1 TERMS & CONDITIONS ( T&Cs ) RHB BANCASSURANCE-FIXED DEPOSIT CAMPAIGN ( BANCA CAMPAIGN ) 1. RHB Bank Berhad (Company No M) will be referred to as the Bank. 2. The Campaign Period 2.1 The Banca Campaign commences from 1 st December 2017 to 31 st December 2017 (both dates inclusive) ( Campaign Period ) unless notified otherwise. 3. Eligibility 3.1 The Banca Campaign is open to all new and existing Bank s customers, both residents and non-residents but it excludes sole proprietorships, partnerships, charitable/non-profit organisations, societies, schools, colleges, universities and corporate and commercial companies ( the Eligible Participants ). All Bank s employees (which includes its employees in overseas offices and branches) are not eligible to participate in this Banca Campaign. 3.2 To participate in the Banca Campaign, the Eligible Participants must, during the Campaign Period, apply for any of the participating Bancassurance Regular Premium Products as stated in the table appended in Clause 4.1 below from the Bank s authorized employees and pay New Business Premium with a minimum Annual Premium Size in respect of the relevant participating Bancassurance Regular Premium Products. 3.3 The participating Bancassurance Regular Premium Products for this Banca Campaign as stated in the table appended in Clause 4.1 below (collectively referred to as the Participating Banca Products and individually referred to as the Participating Banca Product ) are all underwritten by Tokio Marine Life Insurance Malaysia Berhad ( Tokio Marine Life ). 3.4 For the avoidance of doubt:- New Business Premium means the premium paid towards the purchase of any of the Banca Products; Annual Premium Size refers to Annual First Year Premium (AFYP), which is the annualized premium amount with minimum of Ringgit Malaysia Five Thousand (RM5,000) for the Participating Banca Products. 3.5 The Eligible Participants who have committed or are suspected of committing any fraudulent, unlawful or wrongful acts in relation to the Banca Products and/or any of the facilities granted by the Bank or have been declared bankrupt or subject to any bankruptcy proceedings at any time prior to or during the Campaign Period shall NOT be eligible to participate in the Banca Campaign. 4. The Campaign Mechanics 4.1 The Eligible Participants who make fixed deposit placement ( FD Placement") in the prescribed amount in respect of the relevant Banca Products shall enjoy a promotional FD rate set out below ( Qualified Eligible Participants ): Participating Products Banca 1. Prime VantageLife (PVL) Annual Premium Size (per policy) Minimum: RM5,000 AFYP Fixed Deposit ( FD ) Placement Amount (per FD placement advice, per policy) 1 to 1 Basis up to the maximum of RM20,000 FD Promotional Rate (p.a.) 3 Months ( FD Tenure ) FD interest at effective rate of 7.88% p.a. 2 4.2 The Eligible Participants must meet the following requirements with regards to the eligible FD Placement to qualify for the FD promotional rate: Eligible Participants must sign the Declaration and Authorisation Form prior to the FD Placement; The FD Placement amount must NOT be more than the sum equivalent to an annual premium size of the Participating Banca Product; For avoidance of doubt, each FD Placement is capped at a maximum of RM20,000 per FD placement advice, per Participating Banca Product only The minimum FD Placement amount allowed per FD Placement is RM5,000. Annual premium size from multiple Participating Banca Products cannot be accumulated to qualify for FD promotional rate in a single FD placement advice. The minimum FD Placement amount is on a single plan basis; For clause 4.2.2, and 4.2.4, please refer to the illustration on the table below: FD Placement Annual Premium Amount (per FD Size (per policy) placement advice, Campaign Eligibility per policy) RM3,600 RM3,600 No. The minimum FD Placement Amount is RM5,000. The maximum FD Placement Amount is RM20, The signing date of the proposal form in respect of Participating Banca Product(s) and initial FD Placement must be done on the same day; The Participating Banca Product(s) must be in force by Tokio Marine Life and have passed the fifteen (15) calendar days cooling off period. 4.3 For the purpose of this Banca Campaign, the FD Placement shall consist of Fresh Funds only, which refer to funds not transferred from existing Bank s accounts, failing which the Bank reserves the right at its discretion to replace the participant s FD Promotional Rate with the prevailing 3-month FD Board Rate from the date of FD Placement. 4.4 The FD Promotional Rate is only valid on a first-come, first-served basis, subject to the total participating FD placement amount of RM10,000,000 during the Campaign Period. 4.5 Each Participating Banca Product subscribed throughout the Campaign Period is entitled to only one (1) FD Placement, i.e. the eligible FD Placement amount is not allowed to be split or apportioned to multiple FD placement advice. 4.6 In the event Qualified Eligible Participant applies more than one (1) Participating Banca Products throughout the Campaign Period, Qualified Eligible Participant shall be entitled to place multiple FD at FD Promotional Rate (whether in an individual FD account under the Qualified Eligible Participant s name only or a joint FD account where the Qualified Eligible Participant is the Principal FD Accountholder) in respect of the number of the Participating Banca Products subscribed. 4.7 In the case of joint FD accounts, only joint FD accounts where the Qualified Eligible Participant is the Principal FD Accountholder, is entitled for the FD Promotional Rate. 3 4.8 The Bank reserves the right, at its discretion, to revert the FD Promotional Rate of the Participating FD to the prevailing 3-month FD Board Rate from the date of FD Placement, in the event of the following:- (i) Participating Banca Product is cancelled, rejected, surrendered or lapsed by any party for any reason whatsoever at anytime during the FD Placement tenure; and/or (ii) Qualified Eligible Participants do not fulfil the T&Cs herein. 4.9 In the event the Annual Premium Size of Participating Banca Product is revised during the FD Placement tenure, the Bank reserves the right, at its discretion, to revert the FD Promotional Rate of the Participating FD to the prevailing 3-month FD Board Rate from the date of FD Placement or advise Qualified Eligible Participants to uplift the existing FD Placement and make new FD placement with the revised Eligible FD Placement Amount at FD Promotional Rate Upon maturity of the Participating FD tenure, the Participating FD will be auto-renewed at the prevailing 3-month FD Board Rate and the FD Interest under this Banca Campaign will be credited into the Qualified Eligible Participants nominated current account or savings account ( CASA ). Interest add-on to the initial Participating FD placement is not allowed For the purpose of Clause 4.10, the Qualified Eligible Participants nominated CASA must be either the Bank s existing CASA account or a new CASA account is opened with the Bank Partial withdrawal of Participating FD during the FD tenure is not allowed In the event the Participating FD is uplifted prior to maturity of the relevant FD tenure, no interest is to be paid on any Participating FD uplifted Withdrawal of FD can only be made at the home branch i.e. the branch where the FD Placement was made In the event it is subsequently discovered that the Qualified Eligible Participant does not meet any or all of the T&Cs under this Banca Campaign, the Bank reserves the right to claw-back and deduct the additional Participating FD Interest credited earlier from the Qualified Eligible Participant s nominated CASA. The Qualified Eligible Participants will be notified by RHB in writing prior to any FD Promotional Interest claw-back and deduction from the Qualified Eligible Participant s nominated CASA This Banca Campaign is NOT valid with any other on-going campaigns and any sign-up gift offered by the Bank in respect of the Participating Banca Products from time to time. 5. General Terms and Conditions 5.1 The Bank reserves the right at its discretion to withdraw, cancel, suspend, extend or terminate the Banca Campaign earlier in whole or in part, and/or to vary, supplement, add, delete, modify or amend the T&Cs herein, wholly or in part at its discretion, by way of posting on or in other methods which the Bank deems practical, by giving twenty one (21) calendar days prior notice to the participant(s) on such variation, supplemental, deletion, modification or amendment, as the case may be, to these T&Cs. For the avoidance of doubt, cancellation, termination or suspension by the Bank of this Banca Campaign shall not entitle the participant(s) to any claim or compensation against the Bank for any and all losses or damages suffered or incurred by the participant(s) as a direct or indirect result of the act of cancellation, termination or suspension. 5.2 This T&Cs can be obtained from the Bank s website at and/or available on request from the Bank s Premier Centres / Branches. This T&Cs shall prevail over any provision or representation contained in any other promotional material advertising this Banca Campaign. 4 5.3 These T&Cs are in addition to the respective product terms and conditions for the Bank. In the event of inconsistency between these T&Cs and the product T&Cs, these T&Cs shall prevail insofar as they apply to this Banca Campaign. 5.4 The Bank shall not be liable for any default due to any act of God, war, riot, strike, terrorism, epidemic, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of the Bank. 5.5 The Bank shall only be liable for any loss or damage suffered or incurred as a direct result of the Bank s negligence and shall not be liable for any other loss or damage of any kind such as loss of income, profit, goodwill or indirect, incidental, exemplary, punitive, consequential or special loss or damage howsoever arising, whether or not the Bank has been advised of the possibility of such loss or damage. 5.6 The Bank s decision on all matters relating to this Banca Campaign including but not limited to the eligibility to participate, the selection of the recipients for the FD Promotional Rate for this Banca Campaign, and in case of any dispute, shall be final and binding on all Eligible Participant(s) who participate in this Banca Campaign and no correspondence will be entertained. 5.7 By participating in the Banca Campaign, the Eligible Participant(s) consent(s) to the Bank processing their personal information for purpose of administering the Banca Campaign and contacting them in relation to the same ( Purpose ). 5.8 It is necessary for the Bank to process the Eligible Participant(s) s personal information for the Purpose, without which they will not be able to participate in this Banca Campaign. 5.9 The Eligible Participant(s) s personal information may be disclosed to other companies within the RHB Banking Group (which shall include its holding company, subsidiary(s), and any associated company(s), including any company as a result of any restructuring, merger, sale or acquisition), service providers, and vendors and any of their respective agents, servants and/or such persons, whether located within or outside Malaysia for the Purpose, if applicable, subject at all times to any laws (including regulations, standards, guidelines and/or obligations) applicable to the Bank By participating in this Banca Campaign, the Eligible Participant(s) agree(s) to be bound by these T&Cs and the decisions of the Bank The Eligible Participant(s) are liable and shall personally bear all applicable taxes, government fees, all the cost related to delivery or installation or any other charges that may be levied against them under applicable laws, if any, in relation to participating in the Banca Campaign Any notices required to be given in respect of this Banca Campaign by the Bank to the Participant may be given in any of the following manner as determined by the Bank in its absolute discretion:- (a) by hand delivery, which shall be deemed received by the Participant upon written acknowledgement of receipt by an officer or other duly authorised employee or representative of the Participant; or (b) by ordinary post or registered post or courier if sent to or left at the Participant(s) last known address registered with the Bank and shall be deemed to be received by the Participant(s) within three (3) Business Days from posting if sent by ordinary post or registered post and within two (2) Business Days from sending if by courier; or (c) by electronic mail to the Participant s last known address in the Bank records and such notices shall be deemed to be received by the Participant after 24 hours from transmission; or (d) by facsimile to the Participant s last known facsimile number in the Bank records and such notices shall be deemed to have been received by the Participant upon completion of the transmission as evidenced by a fax confirmation slip ; or Terms and Conditions Bancassurance-Fixed Deposit Campaign ver002(1) Page 4

5 (e) by general notice in at least one major national newspaper or posted at the Bank s branch premises or on visual screen through a computer or visual terminal or at the Bank s Website, and the notice shall be deemed to have been received by Participants or effective from the date of such notice is made available or the date specified in the notice; or (f) by notification or communication in any other reasonable or appropriate manner as deems fit by the Bank including telephone call and Short Messaging System (SMS) Words denoting one gender include all other genders and words denoting the singular include the plural and vice versa.
