; gasline; beer; alchl; gratuities; cash r cash equivalents; gift cards; prepaid cards; bill payments; INPulse payments and depsits relating t wireless services; lttery tickets; parking fees; PrivaCash; r casin credits. 8. Change will nt be prvided fr any Certificate prduced that exceeds the ttal amunt f the transactin. Any Certificate value ver the amunt f the transactin will be frfeited. 9. Yu are respnsible fr any applicable taxes n the receipt f UltraONE Pints, shwer credits, r n purchases made using UltraONE Pints, Certificates r ther rewards. UltraONE Pints, Certificates and ther rewards are nt redeemable fr cash, and are nt transferable. 10. Purchases (including Web Site Purchases) made with UltraONE Pints, Certificates r rewards may be returned fr exchange nly (i.e. n cash refunds). TA will nt credit UltraONE Pints r rewards back t the Prgram accunt fr returned merchandise. TA will nt issue UltraONE Pints r reward credits fr returned merchandise. 11. Rewards are subject t availability and subject t change. Cnditins r restrictins specified by TA r the prviding cmpany, spnsr, r prmter will be bserved. TA is nt respnsible, and assumes n liability, fr changes r discntinuances f rewards r the availability f such rewards. 12. There may be separate rules gverning the awarding and redeeming f UltraONE Pints thrugh ther retailers r cnsumer prduct cmpanies, if applicable. Thse rules will be psted n the Web Site. Shwer Credits 1. One (1) shwer credit is added t a Card fr each individual purchase ttaling sixty (60) gallns (apprximately tw hundred twenty-eight (228) liters in Canada) r mre f diesel fuel at a Lcatin. Cumulative purchases ttaling sixty (60) gallns (r apprximately tw hundred twenty-eight (228) liters) r mre f diesel fuel d nt qualify fr a free shwer credit. There is n limit n the number f shwer credits Standard level members can accumulate n their Cards at any ne time. Each shwer credit issued t a Standard level member expires furteen (14) days frm the date f the qualifying purchase. Shwer credits fr UltraONE Platinum members d nt expire. UltraONE Platinum members may hld a maximum f ten (10) shwer credits at any ne time n their Cards. At Lcatins using the Shwer System, a driver can btain a shwer by reserving it in ne f tw (2) ways: (i) thrugh a Kisk (nce the Shwer Nw screen is cnfirmed, the redeemed shwer credit can be used at that Lcatin nly); r (ii) thrugh TruckSmart (if a member s UltraONE accunt is set up n the TruckSmart app) by using the Instant Shwer feature, selecting the Lcatin and selecting Shwer Credit (nce the Shwer Cnfirmatin screen is cnfirmed, the redeemed shwer credit can be used at that Lcatin nly). TA will nt restre shwer credits t accunts fr use at anther Lcatin. 2. Fr Lcatins nt using the Shwer System, shwer certificates can be printed at a Kisk and presented t a TravelCenters r Petr representative. A shwer certificate must be presented t a TravelCenters r Petr representative within twenty-fur (24) hurs f printing the same in rder t btain a free shwer. Shwer certificates expire twenty-fur (24) hurs frm the time f printing. TA reserves the right t request that the crrespnding Card be presented at the same time the shwer certificate is redeemed. 3

4 3. Team drivers will be allwed ne (1) shwer each upn redemptin f a shwer certificate r use f a shwer credit prvided that bth shwers are taken at the same Lcatin n the same day. Bth drivers must be present when requesting tw (2) shwers frm ne (1) shwer certificate. At thse Lcatins using the Shwer System, team drivers shuld fllw the menu prmpts fr team drivers t btain a shwer certificate frm a Kisk and prceed t the shwer desk. The Custmer Service Representative will reserve a shwer fr the secnd driver. 4. N mre than tw (2) shwer credits can be earned r redeemed frm the same Card in ne (1) 24-hur perid. Lst r Stlen Cards 1. If yur Card is lst r stlen, immediately cntact UltraONE tll-free at Yur lst r stlen Card will be de-activated and all UltraONE Pints and shwer credits and rewards can be credited t a new Card. 2. When transferring t a new Card as a result f a lst r stlen Card, yu will be required t verify certain accunt infrmatin. An accunt balance transfer t a new Card will nt be issued unless prf f identity is cnfirmed. TA reserves the right t charge a fee fr replacement Cards. Special Offers 1. TA r vendr partners f TA may peridically ffer Prgram members the pprtunity t earn additinal UltraONE Pints n their accunt when making purchases f specified gds r services during specified prmtinal time perids. 2. Special ffers, if any, are valid nly at participating Lcatins. 3. Prir t printing a Certificate fr a special ffer ( Special Offer Certificates ), yu must check t ensure the prducts yu are purchasing are available fr retail sale at the Lcatin where yu are redeeming the Special Offer Certificate. 4. TA r the vendr partner specifies special ffer rewards fr qualifying purchases at participating Lcatins. The individual purchase requirements will be psted n the Kisks, the Web Site, r thrugh ther prmtinal materials at the Lcatins. 5. Special Offer Certificates must be redeemed within thirty (30) days frm the date that the Special Offer Certificate is printed. 6. Special Offer Certificates cannt be used in cnjunctin with a Natinal Tire Accunt purchase. IMPORTANT NOTICES 1. TA prvides the Prgram, these and ther materials, and ther services and prducts As Is and, t the fullest extent permitted by applicable law, expressly disclaims any representatin r warranties f any kind, express r implied, including but nt limited t warranties f merchantability, r fitness fr a particular purpse. Under n circumstances, including but nt limited t, negligence, shall TA be liable fr any direct, indirect, incidental, special r cnsequential damages arising ut f the Prgram r any such ther prducts r services, even if TA has been advised f the pssibility f such damages. In the event TA r the Prgram is held liable fr any damages related t these matters, yur sle and exclusive remedy will be limited t reimbursement fr services r prducts paid fr by yu t the entity held liable. 2. Earning UltraONE Pints, rewards, shwers and/r ther credits and redemptin f awards is subject t all applicable laws and regulatins. Benefits and awards may be subject t incme r ther taxes. Such taxes and all disclsures related theret are the sle respnsibility f the member. TA shall nt be respnsible fr crrespndence lst r delayed in the mail. TA is nt respnsible fr, and reserves the right t crrect any pricing r typgraphical errrs, errrs f descriptin, r errrs regarding partners r ffers. 3. If TA and/r any Prgram partner r participant imprperly denies a member UltraONE Pints r sme ther benefit, the member s exclusive remedy shall be the issuance f the imprperly denied UltraONE Pints, credit, award r benefit if available, r such ther alternative cmparable benefit as determined by TA, which shall have n liability whatsever. In n event shall TA r any Prgram partner r participant be liable t any member, r anyne claiming thrugh a member, fr any direct, indirect r cnsequential damages, r lst revenue r prfits, arising ut f TA s r any Prgram partner s r participant s acts r missins in cnnectin with the Prgram. 4. TA reserves the right t crrect any UltraONE Pint value r ther benefit granted in errr. In the event TA imprperly denies UltraONE Pints accrual r membership benefits, TA s liability is limited t the prper psting f UltraONE Pints r benefits. 5. TA is nt respnsible fr late, lst, incmplete, r misdirected entry infrmatin r cmmunicatins; cmputer system, phne line, electrnic equipment, cmputer hardware, sftware r prgram malfunctins, r ther errrs; failures r delays in cmputer transmissins r netwrk cnnectins; r fr any ther technical prblems. TA is nt respnsible fr incrrect r inaccurate entry infrmatin, whether caused by members r by any f the equipment r prgramming assciated with r utilized in the Prgram, r by any technical r human errr which may ccur in the prcessing f UltraONE Pints and accunt infrmatin. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, TA RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 6. This Prgram is gverned by the laws f the United States and the State f Ohi, withut respect t cnflict f law dctrines. As a cnditin f participating, yu agree that any and all disputes which cannt be reslved between the parties, and causes f actin arising ut f r in cnnectin with this Prgram, shall be reslved individually, withut resrt t any frm f class actin, exclusively befre a curt lcated in Ohi having jurisdictin. Further, in any such dispute, under n circumstances will participants be permitted t btain awards fr, and hereby waive all rights t claim punitive, incidental 4

5 r cnsequential damages, including attrneys fees, ther than member s actual ut-f-pcket expenses, and member further waives all rights t have damages multiplied r increased. TA, TravelCenters f America, Petr Stpping Centers, UltraONE, Petr:Lube and TruckSmart are all registered trademarks wned by r licensed fr use by TA Operating LLC. 5
