Declaratin - The Bard f Trustees f Austin Cmmunity Cllege District has delegated t the Administratin the fllwing respnsibilities with respect t the selectin f service prviders fr the design and cnstructin f this prject: 1. wrk with an external advisry cmmittee and a cllege cmmittee f faculty, staff, and students t identify instructinal prgrams, supprt services, and ther space needs; 2. serve as primary/first cntact with all external prfessinals wh may be hired fr this prject; 3. develp and publicize scpe f prject and evaluatin criteria fr selectin f Architectural and cnstructin services (t be reviewed by and subject t Bard apprval); 4. submit rankings f respndents t the Bard f Trustees fr final selectin and apprval; 5. arrange fr prfessinal respndents (finalists) presentatins t the Bard; RFQ # RW Page 1 f 18

Selectin Prcess This Request fr Qualificatins is the first step in a tw-step prcess fr selecting a Cnstructin Manager fr the fllwing cnstructin prject: ACC Leander Campus The steps in the selectin prcesses are as fllws: 1. Step 1 Request fr Qualificatins 2. Step 2 Request fr Prpsals. C. Eligibility - Any General Cntractr r Cnstructin Manager prject team is invited t submit a statement f qualificatins fr cnsideratin as a candidate fr this prject. Each firm must present a statement f qualificatins in rder t be cnsidered as a candidate, and an authrized representative f the firm must sign the statement f qualificatins. D. Licensure All respndents must have legally required licensure s that all services required frm them may be delivered in accrdance with applicable law. Althugh prf f licensure is nt required as a part f this respnse, team members are encuraged t submit phtcpies f relevant current licenses. E. Inquiries and Pint f Cntact ACC will try t answer written inquiries cncerning this RFQ, but shall nt be bligated t d s. Public Infrmatin ACC is a public institutin and subject t the Texas Public Infrmatin Act. Any infrmatin submitted t ACC is presumed t be public infrmatin and available t the public. Any infrmatin r materials submitted t ACC that is cnsidered cnfidential must be clearly marked "CONFIDENTIAL". If an utside individual r entity requests review r cpies f the infrmatin marked Cnfidential, ACC will advise the Supplier f the request. Small Business Develpment Prgram Pursuant t ACC s Bard Plicy G-2, Sectins D thrugh F, ACC is cmmitted t maximize the vitality and rbustness f the ecnmy f the Cllege s service area thrugh enhanced pprtunities fr the utilizatin f Small Lcal Business Enterprises as defined within that Small Business Develpment Prgram. The vendr is required t use its best effrts t assist the ACC in achieving this bjective thrugh prviding maximum pprtunities fr Small Lcal Business Enterprises t participate n its team, and by using its best effrts t encurage the maximum use f Small and Lcal Business Enterprises and Emerging Small and Lcal Business Enterprises (SLBE/ESLBE) by ther vendrs, suppliers, prfessinals, subcntractrs and sub-vendrs when pssible. Vendrs are required t prvide a plan describing the Vendr s actins t encurage and utilize SLBE/ESLBEs in all phases f the cntract. Vendrs may cntact the Small Business Develpment ( SBD ) Office fr assistance r clarificatin with issues specifically related t ACC s plicy, the cmpletin f SLBE/ESLBE frms and related reprts as specified by the SBD Office, by the terms f the cntract, and / r by ACC Bard Plicy G-2 Sectin E. I. Cnstructin Cntract. The selected Respndent will be required t enter int a cnstructin cntract with ACC substantially in the frm f ACC s standard cntract fr Cnstructin Manager at Risk, with assciated general cnditins and attachments, which may be btained frm the ACC Purchasing Office website advertising this slicitatin, withut lengthy negtiatins r extensive mdificatins t the terms. ACC Insurance Requirements and link Cntractr shall prcure and maintain at its wn expense the fllwing minimum insurance cverages insuring all services, wrk activities and cntractual bligatins undertaken in this cntract. These insurance plicies must be written by insurers acceptable t ACC. Evaluatin Methdlgy - Under the prvisins f the Texas Gvernment Cde Sectin (b) the Bard f Trustees has selected the fllwing criteria fr evaluating cnstructin management services as part f the verall cntracting prcess prvided in the Texas Educatin Cde Sectin t cntract fr the cnstructin f the Leander Campus. 1. Acceptance f Evaluatin Methdlgy By submitting Qualificatins in respnse t the RFQ, respndent accepts the evaluatin prcess and acknwledges and accepts that determinatin f the mst qualified firms/respndants will require subjective judgments by the Owner. BY SUBMITTING A RESPONSE TO THIS REQUEST FOR QUALIFICATIONS, THE RESPONDENT AGREES THAT IT WAIVES ANY CLAIMS IT HAS OR MAY HAVE AGAINST ACC, ACC S EMPLOYEES, OFFICERS, AGENTS, REPRESENTATIVES AND MEMBERS OF ACC S GOVERNING BODY, IN CONNECTION WITH OR ARISING OUT OF THIS RFQ, INCLUDING THE ADMINISTRATION OF THE RFQ, THE BASIS FOR SELECTION, THE EVALUATION OF THE RESPONSES, THE METHOD USED FOR SELECTION, AND ANY DISCLOSURE OF INFORMATION REGARDING THE RESPONSES OR EVALUATIONS. THE SUBMISSION OF QUALIFICATIONS CONSTITUTES THE ACCEPTANCE BY THE RESPONDENT OF THE EVALUATION TECHNIQUE DESCRIBED IN THIS RFQ. O. Scpe f Services ACC requests that the selected Cnstructin Manager prvide a full range f Pre-Cnstructin, Cnstructin, and Pst-Cnstructin services fr this prject including (but nt limited t) cst estimating, schedule assessment, cnstructability review, cmpliance with Small Business Develpment Prgram requirements fr SLBE and Emerging SLBE slicitatin, mnitring, utilizatin, and ther Prgram requirements, bidding f subcntracts, site imprvements and strmwater management, extensin f utilities t the site, building cnstructin, landscaping. Delivery f clse-ut dcuments and training f Owner s maintenance and peratins persnnel is required. Crrective wrk during warranty perid is required. All wrk perfrmed by the Cnstructin Manager must be in cmpliance with existing federal, state, and lcal cdes, statutes, and requirements. LEED Silver certificatin is expected fr all majr renvatin prjects; assistance in meeting this gal is required. P. Award Prtest Pursuant t the Purchasing Custmer Handbk gverns award prtest. The Purchasing Custmer Handbk is available n the ACC Purchasing Website at: 1. Rights. Any bidder wh is aggrieved in cnnectin with this prcurement may prtest t the Directr f Purchasing. 2. Ntificatin. The prtest shall be submitted in writing and received in the ffice f the Directr f Prcurement and Materials Management within ten (10) calendar days after the aggrieved knws r shuld have knwn the facts giving rise theret. 3. 7 II. Prject Descriptin - The Directr f Purchasing shall review and determine validity. If a mutual reslutin is nt made, then the prtest shall be submitted t the Executive Vice President f Finance and Administratin. 4. Authrity. The cllege President r his designee shall have the final authrity fr determinatin and t take any actin t reslve a prtest appeal. A. Backgrund Austin Cmmunity Cllege District has acquired a site encmpassing 100 acres near the MetrRail statin in the Transit Oriented Develpment district in Leander, Texas. The District intends t cnstruct a new campus n this site t expand its prvisin f higher educatin instructin in this rapidly grwing area. B. General The prpsed Leander Campus is expected t include facilities t supprt instructin predminantly in cre curriculum curses. The District intends the Leander Campus t prvide facilities fr the fllwing: Classrms and labratries; Instructin and ffice space fr Cntinuing Educatin and Adult Educatin; Offices fr Faculty and Staff; Library and Media Center; Administrative ffices; C. Building supprt and service spaces as needed t supprt the campus. D. Site The District wns the site. The District intends t cnstruct a first phase f a campus in a manner cnsistent with the visin f the Transit Oriented Develpment district. E. Budget The Cnstructin Cst Limit fr the cntract fr general cnstructin fr the prject is estimated t be apprximately $40,500,000. F. Schedule - ACC intends t select a Cnstructin Manager in Nvember, The District needs t take beneficial ccupancy by February, 2018, in rder t be prepared fr classes in the Summer Semester f 2018 at the latest. G. Cntract The District s cntract fr Cnstructin Management at Risk services, with assciated general cnditins and attachments, is attached t the RFQ. Exceptins must be nted at the time f submittal, as described in Sectin I, para I. abve. H. Utilities The Cnstructin Manager fr this prject will assist in the evaluatin f the best value t the District relative t extensins f utilities t the site. I. Finally, the cver sheet must have a statement that the respnse and all attachments are being submitted t Austin Cmmunity Cllege District as a statement f qualificatins and request fr cnsideratin f the firm as a candidate t prvide Cnstructin Management at Risk services fr the Cnstructin f the Leander Campus, and it must be dated and signed by the authrized representative. 2. Prvide a statement f interest fr the prject including a brief narrative describing the Prime Firm s and Prject Team s unique qualificatins as they pertain t this particular prject. 3. Prvide a statement f availability and cmmitment f the Prime Firm and its principal(s) and assigned prfessinals t undertake the prject. 4. Prvide a brief histry f the Prime Firm(s) prpsed fr the prject. 5. Prvide an rganizatin chart f the prject team, identifying the Prime Firm and any ther cntractrs r cnsultants prpsed fr the prject and clearly identifying the primary pints f cntact. 6.
