ApplicantCare ApplicantCare is an nline applicatin and candidate management tl that autmates the hiring prcess It is the plicy f Kelis, and all affiliated cmpanies, t utilize the ApplicantCare system t identify and select the mst qualified Emplyees in a standardized manner acrss all lcatins. Applicants fr emplyment begin the hiring prcess nline by registering, answering rganizatinal and jb-specific pre-qualifying questins, and filling ut the electrnic Jb Applicatin. Autmatic and manual updates t the applicant s status are made at each step in the hiring prcess, ensuring cmpliance with ur rganizatin's hiring prcess as defined belw. Applicants fr emplyment will fllw the general list f steps in the selectin prcess utlined belw. Steps fr specific psitins may differ. 2 Emplyees may be exempt r nn-exempt with regards t minimum wage and vertime cnsideratins defined belw. Exempt Emplyees - Emplyees wh meet ne f the Fair Labr Standards Act (FLSA) exemptin tests and wh are paid n an annual salary and are nt entitled t vertime. Exempt level emplyees are paid fr the wrk that they d and are cmpensated fr the wrk prduct. Nn-Exempt Emplyees Emplyees wh d nt meet any ne f the FLSA exemptin tests and are paid n an hurly basis and cvered by wage and hur laws regarding hurs wrked, vertime pay, etc. Nn-Exempt emplyees are paid fr the time it takes t cmplete their wrk assignments. Please refer t a Human Resurce Representative fr specific questins regarding Jb Classificatin. Minimum Qualificatins fr Nn-Operatr Psitins The fllwing minimum qualificatins refer t individuals applying fr psitins that d nt invlve peratin f a vehicle r equipment. The fllwing qualificatins d nt apply t thse applying fr senir r executive level psitins. T be cnsidered fr emplyment, applicants must adhere t the fllwing minimum qualificatins: Applicants must cmplete and sign an Emplyment Applicatin in its entirety via the ApplicantCare system. Applicatin must be reviewed fr accuracy, cmpleteness and digital signature. An unjustified refusal t supply requested infrmatin r a falsificatin f infrmatin will result in eliminatin f the individual frm cnsideratin fr emplyment Applicants must prvide a cmplete and verifiable emplyment histry. Three (3) years f emplyment histry must be verified with all emplyers listed n the applicatin. Emplyment histry must be verified with all emplyers listed n the applicatin prir t an ffer f emplyment. Any gaps in emplyment must be explained and dcumented by the applicant n the applicatin. All reference infrmatin must be dcumented, including a list f references wh were cntacted and the infrmatin received. References must be asked a standard set f jb related questins fr all applicants using the Reference Verificatin nline as part f the ApplicantCare prcess. Applicants must underg a pre emplyment drug test by a Cmpany appinted physician/facility prir t an ffer f emplyment and as a cnditin f emplyment. Applicants must underg a drug test withut advance ntice f the drug test appintment. 2

3 Applicants must receive a negative test result prir t training r wrking in a safety sensitive psitin. If the drug test is cancelled fr any reasn, applicants must re take the test and receive a negative result prir t wrking in a safety sensitive psitin r entering a Cmpany vehicle. Applicants wh have previusly failed a drug r alchl test while in a safetysensitive psitin will nt be cnsidered fr emplyment, unless prf f successfully cmpleting a treatment prgram is prvided Applicants must pass a criminal backgrund check based n standards established by federal and state law. Applicants must meet the fllwing Cmpany standards when nt specifically prhibited by state law: N felny cnvictins within the past seven (7) years. N cnvictin fr drug pssessin r use within the past seven (7) years. Never have a cnvictin fr drug trafficking r manufacturing. N cnvictin fr assault within the past seven (7) years. N pattern f illegal activities within the past seven (7) years. N cnvictin fr a sexual ffense. N cnvictin fr murder Applicants must cnsent t a backgrund check using the apprpriate Authrizatin t Cnduct Backgrund Check (FCRA Authrizatin), included nline as part f the ApplicantCare prcess. Any variance t these minimum standards must be apprved in writing by Human Resurces Applicants must cmplete a structured and dcumented emplyment interview. Structured interviews reduce the risk f a legal challenge if the hiring decisin is challenged by an applicant claiming differential treatment during the interview. Interview questins must be based n jb requirements and derived directly frm perfrmance criteria stated in the jb descriptin. Interview questins shuld be behavir based questins, fcusing n behavirs the applicant perfrmed in past situatins relevant t the psitin. Every applicant must be asked the same interview questins fr the same r similar psitins. The Interviewer must take detailed ntes and dcument respnses t interview questins Applicants must cmplete all additinal requirements as utlined by the Human Resurces Department. This includes all required paperwrk determined by federal, state and lcal requirements. Applicant must cmplete all relevant tax and emplyment verificatin frms such as the fllwing: 3

T be cnsidered fr emplyment, candidates applying fr driving psitins must meet the fllwing minimum qualificatins: Applicants must pssess a valid driver s license in the state they reside, including prper endrsements. A phtcpy f the applicant s current driver s license must be kept n file at all times. A valid class B license with a P endrsement as warranted by the assigned psitin. Califrnia residents must have a valid class B r C Califrnia driver's license Applicants must meet the fllwing minimum requirements: Be at least twenty-ne (21) years f age. Have a minimum f ne (1) year driving experience. Pssess a high schl diplma r GED. The Hiring Manager/Human Resurce Department must verify each applicant s age by examining the date f birth n the applicant s driver s license. Applicants must be a US citizen r prvide prf f the right t wrk in the United States. Applicants must be able t cmmunicate in English, bth rally and written. Althugh it is the plicy f ur Cmpany t encurage diversity and inclusiveness in all f its Crprate pursuits, there are sme ccasins when the Cmpany will require that its Emplyees cnverse r take directin and guidance in English. Thus, this English-nly plicy will prvide specific circumstances where English-nly rules must be bserved: English will be used when dealing with custmers wh express a preference r the expectatin that ur Emplyees are prficient in English. All task directins and wrk directives will be prvided in English and, while Emplyees are engaged in such wrk-related effrts r n prject teams, they will be expected t cmmunicate in English. All safety, facility and security related materials will be prvided in English, and team r departmental meetings that relate t business peratins, safety, facility and/r persnal security will be expected t be cnducted in English. The use f the Cmpany Internet and Intranet, as well as all wrk-related e- mailing, is expected t be cmmunicated in English, unless custmer requirements state a preference that anther language be used. Emplyees having cncerns r questins regarding these enumerated plicies shuld address them with their immediate Supervisr r Human Resurces fr reslutin. Our rganizatin remains cmmitted t the expressin f its diversity effrts, which include the use f languages ther than English, but realizes that specific business peratinal requirements 4

Applicants and emplyment references must be treated fairly and cnsistently. All reference infrmatin must be dcumented, including a list f references wh were cntacted and the infrmatin received Mtr Vehicle Recrd (MVRs) fr an Operatr psitins must meet the fllwing standards: N hmicide, manslaughter, r assault cnvictins assciated with peratin f a mtr vehicle. N cnvictins fr driving while intxicated within the past seven (7) years. N mre than tw (2) minr mving vilatins within the past thirty-six (36) mnths. N majr mving vilatins within the past thirty-six (36) mnths, including but nt limited t: failure t stp at the scene f an accident; speeding thirty (30) mph r mre abve the psted speed limit; driving with a revked license; pssessin f pened alchlic cntainers; attempting t elude an fficer/n accidents in previus twelve (12) mnths. N mre than ne (1) ticketed at fault accident within the past thirty-six (36) mnths. Kelis will review the existence f any vilatins r cnvictins and may deny emplyment based n a vilatin, cnvictin, r pattern f vilatins/cnvictins indicating safety risk. Original MVRs must be btained befre the emplyment applicatin is acted upn. Cpies f MVRs will nt be accepted. 5

6 Certain lcatins may btain MVRs thrugh the apprpriate backgrund check vendr, given that the MVR meets Cmpany, state and cntract requirements. Under n circumstances shall an applicant be hired, given a rad test, placed in training, r be allwed t drive a Cmpany vehicle withut an MVR in cmpliance with this plicy. Applicants wh fail t authrize an MVR check will nt be cnsidered fr emplyment.
