1 Prducer Statements Plicy This plicy has been prepared t ensure that Cuncil has clearly dcumented plicies and prcedures fr the request fr and acceptance f Prducer Statements in cnnectin with applicatins fr Building Cnsent, issue f Cde Cmpliance Certificates and ther Regulatry functins under the Building Act 2004 Cuncil is under n legal bligatin t accept Prducer Statements. Hwever, it is recgnized that Prducer Statements are an accepted tl within the industry and, as part f a prperly managed and cnsidered prcess, have a part t play in cnfirming that cmpliance with the Building Cde and/r cnditins f Building Cnsents/Certificates f Acceptance has been/will be achieved. Prducer Statements may be requested additinally t any Restricted Building Wrk Memranda required t be supplied by S.88 f the Building Act 2004 in accrdance with WDC BCA practice nte 001/14 (Planning f Inspectins). Prducer Statements will be accepted nly in accrdance with this plicy. Scpe f Plicy Dcuments within the scpe f this plicy This plicy relates t dcuments prvided t WDC in cnnectin with applicatins fr Building Cnsent, Cde Cmpliance Certificate, Certificate f Acceptance and ther Regulatry functins under the Building Act 2004 which are relied upn t cnfirm that cmpliance with the Building Cde and/r cnsented dcuments will be/has been achieved. These will be requested by Cuncil at any ne f the fllwing stages: During the prcessing stage f the Building Cnsent As a cnditin f Cnsent at issue. Fllwing the issue f an amendment t a Building Cnsent During the cnstructin phase f the prject. At applicatin fr Cde Cmpliance Certificate r Certificate f Acceptance Dcuments utside the scpe f this plicy It has becme cmmn practice in sme areas f industry fr dcuments claiming t be Prducer Statements t be included as part f the supprting infrmatin fr applicatins fr Building Cnsent r t be submitted fllwing inspectin wrk during the cnstructin phase. Often these dcuments add little t the prcess f cnfirming cmpliance with the Building Cde (fr example, when WDC Building Officers have assessed the particular cde clause r inspected the wrk) and, as such, are nt cvered by this plicy. The receipt f such dcuments will be recrded n either the prcessing sheet r the Field Advice Ntice (as apprpriate) using the term Statement received frm supprting infrmatin nly r similar. The dcuments will then be stamped Supprting infrmatin nly, initialed and placed n the Building Cnsent file. Tradespersns and prfessinals listed belw will autmatically be accepted as Prviders f Prducer Statements. Hwever, statements prvided by them will underg checking prir t acceptance as detailed later in this dcument: Tradespersns identified in S19 f the Building Act 2004 (Registered Electricians and Certifying Gas Fitters) Certifying Plumbers in cnnectin with pressure testing f plumbing systems Certifying Drain layers Registered Chartered Prfessinal Engineers acting within their area f cmpetency Independent Qualified Persns, fr building systems fr which they are apprved n the WDC register Wet area waterprfing applicatrs where a PS3 is accmpanied by evidence f cmpletin f manufacturers training fr the prduct installed Versin 3 11/06/2014

3 System Descriptin Definitin f Prducer Statement Fr the purpses f this plicy, Cuncil will use the definitin f the term Prducer Statement as defined by the Department f Building and Husing (DBH Draft manual fr Accreditatin) Prducer Statements are frmal statements supplied by r n behalf f: An applicant fr Building Cnsent, r A persn wh has carried ut building wrk Prducer Statements cnfirm that certain wrk will be, r has been, carried ut in accrdance with nminated perfrmance requirements f the Building Cde r cnditins f Building Cnsent A Prducer Statement shuld be in the frm f a certificate r written statement, signed by a design prfessinal r cnstructr. Fr example, a recgnised engineer wh has the experience, qualificatins and cmpetence t carry ut the wrk in questin. a Types f Prducer Statement Prducer Statement fr design als knwn as a PS1 These statements are issued by design prfessinals stating in their view that part r all f the building wrk as described n nminated plans and specificatins has been designed in accrdance with certain perfrmance requirements f the Building Cde. b Prducer Statement fr design review als knwn as a PS2 These statements are issued by design prfessinals cnfirming that a peer review has been carried ut n the wrk undertaken by the designer. c Prducer Statement fr cnstructin als knwn as a PS3 These statements are usually issued by cntractrs stating that part r all f the building wrk as described n nminated plans and specificatins has been cnstructed and meets certain perfrmance requirements f the Building Cde and/r cnditins f Building Cnsent. d Prducer Statement fr cnstructin review als knwn as a PS4 These statements are usually issued by cnsulting engineers wh have been engaged t inspect part r all f the building, and cnfirm that the building wrk in questin has been cnstructed and meets certain perfrmance requirements f the Building Cde and/r cnditins f Building Cnsents. Situatins in which a Prducer Statement may be requested/accepted As supprting dcumentatin t an applicatin fr Building Cnsent, Cde Cmpliance Certificate and ther regulatry functins under the Building Act 2004 where: The technical issues invlved are utside the cmpetency levels f Cuncil staff Inspectin by Cuncil staff wuld cause majr disruptin t the prject Where prir arrangements have been made with BCA management. Cuncil staff, even if they carried ut an inspectin, wuld have difficulty in cnfirming cmpliance with the Building Cde and/r the cnsented dcuments. eg, Wet area waterprfing All ther Prducer Statements will be accepted at the discretin f the Building Officer and accmpanied by any relevant supprting evidence as t the credentials f the authr. It is imprtant that the requirement fr Prducer Statements t be submitted as supprting dcumentatin fr applicatins fr Cde Cmpliance Certificates is identified at the prcessing stage and included in the Building Cnsent dcumentatin as a cnditin. A Prducer Statement - Cnstructin (PS3) is t be prvided by the installer f the wet area membrane specified in the cnsented dcuments. The installer must have undertaken apprpriate training by the prduct manufacturer. Evidence f training must be supplied in supprt f th e PS3. Versin 3 11/06/2014

4 Frmat f Prducer Statements WDC has designed the fllwing standard frmats fr Prducer Statements: A generic frm fr general use (TRIM 07/67915) See Appendix A Wet area frm fr qualified applicatrs, (TRIM 13/75818) See Appendix. A separate template fr Certifying Plumbers t use when cnfirming pressure tests f plumbing systems (TRIM 06/703391) See Appendix Use f these frms is nt mandatry althugh all Prducer Statements submitted mus t cntain the infrmatin cntained n thse frms, as fllws: Name f the Statement Prvider Business address f the Statement Prvider Name f the applicant as cntained n the Applicatin fr Building Cnsent t which the statement relates Building Cnsent number t which the Statement relates (in the case f a Statement received after the cnsent has been issued) Clause(s) f the Building Cde r cnditin f Building Cnsent the Statement cnfirms cmpliance with Specific part(s) f the prject t which the Statement relates Prduct used (if applicable) Any items that are specifically excluded frm the scpe f the Prducer Statement Any cnditins related t the Prducer Statement Cpies f any structural calculatins relied upn when cmpiling the Prducer Statement A statement as fllws: I understand that this Prducer Statement will be relied n by Cuncil t cnfirm cmpliance with the Building Cde and/r cnditins f the Building Cnsent t which it relates The signature f the Prvider The date f issue In the case f the Certifying Plumber s pressure tests, the infrmatin related t pressure tests must als be included. Prducer Statements submitted withut this infrmatin will nt be accepted by Cuncil Prcedural Arrangements Deciding t accept a Prducer Statement Prducer Statements, submitted as part f the supprting plans and specificatins fr an applicatin fr Building Cnsent, will be assessed at the assessment (prcessing) stage. Als at this stage, the requirement fr Prducer Statements t be prvided at later stages f the prject will be identified. These will be added as cnditins f cnsent in the same way as inspectin requirements. In accrdance with WDC BCA practice nte 001/14 (Planning f Inspectins). Prducer Statements submitted as part f the inspectin and Cde Cmpliance Certificate issue prcesses will be assessed against the riginal Building Cnsent t ensure that they are relevant t that and the required infrmatin has been prvided. Every Prducer statement frm wet area waterprfing applicatrs is t be accmpanied by a cpy f their manufacturers training qualificatin fr the prduct used. Versin 3 11/06/2014

5 Prducer Statements will be assessed fr suitability fr acceptance by Building Officers using the fllwing standard frms: At the prcessing stage, the standard template check sheet (TRIM 07/86242). At the CCC stage when the WDC frm has been used, the check bxes n the frm At the CCC stage when a frmat ther than the standard WDC frm has be en used, the standard template check sheet. If there are any missins r questins that cannt be answered, further infrmatin will need t be btained befre the statement can be accepted. Building Officers will access the apprpriate prfessinal r trade websites when deciding whether the statement can be accepted. When making this decisin, the Building Officer will have regard t: The categry f wrk t which the statement relates The cmplexity f wrk t which the statement relates Whether the Statement fully meets the requirements cntained in the Building Cnsent dcumentatin Whether the frm is fully cmpleted and signed Whether the Prvider s registratin is current If the Building Officer is satisfied that the Prducer Statement can be accepted, this decisin will be recrded and the statement will be placed n the Building Cnsent file.
