1 INSTRUCTIONS SPECIAL CIRCUMSTANCES REPAYMENT / REMISSION / RE-CREDIT APPLICATION Wh shuld use this frm? This frm applies t all internatinal and dmestic fee paying students and all dmestic Cmmnwealth supprted students at the University f Adelaide wh withdraw frm a curse r curses after the curse census date, r wh have nt successfully cmpleted the requirements f a curse, and wh seek ne r mre f the fllwing: 1. a remissin f HECS-HELP debt and/r a repayment f any up-frnt Student Cntributin payments 2. a repayment f tuitin fee payment 3. a re-credit f FEE-HELP balance, due t special circumstances having prevented them frm successfully cmpleting their curse(s). Please Nte: In the event yur applicatin fr Special Circumstances Repayment, Remissin r Re-credit is apprved n repayment will be prvided fr the Student Services and Amenities Fee. Further there is n capacity under the Higher Educatin Supprt Act 2003 fr the prvider t remit an SA-HELP debt incurred by a student, therefre any SA-HELP debt at the due date will als remain. THRESHOLD CRITERIA In rder t be eligible t apply fr special circumstances repayment/remissin/re-credit, yu must first satisfy all f the fllwing threshld criteria: 1. Yu were enrlled in a unit (r units) f study with the University 2. Yu did nt cmplete the requirements f the unit(s) during the study perid 3. Yu apply in writing fr special circumstances repayment/remissin/re-credit 4. Yu apply within 12 mnths f the date yu withdrew frm yur curse(s), r if yu did nt withdraw frm yur curse(s), yur applicatin must reach Student Finance within 12 mnths frm the last day f the study perid in which yu were enrlled in the curse(s). These arrangements apply t bth standard and nn-standard study perids. A lack f knwledge r understanding f the requirements fr applying fr a re-credit, remissin and/r repayment is nt a valid reasn fr applying after the deadline. The 12-mnth timeframe is set by Cmmnwealth legislatin, and applicatins after this time cannt be cnsidered under nrmal cnditins. In the event an applicatin is submitted after the 12-mnth timeframe, the applicatin must als be accmpanied by further independent evidence prviding additinal supprt fr the medical/family/persnal/emplyment related reasns fr the late applicatin. The additinal evidence supprting the late applicatin, utside f the 12-mnth timeframe, will be assessed separately and distinctly t that prvided t supprt the special circumstances during the relevant study perid. Once yu have met the abve Threshld Criteria, yu must then satisfy the fllwing Special Circumstances criteria:

2 SPECIAL CIRCUMSTANCES CRITERIA What special circumstances are accepted? In all cases, special circumstances must have a significant impact n yu and yur ability t cmplete the curse(s) yu have undertaken t study. Therefre yu shuld demnstrate that the circumstances: (a) are beynd yur cntrl; are nt a result f yur actin r inactin; and are unusual, uncmmn r abnrmal; AND (b) ccur n r after the census date OR ccur befre the census date, but wrsen after that day, OR ccur befre the census date but the full effect r magnitude des nt becme apparent until n r after that day; AND (c) make it impracticable fr yu t cmplete the attendance and/r assessment requirements f yur curse(s). Please nte: Cnsideratin will be given t whether, at the time the circumstances emerged, it was already impracticable fr yu t meet the requirements f the curse(s). Fr example, where prgressive requirements relating t cmpulsry assessment and/r attendance at classes fr the curse(s) had nt been met at the time the circumstances emerged. Why d I need independent supprting dcumentatin? Yur applicatin will be cnsidered principally n the basis f yur independent dcumentatin t supprt yur claims. It is nt sufficient t prvide nly a persnal statement utlining yur special circumstances. Supprting independent dcumentatin must demnstrate hw yur circumstances affected yur ability t study, the date the special circumstances began r changed, and when it became apparent that yu culd nt cntinue and cmplete yur curse(s). Supprting dcumentatin may include: Fr medical reasns: Eg, where yur medical cnditin has changed t such an extent that yu are unable t cntinue studying: a statement frm a treating dctr Fr family/persnal reasns: Eg, death, severe medical prblems r unfreseen financial difficulties within a family s that it is unreasnable t expect yu t cntinue studying: a statement frm a dctr, cunsellr r independent member f the cmmunity (depending n the individual circumstances invlved) Fr emplyment-related reasns: Eg, where yur emplyment status r arrangements have changed s that yu cannt cntinue studying: a statement frm yur emplyer. Supprting dcumentatin must be signed riginal dcuments, i.e. nt cpies r faxes, and shuld be n apprpriate cmpany r business letterhead. Medical dcumentatin must include a relevant Medicare prvider number. Supprting dcumentatin must be in English, r if in anther language, must be accmpanied by an accredited translatin int English. In accrdance with Cmmnwealth regulatins, applicatins fr remissin f a HECS r PELS debt incurred prir t 2005 cannt be accepted. These applicatins were administered by the Cmmnwealth Department f Educatin under the Higher Educatin Funding Act 1988 (HEFA).The ldgement deadline fr pre-2005 applicatins was 12 mnths frm the date f withdrawal frm a curse f study, and this deadline has lapsed.

3 What happens t my applicatin after it has been ldged with Student Finance? Yu will receive a letter cnfirming the receipt f yur applicatin and case number. Yu will be advised f the utcme f yur applicatin within 28 days f the receipt f yur applicatin and/r supprting evidence. If further infrmatin is required frm yu, it will be requested via yur student . If yu are nt satisfied with this decisin, yu will be affrded the pprtunity t request a review f yur case, and will be advised hw t request this in the letter yu receive advising yu the utcme f yur case (see Student Finance website at under Review and Appeal fr mre infrmatin). If yu are a Cmmnwealth supprted student and yur applicatin fr remissin f HECS-HELP debt and/r repayment f upfrnt Student Cntributin payment is successful, the University will ntify the Cmmnwealth Department f Educatin with the necessary details t enable yur HECS-HELP debt t be remved r reduced as applicable. Alternatively and/r additinally, yu will receive a repayment f any upfrnt payments made fr the curses t which yur successful applicatin relates. The repayment will be made t yur nminated bank accunt. If yu are an internatinal r dmestic fee paying student, and yur applicatin fr a repayment f tuitin fees is successful, yu will receive a repayment fr payments made fr the curses t which yur successful applicatin relates. Refund payments are nrmally made directly int a bank accunt (EFT) using yur nminated bank accunt details. All refunds are made in Australian dllars and are payable t the yur nminated accunt, unless yu are supprted by a recgnised third party spnsr and that spnsr is entitled t the refund [ESOS Act, s.28(2)]. Please nte: we may be required t prcess yur refund t the riginal credit card, hwever bank details are required t ensure payment can be finalised. If yu are a dmestic fee paying student and deferred yur fees t FEE-HELP, and yur applicatin fr re-credit f FEE-HELP balance is successful, the University will ntify the Cmmnwealth Department f Educatin, with the necessary details t enable yur FEE-HELP balance t be re-credited, and yur FEE-HELP debt t be remved r reduced as applicable. Privacy Persnal infrmatin cllected n this frm r supplied by yu t the University is treated in the strictest cnfidence. The infrmatin cllected is used slely fr the purpse f assisting the University t make an infrmed decisin n yur case. Permissin t cnsult Cunselling & Disability Services Smetimes it may be helpful t cnsult staff in Cunselling & Disability Services t establish the nature and severity f a student s special circumstances. Students have the ptin n their applicatin frm (pages 3 and 4) t indicate whether they wish this cnsultatin t ccur.
