1 Flrida Department f Transprtatin (FDOT) Business Participatin Plan FY Missin, Visin, and Statement f Cmmitment fr Enhancing Supplier Diversity FDOT is respnsible fr the state highway systems and public transprtatin systems including air, transit, and prts. Cntracting fr highly specialized services and purchasing cmmn prducts are tp pririties in the agency. FDOT purchases rad materials, cnstructin materials, and any prducts r services related t highway rad and bridge cnstructin. FDOT als purchases numerus supplies and services that help the agency run efficiently in the day t day peratins. FDOT is decentralized with the Central Office, seven districts, and Turnpike Enterprise respnsible fr cntracting thrughut the state; each has ffices respnsible fr acquiring cmmdities, cntractual services, rad and bridge cnstructin and maintenance, and prfessinal services. Missin: T fster the cntinued develpment and ecnmic grwth f small businesses thrugh equity in cntracting with minrity and wmen wned business enterprises. Visin: T have a supplier base that reflects Flrida s brad diversity. Statement f cmmitment fr enhancing supplier diversity: FDOT is cmmitted t develping, implementing, and mdifying strategies that maximize supplier diversity and small, minrity, veteran, and disadvantaged business enterprise (S/M/V/DBE) participatin in the prcurement prcess and wrking with all departments and districts in achieving FDOT s annual Minrity Business Enterprise (MBE) and Disadvantaged Business Enterprise (DBE) gals. FDOT s plicy is that DBEs, as defined by 49 Cde f Federal Regulatins Part 26, have an pprtunity t participate in the perfrmance f FDOT cntracts in a nndiscriminatry envirnment. FDOT als expects that grant recipients, cntractrs, cnsultants, and suppliers take all necessary and reasnable steps t ensure that DBEs have an pprtunity t cmpete fr and perfrm FDOT cntract wrk in a nndiscriminatry envirnment. 2. Senir Official Respnsible fr Mnitring and Implementing Plan The Equal Opprtunity Office (EOO) Manager is the senir fficial respnsible fr develping, mnitring, and implementing FDOT s plan. At each mnthly Executive Perfrmance Review Meeting, the EOO Manager reprts t the Secretary and senir management n the current level f mnthly DBE and MBE spending by each district. The EOO Manager analyzes FDOT s prgress tward gal attainment and identifies new and innvative methds t achieve the DBE and MBE gal in a race neutral envirnment. FDOT s DBE gal fr is 10.65%. Tracking data related t the plan: FDOT tracks data related t the plan via the Equal Opprtunity Cmpliance (EOC) database. Please see attached reprt fr an example f hw FDOT mnitrs and tracks certified minrity spending thrughut the year. If spending is nt n track during the year, the EOO Manager will reprt n any new strategies develped t increase FDOT s spending during the fiscal year.

Prpsal t Establish a Minrity Business Enterprise Cntracting Prgram FDOT has fur different types f minrity/small business prgrams: the Disadvantaged Business Enterprise (DBE) prgram, the Minrity Business Enterprise (MBE) prgram, the Business Develpment Initiative (BDI), and the Cnstructin Management Develpment Prgram (CMDP). FDOT puts frth great effrt t educate minrity businesses n these fur separate and distinct prgrams. The Equal Opprtunity Office is respnsible fr prmting and mnitring the participatin f minrity businesses. The DBE Prgram is a federal prgram that applies nly t FDOT and is limited t cntractrs and cnsultants invlved in planning, design, right f way, cnstructin, and ther prjects included in the FDOT s Wrk Prgram. FDOT is race neutral and des nt use individual cntract gals t administer the prgram. The Prgram s bjectives are: T ensure nndiscriminatin in the award and administratin f cntracts, T ensure firms fully meet eligibility requirements, T help remve barriers t participatin in FDOT cntracts, T create a level playing field, and T assist in the develpment f a firm s the firm can cmpete successfully utside f the prgram. EOO administers the DBE prgram and encurages diversity in cntracting fr tw types f cntracts: Cnstructin and Maintenance cntracts (in accrdance with Chapter 337, F.S.), and Architectural and Engineering cntracts (in accrdance with Chapter , F.S. and Chapter 14-75, F.A.C.). EOO is als respnsible fr prmting minrity participatin fr the cntracting f cmmdities and cntractual services (in accrdance with Chapter 287, F.S. and Chapter 60A-1, F.A.C.), and fixed capital utlay prjects (in accrdance with Chapter 255, F.S. and Chapter 60D-5, F.A.C.). The DBE Prgram is designed fr business wners deemed scially and ecnmically disadvantaged. T achieve DBE status, a business must be minrity r female wned r specifically shw scial disadvantage. The disadvantaged wner must hld a minimum f 51% f the cmpany r crprate stck. The primary wners must als maintain day-t-day cntrl f peratins, pssess an expertise in their wrk specialty, and have an investment in their cmpany. The primary wner cannt have a net wrth that exceeds $1.32 millin (excluding the wner s stake in the business and their primary residence). Prime cntractrs are encuraged t use subcntractrs certified as a Disadvantaged Business Enterprises. The MBE Prgram applies t all state agencies and is administered by the Department f Management Service s Office f Supplier Diversity (OSD). The MBE prgram certifies small businesses dmiciled in Flrida. The business must be at least 51% wned by a minrity persn wh is a Flrida resident and whse management and daily peratins are cntrlled by a minrity persn(s). The firm must emply 200 r fewer emplyees and have a business net wrth f nt mre than $5 millin. FDOT encurages DBE subcntractrs t apply fr certificatin in the state s MBE prgram. While the certified minrity business cap is different between MBEs and DBEs, FDOT believes there is pprtunity fr verlap that will increase the availability pl f certified minrity businesses. The Business Develpment Initiative (BDI) is ne f FDOT s effrts t increase cmpetitin, lwer prices, and increase supprt t small businesses t meet its cntracting needs ver the next ten (10) years. On July 1, 2016, Huse Bill 7027 ( F.S.) went int effect t include the establishment f a Business Develpment Prgram t assist small businesses in btaining cntracts with the department, and is nw FDOT s way f ding business.

Gaining experience n small FDOT cntracts will prepare these small businesses t bid n larger cntracts. The BDI prvides the fllwing assistance t small businesses: Reserves Cnstructin and Maintenance cntracts f less than $1,500,000. These prjects are listed n the FDOT website Waives perfrmance bnd requirements fr cntracts under $250,000. Required bid bnds are $500 fr cntracts ver $150,000 Mdifies the qualificatin prcess. Bidders n reserved BDI cnstructin and maintenance cntracts are nt required t be prequalified Reserves Prfessinal Services cntracts f less than $1,500,000 fr state funded r federal funded prjects; hwever, prfessinal service prjects that are reserved require prequalificatin Reduces liability insurance requirements T be eligible t bid n BDI cntracts, the firm must: Meet the small business definitin as defined by FDOT Submit a ntarized affidavit n a frm prvided by FDOT attesting t meeting the definitin f a small business Prvide a listing f cntracts that the firm has perfrmed either as a prime r subcntractr. This is part f the mdified prequalificatin requirement fr small cntractrs, nt cnsultants. 4. Prpsed Outreach Activities FDOT encurages S/M/DBEs t bid n cnstructin prjects thrugh utreach, educatin, and matchmaking activities. FDOT participates in district level and statewide effrts t reach ut t lcal businesses desiring t d business with FDOT, including matchmaking activities spnsred by OSD. Outreach activities planned fr fiscal year target bth certified and nn-certified S/M/DBEs infrming them abut available FDOT cntracting pprtunities including, but nt limited t: Prviding infrmatin abut training available t certified and nn-certified S/M/V/DBEs thrugh the FDOT Cnstructin Management Develpment Prgram (CMDP), Prviding infrmatin abut the FDOT DBE Supprtive Services (DBE/SS) Bid Matching Prgram t increase the number f DBE subscribers, Cnducting DBE seminars n majr design-build prjects by the FDOT Specialized Develpment Prgram (SDP), Recruiting qualified businesses and assisting with DBE certificatin, Making prime cntractrs, FDOT staff, and ther industry rganizatins aware f assistance available t DBEs, Prviding infrmatin t DBEs abut nn FDOT wrk pprtunities, Planning and participating in M/DBE training seminars, wrkshps, and listening sessins, Serving as a liaisn with M/DBEs and prime cntractrs, Educating and encuraging cities and cunties t use the BDI t include Lcal Agency Prjects (LAP) cntracts, Encuraging the districts t identify additinal cntracts that can be reserved fr small businesses, Presenting M/DBE prgrams at wrkshps n jint venturing, bnding, estimating, and bidding t FDOT, Expediting certificatin fr truckers, and Participating in the fllwing: OSD Supplier Diversity Exchanges and varius reginal matchmaker wrkshps Flrida Minrity Supplier Develpment Cuncil Annual Trade Fairs

Planned Prgrams t Educate Business Owners FDOT educates businesses n hw t d business with the State f Flrida and FDOT thrugh varius prcesses t ensure that the prgrams reach certified and nn-certified small, minrity, and disadvantaged businesses. The Vendr Guide, which is available n FDOT s prcurement website, is als disseminated at trade shws. The guide includes infrmatin abut registering as a vendr in the MyFlridaMarketPlace (MFMP) t receive ntificatins fr bid slicitatins. The guide als advises n hw t determine the categry a business falls under, and prvides an understanding f hw FDOT cntracts fr thse services (cnstructin and maintenance; fixed capital utlay; architectural and engineering; and cmmdities and cntractual services) and whether a business qualifies as a DBE and/r Certified MBE. The prcurement ffice s website als has marketing infrmatin available categrized by district marketing sites. FDOT prvides additinal supprt t S/M/DBEs thrugh its Supprtive Services prgrams. The prgrams are designed s that DBEs receive training, infrmatin, and assistance in preparing bids, and btaining bnding, financial assistance, and insurance. The Cnstructin Estimating Institute (CEI) is the statewide prvider and administers the fllwing prgrams: DBE Supprtive Services - the purpse is t increase the number f certified DBEs participating in the highway prgram, and t cntribute t the grwth and eventual self-sufficiency f DBEs s that they may achieve prficiency in cmpeting fr cntracts and subcntracts. Cnstructin Management Develpment Prgram - assists S/M/V/DBEs with training and n-thejb instructin t raise the level f prfessinalism, prficiency, and cmpetitiveness f small, minrity and scially and ecnmically disadvantaged businesses. CEI prvides managerial and technical assistance t certified DBEs cmpleting the CMDP. Bnd Guarantee Prgram - prvides eligible DBE cntractrs with bnding pprtunities, s they may participate in transprtatin cnstructin prjects. In additin t educatinal prgrams, FDOT prvides additinal assistance t DBEs thrugh the Specialized Develpment Prgram (SDP). Administered by the Flrida State Minrity Supplier Develpment Cuncil (FSMSDC). The SDP assists prime cntractrs n pririty prjects, and identifies qualified DBEs t cmpete fr subcntracting pprtunities. 6. Summary f Past Cntracting Success FDOT s prime cntractrs (primes) are the cnstructin and engineering firms that prduce Flrida s rads and bridges. FDOT s prductin plan fr state fiscal year resulted in cnstructin prjects with an estimated value f $3.7 billin and cnsultant prjects estimated at $1 billin. During the last fiscal year, FDOT

5 Flrida Department f Transprtatin Business Participatin Plan Octber 31, 2017 Page 5 expended $378,997,187 t certified minrity businesses (an increase f $81,677,950), and $574,406,022 t nncertified minrity businesses (an increase f $112,056,251). FDOT s cmmitment fr fiscal year is t exceed last year s spending. Attached is a spreadsheet reflecting past cntracting with certified minrity businesses. 7. Methd fr Capturing and Reprting Subcntractr Infrmatin FDOT s Equal Opprtunity Cmpliance System (EOC) is an internet based tracking system that allws primes t lg in and submit subcntractr payments. The system includes an interface with OSD s certified minrity business directry t identify all subcntractr payments t certified minrity firms. EOO requires prime cntractrs and cnsultants t utilize the EOC system t reprt MBE participatin. Thrughut the fiscal year, FDOT uses the Certified Minrity Business Expenditures Reprt by Organizatinal Unit (Districts) t mnitr and identify cntracting and subcntracting pprtunities and expenditures: 8. DBE & MBE Assistance Initiatives Since 1984, FDOT has prvided a state funded business develpment cmpnent thrugh the Cnstructin Management Develpment Prgram/Bnd Guarantee Prgram (CMDP/BGP). In accrdance with Sectin , F.S., the CMDP ffers classrm, n-line, and n-the-jb training and supprt t S/M/V/DBEs. The CMDP is designed t imprve technical and business management skills, as well as, assist in learning hw t d business with FDOT. DBEs cmpleting this prgram are eligible fr bnd guarantees f up t between 80 90% f their cnstructin cntract amunt. The Supprtive Services (SS) Business Develpment Prgram (BDP) is designed t assist DBEs in areas including bid matching assistance, back ffice supprt, and lan applicatins. In additin t DBE/SS general services, qualified DBEs applying fr business develpment, r applying t the SDP Bridging the Gap (mentr-prtégé prgram) may participate in the BDP fr mre detailed technical training tailred t an individual DBE s needs. BDP participants must be invlved with highway, radway, and bridge wrk. Eligible DBEs must be in business fr at least six (6) mnths, and have bid n prjects as either a sub r prime fr any radway and bridge wrk (i.e, FDOT, city, cunty, etc.). The DBE Supprtive Services Prvider (SSP) may waive the six (6) mnth requirement as deemed apprpriate. After admissin t the BDP, the DBE must submit a business plan with assistance frm the DBE SSP, within six (6) mnths. The apprved business plan must be n file with the DBE SSP and include specific targets, bjectives, and gals fr the business develpment f the BDP participant during the next tw (2) years, as stated in Appendix C t Part 26. Once the DBE SSP apprves the business plan, the BDP participant enters the develpment stage f the BDP, which prvides capacity building assistance with special emphasis n FDOT s cre areas f rad and bridge cnstructin. The DBE SSP cmpletes an advanced needs assessment that includes a detailed review f the current business capacity, market ptential, and strengths and weaknesses in the areas f financial, managerial, technical, and labr cnditins. Based n the advanced needs assessment, the DBE SS prvider develps an actin plan with specific training requirements, targeted gals, and cmpletin timetables fr each BDP participant. The DBE SSP will prvide training (utilizing CMDP training materials whenever pssible), and assist with ne-n-ne educatinal and technical needs in business management and business plans; marketing, business law, equal pprtunity, and safety, and cmputer training. As part f the actin plan develped by the DBE SSP prvider, a BDP participant must shw prficiency in prject management skills by graduating r receiving an exemptin frm the Cnstructin Management Develpment Prgram (CMDP). This includes classrm and n-the-jb instructin/technical assistance as

Within twelve (12) mnths f prgram entry, a BDP participant shuld graduate frm the CMDP and be eligible fr the Bnd Guarantee Prgram (BGP). BDP participants als receive back ffice assistance, which includes, but is nt limited t, assistance with setting up the BDP participant s business ffice, such as certified payrll, payrll, and accunts receivable. Additinally, BDP prvides nsite payrll preparatin assistance, as directed by FDOT such as: Certified payrlls and cmpliance with ther federal and state requirements, Financial related assistance such as bnds, finances, and rental agreements, State requirements such as licensing and registratins, Safety requirements, and Assistance with imprving ther nsite ffice and administrative functins. Annually, the DBE SSP will evaluate each BDP participant and review and mdify the BDP participant s currently apprved business plan with the BDP participant, accrding t the participant s structure and redefined develpmental needs. The mdified business plan shuld include a frecast f the BDP participant s need fr cntract awards. Each review shuld track the BDP participant s achievement f targets, bjectives, and gals set in its transitin plan. The apprval date f the initial business plan is the anniversary date fr annual evaluatins. Cmpletin f the develpmental stage will vary by BDP participant hwever, a majr factr is when the BDP participant has cmpleted the actin items in the training plan. Beginning in the first year f the transitinal stage in which the DBE receives specialized assistance with btaining cntracts as primes and graduating frm the DBE Prgram, a DBE participant shuld submit fr inclusin in its annually reviewed business plan a transitin management plan. The plan shuld utline specific steps t prmte prfitable business peratins in areas ther than traditinal areas f DBE participatin after graduatin frm the prgram. The plan shuld als include the BDP participant s needs fr grwing and expanding business int ther areas by diversifying. The mdified business plan shuld include steps fr cntinuing business develpment after the prgram term has expired. Each review shuld shw that the BDP participant has substantially achieved the targets, bjectives, and gals set in the prgram term. BDP participants receive assistance in marketing their business, including the develpment f a website, capability statement, and marketing strategy. BDP participants als receive ne-n-ne assistance in matching participants with Business Develpment Initiative (BDI) prjects, and ther pprtunities n FDOT prjects. The Cnstructin Estimating Institute (CEI): Refers DBEs t the SDP fr identifying pprtunities n majr prjects, Cnducts and participates in DBE Matchmaker cnferences t stimulate grwth fr DBEs by creating pprtunities t netwrk and create new relatinships fr future cntracts with primes, and Assists with finding pprtunities and resurces fr develping jint ventures. DBE Supprtive Services refers DBEs wh have successfully cmpleted wrk n FDOT prjects t the SDP Bridging the Gap Pilt Prgram, designed t assist DBEs with graduating frm the prgram. FDOT s DBE/Supprtive Services Bid Matching Prgram infrms DBEs f upcming cntracting and subcntracting pprtunities available in their specific wrk classificatins. DBEs wh wish t participate in the bid matching prgram must have a current needs assessment n file with the DBE SSP, and must prvide a valid address where the bid matching ntificatins will be delivered. DBEs wh register fr the bid matching prgram receive s prir t every FDOT letting infrming them f pprtunities in their wrk classificatins, and gain access t individual web pages listing cntracting and subcntracting pprtunities in

DBE SSP divides wrk pprtunities int mre than frty (40) different wrk classificatins and match the wrk pprtunities t DBEs by Nrth American Industry Classificatin System (NAICS) cdes. DBE SSP s wrk pprtunity reprts fr each classificatin t DBEs with matching NAICS cdes. The wrk pprtunity reprts cntain detailed line item descriptins f the available wrk, alng with links t the bid slicitatin ntices and the list f prpsal hlders fr each bid slicitatin. 9.
