1 1. The Contest 1.1. The CIMBxSOMPO Snap & Win Contest ( the Contest ) is organised by CIMB Bank Berhad (13491-P) ( CIMB Bank ) For the purpose of these Terms and Conditions, the following words and expressions shall have the meanings assigned to them except where the context otherwise requires:- CIMB Group means all the related corporations and associate corporations of CIMB Group Holdings Berhad whether incorporated inside or outside Malaysia, existing now or in the future and reference to CIMB Group in these Terms and Conditions herein shall include all or any entity within the CIMB Group. Eligible Insured Person means the Insured Person stated in the policy schedule of the General Insurance Products issued during the Contest Period, excluding their spouse(s) and children and who meet the Eligibility Criteria set out in Clause Words denoting person shall include living person and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and vice-versa. 2. Contest Period 2.1. The Contest shall commence from 6 September 2017 to 7 September 2017, both dates are inclusive ( Contest Period ). 3. Contest Eligibility 3.1. To be eligible to participate in the Contest, the following criteria must be met: Eligible Insured Person must first sign up any one (1) of the general insurance products below ( General Insurance Product(s) at any of the Participating CIMB Branch(es) or CIMB Auto Finance Centre (s) by completing and submitting the signed proposal form of the General Insurance Product(s) ( Sign-Up Requirement ):- 1. Eligible Insured Person has to submit one (1) photo of him/her which is captured with the props provided at the Participating CIMB Branch(es) or CIMB Auto Finance Centre (s) where the Eligible Insured Person signed up for the General Insurance Product(s) and hashtag with #CIMBxSOMPO, #achievemoreworryless and #generalinsurance via the Eligible Insured Person s Instagram during the Contest Period; the Eligible Insured Person has to set their Instagram account to public mode( Photo Requirement ) Eligible Insured Person must either be a Malaysian, permanent resident or employment pass / work permit holder, aged between 18 years old to 80 years old Eligible Insured Person must not be a permanent or temporary employee of CIMB Group. collectively referred to as the Eligibility Criteria. 2

3 4. Contest Mechanics 4.1. Eligible Insured Person who fulfills all the Eligibility Criteria as per Clause 3.1 of these terms and conditions shall earn an entry to the Contest to stand a chance to win the Contest Prize as stated in Clause 4.2 ( Qualified Entry(ies) ). For avoidance of doubt, regardless of how many photo posted by the Eligible Insured Person in the manner as stated in Clause above, the Eligible Insured Person will only earn one (1) Qualified Entry(ies) for every one fulfillment of the Eligibility Criteria The Contest Prize is as stated in the table below. Contest Prize Quantity Criteria RM288 Parkson 3 Subject to the fulfilment of the Eligibility Criteria, the shopping voucher Eligible Insured Person shall earn one (1) Qualified Entry(ies) to stand a chance to win the Contest Prize The procedures for the selection of the Contest Prize winners are as follows: All photos posted by the Eligible Insured Persons in the manner as stated in Clause above will be shortlisted by CIMB Bank based on creativity, and originality at CIMB Bank s sole and absolute discretion Each Eligible Insured Person is entitled to win one (1) Contest Prize only in the Contest The shortlisted Eligible Insured Person of the Contest will receive a message via Instagram from CIMB Bank within fourteen (14) calendar days after the end of the Contest to request for their name, identity card number, full correspondence address and mobile phone number to be contacted officially by CIMB Bank for the purpose of selecting the winner of the Contest in accordance with these terms and conditions and/or delivery of the Contest Prize. If the shortlisted Eligible Insured Person does not respond to CIMB Bank to provide more information as per the Clause within seven (7) calendar days from the date of the message, the Contest Prize will be forfeited by CIMB Bank and the next shortlisted Eligible Insured Person will be contacted by the representatives of CIMB Bank via Instagram to request the information as per Clause The process will be repeated until the three (3) Contest winners have been successfully identified. Subject to the Approval Requirement as per Clause of these terms and conditions, the shortlisted Eligible Insured Person will then be contacted via telephone by the representatives of CIMB Bank by referring to the shortlisted Eligible Insured Person s mobile phone number provided in response to CIMB Bank s message via Instagram as stated in Clause The Contest winner will then have to liaise with CIMB Bank s appointed service provider as CIMB Bank may think fit which will be notified to the winner by way of telephone call The first three (3) shortlisted Eligible Insured Person who answered two (2) questions correctly shall be declared as the winner of the Contest and shall win the Contest Prize If the first shortlisted Eligible Insured Person is unable to answer all the two (2) questions or where the answer given is incorrect, the shortlisted Eligible Insured Person will be regarded as unsuccessful to win the Contest Prize, and the second shortlisted Eligible Insured Person will be selected from the pool of the 3

4 shortlisted Eligible Insured Person who will be contacted by the representatives of CIMB Bank and shall be required to answer the two (2) questions correctly. The process will be repeated until the three (3) Contest winners are successfully identified If the shortlisted Eligible Insured Person is not contactable by telephone on the first attempt for the reasons including, but not limited to the following circumstances:- 1. No reply; 2. Not interested to participate; 3. Ended the call during the conversation; 4. Number is not in use; 5. No connection; 6. Voice mailbox reached. Another two (2) attempts shall be made within the next two (2) hours of the first attempt to contact the shortlisted Eligible Insured Person. Where the third attempt is also unsuccessful for whatsoever reasons, CIMB Bank reserves the right to disqualify the first shortlisted Insured Person and proceed to contact the next shortlisted Eligible Insured Person to identify the Contest winner. CIMB Bank shall not be liable or be held responsible in any manner whatsoever in the event any shortlisted Eligible Insured Person cannot be contacted for whatsoever reasons For the avoidance of any doubt, CIMB Bank shall not be liable for any telecommunication charges, roaming or phone charges which is to be borne by the shortlisted Eligible Insured Person, whether within or outside Malaysia CIMB Bank has the sole and absolute discretion to determine the appointed date and time to contact the shortlisted Eligible Insured Person The shortlisting in relation to the Photo Requirement as per Clause of these terms and conditions and all question and answer sessions will be judged and decided by a panel of judges selected by CIMB Bank and the decision of the panel of judges shall be final and binding It shall be the shortlisted Eligible Insured Person s responsibility to ensure the provided phone numbers are current and updated. CIMB Bank shall not be responsible to the shortlisted Eligible Insured Person for any loss (including loss of opportunity and consequential loss flowing there from) suffered in the event the shortlisted Eligible Insured Person s telephone number in the record is not current or correct. 5. Contest Prize Redemption 5.1. The Contest Prize will be couriered to the Contest winners address provided in the manner as per Clause within two (2) months after being successfully contacted by CIMB Bank and who had answered the two (2) questions correctly in the manner as stated under Clause and Provided Always the General Insurance Product(s) signed up by the Eligible Insured Person is not cancelled for any reason whatsoever The Contest Prize under this Contest is not exchangeable for cash, credit or any such other kind, whether in part or in full, and it is not refundable, not replaceable and not transferable for cash or credit under any circumstances Notwithstanding anything contained herein CIMB Bank reserves the right to substitute the 4

5 Contest Prize with another prize of equivalent cost at any time at its absolute discretion with prior notice of at least fourteen (14) calendar days to the Contest winner for any reason whatsoever Where applicable, the Contest Prize shall be subject to the terms and conditions of the supplier, provider, merchant, distributor and/or agent of the relevant Contest Prize, of which terms and conditions are separate from CIMB Bank s terms and conditions governing this Contest The Bank shall not be liable nor shall it accept any form of liability of whatsoever nature and howsoever arising or suffered by the Contest winner (including negligence) with respect to the death, injury, any losses, damages or accidents arising from the use of the Contest Prize by the Contest winner unless the same is due to the gross negligence or willful default of CIMB Bank To the fullest extent permitted by the law, CIMB Bank expressly exclude and disclaim any representations, warranties or endorsements, express or implied, written or oral, in respect of the Contest Prize unless the same is due to the gross negligence or willful default of CIMB Bank. All risks, losses, damages and/or injuries associated with the use of the Contest Prize shall be assumed by the Eligible Insured Person CIMB Bank will not entertain any complaint whatsoever in connection with the Contest Prize. Contest Prize has not been certified by CIMB Bank and under no circumstances shall the inclusion of any Contest Prize in this Contest be construed as an endorsement or recommendation of the Contest Prize by CIMB Bank. If any Eligible Insured Person is dissatisfied with any of the Contest Prize by CIMB Bank, such Eligible Insured Person shall seek recourse with the relevant merchant/provider directly. 6. General Terms and Conditions CIMB Bank is merely a distributor of General Insurance Product(s) which is underwritten and managed by the Berjaya Sompo Insurance Berhad (62605-U) and CIMB Bank shall not be responsible for or be held liable in any way in respect of any matters or claims arising from General Insurance Product(s). The terms and conditions herein shall prevail over any provisions or representations contained in any other promotional materials relating to the Contest. Berjaya Sompo Insurance Berhad being the licensed insurer and manager of General Insurance Products shall undertake the obligations as the Insurer. General Insurance Product(s) is not CIMB Bank s product and therefore there are no obligations nor guarantee by CIMB Bank on the General Insurance Product(s). The Eligible Insured Person is required to sign all relevant standard documents and comply with all terms and conditions in respect of his/her General Insurance Product(s) under the Contest, which are separate from these terms and conditions. By participating in this Contest, the Eligible Insured Person is deemed to have read, understood and agreed to be bound by the Terms and Conditions stated herein and agree that any and all decisions made by CIMB Bank in relation to every aspect of the Contest including but not limited to the eligibility to participate in the Contest shall be final, binding and conclusive provided always that the decision made is fair and reasonable. CIMB Bank reserves it absolute rights and discretion to disqualify and/or reject any Eligible Insured Person that it determines or reasonably suspects to be tampering with the process or the operation of this Campaign, or to be acting in breach of the terms and conditions herein. The Eligible Insured Person agrees and authorises CIMB Bank to disclose his/her details (including but not limited to photos, name, telephone number and address) to the 5

6 distributor/agent who would then contact the Eligible Insured Person regarding the delivery or redemption of the Contest Prize and for promotional purpose as CIMB Bank deems fit. The Contest winners are responsible to make the necessary arrangement with CIMB Bank and/or /distributor/agent to collect or redeem their Contest Prize(s). CIMB Bank will not bear any accommodation and/or transportation and/or other cost that the Contest winners may incur or have to incur in the course of redeeming or using the Contest Prize CIMB Bank shall not be liable to any Eligible Insured Person or any party for any loss or damage of whatsoever nature suffered by the Eligible Insured Person or any party (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in the Contest CIMB Bank reserves the right to cancel, terminate or suspend the Contest upon giving prior notice of not less than fourteen (14) calendar days. For the avoidance of doubt, any cancellation, termination or suspension by CIMB Bank of the Contest, the Eligible Insured Person or any other persons shall not be entitled to any claim or compensation against CIMB Bank for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension CIMB Bank reserves the right upon giving prior notice of not less than twenty-one(21) calendar days to vary, whether by addition, deletion, modification, amendment or otherwise howsoever ( Amendment ) any of the Terms and Conditions herein. Notification to the Eligible Insured Person in respect of the Amendment shall be effected at the CIMB Bank s absolute discretion through any one of the following means of communication, namely:- 1. By ordinary mail to the Eligible Insured Person s last known address; or 2. Via CIMB Bank s website; or 3. By any other means of notice as deemed fit by CIMB Bank. The Amendment shall be deemed as binding on the Eligible Insured Person as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the notification. Eligible Insured Person acknowledges and agrees to access CIMB Bank s website at regular intervals to view the Terms and Conditions and to ensure that they are kept up-to date with any changes or variations to these Terms and Conditions These Terms and Conditions, as the same may be amended from time to time pursuant to Clause 6.7, shall prevail over any provisions or representations contained in any other promotional material advertising the Contest CIMB Bank shall not be liable for any default in respect of the Contest due to any act of war, riot, strike, lockout, industrial action, fire, flood, draught, storm, technical or system failures or any event beyond the reasonable control of CIMB Bank All Terms and Conditions stipulated herein shall be governed by and constructed in accordance with the laws of Malaysia If there is any inconsistency, conflict, ambiguity or discrepancy between the English and Bahasa Malaysia version or other language version of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned where request is made by the Eligible Insured Person and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the Eligible Insured Person s General Insurance Product(s), then the Bahasa Malaysia version of these terms and conditions shall prevail. 6

7 6.12.
