1 TERMS & CONDITIONS HSBC Amanah RBB Business Package Promotion 1. HSBC Amanah Malaysia Berhad (Company No X) will be referred to as HSBC Amanah. DEFINITIONS 2. Online Transactions Fees refers to Bill Payment transaction fees, GIRO, Intrabank Fund Transfer, Interbank RENTAS, DuitNow transaction fees, Inward Telegraphic Transfer (RM5) and Outward Telegraphic Transfer (RM25). The waiver of fees is only applicable to standard local currency charges for domestic and international transfer only. 3. Integrated Total Relationship Balance means Eligible Participant s overall relationship with HSBC Amanah that takes into account total relationship balance of Eligible Participant s Participating Account and total relationship balance of a customer s Personal Account. Personal Account refers to Deposits in Current Account/i, Savings Account/i, Time Deposits, Term Deposits-i, Investments in Unit Trust funds/shariah-compliant Unit Trust funds, Structured Investments-i and/or Direct Retail Bond, and/or Cash value from Takaful/Life Insurance products with investment-linked and savings components. 4. Average ITRB means the total ly ITRB for six months divided by six. 5. ly ITRB refers to the daily end day balance divided by the number of days for that month. PROMOTION PERIOD 6. This HSBC Amanah RBB Business Package Promotion ( Promotion ) shall run from 28 December 2018 at 09:00 Malaysian local time until 31 May 2019 at 23:59 Malaysian local time ( Promotion Period ). ELIGIBILITY 7. This Promotion is open to all new Retail Business Banking ( RBB ) customers who: a) Do not have a 1 Biz Account/-i or a Business Current Account/-i or HSBC Amanah Business Premises Financing-i with HSBC Bank / HSBC Amanah prior to the Promotion Period; b) Submit a completed Application Form together with all requested documentation for 1 Biz Account-i or HSBC Amanah Business Premises Financing-i or both ( Participating Product(s) ) and selecting a preferred RBB Business Package as provided below during the Promotion Period; AND c) The RBB customer s application(s) in (b) above is/are approved by HSBC Amanah (collectively referred to as Eligible Participants ). PROMOTION MECHANICS 8. Eligible Participants who meet the Integrated Total Relationship Balance ( ITRB ) or the minimum approved financing amount (as provided in Clause 9 below) or both of their selected business package will get to enjoy the offer prescribed for the respective business package.

2 9. Below are the RBB Business Packages available for Eligible Participant to select: (a) Business Basic Package Participating Product(s) Selected 1. 1 Biz Account-i with ITRB RM30,000; or 2. HSBC Amanah Business Premises Financing-i with minimum approved financing amount of RM500,000; or 3. Both Note: The ITRB above must be maintained for at least 30 days from the date the Participating Product is approved. (i) (ii) Offer ly HSBCnet Fee of RM30 will be waived*; and Waiver of Online Transactions Fees* Note*: HSBCnet Fee and Online Transactions Fees will be waived for 6 months starting from the date HSBCnet is setup ( Waiver Period ), whether an Eligible Participant applies for one Participating Product or both. or (b) Business Package Participating Product(s) Selected 1. 1 Biz Account-i with ITRB RM200,000; or 2. HSBC Amanah Business Premises Financing-i with minimum approved financing amount of RM1,000,000; or 3. Both Note: The ITRB above must be maintained for at least 30 days from the date the Participating Account is approved. (i) (ii) Offer ly HSBCnet Fee of RM30 will be waived**; and Waiver of Online Transactions Fees** Note**: HSBCnet Fee and Online Transactions Fees will be waived for 6 months starting from the date HSBCnet is setup ( Waiver Period ), whether an Eligible Participant applies for one Participating Product or both. 10. After the Waiver Period, the monthly HSBCnet Fee for Business Basic Package and Business Package will be waived for further six months only if: a) For 1 Biz Account-i, an Eligible Participant s Average ITRB meets the respective minimum ITRB requirement as stated above during the Waiver Period for the selected business package. Otherwise, the monthly HSBCnet Fee will be debited from the Eligible Participant s Participating Account; or b) For HSBC Amanah Business Premises Financing-i, an Eligible Participant does not default in his/her monthly payment of the financing during the Waiver Period. Otherwise the monthly HSBCnet Fee will be debited from the Eligible Participant s Account. 11. After the Waiver Period, the Online Transactions Fees for Business Package will be waived for further six months only if: a) For 1 Biz Account-i an Eligible Participant s Average ITRB meets respective the minimum ITRB requirement as stated above during the Waiver Period for the selected business package.

3 Otherwise, the Online Transactions Fees will be charged to the Eligible Participant s Participating Account; or b) For HSBC Amanah Business Premises Financing-i, an Eligible Participant does not default in his/her monthly payment of the financing during Waiver Period. Otherwise, Online Transactions Fees will be charged to the Participant s Participating Account. c) For the avoidance of doubt, there will be no further waiver for Business Basic Package. Below are illustrations when Eligible Participants are entitled to waiver after the Waiver Period: Business Package Qualified for HSBCnet & Online Transactions Fees Waiver A B C (Business Premises Financing-i) Basic D = RM250,000 (Total ly ITRB for 6 months) / 6 = RM42,000 = RM1,510,000 (Total ly ITRB for 6 months) / 6 = RM251,000 does not default in his/her monthly payment of the financing for six consecutive months = RM1,500,000 (Total ly ITRB for 6 months) / 6 = RM250,000 No (Below the minimum ITRB Requirement) Yes Yes Waiver on HSBCnet Fee only 12. Eligible Participants are not allowed to switch RBB Business Package during the Waiver Period. 13. An Eligible Participant who has a HSBC Amanah Business Premises Financing-i must comply with Clauses 8 to 11 to enjoy the waivers under this Promotion*. * This clause is applicable for products based on concepts other than Qard. 14. HSBC Amanah has in the past provided similar waiver/offer/rewards to HSBC Amanah customers who fulfil or comply with similar requirements. Therefore, an Eligible Participant who has a 1-Biz Account-i and complies with Clauses 8 to 11may enjoy the waivers under this Promotion based on historical basis. The historical rewards shall not be construed as an indicative future reward to the Eligible Participant nor as an obligation on the part of HSBC Amanah to provide such reward in the future*. *This clause is applicable on products based on concept of Qard.

4 GENERAL TERMS AND CONDITIONS 15. HSBC Amanah reserves the right at their absolute discretion to amend, delete or add to these Terms and Conditions from time to time with three (3) days prior notice and such amended terms and conditions shall prevail over any provisions or representations contained in any other promotional materials advertising this Promotion. 16. HSBC Amanah reserves the right to cancel, terminate or suspend this Terms and Conditions with three (3) days prior notice. For the avoidance of doubt, cancellation, termination or suspension of this Terms and Conditions shall not entitle the Eligible Participant(s) to any claim or compensation against HSBC Amanah for any and all losses or damage suffered or incurred by the Eligible Participant(s) as a direct or indirect result of the act of cancellation, termination or suspension. 17. HSBC Amanah shall only be liable for any loss or damage suffered or incurred as a direct result of HSBC Amanah s gross negligence and shall not be liable for any other loss or damage of any kind such as loss of income, goodwill or indirect, incidental, exemplary, punitive, consequential or special loss or damage howsoever arising, whether or not HSBC Amanah have been advised of the possibility of such loss or damage. 18. To the fullest extent permitted by law, HSBC Amanah expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of this Terms & Conditions. 19. HSBC Amanah may use any of the following modes to communicate notices in relation to this Terms & Conditions to the Eligible Participant(s): i. individual notice to the Eligible Participant(s) (whether by written notice or via electronic means) sent to the Eligible Participant(s) s latest address/ address as maintained in HSBC Amanah s records; ii. press advertisements; iii. notice in the Eligible Participant(s) s composite statement(s); iv. display at its business premises; or v. notice on HSBC Amanah s internet website(s); where such notices shall be deemed to be effective on and from the 4th day after its delivery/ publication/display as per the manner described herein. Save and except for notices sent via ordinary mail which will be deemed delivered on the 3rd day after posting, notices sent via other modes as described herein are deemed delivered immediately after posting/ publication/display. 20. These Terms and Conditions are in addition to the existing respective terms and conditions which regulate the provision of the products and services referred to in this Terms & Conditions. In the event of inconsistency between these Terms and Conditions and the existing respective product and service terms and conditions, these terms and conditions shall prevail. The existing terms and conditions applicable to the products and services referred to in this Terms & Conditions are available as follows: Universal Terms & Conditions of HSBC Amanah available at are: (i) Generic Terms & Conditions for Commercial Banking; and (ii) Specific Terms & Conditions for Commercial Banking.

The Eligible Participants shall be personally responsible for all taxes, rates, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to the Promotion. 22. HSBC Amanah shall not be liable for any default due to any act of God, war, riot, strike, terrorism, epidemic, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of HSBC Amanah. 23. HSBC Amanah s decision on all matters relating to this Terms & Condition and in case of any dispute will be final and binding on all Eligible Participant(s) and no correspondence will be entertained. 24. By participating in this Promotion, the Eligible Participant(s) agree(s) to be bound by these Terms and Conditions and the decisions of HSBC Amanah.
