1 CIMB Bank Q2 18 Mail Order Telephone Order ( MOTO ) Campaign Terms and Conditions 1. The CIMB Bank Q2 18 Mail Order Telephone Order ( MOTO ) Campaign ( the Campaign ) is organised by CIMB Bank Berhad (13491-P) ( CIMB Bank ). 2. This Campaign is held in conjunction with the CIMB Islamic Q2 18 Mail Order Telephone Order ( MOTO ) Campaign organised by CIMB Islamic Bank Berhad ( CIMB Islamic ). In carrying out the Campaign in conjunction with CIMB Islamic, the product(s) and/or promotion(s) offered under this Campaign shall come from the same pool of product(s) and/or promotion(s) intended for the campaign organized by CIMB Islamic. Campaign Period 3. This Campaign shall run from 1 May 2018 to 31 July 2018, both dates inclusive ( Campaign Period ). 4. CIMB Bank reserves the right upon giving notice of not less than thirty (30) calendar days to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 5. This Campaign is open to the following groups:- i) All cardholders of credit cards issued by CIMB Bank in Malaysia, and ii) All permanent, probationary and/or temporary staff of CIMB Group of Companies (as defined herein)* in Malaysia who are cardholders of credit cards issued by CIMB Bank in Malaysia, collectively known as ( Eligible Participants ). The Eligible Participants Participating Credit Card are hereinafter collectively referred to as the Participating Credit Card. *CIMB Group of Companies means the groups of companies/legal entities of which CIMB Group Holdings Berhad, being the ultimate holding company of CIMB Bank/CIMB Islamic has a controlling interest, directly or indirectly, either by itself or through its subsidiaries. MOTO Campaign Products and Promotions 6. All Products purchased by the Eligible Participants under this Campaign must be paid using their Participating Credit Card. 10. All prices shown in the table under Clause 8 are inclusive of delivery charges and six percent (6%) Goods & Services Tax, and are not valid with any on-going promotion(s) of CIMB Bank. 11. The following payment arrangements/plans are available to the Eligible Participants under this Campaign: a. Single Purchase. Single Purchase means a one-off payment in full using the Participating Credit Card. b. 0% Easy Pay for 6 months for Products with a minimum price of Ringgit Malaysia Six Hundred (RM600.00) per unit c. 0% Easy Pay for 12 months for Products with a minimum price of Ringgit Malaysia One Thousand Two Hundred (RM1,200.00) per unit. 12. Choices of Products, colours and/or design are subject to stock availability and are based on first-come-first-serve basis. 13. Delivery of all Products is not valid for P.O. Box and/or mailing addresses outside of Malaysia. General Terms and Conditions 14. By participating in the Campaign, the Eligible Participant(s) is deemed to have read, understood and agreed to be bound by the Terms and Conditions stated herein as well as consented to CIMB Bank processing and disclosing their personal data in accordance with the CIMB Group Privacy Notice which can be found at and agree that any and all decisions fairly and reasonably made by CIMB Bank in relation to every aspect of the Campaign shall be final and conclusive. 15. CIMB Bank will not assume any responsibility for the Products, offers, and/or services offered under the Campaign. The Products, offers and/or services are offered and/or provided solely by Vendor 1 under such terms and conditions as determined by the Vendors, and CIMB Bank accepts no liability (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third party) howsoever arising whether in contract, tort, negligence or otherwise in connection with the Campaign and/or the Products, offers, and/or services offered under the Campaign, and all such damages are expressly excluded. 16. CIMB Bank will not entertain any complaint(s) whatsoever in connection with the Products, offers, and/or services offered by the Vendors. The Products, offers and/or services have not been certified by CIMB Bank and under no circumstances shall the inclusion of any Products, offers, and/or services in this Campaign be construed as an endorsement or recommendation of the products, offers, and/or services by CIMB Bank. Any dispute arising from or in connection with the Products, offers, and/or services offered by the Vendors is to be resolved with the Vendors. 17. CIMB Bank shall be entitled to amend, vary, delete or add ( the Amendment ) to any of these Terms and Conditions or any part thereof under this Campaign and/or to extend, modify, shorten, discontinue, cancel, terminate or suspend the Campaign by giving thirty

4 (30) calendar days prior notice to the Eligible Participants. No compensation in cash or any kind shall be given to the Eligible Participants for any losses or damages suffered or incurred by the Eligible Participants as a direct or an indirect result of such variation, deletion, addition or alteration of these Terms and Conditions and/or the extension, modification, cancellation, suspension or termination of this Campaign unless the same is due directly to the gross negligence and wilful default of CIMB Bank. 18. Notification to the Eligible Participants in respect of the Amendment shall be effected at CIMB Bank s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Participants last known address or by posting a notice regarding the Amendment at each of CIMB Bank s branches where detail provisions regarding the Amendment may be provided in the notice itself or may be provided to the Eligible Participants upon request or by effecting an advertisement regarding the Amendment in one newspaper of CIMB Bank s choice, or via CIMB Bank s website or via electronic mail or by any other means of notice which CIMB Bank may select and the Amendment shall be deemed as binding on the Eligible Participants as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the notification. 19. CIMB Bank shall not be liable or held responsible to the Eligible Participants in any manner whatsoever if CIMB Bank is unable to perform any of its obligations stipulated herein where such inability is due directly or indirectly to any Act of God, industrial dispute, war, strike, riot, technical or system failures including arising from any non-receipt or delayed receipt by the Eligible Participants of the statement insert, short message service (SMS) and/or electronic direct mail (EDM) or anything beyond CIMB Bank s reasonable control. 20. These Terms and Conditions (as the same may be amended from time to time pursuant to Clause 17) shall be read in conjunction with the prevailing CIMB Bank Cardholders Terms and Conditions and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials advertising the Campaign. 21. The product images, props and designs featured in any of the advertising materials including website and all printed materials in relation to the Campaign are for illustration purposes only. Actual models/products/colour may vary. 22. If there is any inconsistency, conflict, ambiguity or discrepancy between the Bahasa Malaysia and English version or other language version of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned where request had been made by the Eligible Participant and noted and acknowledged by CIMB Bank in its record that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the Participating Credit Card, then the Bahasa Malaysia version of the terms and conditions herein shall prevail. 23. These Terms and Conditions shall be subject to the application of any prevailing laws, guidelines, directives, notices, regulations enacted and/or any other written laws or which are issued by Bank Negara Malaysia or any other body having supervisory authority over the Bank in relation to or which are applicable to the Campaign or any matters herein. 24.
