1 In this Credit Reprting Plicy, ORIX, we, us and ur mean ORIX Australia Crpratin Limited and ur related cmpanies. Thse related cmpanies may als have their wn privacy r credit reprting plicies which set ut additinal detail r differences in their privacy and credit reprting practices. All terms defined in the Privacy Act 1988 (Cth) (Privacy Act) and the Privacy (Credit Reprting) Cde 2014 (Versin 1.2) (CR Cde) (as updated frm time t time) have the same meaning when used in this Credit Reprting Plicy. When we use the term credit reprting laws we mean the CR Cde and Part IIIA f the Privacy Act, and when we use the term "credit related infrmatin" we mean credit infrmatin and credit eligibility infrmatin as thse terms are defined in the Privacy Act. This plicy sets ut: the kinds f credit related infrmatin we cllect; hw we cllect and hld credit related infrmatin; why we cllect credit related infrmatin; hw we use and disclse credit related infrmatin; hw yu can access and seek t crrect the credit related infrmatin we hld abut yu; whether we disclse yur credit related infrmatin t verseas entities/entities withut an Australian link; and hw yu can cmplain if yu think we have breached this Credit Reprting Plicy r the credit reprting laws. This Credit Reprting Plicy applies in additin t the ORIX Privacy Plicy. We recmmend that yu read this Credit Reprting Plicy in cnjunctin with ORIX's Privacy Plicy which can be accessed n ur website: We may review and update ur Credit Reprting Plicy frm time t time. This will include taking int accunt new laws, regulatins, practices and technlgies. All credit related infrmatin held by us will be gverned by ur mst recent Credit Reprting Plicy. What credit related infrmatin d we cllect and hld and hw d we cllect it? During the curse f cnducting ur functins and activities (which include vehicle leasing, vehicle rental and fleet management) we cllect, hld, use and disclse credit related infrmatin abut individuals wh are r wh are prpsed t be custmers r guarantrs under leasing agreements, hire purchase agreements, fleet and vehicle management agreements and rental agreements with ORIX (r, if the custmer r guarantr is a crpratin, directrs, principals and beneficial wners f that crpratin). The credit related infrmatin which we cllect and hld will be surced frm: the individual directly (fr example, thrugh an applicatin frm r frm any relevant accunts held with us); ur wn recrds (if we have already had dealings with the individual in questin); credit reprting bdies (CRBs) (fr example Equifax Australia Infrmatin Services and Slutins Ltd); ther credit prviders with whm the individual has had cnsumer r cmmercial dealings; gvernment departments, authrities and agencies; and publicly available surces f infrmatin. 2 ther credit reprting infrmatin btained frm a CRB (including cnsumer credit liability infrmatin, the type f cmmercial credit and the amunt f cmmercial credit sught in an applicatin, default infrmatin (and where a default has been remedied, payment infrmatin r new arrangement infrmatin), curt prceedings infrmatin, persnal inslvency infrmatin, certain administrative infrmatin relating t credit (such as accunt and custmer numbers), credit reprting infrmatin we receive frm a CRB including business credit scres and ratings, publicly available credit wrthiness infrmatin, infrmatin that we derive frm the credit reprting infrmatin we receive frm CRBs and (where applicable) an pinin frm a credit prvider that an individual has cmmitted a serius credit infringement). Where we engage with an individual multiple times ver a shrt perid in relatin t the same matter, we may nt prvide the individual with a separate ntice abut cllectin f credit related infrmatin each time we engage with that individual. Why d we cllect and hld credit related infrmatin? We cllect, hld, use and disclse credit related infrmatin as reasnably necessary fr ur business purpses and as permitted by law. We cllect and hld credit related infrmatin s that we can: prvide fleet (vehicle) leasing, nvated leasing, shrt term vehicle rental, fleet / vehicle management services r ther prducts and services t ur custmers and their directrs, principals and emplyees; assess applicatins and guarantrs fr thse prducts and services; manage the credit facilities fr, and delivery f, thse prducts and services; exercise ur rights and bligatins; perfrm any administrative peratins; and cllect payments. ORIX may nt be able t prvide its prducts and services, r a credit accunt r credit facility, withut cllecting the required infrmatin. Hw d we use and disclse credit related infrmatin? We use credit related infrmatin fr the purpses described in the paragraphs abve, including t: assess and cnsider applicatins fr credit and establish and manage the credit facilities required t prvide prducts and services t the relevant individual, a cmpany f which they are a directr, principal, r beneficial wner r t cmpanies r individuals fr whm the individual is (r is prpsed t be) a guarantr; prvide and manage the delivery f ur prducts and services including, but nt limited t, recvering any mney wing r the leased/hired vehicle r equipment; exercise ur rights and bligatins; perfrm any administrative peratins; reprt details f any fraud r ther serius credit infringement; and undertake any ther activity permitted r required under the Privacy Act. ORIX may cllect, use r disclse credit related infrmatin abut yu it cllects frm a CRB fr the purpses f: assessing applicatins fr credit r managing an individual's r an rganisatin's accunt; cllecting verdue payments related t credit; reprting details f any fraud r ther serius credit infringement; r undertaking any ther activity permitted r required under the Privacy Act. ORIX may als disclse t a CRB if yu fail t meet yur payment bligatins in relatin t credit, r if yu cmmit a serius credit infringement. Credit related infrmatin disclsed by us t a CRB may be used in reprts prvided by the CRB t ther credit prviders t assist them in assessing yur credit wrthiness. ORIX uses the credit reprting services prvided by Equifax Australia Infrmatin Services and Slutins Ltd (Equifax). Equifax may include the infrmatin prvided by credit prviders in reprts t assist in the assessment f credit wrthiness. 3 Equifax nt t use the credit related infrmatin fr pre-screening purpses, and nt t use r disclse the infrmatin if they believe n reasnable grunds that the individual has been r is likely t be a victim f fraud. A cpy f Equifax's credit reprting plicy can be btained frm Equifax's website at ORIX may, as permitted by law, disclse credit related infrmatin abut an individual t ther third parties including: ORIX's related cmpanies; CRBs which include Equifax Australia Infrmatin Services and Slutins Ltd ( ther credit prviders and trade referees, including as listed in an individual's r rganisatin's applicatin frm r in reprts prvided by a CRB; rganisatins that perfrm credit prcessing functins, management and debt cllectin activities n ORIX's behalf; rganisatins invlved in debt assignment; securitised lenders t ORIX; ur custmer s guarantrs r prpsed guarantrs; ur agents, auditrs, slicitrs and ther prfessinal cnsultants; cmmercial / mercantile agents and debt cllectrs; inslvency practitiners (fr example, bankruptcy trustees, administratrs, receivers, liquidatrs); and gvernment departments r agencies (where required r authrised by law). ORIX may exchange that infrmatin with third parties fr the purpses f: assessing and prcessing an applicatin fr credit and cllecting verdue payments; ntifying ther credit prviders and trade referees f a default by the individual r rganisatin; ascertaining the status f credit prvided t an individual r rganisatin by ORIX where the individual r rganisatin is in default with ther credit prviders; assessing the individual's, r rganisatin's, credit wrthiness, credit standing r credit capacity; perfrming credit prcessing functins, management and debt cllectin activities n ORIX's behalf; btaining securitised funding; and undertaking any ther activity permitted r required under the Privacy Act. Overseas disclsures We smetimes disclse credit related infrmatin t related cmpanies f ORIX within Australia and verseas. Mstly in this case the recipient wuld be ORIX's New Zealand subsidiary (ORIX New Zealand Ltd) r its parent cmpany in Japan (ORIX Crpratin). In additin, sme f yur credit related infrmatin may be transferred, stred, prcessed r used within Australia r verseas, by us, r by third parties such as ur related cmpanies r third party service prviders wh may nt have an Australian link. Therefre, yur credit related infrmatin may be disclsed t third parties in accrdance with this Credit Reprting Plicy, including t third parties withut an Australian link, which may receive, stre and use yur persnal infrmatin in New Zealand and Japan, and such ther cuntries in which thse parties r their, r ur, cmputer systems may be lcated frm time t time, where it may be used fr the purpses described in, and therwise in accrdance with, this Credit Reprting Plicy. If yu wish t knw r have access t the credit related infrmatin ORIX hlds abut yu, yu can request this by cntacting the ORIX Privacy Officer (cntact details belw). Except where the infrmatin sught is nt readily accessible there will nt be any charge applicable t granting yu access. There are circumstances in which ORIX may decline t prvide yu access t the credit related infrmatin we hld abut yu and if this happens we will ntify yu f this and als yur rights with regard t cmplaining abut ur refusal. T ensure yu have access t the mst up t date credit related infrmatin, yu shuld als access the credit reprting infrmatin abut yu that is held by CRBs including the CRB that ORIX disclses infrmatin t as shwn abve. We take reasnable steps t ensure that any credit related infrmatin we cllect and use is accurate, cmplete and up-t-date. T assist us in this, yu need t prvide true, accurate, current and cmplete infrmatin as requested. In the event yu cnsider that sme f the credit related infrmatin ORIX hlds abut yu is incrrect r requires updating, yu can and shuld ntify us abut this including the particulars f which infrmatin yu cnsider t be incrrect, and f the crrect infrmatin, by cntacting the ORIX Privacy Officer the cntact details f whm are shwn belw. We take reasnable and apprpriate measures t prtect yur credit related infrmatin frm misuse, interference and lss, and frm unauthrised access, mdificatin r disclsure. We use and emply apprpriate systems, security measures, techniques and prcesses fr bth hard cpy and digitally recrded and stred infrmatin.
