New fr 2016 is the additin f hand made nn-fd item vendrs! Rain r shine, the Dwntwn Wildwd Farmers Market, lcated at 3501 Pacific Avenue, will be held frm 8 a.m. until 12:30 p.m. n Saturdays, frm Memrial Day Weekend until Labr Day weekend (5/28 9/3/16). I. Missin Statement / Purpse The Dwntwn Wildwd Farmers Market ( DWFM ) will create a vibrant, family friendly attractin in Dwntwn Wildwd n Saturday mrnings thrughut the summer. The Farmers Market will benefit the Dwntwn Business District by drawing peple int the area and creating ft traffic in the Business District. Businesses are encuraged t maximize this pprtunity by marketing and advertising their business in cnjunctin with the Farmers Market. The Farmers Market will benefit cnsumers by ffering Fresh Prduce, Plants and Flwers, Baked Gds, Specialty Fds, Prepared Fds, Hand Made Gds, lcal wine and refreshments t purchase while interacting directly with the prduct expert. The Farmers Market will supprt lcal farmers, bakers, restaurateurs, specialty fd suppliers, wine makers & crafters by prviding a marketplace t sell their gds & interact with end users. II. Dwntwn Wildwd Farmers Market Cmmittee The Dwntwn Wildwd Farmers Market Cmmittee (the DWFM Cmmittee r the Cmmittee ) is made up f members f The Wildwd Business Imprvement District ( WBID ). The WBID is a cmmunity f residents and businesses wrking tgether t prvide a memrable family experience. The WBID is cmmitted t prviding excellent services that enhance the family, friendship, memries and rmantic traditins f Wildwd. The WBID is prud t spnsr the DWFM as anther means f delivering quality, family friendly and value added events in Dwntwn Wildwd. III. Applicatin Prcess and Fees A. Cmplete Applicatins must be received by Friday, March 11, 2016 All vendr applicatins must be signed, acknwledging the applicant s understanding and agreement t adhere t the DWFM 2016 Rules and Regulatins. All vendr applicatins must be cmpleted in full and include cpies f all applicable permits and/r certificates, including but nt limited t: Prduct & Liability Insurance Certificates, naming WBID as Certificate Hlder ; Health Permits; Special Permit. Applicatins must include a minimum f 25% f the seasnal fee fr all requested bths.

The DWFM Cmmittee, n r befre March 18, 2016, will review all cmpleted applicatins Applicatins will be reviewed upn receipt and wait lists will be maintained as categries are filled. All vendrs will be advised in writing by the Cmmittee f their apprval status. Written apprval is a requirement f selling at the DWFM. The Cmmittee has the right t accept r reject any applicant fr any and all reasns they may see fit in the best interests f the DWFM. If an applicatin is rejected r wait listed, all fees will be refunded. Applicatins received after the 3/11/16 deadline will be reviewed and apprved as space permits and as prpsed prducts fit int the verall market mix. Vendrs are accepted int the market n a yearly basis. 50% f the seasnal fee fr all requested bths must be paid by 4/8/ % f seasnal fee must be paid in full by 5/6/16. C. Fees Seasn Rate: $400 One 10 x10 Bth Space $ due 3/11/16 $ due 4/8/16 $ due 5/6/16 $600 Tw 10 x10 Bth Spaces r between 11 and 20 space $ due 3/11/16 $ due 4/8/16 $ due 5/6/16 Electric (limited availability) $50 per bth space fr the seasn D. The Dwntwn Wildwd Farmers Market will be held rain r shine. N refunds will be given under any circumstances. IV. Insurance A. Due t requirements f the WBID Insurance carrier, all vendrs and nn-prfit grups will be required t prvide the DWFM Cmmittee with evidence f Liability insurance, naming The WBID as additinal insured Certificate Hlder in the amunts as fllws: Hme business type $100,000 liability. Vendr may use hmewner Plicy. Nn Prfit/ Charity type $300,000 liability. Business $1 millin liability. B. EVIDENCE OF INSURANCE MUST BE ACCURATE, COMPLETE and PROVIDED TO THE WBID BY 5/6/16 IN ORDER TO PARTICIPATE IN THE MARKET ON OPENING DAY, 5/28/16. Please check with yur insurance carrier fr infrmatin n yur specific needs. V. Indemnificatin All vendrs shall be respnsible fr any and all claims, suits and liabilities based upn damages t, r destructin f, any prperty r injury t any persn (including death) in cnnectin with its participatin in the DWFM r therwise arising ut f r attributable t the DWFM and/r these rules and regulatins and the acts r missins f the vendr including, but nt limited t, their respective emplyees, cntractrs and agents.

Limitatin n Liability Except fr indemnificatin pursuant t Sectin V and fr any deliberate breach f the rules and regulatins by either party, neither party shall be liable t the ther, r any f their respective agents, representatives, emplyees fr any lst revenue, lst prfits, lss f technlgy, rights r services, incidental, punitive, indirect, special r cnsequential damages, lss f data, r interruptin r lss f use f service, even if advised f the pssibility f such damages, whether under thery f cntract, trt (including negligence), strict liability r therwise. VII. Vendr Prducts A. The DWFM Cmmittee reserves the right t accept r reject any vendr fr any and all reasns as it sees fit in the best interest f the DWFM. Acceptance int DWFM will be based n the fllwing list f acceptable prducts, which may be amended at the discretin f the DWFM Cmmittee: 1. Agricultural Prducts: a. Vegetables and fruits b. Flwers, herbs, plants, and nursery crps c. Nuts, seeds, and grains d. Meat, eggs, and unprcessed dairy prducts (further regulatins may apply) e. Hney, wl, and ther animal prducts f. Wine, Craft Beer 2. Prepared, prcessed and pre-packaged fd prducts: a. All prcessed fd must be prduced in a health department-apprved kitchen and vendr must have a license in their individual r cmpany name. Licenses must be n file with the DWFM Cmmittee and n display at the market r available fr review at all times. b. All Fd vendrs must cmply with all applicable lcal, Cunty and State and Federal health regulatins. All fd vendrs MUST have prir apprval frm the Cape May Cunty Department f Health t participate in the market. 3. Hand Made Nn-Fd Items: (Art & Crafts) riginal hand made items such as jewelry, metal, glass, phtgraphy, fine arts / graphics, leather, pttery, textiles, wd, etc. At least 2 pictures and a detailed descriptin must be submitted with applicatin.

On the first day f market seasn, vendrs will be assigned spaces by Market Management. 2. While the same space each week is nt guaranteed, all reasnable effrt shall be made t assure that vendrs maintain the same apprximate space each week. 3. Due t cncerns f market esthetics, vendr s spaces may be mved at the discretin f the market manager thrughut the seasn. 4. Space assignments may be mved due t late arrivals, special events, and fluctuatin in verall size f the market. 5. Vendrs must ccupy their assigned space(s) at least 30 minutes prir t the pening f the market r the market manager may assign the space t anther vendr. 6. Vendrs are expected t ntify the market manager f intended absences at least 24 hurs in advance. 7. Tw absences r late arrivals withut market manager apprval will result in revcatin f seasnal space assignments. N refunds shall be prvided. 8. All n site decisins by the market manager are final and binding. Any appeals must fllw the prcedures utlined in Sectin VIII. B. Vendr Bth 1. Each bth space is apprximately 10 x 10. Vendrs requiring mre than ne (1) bth are required t pay fr each additinal space. 2. Multiple spaces are nt guaranteed and shuld be reserved early. Bth space requirements will be permitted based n availability at the time f DWFM COV receipt f fully cmpleted applicatin. 3. Vendrs requiring electricity shall be subject t an additinal $50 seasnal charge. Electricity has limited availability therefre electrical requirements will be permitted based n availability at the time f WWFM COV receipt f fully cmpleted applicatin. 4. Resale r subletting f Vendr Bth is strictly prhibited and are grunds fr suspensin frm the market and frfeiture f fees paid. 5. Sharing f Bths must be pre-apprved by the manager and will be limited t like vendrs. Yu may bth share the same bth each week r yu may alternate weeks in the bth thrughut the seasn. Please prvide details fr sharing parties with yur applicatin.

5 Dwntwn Wildwd Farmers Market 2016 Rules & Regulatins 5 C. Market Safety 1. Vendrs may nt begin setting-up until 6:30 am and breakdwn may nt begin until 12:30 pm and must be cmpleted by 2pm. Exceptins may be granted n a case-by-case basis at the discretin f Market Management and DWFM Cmmittee. 2. Canpies shuld be designated fr utdr use and must be anchred with weights r spikes. 3. Vendrs will sell at designated bth space and maintain the space in a sanitary and safe cnditin. 4. Vendrs are respnsible fr cleaning up their bth space and remving all trash. Failure t cmply with this Rule will result in revcatin f seasnal space assignment. N refund shall be prvided. 5. Vehicles may park behind bth space that can accmmdate a vehicle withut disrupting the Market. Fr bth spaces that cannt accmmdate a vehicle, vendrs may drive vehicles int market aisles fr unlading, prvided the vehicle is remved frm the market area at least 30 minutes prir t market pening. Vendrs are nt t park in bth spaces. Vehicles are nt permitted t re-enter the market until all shppers have vacated the Farmers Market lt. 6. Vendrs unable t park their vehicle behind their bth space shuld park in the adjacent lt. 7. Late arrival participatin will be cntingent n available space. Vendrs wh arrive late must park utside f designated market bundaries and carry prduct t bth space. 8. Vendrs are respnsible fr the safety and behavir f their staff and children. Vendrs are nt permitted t bring animals t the market. 9. Vendrs are respnsible fr weighting and/r tying dwn their tents and umbrellas t sufficiently eliminate wind disruptin and danger. Vendrs are liable fr any damage ccurring frm their persnal prperty. 10. N mving vehicles are allwed n the market site fr any reasn while shppers are n the site. D. General Market Rules 1. Vendrs may begin selling 30 minutes prir t the fficial Market pening. 2. Early breakdwns are nt allwed bths must be manned and stcked fr sales until clsing time. 3. All permits necessary t sell must be n display r available fr review at all times. 4. All scales must bear a current seal frm the Dept. f Weights and Measures. 5. Signs must be accurate and truthful. 6. Vendrs wh market their prducts as Organic must prvide prf f certificatin t market management and have certificate n display.

Music may nt be played while the Dwntwn Wildwd Farmers Market micrphne is being used by musicians r thers and must nt be disruptive t neighbring bths r t the verall market. IX. Enfrcement f Market Rules A. Vendrs and management are expected t maintain high standards f hnesty and respect tward ne anther and custmers and t cnduct themselves in a curteus and helpful manner. Rudeness and dishnesty are grunds fr suspensin frm the market. B. The market management and DWFM Cmmittee members shall have discretin t make any nsite decisins regarding market vilatins. C. Any vendr vilating the abve stated rules and regulatins f the DWFM r the regulatins f Cape May Cunty Health Department r ther lcal, state, r federal agencies may be issued a written r verbal warning fr market vilatins. Verbal warnings will be recrded and if the prblem is nt crrected in a timely manner, a written warning will be issued. Cntinued r repeated nn-cmpliance shall result in a written advisement f expulsin frm the market. Such expulsin shall be effective immediately. Expulsin is permanent until the vendr is reinstated by the Cmmittee f Vlunteers. Vendrs wh are expelled frm the market due t vilatins will nt be refunded any applicatin r bth fees. D. Any persn wishing t file a cmplaint abut the market r an individual vendr must d s in writing t the Cmmittee. E. Any serius vilatins r illegal activity will be reprted t the prper authrities. X. Appeals A. Vendrs have the right t appeal any decisin f a ntice f vilatin r expulsin t the DWFM Cmmittee. 1. Appeals must be received in writing by the DWFM Cmmittee within tw weeks f the vilatin/expulsin date. 2. Appeals shuld cntain an explanatin f the situatin, grunds f the appeal, and prpsed slutin. 3. The DWFM Cmmittee will respnd t the appeal. 4. An in-persn meeting between the vendr and the DWFM Cmmittee may be granted t discuss the appeal at the discretin f the Cmmittee. B. Decisins f the DWFM Cmmittee are final and binding. C. Vendrs wh are expelled frm the market may nly be readmitted by a majrity vte f the DWFM Cmmittee.
