1 TERMS & CONDITIONS HSBC AMANAH GO BIG PROMOTION 1. HSBC Bank Malaysia Berhad (Company No V) will be referred to as HSBC Bank and HSBC Amanah Malaysia Berhad (Company No X) will be referred to as HSBC Amanah, collectively referred to as HSBC. THE PROMOTION PERIOD 2. The HSBC Amanah Go Big Promotion ( Promotion ) shall run from 4 July 2018 to 30 September 2018, comprising the following periods:- Promotion Month Promotion Dates 1 4 July 2018 to 31 July August 2018 to 31 August September 2018 to 30 September 2018 (collectively, the Promotion Period ) ELIGIBILITY 3. The Promotion is open to the following primary and supplementary credit cardholders of HSBC Amanah who receive an SMS and/or Electronic Direct Mailer ( EDM ) invitation from HSBC Amanah on this Promotion: a. HSBC Amanah Credit Card-i(s): HSBC Amanah Premier World MasterCard Credit Card-i, MPower Visa Platinum Credit Card-i and MPower Visa Credit Card-i. (collectively, the Participating HSBC Amanah Credit Card-i(s) ) EXCEPT for the following categories of persons: i. Cardholder(s) of HSBC Amanah Credit Card-i(s) that are not issued in Malaysia; and/or ii. Cardholder(s) of invalid or cancelled HSBC Amanah Bank Credit Card-i(s) and/or whose accounts are delinquent within HSBC Amanah s definition at any time during the Promotion Period; and/or iii. Cardholder(s) of company and/or corporate HSBC Amanah Bank Credit Card-i(s) (hereinafter collectively referred to as the Eligible Cardholder(s) ). PARTICIPATION CRITERIA 4. The Eligible Cardholder must spend on Eligible Spend using their Participating HSBC Amanah Credit Cardi(s) in the manner explained below during the Promotion Period to stand to win a Monthly Prize of an Apple ipad GB or a Grand Prize of an Apple MacBook 13 : a. Monthly Prize Minimum Spend Amount (or equivalent if spend is made in foreign currency) Every RM800 spend in a single receipt/transaction No. of Contest Entries 1 entry The following are examples of the number of Contest Entries that can be earned: Scenario A: Eligible Cardholder spends RM1, in a single receipt during the Promotion Month 1, he/she will earn a total of 2 Contest Entries for that transaction during Promotion Month 1.

2 The Monthly Prize winners will then be selected based on the Monthly Prize Selection Process as per Clause 15. b. Grand Prize The first 28 Eligible Cardholders with the highest Eligible Spend amount throughout the Promotion Period ( Grand Winners ) will each win one (1) Apple MacBook 13 as per Table 1 below. In the event of a tie in the amount spent for the top 28 positions throughout the Promotion Period, the Eligible Cardholder who achieves the tied Eligible Spend amount first will be the Grand Prize Winner. 5. The Eligible Cardholder must spend using their Participating HSBC Amanah Credit Card-i(s) (independently or collectively) on any Eligible Spend as defined below ( Participation Criteria ). ELIGIBLE SPEND CRITERIA 6. Eligible Spend for this Promotion are those that are: a. Charged to any of the Eligible Cardholder s Participating HSBC Amanah Credit Card-i(s) including the supplementary credit card-i(s) within the Promotion Period; Includes all internet transactions, local and overseas retail transactions, petrol, 0% instalment plans; and b. Excludes cash advances, Cash Instalment Plan, Balance Transfer, standing instructions/auto-billing, finance charges/ management fees, and credit card annual fees. (the Eligible Spend ) 7. Both primary and supplementary/ies credit card-i spend will be taken into account to meet the Eligible Spend and Participation Criteria. If the Eligible Cardholder has multiple Participating HSBC Amanah Credit Card-i(s) accounts, Eligible Spend made on all Participating HSBC Amanah Credit Card-i(s) by the primary credit card-i cardholder and his/her supplementary/ies credit card-i cardholder(s) will be consolidated and will not be viewed individually to meet the respective Eligible Spend and Participation Criteria for the Promotion. Example: Cardholder A has an HSBC Amanah Premier World MasterCard Credit Card-i, an HSBC Amanah MPower Platinum Visa Credit Card-i and 2 supplementary HSBC Amanah MPower Visa Credit Cards-i. All transactions on Eligible Spend made with all of those Participating HSBC Amanah Credit Card-i will be consolidated and not viewed individually to meet the respective Eligible Spend and Participating Criteria of the Promotion 8. The tracking of the Eligible Spend is based on transaction dates (Malaysian Time) PRIZE CONDITIONS 9. Both Monthly and Grand Prizes will be given to the primary Eligible Cardholder only. 10. The Eligible Cardholder can receive a maximum of one (1) Monthly or Grand Prize only throughout the Promotion Period. There are a total of forty five (45) units of Monthly Prize and twenty eight (28) units of Grand Prize (collectively known as Prizes ) for this Promotion which are pooled together with the HSBC Go Big Promotion. HSBC Bank is the sole provider for all the Prizes in this Promotion. 12. The following terms and conditions apply to the Prizes: a. The Prizes are provided on an As Is basis. b. The Prizes are not transferable and cannot be exchanged for cash, credit or in kind. c. The winners under this Promotion will be notified via SMS within twelve (12) to sixteen (16) weeks after the Promotion Period. The SMS(s) will be sent to the contact details of the primary Eligible Cardholder maintained in HSBC Amanah s records. d. HSBC Amanah reserves the right, at its sole discretion, to provide the Prizes in any colour that is available. e. The Prizes will be couriered within sixteen (16) weeks after the Promotion Period to the primary Eligible Cardholder s address as maintained in HSBC Amanah s records. HSBC Amanah will not entertain any request to deliver the Prizes to an overseas or third party address, a P.O. Box address and/or an address other than that maintained in HSBC Amanah s record. During the call for delivery address confirmation, Weekly Winners and/or Grand Winners with an overseas address shall nominate a proxy in Malaysia with a Malaysian address who will receive a Prize on behalf of the said Weekly Winner and/or Grand Winner. f. HSBC Amanah reserves the right to substitute the Prizes with any other item of similar value at any time with 3 days prior notice. g. HSBC Amanah will not be held liable for any mishaps, injuries or accidents that may occur in the course of delivery or usage of the Prizes received under this Promotion. h. Any loss or damage to the Prizes are passed on to the Weekly Winner and/or Grand Winner upon delivery of the Prizes. i. To the fullest extent permitted by law, HSBC Amanah expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of the Prizes. j. The Prizes do not include any accessories or items that are shown in the leaflet or website or any marketing materials, as they are for illustration purposes only. k. Apple is not a participant in or sponsor of this Promotion. Apple, the Apple logo and iphone are trademarks of Apple Inc., registered in the U.S. and other countries. 13. At the time of fulfilment of the Prizes and during the Promotion Period, all the Eligible Cardholders MUST NOT be delinquent, and/or invalid or cancelled within HSBC Amanah s definition, otherwise they will be disqualified from participating or receiving the Prize from this Promotion. 14. If any Eligible Spend for the Promotion is disputed or alleged to be fraudulent, the Prize(s) will be forfeited and the Eligible Cardholder will not receive the Prize(s) from this Promotion. MONTHLY PRIZE SELECTION PROCESS 15. The Monthly Prize Selection Process is as follows: a. Each entry is assigned with a serial number in HSBC Amanah s randomizer system b. To determine the Monthly Prize Winners, HSBC Amanah will pool together the entries from each Promotion Month and will perform a one (1) time randomization of the entries received for each Promotion Month. c. The entries that are ranked 1 st to 15 th in each Promotion Month from the randomization results will be shortlisted as Potential Monthly Prize Winners. d. The Potential Monthly Prize Winners will receive an SMS notifying them that they stand to receive the Monthly Prize, subject to answering a question via SMS correctly. He/ she must answer/reply the question via SMS to within 5 days from the date of receipt of the SMS to receive the Monthly Prize.

4 e. An SMS will be sent to confirm the Monthly Prize Winners. f. He/she who has not fulfilled the requirements under Clause 15(d) will be forfeited as a Potential Monthly Prize Winner. g. In the event the randomization results shortlist an Eligible Cardholder as a Potential Monthly Prize Winner more than once, AND he/she has been selected as a Monthly Prize Winner once, he/she will forfeit all other shortlisting as a Potential Monthly Prize Winner. h. In the event HSBC Amanah has not selected 15 Potential Monthly Prize Winners for each Promotion Month due to Clause 15(f) or (g), the next entry from the randomization results in Clause 15(b) (i.e. ranked 16 th and above for the Promotion Month) will be shortlisted as the Potential Monthly Prize Winner, and the same process in Clause 15(d) to (f) shall repeat up to two (2) rounds, and thereafter the remaining Monthly Prize(s) for the Promotion Month, if any, will be forfeited. GENERAL TERMS & CONDITIONS 16. HSBC Amanah reserves the right at its absolute discretion to vary, delete or add to any of these Terms & Conditions with 3 days prior notice. 17. The Terms and Conditions, as amended from time to time, shall prevail over any provisions or representations contained in any other promotional materials advertising this Promotion. 18. HSBC Amanah may use any of the following modes to communicate notices in relation to this Promotion to the Eligible Cardholder: I. individual notice to the Eligible Cardholder (whether by written notice or via electronic means) sent to the Eligible Cardholder s latest address/ address as maintained in the HSBC Amanah s records; II. press advertisements; III. notice in the Eligible Cardholder s credit card statement(s); IV. display at its business premises; or V. notice on HSBC Amanah s internet website(s); where such notices shall be deemed to be effective on and from the 4th day after its delivery/publication/display as per the manner described herein. Save and except notices sent via ordinary mail which will be deemed delivered on the 3rd day after posting, notices sent via other modes as described herein are deemed delivered immediately after posting/publication/display. 19. These Terms and Conditions are in addition to the respective Universal Terms and Conditions ( UTCs ) for HSBC Amanah of which the respective Cardholder Agreements are a part of and which regulate the provision of credit card-i facilities by HSBC Amanah. The UTCs are available at In the event of inconsistency between these Terms and Conditions and the UTCs, these Terms and Conditions shall prevail in so far as they apply to this Promotion. 20. HSBC Amanah shall not be liable for any default due to any act of God, war, riot, strike, terrorism, epidemic, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of HSBC. 21. HSBC Amanah reserve the right to cancel, terminate or suspend this Promotion with 3 days prior notice. For the avoidance of doubt, cancellation, termination or suspension by HSBC Amanah of this Promotion shall not entitle the Eligible Cardholder to any claim or compensation against HSBC Amanah for any and all losses or damages suffered or incurred by the Eligible Cardholder as a direct or indirect result of the act of cancellation, termination or suspension. 22. HSBC Amanah shall only be liable for any loss or damage suffered or incurred as a direct result of HSBC Amanah s gross negligence and shall not be liable for any other loss or damage of any kind such as loss of income, profit, goodwill or indirect, incidental, exemplary, punitive, consequential or special loss or damage howsoever arising, whether or not HSBC Amanah have been advised of the possibility of such loss or damage.

The Eligible Cardholder shall be personally responsible for all taxes, rates, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to this Promotion. 24. HSBC Amanah s decision on all matters relating to this Promotion shall be final and binding.
