1 Part II Order Request Frm Ministry f the Envirnment and Climate Change General: General Infrmatin and Instructins Anyne wh has utstanding envirnmental issues that have nt been addressed thrugh the Class Envirnmental Assessment prcess can request the Minister f the Envirnment and Climate Change t make an rder under Part II f the Envirnmental Assessment Act. This is knwn as requesting a Part II Order. A Part II Order request shuld be submitted after the prpnent has issued the Ntice f Cmpletin fr a Class Envirnmental Assessment fr a prject. The request shuld be submitted within the review perid/cmment perid utlined in the Ntice f Cmpletin. The Ministry recmmends that yu fllw the prcess set ut belw befre submitting a Part II Order request: Participate in the cnsultatin pprtunities prvided t the public within the Class Envirnmental Assessment prcess Engage in discussins with the prpnent t try t address and reslve yur cncerns A Part II Order request shuld nt be submitted fr the sle purpse f delaying, stpping, r frustrating the planning and implementatin f an undertaking prceeding under a Class Envirnmental Assessment prcess. The Minister may cnsider the effrts f the requester t reslve the cncerns directly with the prpnent when deciding whether t make an rder. Step 1 - Get the Facts: Class Envirnmental Assessments are used fr prjects that the Ministry f the Envirnment and Climate Change cnsiders rutine, with predictable and manageable effects n the envirnment. A Part II Order request will nt stp a prject frm prceeding. The Minister has fur ptins when deciding a Part II Order request: T request mediatin between yu and the prpnent t help address yur cncerns befre making a decisin T deny the request T deny the request but require the prpnent t fulfill additinal cnditins befre the prject can prceed, such as further studies r mre public cnsultatin T require the prpnent t cnduct a higher review f the prject thrugh an Individual Envirnmental Assessment; this happens nly in rare and exceptinal cases. Key factrs that the Minister may cnsider when lking at a Part II Order request are: whether the prject has the ptential t pse significant adverse effects n the envirnment hw the prject is significantly different frm ther prjects in its class whether the prcess fr the Class Envirnment Assessment was adequate. 3 With all Part II Order requests, the Ministry maintains a public file that is available fr viewing by any member f the public upn request. If yu wish fr yur infrmatin t be excluded frm the public file, yu can advise the Ministry by checking the bx in the declaratin belw. Even if yu request that yur infrmatin be excluded, yur cntact infrmatin may still be btained by members f the public if the ministry is required t disclse the infrmatin under the Freedm f Infrmatin and Prtectin f Privacy Act.
