Eligible Claimants The Prmtin is nly pen t individuals aged 18 years r lder wh are residents f Australia, excluding: management and emplyees f the Prmter, its assciated cmpanies/subsidiaries, Participating Stres and agencies assciated with this Prmtin. Emplyees means any directrs, management, emplyees, cncessinaires, cnsultants, fficers and cntractrs r ther such peple wh perfrm wrk under the cntrl f anther in exchange fr payment. The Prmter is respnsible fr determining whether a persn is an Eligible Claimant in its abslute discretin. Hw t Participate T participate in the Prmtin and claim a Gift, an Eligible Claimant must: (a) during the Purchase Perid, purchase any Participating Prduct frm a Participating Stre ( Qualifying Purchase ). (b) cllect and retain a cpy f their purchase receipt; and (c) within the Claim Perid visit and fllw the links t the Prmtin site r visit (d) fully cmplete and submit the nline claim frm n the Prmtin site, prviding all details required including, but nt limited t name, street address, suburb, state, pstcde, valid address, phne and age; the unique cde fund in the Participating Prduct s packaging; uplading a cpy f their Qualifying Purchase Receipt in an accepted file size/frmat; indicating their acceptance f these Terms and Cnditins. If an Eligible Claimant s cmplies with steps (a) (d) abve and their claim is deemed valid, they will receive an (t the address prvided as part f their valid claim) within tw (2) business days f submissin f the valid claim ( Gift Activatin ). The Eligible Claimant must then: (e) fllw the links in the Gift Activatin t access the redemptin prtal; and (f) enter the digital gift card unique cde.

2 If an Eligible Claimant s cmplies with steps (e)-(f) abve they will be ed their $10 David Jnes digital gift card. A Gift must be activated within ne (1) mnth frm the date f the Gift Activatin , r frfeited. If requested by the Prmter, Eligible Claimants must prduce, within the time requested by the Prmter at its abslute discretin: (a) apprpriate pht identificatin r ther dcumentatin, required by the Prmter t verify their identity, age, eligibility t participate in the Prmtin and claim a Gift and cmpliance with these Terms and Cnditins; and (b) their Prf f Purchase that crrespnds t the claim/s they have submitted in the Prmtin. If the items required by the Prmter are nt received r a claimant has nt been verified t the satisfactin f the Prmter within the time perid required by the Prmter, the claim/s submitted by the claimant will be deemed invalid. Gifts will nly be awarded fllwing all validatin and verificatin requirements f the Prmter being met t its satisfactin. Validatin & Ntificatin All claims submitted in the Prmtin will be reviewed by a representative f the Prmter (Validatin). Claimants must allw tw (2) business days fr Validatin t be cmpleted. If a claim is deemed valid, the Eligible Claimant will receive a Gift Activatin in accrdance with Hw t Participate abve. If a claim is deemed invalid, the Eligible Claimant will receive an ntifying them that their claim is invalid, reasns why (such as but nt limited t the purchase receipt prvided being unclear) and, if applicable, next steps. The Eligible Claimant will have three (3) business days frm the date f the ntificatin t prvide the requested infrmatin t the Prmter. The Prmter reserves the right t invalidate any claims if the Eligible Claimant has failed t prvide the further requested infrmatin within three (3) business days f the ntificatin by the Prmter. Gift Each Gift is a AUD$10 David Jnes egift Card, valid fr 18 mnths frm date f issue. Each Gift must be activated as per the instructins detailed in Hw t Participate abve, therwise frfeited.

GENERAL CONDITIONS 1. Details abve and the fllwing clauses cllectively frm the terms and cnditins f this Prmtin ("Terms and Cnditins"). 2. Each claimant is respnsible fr ensuring his r her familiarity with these Terms and Cnditins at the time f participatin. Participatin in this Prmtin is deemed acceptance f these Terms and Cnditins. The Prmter s decisin nt t enfrce a specific restrictin (whether cmmunicated t a claimant r nt) des nt cnstitute a waiver f that restrictin r f these Terms and Cnditins generally. 3. The Prmter s decisin in relatin t any aspect f these Term and Cnditins and the Prmtin is final and binding n every persn wh participates. N crrespndence will be entered int. 4. Each Qualifying Purchase f ne (1) Participating Prduct can be used twards ne (1) claim nly. 5. This Prmtin is nt valid in cnjunctin with any ther ffer. 6. Claimants can nly participate in the Prmtin in their wn name. Claimants wh enter using multiple aliases (e.g. multiple names, addresses and/r addresses) will be disqualified. 7. All claimants acknwledge that the Prmter can rely n these Terms and Cnditins even if the Prmter nly learns f a persn s ineligibility after the Prmter has awarded a Gift t the ineligible persn. Payment f the Gift value t the Prmter may be required by the Prmter if this ccurs. 8. Incmplete, indecipherable r incrrect claims will be deemed invalid. Claimants are respnsible fr ensuring their crrect persnal details are prvided and any updated details are ntified t the Prmter. The Prmter accepts n respnsibility shuld an Eligible Claimant fail t receive their Gift because f a failure t ntify the Prmter f crrect details r f a change t their details, r fr prviding invalid infrmatin. 9. There is a limit t the number f invalid Prmtin unique cdes that may be submitted by a claimant in attempting t enter the Prmtin. The Prmter may, at its abslute discretin, blck and/r disqualify claimants frm submitting further entries int the Prmtin where they have reached that limit.

4 10. Claims are deemed t be received at the time f receipt int the Prmter's database, nt time f transmissin by the claimant. 11. The Prmter des nt warrant that the claim mechanism will be available, r the Participating Stres will be pen, at all times during the Prmtin Perid. 12. The Prmter is nt respnsible fr any undelivered s due t a claimant s spam filters r settings. 13. The Prmter shall nt be liable fr a Gift being lst, deleted, stlen, damaged r tampered with in any way befre it reaches a claimant r after it has been released t a claimant. 14. Any csts assciated with accessing the Prmtin r Gift prvider s website, r assciated with redeeming a Gift are the claimant s respnsibility and are dependent n the internet service prvider used. Eligible Claimants must submit their claim manually using a cmpatible internet brwser. The use f any autmated sftware r any ther mechanical r electrnic means that allws a claimant t autmatically submit claims in the Prmtin repeatedly is prhibited and will render all claims submitted using such means invalid. 15. The Prmter may, in its sle discretin, declare any claim r claimant invalid if the claimant: (a) disrupts, annys, abuses, threatens, harasses r attempts t d any f these things t the Prmter, anther claimant r ptential claimant f, r anyne else assciated with, this Prmtin; (b) submits a claim that is nt in accrdance with these Terms and Cnditins r wh tampers with the claim prcess; r (c) engages in cnduct in relatin t this Prmtin which is misleading, deceptive, fraudulent r damaging t the Prmter's gdwill r reputatin. 16. If this Prmtin is interfered with in any way r is nt capable f being cnducted as reasnably anticipated due t any reasn beynd the reasnable cntrl f the Prmter, the Prmter reserves the right, in its sle discretin, t the fullest extent permitted by law t mdify, suspend, terminate r cancel the Prmtin, as apprpriate, subject t any directins frm any relevant authrity. 17. As a cnditin f claiming a Gift, the claimant may be required t (at the Prmter s discretin) sign any legal dcumentatin as and in the frm required by the Prmter and/r Gift suppliers in their abslute discretin. 18. The Prmter may cmmunicate r advertise this Prmtin via Facebk. Hwever, the Prmtin is in n way spnsred, endrsed r administered by, r assciated with, Facebk. Claimants are prviding their infrmatin t the Prmter and nt t Facebk. Each claimant cmpletely releases Facebk frm any and all liability. 19. Gifts must be taken as ffered and may nt be varied. Gifts are nt transferable, exchangeable r redeemable fr cash. If a Gift is unavailable fr any reasn, the Prmter reserves the right t substitute anther gift f equal r greater value fr that Gift, r element f it, subject t the apprval f any relevant authrity. 20. Except fr any liability that cannt be excluded by law, the Prmter (including its fficers, emplyees and agents) excludes all liability (including negligence), fr any persnal injury; r any lss r damage (including lss f pprtunity); whether direct, indirect, special r cnsequential, arising in any way ut f the Prmtin, including, but nt limited t, where arising ut f the fllwing: (a) any technical difficulties r equipment malfunctin (whether r nt under the Prmter s cntrl); (b) any theft, unauthrised access r third party interference; (c) any claim that is late, lst, altered, damaged r misdirected (whether r nt after their receipt by the Prmter) due t any reasn beynd the reasnable cntrl f the Prmter; (d) any variatin in Gift value t

5 that stated in these Terms and Cnditins; (e) any tax liability/implicatins incurred by a claimant; r (f) use f a Gift. 21. The: (a) Prmter, the Prmter's related entities, the Participating Stres and all agencies assciated with the Prmtin; and (b) the emplyees, agents, directrs and cntractrs, f all entities referred t in this clause, shall nt be liable fr any lss r claim, actin, demand, liability, damage, cst, expense r persnal injury whatsever (including but nt limited t any direct, indirect r cnsequential lss), incurred, suffered r sustained by any persn r entity (withut limitatin) in cnnectin with, r arising frm, the Prmtin r acceptance f a Gift, except that which cannt be excluded by law (in which case that liability is limited t the maximum extent allwable by law). 22. Claimants must, at the Prmter's request, participate in any Prmtin activity (such as publicity and phtgraphy) relating t participating in the Prmtin, free f charge, and they cnsent t the Prmter using their name and image in any future prmtinal material. 23. CAUTION: Any attempt t deliberately undermine the legitimate peratin f this Prmtin may be a vilatin f criminal and civil laws and shuld such an attempt be made, whether successful r nt, the Prmter reserves the right t refer the matter t law enfrcement authrities and/r t seek damages r such ther civil remedies as the Prmter may determine frm time t time t the fullest extent permitted by law. PERSONAL INFORMATION 24. Immediately upn submissin by a claimant, their claim becmes the sle prperty f the Prmter. 25. All infrmatin claimants prvide ( Persnal Infrmatin ) will be used by the Prmter fr the purpse f administering this Prmtin and awarding Gifts. 26. The Prmter may disclse claimants' Persnal Infrmatin t its cntractrs and agents t assist in cnducting this Prmtin and as required, t Australian regulatry authrities. OPTING-IN TO HEAR FROM THE PROMOTER 27. Shuld a claimant cnsent t receiving future infrmatin frm the Prmter, via placing a tick in the pt in bx featured n the Prmtin claim site, infrmatin prvided by the claimant may be entered int a database and used by the Prmter, the Prmter's related entities and agencies engaged by the Prmter, fr the Prmter's current and future prmtinal and marketing purpses withut further reference r cmpensatin t them. Shuld a claimant wh elects t pt in wish t pt ut r access r update their infrmatin held by the Prmter at any time, they can cntact the Prmter as per paragraph The Prmter's privacy plicy can be fund at The Privacy Plicy cntains infrmatin n: (a) hw a claimant may access the Persnal Infrmatin that is held by the Prmter and seek crrectin f such infrmatin; and (b) hw a claimant may cmplain abut a breach f the Australian Privacy Principles, r a registered privacy cde that binds the Prmter, and hw the Prmter will deal with such a cmplaint.

6 If a claimant has any questins regarding their privacy, they shuld cntact the Prmter using the cntact details cntained in the Privacy Plicy The Prmter and Participating Stres are bund by the Australian Privacy Principles in the Privacy Act 1988 (The Privacy Amendment (Enhancing Privacy Prtectin) Act 2012).
