1 Terms and Conditions CIMB FIESTA 2016 ( Event ) The Event Period 1. The CIMB FIESTA 2016 ( Event ) is organised by CIMB Bank Berhad (13491-P) (referred to as CIMB ) and held in conjunction with CIMB FIESTA 2016 by CIMB Islamic Bank Berhad ( H). The Event shall be held from 14 October 2016 to 16 October 2016, both dates inclusive from 10am to 9.30pm ( Event Period ) hosted at Mid Valley Exhibition Centre, Kuala Lumpur. 2. CIMB reserves the right upon giving prior notice of fourteen (14) calendar days to change the duration and/or commencement and/or expiry date of the Event Period. Eligibility 3. This Event is open to all CIMB credit cardmembers, debit cardmembers and Kwik accountholders issued with physical card under the Kwik account (collectively herein referred to as cardmember(s) ) and all transaction payments during the Event must be made with CIMB credit, debit or Kwik card. Cash payment will not be accepted. Promotions 4. During the Event, six exclusive promotions will also be offered namely Super Deals, Early Bird Deals, Happy Hour Sales, RM1 Deals, Redemption Offer and RM50 Cash Vouchers ( Promotions ). 5. The Promotions are extended by selected participating merchants 6. Super Deals: Limited number of selected participating merchants items at up to 70% discount on a while stock last basis. 7. Early Bird Deals: (i) Goodie Bags 1,000 goodie bags to be given away to cardmembers daily from 10am onwards. The first 300 cardmembers will get a goodie bag each containing either a kettle/ iron/ backpack/ massager and vouchers. The subsequent 700 cardmembers will get a goodie bag each containing vouchers only. (ii) Early Bird Items Purchase of product by participating merchants at special price stated on the Direct Mailer. There will be selected products offered daily. 8. Happy Hour Sales: There will be 4 sessions daily (12pm 1pm, 2pm 3pm, 5pm 6pm and 7pm 8pm) held at the FIESTA s stage. This promotion is extended with limited units at

2 special price on a first come first serve basis. Cardmembers will have to queue at the respective product s offer lane which cardmembers intend to purchase. 9. RM1 Deals (Price stated inclusive of 6% GST) The promotion is extended with limited units at RM1 on a while stock last basis and cardmembers can proceed to the respective participating merchants to purchase the selected products. (i) RM1 where second purchase is not required Cardmembers can purchase the selected items as stated in the Direct Mailer at RM1. RM1 Deals is limited to only one unit per cardmemberper day for each item. (ii) RM1 for the second purchase First purchase is required in order to purchase the second item at RM Redemption Offer: Cardmembers are entitle to redeem one cup of black coffee from San Francisco Coffee booth or one mini mango pudding dessert from Hui Lau Shan booth with minimum spend of RM500 in a single transaction slip. Redemption must be made within the same day and it is on a while stock last basis during the Event Period. CIMB reserves the right to replace the black coffee or mini mango pudding with another coffee or dessert of similar cost. 11. RM50 Cash Vouchers: Limited number of selected participating merchants cash vouchers. Cardmembers are allowed to purchase the RM50 cash voucher at RM50 or to redeem with their bonus points at conversion rate equivalent to RM50 = 12,500 Bonus Points. Cardmembers who redeem up to RM200 cash vouchers in a single day at the CIMB Voucher Booth are entitled to purchase one Petronas Gift Card worth RM50 at RM1 from the Petronas Booth on a while stock last basis during the Event Period. Each cardmember is only entitled to purchase one (1) Petronas Gift Card per day and the Petronas Gift Card worth RM50 is limited to 500 units per day. Each cardmember is only entitled to redeem or purchase a minimum of RM50 and maximum of RM1,000 worth of vouchers per day. Total vouchers available is capped at RM150,000 per day, while stocks last on first come, first served basis. Rewards 12. Rewards are referring to Guaranteed Gifts, Pay with Bonus Points where 250 Bonus Points = RM1, 5x Bonus Points & 2x Bonus Points, 10x Bonus Points for 0% Easy Pay, and Daily Grand Prize. Guaranteed Gifts (i) The Guaranteed Gifts is open to cardmembers who spend at least Ringgit Malaysia One Thousand and Five Hundred (RM1,500) only in a single day at any of the participating merchants during the Event Period ( qualified cardmember(s) ). (ii) Promotion is valid for single or accumulated card transaction slip(s) charged to a CIMB credit, debit or Kwik card on the same day. (iii) Redemption of the Guaranteed Gifts shall be held during the Event Period.

(v) Each qualified cardmember is only entitled to one (1) gift per day during the Event Period. (vi) The qualified cardmember may exchange the gift for another gift of lower value. (vii) Promotion is not applicable for CIMB bonus points redemption. (viii) Gift redemptions are on a while stocks last basis and CIMB reserves the right to replace the gift with another gift of similar cost. Pay with Bonus Points where 250 Bonus Points = RM1 (i) The conversion rate is 250 bonus points equal to Ringgit Malaysia One (RM1) only and the conversion rate may change from time to time by giving the cardmembers fourteen (14) calendar days prior notice. (ii) This reward is open to CIMB cardmembers who possess card with bonus points feature. This conversion rate is applicable during the Event Period only. 5x Bonus Points & 2x Cash Rebate (i) 5x Bonus Points and 2x Cash Rebate reward are open to CIMB credit cardmembers and debit cardmembers who utilize their card for any payment transaction with any of the participating merchants during the Event Period. (ii) 5x Bonus Points will be rewarded for credit and debit card with bonus point feature based on the purchase amount made in every single receipt from the participating merchants during the Event Period. Every Ringgit Malaysia spent with the credit or debit card would be rewarded with 5 Bonus Points. Bonus Points earned will be credited into the cardmember's credit or debit card account within 14 working days after the end of the Event. (iii) 2x Cash Rebate will be rewarded for usage of cash rebate credit card based on purchase amount made in every single receipt from the participating merchants during the Event Period. Every Ringgit Malaysia spent with the credit card would be rewarded with: 0.4% cash rebate for CIMB Cash Rebate Gold MasterCard, CIMB Cash Rebate Platinum MasterCard, CIMB Petronas Gold MasterCard and CIMB Petronas Platinum MasterCard. 1% cash rebate for CIMB Platinum Business Card, CIMB Visa Infinite and CIMB Visa Infinite by Invitation. The cash rebate earned will be credited into the cardmember's credit card account on the cardmember s next monthly statement date.

4 10x Bonus Points for 0% Easy Pay (i) The 10x Bonus Points for 0% Easy Pay is open to cardmembers who possess credit card with bonus points feature and spend with selected participating merchants in the CIMB FIESTA 2016 during the Event Period. Monthly repayment should be made by an installment basis under the 0% Easy PayPlan of CIMB (ii) Evidence of purchase in a single transaction under the 0% Easy Payment from any of the participating merchants during the Event Period shall be evidenced by the original card transaction slip. Upon verification of the original card transaction slip, the cardmember who has successfully signed up for the 0% Easy Payment Installment Plan shall be entitled to 10x Bonus Points. (iii) Every Ringgit Malaysia spent with credit card with bonus points feature would be rewarded with 10 Bonus Points. Bonus Points earned will be credited into the cardmember's credit card account within 14 working days after the end of the Event Period. Daily Grand Prize (i) This reward is open to cardmembers who spend at least Ringgit Malaysia One Thousand (RM1,000.00) only in a single day from any of the participating merchants during the Event Period ( qualified cardmembers ). The amount spent shall be evidenced by original card transaction slips. (ii) Qualified cardmembers are required to register at CIMB Customer Service Counter located at the Foyer by presenting the original card transaction slips and also CIMB card as evidence of amount spent during the Event Period. The amount spent may consist of combined spending charged on credit, debit or kwik card within the same day. One entry form will be given to the qualified cardmember for every Ringgit Malaysia One Thousand (RM1,000.00) only spent after due verification. Entry form must be filled in by the qualified cardmember and returned to the CIMB Customer Service Counter latest by 8pm within the same day of purchase. Example: A total spending of RM2,500 in a day or one single day will entitle the eligible participant for two (2) entries. (iii) Entry forms which have been duly filled in by qualified cardmembers will be collected by CIMB on a daily basis. Thereafter winner will be randomly selected from the entry forms collected within the same day by CIMB. During the Event, the selected qualified cardmember will be announced on stage on a daily basis i.e. on 14 October 2016, 15 October 2016 and 16 October 2016 at 9pm. Upon announcement, the selected qualified cardmember has to be present their mykad or passport or any relevant document for verification on stage and will be required to answer correctly one (1) pre-determined question selected by CIMB, failing which his or her entitlement to win the Prize will be forfeited and the next selected qualified cardmember will be announced. This process will be repeated until a selected qualified cardmember is able to answer the pre-determined question successfully on stage daily during the Event and announced as the winner of the Prize. For the avoidance of doubt, there is only one (1) Prize to be won each day during the Event Period. (iv) CIMB reserves the right to replace the prize with any other prize of similar cost. By participating in the Event, cardmembers shall be deemed to have read, understood and agreed to be bound by the terms and conditions stated herein and agree that CIMB s decision on all matters relating to the Event, including the determination of qualified cardmembers entitlement to participate in the Event and the entitlement to the Bonus Points, Cash rebate, gift(s), and the Prize are final, binding and conclusive provided always the decision must appear to be fair and reasonable. 2. The Event and the Event Period are subject to change at any time and from time to time by CIMB and CIMB reserves the right to suspend, cancel, terminate or withdraw the Event in whole or part, by giving the cardmembers fourteen (14) calendar days prior notice. For the avoidance of doubt, suspension, cancellation, termination or withdrawal of the Event shall not entitle any of the cardmembers to any claim or compensation against CIMB for any losses or damages suffered by the cardmembers as a direct or indirect result of the act of suspension, cancellation or termination. 3. CIMB reserves the rights upon giving twenty one (21) calendar days prior notice to vary (whether by addition, deletion, modification, amendment, or otherwise howsoever) ( Amendment ) any of the terms and conditions herein. Any Amendment to the provisions herein shall be binding on the cardmembers and CIMB is deemed to have notified cardmembers of the Amendment by: (i) its display at CIMB premises and website regarding the Amendment where detailed provisions regarding the Amendment may be provided in the notice itself or may be provided to the cardmembers upon request; or (ii) by a notice being sent by CIMB to the cardmember s last known address; or (iii) advertised in one newspaper of CIMB choice; or (iv) via electronic mail or by any other means of notification which CIMB may select and the Amendment shall be deemed binding on the cardmember as from the date of notification of the Amendment or from such other date as may be specified by CIMB in the notification. 4. All redemptions and purchase with bonus points can only be done by the principal credit cardmembers. 5. On the spot bonus point transfer request will not be available during the Event Period and all CIMB Preferred Customers, Prime Banking Customers, CIMB@Work Customers and Debit Cardmembers are required to transfer their bonus points to designated credit card account prior to the Event. The transfer of bonus points to their credit card account will take approximately fourteen (14) business days from the date of CIMB s receipt of CIMB Order Form or request to transfer online via CIMB Clicks at CIMB shall not reverse nor cancel any successful transfer of bonus points. 6. To the fullest extent permitted by law, CIMB expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including

6 but not limited to any warranty of quality, merchantability or fitness for a particular purpose in respect of the gift(s), the Prize won under the Event or the goods or services redeemed from the bonus points or the goods and services purchased and/or obtained during the Event. 7. In no event will CIMB be liable for any loss or damages (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Event, even if CIMB has been advised of the possibility of such damages in advance, and all such damages are expressly excluded unless they arise from and are caused directly by CIMB s gross negligence or willful default. 8. Cardmembers shall assume all liability for any misconduct, damage, claim or expense arising from participating in the Event (this includes legal costs on a solicitor client basis). 9. By participating in this Event, cardmembers hereby agree and irrevocably and unconditionally undertake to fully absolve CIMB of all liabilities and agree to indemnify CIMB (on full indemnity basis) and hold CIMB harmless against any claim by any third party and against any loss, damage, cost or expense (including solicitors fees and cost) that CIMB may suffer or incur as a result of or in connection with the Event unless they arise from and are caused directly by CIMB s gross negligence or willful default. 10. These terms and conditions will prevail over any provisions or representations contained in any other promotional materials advertising the Event. 11. The decision of CIMB and/or CIMB judges in relation to every aspect of the Event shall be final, binding and conclusive provided always the decision must appear to be fair and reasonable. 12. If there is any inconsistency, conflict, ambiguity or discrepancy between the Bahasa Malaysia and English version or other language version of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned where request had been made by the cardmember and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the cardmember s credit and/or debit card and/or CIMB Kwikaccount, then the Bahasa Malaysia version of these terms and conditions herein shall prevail.
