Definition 1.1 For the purpose of this Terms and Conditions, the following words and expressions shall have the meanings assigned to them except where the context otherwise requires:- The Bank means AmBank (M) Berhad (Company No.8515-D), company incorporated in Malaysia under the Companies Act 1965 and having its registered address at Level 22, Bangunan AmBank Group, No.55, Jalan Raja Chulan, Kuala Lumpur. AmBank Group means all the Related Corporations and Associate Corporations of the Bank whether incorporated inside or outside Malaysia, existing now or in the future and reference to AmBank Group in this Terms and Conditions herein, shall include all or any entity within the AmBank Group. Day means Monday to Friday, and whereby the registered office of the Bank is open, unless stated otherwise. Prior Notice means notice by the Bank of certain facts or of a particular state of affairs of at least three (3) calendar days. Eligible Products for The Campaign means Bank s Savers GANG account and Fixed Deposit/ Am50Plus. New Customer means an individual who does not have any of the Eligible Products with the AmBank Group prior to the commencement of the Campaign Period and subject to the eligibility pursuant to Clause 3 below Existing Customer means an individual who has any one of the Eligible Products prior to the commencement of the Campaign Period and subject to the eligibility pursuant to Clause 3 below Eligible Customer means new or existing individual customer who has applied the Eligible Products under this Campaign. Successful Eligible Customer means the first Eligible Customer who meets the criteria as stated in Clause 4.1 and Clause 6.1 Fresh Funds means monies or funds that are:- (a) (b) not transferred from any existing deposit account held with the Bank; or funds transferred from another bank/financial institution into the Eligible Customer s Bank deposit account not more than seven (7) calendar days prior to placement. The Campaign means organised by the Bank in accordance with the Terms and Conditions stipulated herein. 1.2 Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and vice versa. Words importing the masculine gender shall include the feminine and neuter gender. 1 AmBank Savers GANG_ Terms and Conditions

2 1.3 The term Associate Corporations shall have the same meaning assigned to it under Section 2(1) of the Financial Services Act The term Related Corporations shall have the same meaning assigned to it under Section 6 of the Companies Act Campaign Period 2.1 The Campaign shall commence from 1 February 2016 until 30 April 2016 (both dates are inclusive) ( Campaign Period ): 2.2 The Bank reserves the right to vary or amend the duration of the Campaign Period at its sole and absolute discretion with Prior Notice. 3. Eligibility 3.1 Any Eligible Customer may participate in this Campaign except for non-individual customer. Non-individual customers shall only consist of the following: a) Sole-proprietorships/partnerships; b) SMEs (Small Medium Enterprises with annual turnover of less than RM25million) c) Non-profit organizations/charitable bodies/societies 3.2 Employees of the AmBank Group and their immediate family members (spouses, children and parents) are also eligible to participate in this Campaign. 3.3 The following individuals/entities are not eligible to participate in this Campaign: a) Government/Statutory Bodies and Corporate Customers (companies and corporates with annual turnover above RM25million) 4 Campaign Mechanics A) Savers GANG Premium Gifts 4.1 Eligible Customer is required to deposit a lump sum Fresh Fund amount and keep this amount earmarked into Savers GANG Accounts for four (4) months ( Earmark Period ) from date of placement in order to be entitled for the following Savers GANG premium gift ( Gift ) as stipulated in Table 1:- Table 1: Category Minimum Eligible Fresh Fund Deposit (RM) 1 3, , ,000 Earmarked Period Gifts Quantity Available 4 months from placement date Faber Castell My Advanced Coloring Set worth RM29.90 OOPS Happy Back Pack worth RM89.00 Crayola-Grow-with-Me-Easel worth RM ,000 2, The Campaign is only applicable for deposit of Fresh Fund as defined in this campaign term and condition to be eligible for the Gift. 2 AmBank Savers GANG_ Terms and Conditions

3 4.3 The earmarking process will be done at the branch where the Savers GANG Account placement is made. For the earmarking purposes, Eligible Customer is required to acknowledge the Acknowledgment Note provided by the branch upon successful deposit placement or top up of their Savers GANG Account. 4.4 Any deposit placements made by way of cheque(s) are subject to their clearance and will only be considered as deposit placements by the Eligible Customers after the cheque(s) are paid or cleared. 4.5 Availability of the gifts is restricted to the quantity as stated in Clause Earmarked Fund 5.1 Deposit placement or top up placed in the Savers GANG shall be earmarked by the Bank for four (4) months from placement date as stipulated in clause 4.1 above. 5.2 In the event the earmarked amount in the Savers GANG Account (in part of full) is cancelled, withdrawn or released during the Earmarked Period for any reason whatsoever, the Bank reserves the absolute right to deduct the following penalty fee from the applicable Eligible Customer s Savers GANG Account as stipulated in Table 2 below on the withdrawal date. 5.3 The following penalty fee amounts stated in Table 2 are equivalent to the cost price of the Gifts in the event the Gifts have already been redeemed. Gift Redemption 6.1 The Gifts are valid on a first-come-first-serve basis and subject to the stock availability, limited to three (3) Gifts for each category for each Successful Eligible Customer throughout the Campaign Period. 3 AmBank Savers GANG_ Terms and Conditions

4 6.2 The Gift from tier one (1) category will be given immediately on the spot to the Successful Eligible Customer at the respective branches upon fulfillment of the criteria as specified in Clause 4.1 above subject to stock availability at the branches. 6.3 As for the tier two (2) and three (3) category, the Gift will be available for collection by the Successful Eligible Customer within ninety (90) days after end of Campaign Period failing which, the Successful Eligible Customer shall be deemed to have forfeited the Gift. 6.4 The collection of the Gift is to be collected from the branch where the Savers GANG Account placement is made. 6.5 Successful Eligible Customer for Gift category two (2) and three (3) will be announced at our Bank s official website, at within ninety (90) days from end of Campaign Period. 6.6 Successful Eligible Customer for Gift category two (2) and three (3) will be notified to collect their Gift via Short Message Service (SMS) or any other methods deem appropriate by Bank within ninety (90) days from end of Campaign Period. 6.7 Gifts will be given or issued to the Successful Eligible Customer in accordance to the placement of deposits pursuant to Table 1 above. The decision on this shall be final, no correspondence or appeal will not be entertained to change the Gift. 6.8 Gift(s) will be given or issued in the name of the Successful Eligible Customer and it is nontransferable. 6.9 Gift(s) will be given or issued as per according to the placement deposit category been made. Eligible Customer is also not allowed to choose color of the gift. The decision on this shall be final, no correspondence or appeal will not be entertained to change the gift In the event of joint account holders, the Gifts shall be given to the primary account holders only The Bank reserve full right to add/remove and to substitute any Gift(s) with items of similar retail value with Prior Notice to the Eligible Customer The Gifts shown in the advertisements and other marketing materials (if any) are for illustration purposes only and the actual design may differ The Successful Eligible Customer shall be responsible to pay all and any tax, incidental cost not limited to any applicable taxes, and all other personal expenses and/or any other charges relating to the collection of the Gift and/or Campaign The Bank shall not be held liable for any tax, incidental cost, charges and/or damages caused by the Gift and non-fulfilment by any of its agents / distributors The Bank shall not be liable nor shall it accept any form of liability of whatsoever nature and howsoever arising or suffered by the Successful Eligible Customer (including negligence) with respect to death, injury, any losses, damages or accidents arising from the use of the Gift by the Successful Eligible Customer The Bank expressly excludes and disclaims any representations, warranties or endorsements, expressed or implied, written or oral with respect to the quality or suitability of 4 AmBank Savers GANG_ Terms and Conditions

5 the Gift. The Bank will also bear no responsibility for resolving disputes with the manufacturer or supplier of the Gift and the Eligible Customer are to deal directly with the manufacturer or supplier for all warranty information Until and including the day the Gift(s) is given out to the Successful Eligible Customer, the Savers GANG Account must remain active and valid to the satisfaction of the Bank, failing which the Eligible Customer shall be deemed to have forfeited the Gift(s) and the Bank shall retract the said Gift(s) The Bank shall not be responsible to replace any damaged or stolen Gift. The Gift cannot be exchangeable for cash or other kinds and is subject to the Terms and Conditions stated herein The Bank shall not be responsible to replace any Gift damaged or stolen after it is collected by the Eligible Customer The Bank reserves the right to disqualify or retract the Gift awarded to the Successful Eligible Customer if such person has committed fraudulent or wrongful acts in relation to their account. 7. B) Fixed Deposit Promotional Rate 7.1 FD promotional rate is open to Bank s new and existing Retail Individual customers who have joint FD account with their children that have Savers GANG Account ( Eligible Customer for FD Promo Rate ). 7.2 To enjoy the promotional rate specified in the table below, an Eligible Customer for FD Promo Rate is required:- a) To make a minimum lump sum Fresh Funds placement of RM10,000 (Ringgit Malaysia Ten Thousand) during the Campaign Period: Tenure Promotional Rates (p.a.) 7 months 4.20%p.a. 7.3 Interest earned will be credited to the Eligible Customer s designated conventional current account or savings account (CASA) maintained with the Bank. 7.4 Any deposit placements made by way of cheque(s) are subject to their clearance and will only be considered as deposit placements by the Eligible Customers after the cheque(s) are paid or cleared. 7.5 Any early withdrawal for placement of three (3) months and below will not be entitled for any interest. For placement of four (4) months and above, no interest whatsoever will be paid if the Eligible Customer makes an early withdrawal before completion of three (3) months from the date of placement. If the Eligible Customer makes an early withdrawal after completion of three (3) months from the date of placement, the interest payable will be half (50%) of the Bank s contracted rate based on completed months. For FD Account, this Terms and Conditions are to be read together with the General Terms and Conditions of Accounts and Services available at 5 AmBank Savers GANG_ Terms and Conditions

6 7.6 The Promotional Rate stated above is applicable for one (1) cycle only. Upon maturity of the FD Account(s) after the Campaign Period, the Bank s prevailing board rates for FD Account(s) shall apply to any rollovers and/or renewal. 7.7 FD Promotional Rate is available for placement made over the counter only at any Bank branches in Malaysia. 8. General 8.1 The Bank shall have the right to use, publish or display in any form as it deems necessary and appropriate the selected Eligible Customer details (including but not limited to) the name(s), picture(s), and city of residence(s) of the selected Eligible Customer for advertising and publicity purposes (if any). By participating in this Campaign, the selected winner hereby expressly consents to and agrees for the Bank to exercise the aforesaid rights. The Eligible Customer shall have the discretion to access and update their personal details by notifying the Bank in writing throughout the Campaign Period. 8.2 The Bank s decision on all matters and/or disputes relating to this Campaign shall be final, binding on all Eligible Customer, no correspondence or appeal will not be entertained. 8.3 All transactions recorded by the Bank are final and conclusive. 8.4 The Bank shall have the absolute right to cancel, terminate or suspend this Campaign at any time without assigning any reason with Prior Notice via the Bank s official website or at its branches. 8.5 The Bank shall have the right and absolute discretion to vary, amend, delete or add to any of the Terms and Conditions specifically set out herein, in whole or in any part from time to time including to vary the Campaign s tenure as it deems necessary and appropriate with Prior Notice via the Bank s official website, at or at the Bank s branches. Unless stated otherwise in this Terms and Conditions, any notice given by the Bank shall be deemed given when so posted at its official website or its branches, whichever is earlier. 8.6 The Bank shall have the right to alter, remove, substitute, add or cancel any of the Campaign Gifts at any time without assigning any reason with Prior Notice via the Bank s official website or at its branches. 8.7 The Bank shall have the right and absolute discretion to disqualify any Eligible Customer that it finds or determines to have tampered or be tampering with the entry process and/ or the operation of the Campaign, to be acting in breach or potential breach of the Terms and Conditions herein. 8.8 This Terms and Conditions shall prevail over any other provisions and/or representations contained in any other promotional materials advertising this Campaign. 8.9 By participating in this Campaign, Eligible Customers and/or any parties related herein agree to be bound by this Terms and Conditions Under no circumstances will the Bank be held liable for any loss or damages, including without limitation to loss of income, profits, goodwill, direct or indirect, incidental, 6 AmBank Savers GANG_ Terms and Conditions

7 consequential, exemplary, punitive or special damages of any party including third parties, howsoever arising whether in contract, tort, negligence or otherwise, in connection with participation in this Campaign, or any of the Campaign Gifts, or the Bank having exercised its rights and entitlement under this Terms and Conditions, including but not limited to pursuant to clauses 3, 4, 5, 6, 7 and 8. Even if the Bank has been advised of the possibility of such damages in advance, all such damages are expressly excluded The Bank shall not be liable for any default in respect of the Campaign due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, technical or system failures or any event beyond the reasonable control of the Bank All Terms and Conditions stipulated herein shall be governed by and construed in accordance with the laws of Malaysia In the event of any discrepancies or conflict in the interpretation of this Terms and Conditions, the English and Bahasa Malaysia versions of each of this Terms and Conditions shall be construed as equivalent and each of the Terms and Conditions stipulated shall carry the same meaning All customers are required to log on to the Bank s corporate website for promotion updates at for the latest Terms & Conditions, if any. 7 AmBank Savers GANG_ Terms and Conditions
