1 Amended HSBC Premier 6-Month Step Up Term Deposit-i Promotion ( Promotion ) Terms and Conditions (Phase I) This Promotion shall be extended until 30 April 2015 and Clause 1 has been amended to reflect the extended promotion period. where clause 2 is deleted to allow HSBC Bank, HSBC Amanah and HSBC Amanah Takaful (Malaysia) Berhad employees and their immediate family members to participate in this Promotion. HSBC Bank Malaysia Berhad (Company No V) will be referred to as HSBC Bank and HSBC Amanah Malaysia Bhd (Company No X)) will be referred to as HSBC Amanah. 1. This Promotion by HSBC Bank and HSBC Amanah is valid from 09 February April 2015 ( Promotion Period ), both dates inclusive. The 6-Month Step Up Term Deposit-i ( Step Up TD-i ) is a product of HSBC Amanah. 2. This Promotion is only open to new-to-hsbc Premier customers, who may be existing HSBC Bank customers who upgrade to HSBC Premier except for the following categories of persons:- (ii) non-individuals or corporate customers; and (iii) non-hsbc Premier customers, i.e. HSBC Advance or other customers who do not upgrade to HSBC Premier; (hereinafter referred to as Eligible Customer(s) ). 3. Eligible Customer(s) must meet any of the criteria below, subject to clause 9 below: i. Have applied for, and accepted a housing loan of RM750,000 or more from HSBC Bank; or ii. Have received an invitation via letter, or short message service (SMS) from HSBC Bank, (hereinafter referred to as Eligible Criteria ). 4. Under this Promotion, the Eligible Customer(s) will be entitled to place Step Up TD-i with the following special MYR Term Deposit-i Standard Scheme (Eligible for protection by PIDM) profit rates by HSBC Amanah: Total Tenure 6 Months Special TD-i Profit Rate p.a. 1 st & 2 nd month 3.18% 3 rd & 4 th month 4.18% 5 th & 6 th month 6.18% 5. The TD-i placement amount must be Fresh Funds, where Fresh Funds mean funds obtained from sources other than any existing account(s) with HSBC Bank or HSBC Amanah, whether or not the account(s) are held in the name of the Eligible Customer(s).

2 Transfers of funds from other branches of HSBC Bank or HSBC Amanah are not allowed under this Promotion. 6. The minimum and maximum TD-i placement amounts are RM150,000 and RM250,000 respectively per Eligible Customer. 7. The TD-i placement(s) must be made within 7 working days of the Fresh Funds being transferred to HSBC Bank. 8. For TD-i placement, if Eligible Customer(s) has participated in this Promotion under a joint account, he or she cannot participate in the Promotion again under a sole account and vice versa. For illustration: Scenario 1 Customers A+B are joint customers who meet the Eligibility Criteria. During the Promotion Period, customers A+B open an HSBC Premier Account as joint accountholders. To participate in the Promotion, customers A+B will have to place the TD-i as joint accountholders and cannot participate in the Promotion under their sole names. Scenario 2 Customers A+B are joint customers who meet the Eligibility Criteria individually. During the Promotion Period, A and B open a sole HSBC Premier Account separately. To participate in the Promotion, both A and B can place TD-i under their sole names up to RM250,000 respectively but cannot participate in the Promotion under their joint account. Scenario 3 Customer A is a sole customer who meets the Eligibility Criteria and opens a sole HSBC Premier Account. Customer A also opens a joint HSBC Premier Account with customer B. To participate in the Promotion, the TD-i placement can only be made under customer A s sole account or customer A+B s joint account. Customer B can only participate in the Promotion under B s sole name if A has opted to place the TD-i in A s sole name, B has a sole HSBC Premier Account and B meets the Eligibility Criteria. 9. In order to effect the Step Up TD-i for 6 months, the TD-i placement will be in 3 tranches of 2 months each. On completion of the first 2 months, the TD-i placement amount ( Principal ) and profit will be credited to the Eligible Customer s account and the Principal will then be debited from the Eligible Customer s account and placed into the second tranche TD-i at 4.18% p.a. This cycle will repeat on completion of the 3 rd and 4 th months and the Principal placed into the 3 rd tranche TD-i at 6.18% p.a. 10. If Eligible Customer(s) uplift the TD-i prematurely at any time before completion of any 2 months, the Eligible Customer agrees that HSBC Amanah shall be entitled to a compensation payment equivalent to the profit from the TD-i Principal for those 2 months only. The Eligible Customer also agrees that he/she will not be able to continue with the next tranche TD-i.

3 11. Upon completion of the 6 months, the TD-i Principal will automatically be renewed for 6 months at the prevailing board rate unless the Eligible Customer instructs otherwise. 12. This Promotion is not valid with other deposit offers and promotions that are concurrently offered by HSBC Bank or HSBC Amanah. General Terms and Conditions 13. HSBC Bank and HSBC Amanah reserve the right at its absolute discretion to amend, delete or add to these Terms and Conditions from time to time with 3 days prior notice and such amended terms and conditions shall prevail over any provisions or representations contained in any other promotional materials advertising this Promotion. 14. HSBC Bank and HSBC Amanah serve the right to cancel, terminate or suspend this Promotion with 3 days prior notice. For the avoidance of doubt, cancellation, termination or suspension by HSBC Bank and HSBC Amanah of this Promotion shall not entitle the Eligible Customer(s) to any claim or compensation against HSBC Bank and HSBC Amanah for any and all losses and damages suffered or incurred by the Eligible Customer(s) as a direct or indirect result of the act of cancellation, termination or suspension. 15. HSBC Bank and HSBC Amanah shall only be liable for any loss or damage suffered or incurred as a direct result of HSBC Bank and HSBC Amanah s gross negligence and shall not be liable for any other loss or damage of any kind such as loss of income, profit, goodwill or indirect, incidental, exemplary, punitive, consequential or special loss or damage howsoever arising, whether or not HSBC Bank and HSBC Amanah have been advised of the possibility of such loss or damage. 16. To the fullest extent permitted by law, HSBC Bank and HSBC Amanah expressly exclude and disclaim any representations, warranties or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of this Promotion. 17. HSBC Bank and HSBC Amanah may use any of the following modes to communicate notices in relation to this Promotion to the Eligible Customer(s): a. individual notice to the Eligible Customer(s) (whether by written notice or via electronic means) sent to the Eligible Customer(s) latest address/ address as maintained in the HSBC Bank and HSBC Amanah s records; b. press advertisements; c. notice in the Eligible Customer(s) s composite statement(s); d. display at its business premises; or e. notice on HSBC Bank and HSBC Amanah s internet website; where such notices shall be deemed to be effective on and from the 4 th day after its delivery publications per the manner described herein. Save and except notices sent via ordinary mail which will be deemed delivered on the 3 rd day after posting, notices sent via other

4 modes as described herein are deemed delivered immediately after posting/publication/display. 18. These Terms and Conditions are in addition to the existing respective terms and conditions which regulate the provision of the products and propositions referred into this Promotion. In the event of inconsistency between these Terms and Conditions and the existing respective product and proposition terms and conditions, these terms and conditions shall prevail in relation to this Promotion. The existing terms and conditions applicable to the products and propositions referred in this Promotion are available as follows: a. Universal Terms and Conditions of HSBC Bank available at are: (ii) (iii) (iv) Generic Terms and Conditions; Specific Terms and Conditions for HSBC Premier and HSBC Advance; Special Terms and Conditions for Retail Banking and Wealth Management; and Cardholder Agreement; and b. Universal Terms and Conditions of HSBC Amanah available at are: (ii) (iii) (iv) Generic Terms and Conditions; Specific Terms and Conditions for HSBC Amanah Premier and HSBC Amanah Advance; Special Terms and Conditions for Retail Banking and Wealth Management; and Cardholder Agreement. 19. The Eligible Customer(s) is reminded that he/she will be responsible for all applicable government taxes or levies relating to this Promotion (if applicable). 20. HSBC Bank and HSBC Amanah shall not be liable for any default due to any act of God, war, riot, strike, terrorism, epidemic, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of HSBC Bank and HSBC Amanah. 21. HSBC Bank and HSBC Amanah s decision on all matters relating to this Promotion and in case of any dispute will be final and binding on all Eligible Customer(s) of this Promotion and no correspondence will be entertained.

5 22. By participating in this Promotion, the Eligible Customer(s) agrees to be bound by these Terms and Conditions and the decisions of HSBC Bank and HSBC Amanah.
