1 SHELL HELIX THE ULTIMATE FERRARI EXPERIENCE CONTEST Terms and Conditions 1. The Ultimate Ferrari Experience Contest ( Contest ) is divided in to two (2) Tiers. 2. This Contest is open to Malaysian Residents, 21 years old and above ( Eligible Participants ), with the exception of the following: a. Permanent and/or contract employees ( Employees ) of Shell Malaysia Trading Sdn. Bhd. ( SMTSB ) and its subsidiaries and related companies, and their immediate family members i.e. spouses, children, parents, brother and sisters ( immediate family members ). b. Service Providers engaged by SMTSB (e.g. advertising agencies, promotions agencies, printing company and event management agencies) and their employees and immediate family members. c. Dealers or distributors of SMTSB products (i.e. Shell Petrol Station Retailers and dealers/distributors of any Shell products and their Employees and their Employee s immediate family members). 3. All disputes shall be resolved at the sole discretion of SMTSB. SMTSB s decision shall be final and no correspondence or appeals shall be entertained. 4. SMTSB reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions without prior notice. 5. These Terms and Conditions, may be amended from time to time pursuant to clause 4 above, shall prevail over any provisions or representations contained in any other promotional material advertising this Contest. 6. In the event of any inconsistencies, conflicts, ambiguity or discrepancies between the English, Bahasa Malaysia and Chinese version of these Term and Conditions, the English version shall prevail. 7. By submitting the Contest forms, the eligible participant is deemed to have agreed to a. Participating in the Contest; b. Be bound by the Terms and Conditions herein, including the decisions of SMTSB concerning this Contest; and c. The Privacy Policy contained this Terms and Conditions. 8. SMTSB reserves the right to cancel, terminate or suspend this Contest without prior notice. For the avoidance of doubt, cancellation, termination or suspension by SMTSB of this Contest shall not entitle any party to any claim or compensation against SMTSB for any and all losses or damage suffered or incurred by Shell customers as a direct or indirect result of the act of cancellation, termination or suspension. 9. In no event will SMTSB be liable for any loss or damages including without limitations, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Contest, even if SMTSB has been advised of the possibility of such damages in advance, and all such damages are expressly excluded. TIER The Contest Period is from 1 st April 2014 to 30 th June 2014 (11:59 PM, GMT +8). 11. Proof of purchase as follows is required:

2 a. Minimum 4 liters of Shell Helix Ultra, Shell Helix HX7, Shell Helix HX7 E OR Shell Helix HX7 Diesel in a single receipt dated during the Contest period. b. Every 4 liters of Shell Helix Ultra in a single receipt is eligible for three (3) entries. c. Every 4 liters of Shell Helix HX7, Shell Helix HX7 E OR Shell Helix HX7 Diesel in a single receipt is eligible for one (1) entry. d. Pre-paid sales receipts do not qualify as a valid receipt. 12. Original Contest forms can be found at participating Shell Helix workshops, Spare Part Shops and Shell Stations. Photocopies of the Contest form are allowed and the form can also be printed from website 13. All completed Contest forms must be submitted to the prepared Contest drop boxes at Shell Station nationwide by 30 th June 2014 (11.59 PM, GMT +8) OR by mail to Suite #302, P05A Empire Shopping Gallery, Jalan SS16/1, Subang Jaya, Selangor. 14. To be in the running to win, participants are required to answer the question Is Shell Helix Ultra formulated with patented Shell PurePlus Technology? The answer needs to be recorded in the Contest form in the appropriate space provided. 15. Eligible participants can submit as many entries as they wish within the Contest Period for Tier 1. However, each entry form needs to be accompanied with the required proof of purchase. 16. Only entries with the correct answer as per clause 14 above are eligible for advancement to Tier 2. In the event the number of entries with the correct answer exceeds the number of slots open for the Tier 2 Challenge, participants will be selected in a random draw from among all such entries with the correct answer. There will be a total of 109 winners selected monthly from May-June, and 312 winners selected in July, in total 515 winners in Tier 1 Contest. 17. Winning Participants in Tier 1 will be notified via telephone call and mail. Details of venue, dates and times for prize collection shall be informed via telephone call and published on Shell Malaysia s website SMTSB does NOT use text messages to communicate to winners. 18. SMTSB Support Team shall make two attempts to call winners via the telephone number provided on the Contest form. Winner s announcement will be published onwww.shell.com.my/helix-ultimateexperience. 19. Should the first attempt to call the eligible winners of Tier 1 fail, i.e. no reply, telephone number not in service, no connection etc, another two (2) attempts will be made within the next four (4) hours. Where such further attempts are unsuccessful, SMTSB and its appointed agency reserve the right to select

3 another eligible winner in place of the eligible winner which could not be contacted and the same process will be repeated until a New Winner is determined for the Tier 2 challenge 20. Tier 2 will involve a series of challenges at a predetermined location. This location will be advised at a future date, closer to the date of the Tier 2 event. 21. The Tier 1 Prizes are: 10 x 1st Prize: RM 1,500 cash 10 x 2nd Prize: RM 1,000 cash 10 x 3rd Prize: RM 500 cash 500 x Special Prize: Shell Helix Ultra 4L worth RM226 TIER The 10 x 1 st Prize Winners from Tier 1 will have the first rights to refuse participating in the Tier 2 Challenge for the Grand Prize of 5 x All Expense Paid VIP Trip to Belgium, August The rules for the Tier 2 Challenge shall be announced after the 10 successful participants have been selected. 23. Winners will receive an additional RM 500 for accepting the Tier 2 Challenge. 24. The cost(s) of traveling to and from the Tier 2 Challenge location shall be borne by the successful participant(s). 25. If any of the successful participants from Tier 1 decline to participate in Tier 2, their place will be offered to the subsequent successful participant in Tier The Tier 2 Challenge shall be conducted at a predetermined location which will be advised closer to the actual date of the Tier 2 event. The Tier 2 Challenge shall consist of several challenges as determined by SMTSB and the Tier 2 participants shall compete for the Grand Prize according to the rules as communicated by SMTSB on the actual date of the Tier 2 Challenge. 27. The Grand Prize for the Tier 2 Challenge is 5 x All Expense Paid VIP Trip to Belgium. 28. The Grand Prize winner/s for Tier 2 shall be disqualified if he/she is: a. Denied entry to Belgium for any reason. b. Not allowed to leave Malaysia for any reason. c. Unable to attend the trip on the date/s offered. 29. Each Grand Prize for Tier 2 includes the following*: a. Hotel accommodation for (1) pax b. 1 return flight ticket from to KLIA, Malaysia to Belgium c. Airport and Hotel transfer (only in Belgium) d. Selected meals e. All other event in the official agenda in Belgium * Detailed terms to be finalised prior to departure date 30. The Grand Prize for Tier 2 does not include passport/visa charges, transport charges from the winner s homes in Malaysia to the airport (KLIA, Sepang), transport charges from the airport (KLIA, Sepang) to the winner s home in Malaysia and out of pocket expenses. 31. Prizes are not transferable or exchangeable for cash or any other products. However, SMTSB reserves the right to offer alternatives at any time without prior notice at its sole discretion. 4 Privacy Policy 1. This privacy policy sets out how SMTSB uses and protects any information provided when entering this promotion. 2. SMTSB may change this policy from time to time by updating this Terms and Conditions without prior notice. 3. Your personal data (including name, address, telephone number and ) provided to SMTSB through your participation in the Contest, may be processed by SMTSB, its subsidiaries and related companies, or on behalf of SMTSB, for the following purposes: a. For internal record keeping. b. To improve Shell products and services. c. To send promotional s about new products, special offers or other information which Shell customers may be interested to know. d. To contact Shell customers for market research purposes via , phone, fax or mail. e. For direct marketing purpose as SMTSB, its subsidiaries or related companies deems fit, without further notice or compensation. 4. In order to do the above, SMTSB may utilize a third party contractor or agent to handle or process the data collected. 5. By submitting your personal data to participate in the Contest, you: a. Declare that you have read, understood and accepted the statements set out in this privacy policy. b. Declare that the information provided to SMTSB in your submission is accurate, complete and true. c. Are giving your consent to the processing of your personal data that is being processed, or that is to be collected and further processed by us. d. Consent to the transfer of your data between SMTSB, its subsidiaries or related companies, and/or third parties processing your data on behalf of SMTSB in the manner and to the extent described in this privacy policy, irrespective of their location. e. Consent to the transfer of your data to locations outside of Malaysia or disclosure to our business partners and/or service providers, who may be located within or outside Malaysia. 6. SMTSB, its subsidiaries or related companies and their third party contractors or agents may reproduce and distribute the eligible participant s photograph, image or likeness and/or name, quotes, identification number and/or city of residence, without compensation for any purpose which it deems fit in the conduct of its business, including without limitation the promotion, marketing, advertising or publishing of the participant s image or likeness in relation to this Contest. 7. Eligible participants may choose to restrict the processing of their personal data in the following ways: a. Decline from participating in the Contest. b. At any time after the entry of this Contest, by writing to the address set out below. 8. A request to access, update or correct any information should be directed to SMTSB in writing at the address set out below. 5 11. If a participant believes that any information SMTSB hold on him/her is incorrect or incomplete, such participant is urged to contact SMTSB as soon as possible, at the above address and such correction will be made promptly.
