1 Terms and Conditions CIMB F.I.R.S.T. Rewards Campaign 1. The Campaign 1.1 The CIMB F.I.R.S.T. Campaign ( Campaign ) organized by CIMB Bank Berhad [13491-P] ( CIMB Bank ) shall commence on 16 th October 2017 and end on 15 th January 2018, both dates inclusive ( Campaign Period ). 1.2 CIMB Bank reserves the right upon giving prior notice of fourteen (14) days to change the duration and/or the commencement and/or expiry dates of the Campaign Period. 2. Eligibility 2.1 This Campaign is open to all: (a) CIMB Bank s and CIMB Islamic Bank s existing customers in CIMB Bank s or CIMB Islamic Bank Berhad s [ H] ( CIMB Islamic Bank) records; and (b) CIMB Bank s or CIMB Islamic Bank s new customers who signed up for the Eligible Product(s) (as defined in Clause 4.2) via CIMB Bank or CIMB Islamic Bank branches or CIMB Mobile Sales Force sales personnel during the Campaign Period; (c) All CIMB Bank and CIMB Islamic Bank staffs (including its subsidiaries and related companies) are eligible to participate in this campaign. who are individuals residing in Malaysia, including Malaysian citizens, permanent residents or non-malaysian citizens, of 18 years and above ( Eligible Customer(s) ). 3. Cash Rewards 3.1 Subject always to Clause 5.1, Cash Rewards will be awarded to Eligible Customer(s) who meet the Participation Criteria as defined in Clause 4.1 of these terms and conditions during the Campaign Period. 4. Campaign Mechanics 4.1 To participate in the Campaign and subject always to Clause 5.1, the Eligible Customer(s) must: (a) have a CIMB Bank or CIMB Islamic Bank Current Account or Saving Account ( CASA ) (opened prior to the Campaign Period or during the Campaign Period) ( Account Criteria ); (b) sign up for the Eligible Product(s) (as defined in Clause 4.2) via CIMB Bank or CIMB Islamic Bank branches or CIMB Mobile Sales Force sales personnel ( Product Criteria ); and (c) meet all the criteria applicable to the respective Eligible Product(s) as set out below from clause to clause ( Sign-Up Criteria ): - The Account Criteria, Product Criteria and Sign-Up Criteria are collectively referred to as the Participation Criteria Finance Property Financing a) Apply for any CIMB Bank home loan / CIMB Islamic Bank financing or CIMB Bank business premises loan/ CIMB Islamic Bank financing (Under-Construction Property/Completed Property/Refinancing/Home Extra) as set out in Clause 4.2 under individual name(s) during the Campaign Period. 1

2 b) Acceptance of the Letter of Offer and execution of all CIMB Bank loan/ CIMB Islamic Bank financing security documents by the Eligible Customer(s) must be completed before/on 15 th February c) Only primary borrower/customer will be considered as Eligible Customer(s) for the purpose of this Campaign. ASB Financing / Term Financing-i ASB / Personal Loan/Financing / Hire Purchase Loan/Financing a) Apply for CIMB Bank ASB Financing / CIMB Islamic Bank Term Financing-i ASB / personal loan/financing / hire purchase loan/financing as set out in Clause 4.2 during the Campaign Period. Loan(s)/Financing(s) applied must be approved and disbursed before/on 15 th February b) Only primary borrower/customer will be considered as Eligible Customer(s) for the purpose of this Campaign Insure Sign up for any Bancassurance/ BancaTakaful underwritten/managed by Sun Life Malaysia Assurance Berhad/Sun Life Malaysia Takaful Berhad ("Sun Life Malaysia") products under the category of Insure as set out in Clause 4.2 that are distributed by CIMB Bank during the Campaign Period. Subject to Clause 5.1, if any Eligible Customer(s) surrenders the Bancassurance/BancaTakaful product(s) within the free-look period or cancels the Bancassurance/BancaTakaful product(s) purchased during the Campaign Period or if the policy of the Bancassurance/BancaTakaful Product(s) is not issued before/on 15 th February 2018 due to the fault on the part of the Eligible Customer(s), the Eligible Customer(s) Bancassurance/BancaTakaful product(s) sign up will not be entitled to the Cash Reward(s) under this Campaign. The freelook period is defined as a period where the policy owner is given a free-look period of 15 days to review the suitability of the newly purchased Bancassurance/BancaTakaful Product(s). If the policy is surrendered within this free-look period, the full premium minus the medical examination expenses incurred, if any, will be refunded to the policy owner. Only policy/certificate owner of the Bancassurance/BancaTakaful products(s) under the category of Insure as set out in Clause 4.2 will be considered as Eligible Customer(s) for the purpose of this Campaign Returns Invest in any investment products under the category of "Returns" of the Eligible Product(s) as set out in Clause 4.2 (excluding Share Trading, Wills & Wasiat) subject to the minimum investment amount for different investment products during the Campaign Period. Only primary investment account holder will be considered as Eligible Customer(s) for the purpose of this Campaign Save Sign up and open any CIMB Bank or CIMB Islamic Bank CASA as set out in Clause 4.2 during the Campaign Period. Only primary account holder will be considered as Eligible Customer(s) for the purpose of this Campaign. 2

3 4.1.5 Transact Apply any principal CIMB Credit Cards / Prepaid Cards under the category of "Transact" in Clause 4.2 which must be approved within the Campaign Period and activated on or before 15th February CIMB Debit Card is not applicable for this campaign. For the avoidance of doubt, CIMB Bank, CIMB Islamic Bank, CIMB Investment Bank, the unit trust management company or the Insurer of the relevant Eligible Product(s)has sole and absolute discretion to determine if the supporting documents are sufficient for the purpose of processing the Eligible Product(s) applications submitted to CIMB Bank, CIMB Islamic Bank, CIMB Investment Bank, the unit trust management company or Sun Life Malaysia. 4.4 The Eligible Customer(s) is required to sign all relevant standard documents and comply with all terms and conditions in respect of his/her Eligible Product(s) under the Campaign which are separate of these terms and conditions. 5. Cash rewards and fulfilment 5.1 Eligible Customer(s) will be entitled to the following cash reward(s) ( Cash Reward(s) ) if the Eligible Customer(s) sign up for a minimum of two (2) Eligible Product(s), each from different product categories and meet the Participation Criteria as defined in Clause 4.1 of these terms and conditions: - Number of Eligible Product(s) Sign Up from different product categories Sign-up of any 2 Eligible Product(s) from different categories Sign-up of any 3 Eligible Product(s) from different categories Sign-up of any 4 Eligible Product(s) from different categories Sign-up of any 5 Eligible Product(s) from different categories Cash Reward(s) RM 50 RM 100 RM 150 RM 200 For clarity, the following are the different product categories of the Eligible Product(s) for the purpose of this Campaign as set out in Clause 4.2 of these terms and conditions: (1) Finance (2) Insure (3) Returns (4) Save (5) Transact. 5

6 5.2 Please refer the examples of different scenarios but not limited to the following on the basis that the Eligible Customer(s) meet the Participation Criteria in Clause 4.1: Eligible Customer(s) A signed up for a CIMB Bank or CIMB Islamic Bank Savings Account & Current Account during the Campaign Period, he/she is not eligible to receive Cash Reward(s) as both Eligible Product(s) fall under the same category Eligible Customer(s) B signed up for CIMB Bank or CIMB Islamic Bank CASA & successfully applied for a CIMB Bank or CIMB Islamic Bank Credit Card and got it approved during the Campaign Period and activated before/on 15 February 2018, he/she is eligible to receive RM50 Cash Reward(s) as both Eligible Product(s) do not fall under the same category and Sign-Up Criteria is fulfilled Eligible Customer(s) C signed up for CIMB Bank or CIMB Islamic Bank CASA, made an investment in CIMB Bank or CIMB Islamic Bank Unit Trust and successfully applied for a CIMB Credit Card and got it approved during the Campaign Period but does not activate it before/on 15 February 2018, he/she is eligible to receive RM50 Cash Reward(s) instead of RM100 as the Eligible Customer(s) does not fulfil the Sign-Up Criteria for the credit card Eligible Customer(s) D signed up for CIMB Bank or CIMB Islamic Bank CASA, made an investment into CIMB Bank or CIMB Islamic Bank Unit Trust, purchased a Bancassurance/BancaTakaful product and applied for a CIMB Bank or CIMB Islamic Bank Credit Card and got it approved during the Campaign Period & activated it before/on 15 February 2018, the Eligible Customer(s) will receive RM150 Cash Reward(s) Eligible Customer(s) E have a CIMB Bank or CIMB Islamic Bank CASA with CIMB Bank or CIMB Islamic Bank prior the Campaign, successfully applied CIMB Bank or CIMB Islamic Bank Credit Card and got it approved during the Campaign Period and activated it before/on 15 February 2018, the Eligible Customer(s) is not eligible for Cash Reward(s) as he/she only signed up for one (1) Eligible Product(s) during the Campaign Period Eligible Customer(s) F have a CIMB Bank or CIMB Islamic Bank Credit Card prior the Campaign, signed up for a CIMB Bank or CIMB Islamic Bank CASA during the Campaign Period and made an investment into PRS, Eligible Customer(s) is eligible for RM50 Cash Reward(s) as the Eligible Customer(s) signed up for two (2) Eligible Product(s) and both Eligible Product(s) do not fall under the same category Eligible Customer(s) G have a CIMB Bank or CIMB Islamic Bank CASA with CIMB prior the Campaign, signed up for a CIMB Bank or CIMB Islamic Bank CASA during the Campaign Period and personal loan/financing applied during the Campaign Period which is approved and accepted by 15 th February 2018 is eligible for Cash Reward(s) of RM50 as the Eligible Customer(s) signed up for two (2) new Eligible Product(s) under different product category 5.3 The Cash Reward(s) will be credited into Eligible Customer(s) s active CIMB Bank or CIMB Islamic Bank CASA whether opened prior to or during the Campaign Period, two (2) months after the Campaign has ended. All Eligible Product(s) signed up during the Campaign Period must not be terminated / closed when the Cash Reward(s) is credited. 6. Other Terms and Conditions 6.1 By participating in the Campaign, Eligible Customer(s) are deemed to have read, understood and agreed to be bound by the terms and conditions stated herein and 6

7 agree that any and all decisions made by CIMB Bank in relation to every aspect of the Campaign shall be final, binding and conclusive. 6.2 CIMB Bank shall not be liable to any Eligible Customer(s) or any party for any loss or damage of whatsoever nature suffered by the Eligible Customer(s) or any party (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in the Campaign unless the same is caused directly by the CIMB Bank s wilful default or gross neglect. 6.3 CIMB Bank reserves the right to cancel, terminate or suspend the Campaign upon giving notice of not less than fourteen (14) calendar days. For the avoidance of doubt, cancellation, termination or suspension by CIMB Bank of the Campaign shall not entitle the Eligible Customer(s) or any other persons whatsoever to any claim or compensation against the CIMB Bank for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension unless the same is caused directly by the CIMB Bank s wilful default or gross neglect. 6.4 CIMB Bank reserves the right upon giving notice of not less than twenty-one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( the Amendment ) any of the terms and conditions herein. Notification to the Eligible Customer(s) in respect of the Amendment shall be effected at CIMB Bank s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Customer(s) last known address or by posting a notice regarding the Amendment at each of the CIMB Bank s branches where detail provisions regarding the Amendment may be provided in the notice itself or may be provided to the Eligible Customer(s) upon request or by effecting an advertisement regarding the Amendment in one newspaper of CIMB Bank s choice, or via CIMB Bank s website or via electronic mail or by any other means of notice which CIMB Bank may select and the Amendment shall be deemed as binding on the Eligible Customer(s) as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the notification. Eligible Customer(s) acknowledge and agree to access CIMB Bank s website at regular intervals to view the terms and conditions of the Campaign and to ensure that they are kept up-to date with any changes or variations to these terms and conditions. 6.5 By participating in the Campaign, the Eligible Customer(s) agree that CIMB Bank shall not in any manner whatsoever be liable or held responsible to the Eligible Customer(s) if CIMB Bank is unable to perform in whole or in part of any of its obligations herein, attributable directly or indirectly to the failure of any mechanical or electronic device, data processing system, transmission line, electrical failure, industrial dispute, war, strike, riot, any act of God beyond CIMB Bank's control or due to any factor in a nature of a force majeure which is beyond CIMB Bank s reasonable control. 6.6 These Terms and Conditions of the Campaign, as the same may be amended from time to time in accordance to Clause 6.4, shall prevail over any provisions or representations contained in any other promotional/advertising material in relation to the Campaign. 6.7 The Terms and Conditions herein shall be read in conjunction with the prevailing terms and conditions governing the relevant Eligible Product(s) of CIMB Bank and/or CIMB Islamic Bank. 7

8 6.8 If there is any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the Bahasa Malaysia and English version or other language version of these Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request is made by the Eligible Customer(s) and noted and acknowledged by CIMB Bank or CIMB Islamic Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the relevant Eligible Product(s) of CIMB Bank, then the Bahasa Malaysia version of these Terms and Conditions shall prevail. 6.9 The Eligible Customer (s) credit card account(s) and/or deposit account (i) MUST not be in breach of the terms and conditions governing the said account(s) AND (ii) MUST not be terminated or closed or be made subject to any attachment, adverse orders made by the Court or any authorities sanctioned by laws, delinquent, and/ or be invalid or cancelled as determined by CIMB Bank and/or CIMB Islamic Bank, otherwise the Eligible Customer(s) will be disqualified from participating in this Campaign CIMB Bank does not warrant that this Campaign shall not be uninterrupted and/or error free. By participating in this Campaign, the Eligible Customer(s) hereby acknowledges and irrevocably agrees that CIMB Bank shall not in any manner whatsoever be liable for any technical failures of any kind, whatsoever intervention, interruption and/or any electronic error arising from this Campaign unless the same arise from and are caused directly by CIMB Bank s gross negligence or wilful default CIMB Bank is merely a distributor of the Eligible Product(s) under the category of Insure underwritten by Sun Life Malaysia Assurance Berhad ( U), an insurer registered with Bank Negara Malaysia under the Financial Services Act 2013 and; managed by Sun Life Malaysia Takaful Berhad ( M), a takaful operator registered with Bank Negara Malaysia under Islamic Financial Services Act 2013; as set out in clause 4.2 and shall not be responsible or be held liable in any way whatsoever in respect of any matter or claims arising from the Eligible Product(s) under the category of Insure provided by Sun Life Malaysia Assurance Berhad and Sun Life Malaysia Takaful Berhad. Sun Life Malaysia Assurance Berhad and Sun Life Malaysia Takaful Berhad being the licensed insurer and underwriter / manager of the Eligible Product(s) under the category of Insure shall fully undertake the insurance/takaful obligations. The Eligible Product(s) under the category of Insure are not CIMB Bank s products and therefore not an obligation of / not guaranteed by CIMB Bank and/or and of its subsidiaries and affiliates CIMB Bank accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected application of the Eligible Product(s) or related correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise unless the same arise from and are caused directly by CIMB Bank s gross negligence or willful default By acceptance or receipt of the Cash Reward(s), Eligible Customer(s) who received the Cash Reward(s) agrees to hold CIMB Bank and its affiliates and their respective directors, officers, employees and agents harmless from any claim, action, proceeding, judgment, damage, loss, expense or liability suffered by CIMB Bank and its affiliates and their respective directors, officers, employees and agents in connection with the Eligible 8

9 Customer(s) participation in the Campaign or receipt or use of the Cash Reward(s) unless the same is due to CIMB Bank s gross negligence or willful default Any query, feedback, concern, issue or complaint by the Eligible Customer(s) pertaining to the Eligible Product(s) under CIMB Islamic Bank shall be directed to CIMB Islamic Bank and CIMB Bank accepts no responsibility for any matter relating to the Eligible Product(s) under CIMB Islamic Bank The investments in the Eligible Product(s) under Returns category are not obligation of, guaranteed or insured by CIMB Bank and CIMB Islamic Bank and are subjected to investment risks, including the possible loss of the principal amount invested. Eligible Customer(s) are advised to read the terms and conditions of the Eligible Products (s) under Returns category before investing. Eligible Customer(s) should also consider all fees and charges involved before investing. Past performance of the Eligible Product(s) under Returns category is not an indication of future performance and income distributions are not guaranteed. Eligible Customer(s) should rely on their own evaluation to assess the merits and risks of any investment. Eligible Customer(s) who are in doubt as to the action to be taken should consult their professional advisers immediately. The Eligible Product(s) under Returns category are not insured by Perbadanan Insurans Deposit Malaysia (PIDM) The Eligible Customer(s) is not covered by the compensation fund under Section 158 of the Capital Markets and Services Act 2007 (CMSA). The compensation fund does not extend to the Eligible Customer(s) who has suffered monetary loss as a result of a defalcation or fraudulent misuse of moneys or other property, by a director, officer, employee or representative of CIMB Bank and CIMB Islamic Bank. Where the Eligible Customer(s) suffers monetary loss in the above circumstances related to the acts of the Bank s employees, the Eligible Customer may lodge a complaint with the CIMB Bank s Customer Resolution Unit (CRU) as set out in clause 6.17 of these Terms and Conditions. The Eligible Customer(s) who is not satisfied with the Bank s CRU's decision may refer the case to the Securities Industry Dispute Resolution Centre ( SIDREC ) and/or the Federation of Investment Managers Malaysia s Complaints Bureau ( FIMM ) and/or the Ombudsman for Financial Services within 6 months of receiving a final decision from the Bank or after 60 calendar days from the date the complaint was filed with the Bank for which no reply was received by the Eligible Customer(s).
