NOTICE INVITING TENDER (TWO COVER SYSTEM) (Through e-procurement portal only) Date: 15 th December The Chief Engineer (Civil) invites item rate tenders from eligible tenderers for the following work of YTPS detailed in the table given below. 02. Tender documents may be downloaded from Government of Karnataka e-procurement website under login for Contractors: After login to Contractors, Please scroll down to the right side bottom to see List of tenders, please click there to find the details of NIT and download copy of the tender. The tender can be downloaded in the portal as per prescribed date and time published in the portal. Only interested Contractors who wish to participate should remit on line transaction fee for tender after registering in the portal. The transaction fee is non-refundable. 03. Tenders must be accompanied by Earnest Money Deposit which should be paid online through e-procurement portal using any of the following payment modes a) Credit Card, b) Direct Debit, c) National Electronic Fund Transfer (NEFT), d) Over the Counter (OTC) (only through designated branches of ICICI Bank). 04. Tenders must be electronically submitted (online through Internet) within the date and time published in e-procurement portal. First Cover Tenders will be opened at prescribed time and date in the e-procurement portal, in the presence of the Tenderers who wish to attend at the Office of the Chief Engineer (Civil ), RPCL, YTPS, Yermarus , Raichur District. 1

Any reputed individual /Company registered as Class-I Contractor either with KPCL or with any Govt./Govt. under taking departments. 02. No Joint Venture /Consortium are permissible. 03. Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by KPCL or by any State Government / Government of India /Union Territory. 04. None of the contracts of the tenderer should have been terminated/ foreclosed on account of his default in KPC or elsewhere during last ten years. 05. The bidder should have the following documents; a. Income tax PAN. b. VAT registration certificate & composition c. Independent PF code. d. Service tax registration certificate. 06. MINIMUM PRE-QUALIFYING REQUIREMENTS To qualify for awarding the contract the tenderer should have the following in his name in the last five years. (i.e to ) i. The bidder should have satisfactorily completed one Over Head tank work of not less than 400 cum capacity with height not less than 15m either in State/Central Department or Government undertakings in the last five years (i.e to ) under a single contract. (The value of the completed works shall be given a weightage of 10% 2

3 per year to bring them to the price level of the FY in which the tenders are invited.) ii. The bidder out of the past five financial years (i.e to ) should have a minimum annual financial turnover of not less than `642.00Lakhs at least in any two financial years. (Financial turnover of previous years shall be given a weightage of 10% per year to bring them to the price level of the FY in which the tenders are invited) 07. The tender is of two cover system. The Bidder should upload scanned copies of the following documents. COVER-I (Technical bid) a) Appropriate Class of Registration of contractor certificate issued by Govt/Govt. under takings. b) The declaration by the bidder that none of his contracts have been terminated/foreclosed on account of his default in KPC or elsewhere during last ten years in the prescribed format uploaded. c) 1) Income tax PAN. 2) VAT registration certificate & composition 3) Independent PF code. 4) Service tax registration certificate. d) Declaration that bidder s offer has no conditions contravening the commercial conditions of the bid in the prescribed format uploaded. e) Declaration by the bidder that he has studied the site conditions, labour conditions and read the Bid documents and related matters carefully and diligently and that he has submitted the bid having studied, understood and accepted the full implications of the agreement in the prescribed format uploaded. f) EMD: The e-payment shall be made for Rs. 4,82,000/- (Direct debit, credit card & National Electronic Fund Transfer (NEFT) or Over the Counter (OTC) only through ICICI Bank). EMD shall be valid for a period of 180 days from the date of opening of the Technical bid (cover-i). Only on receipt of full EMD of Rs.4,82,000/- along with Technical Bid, Financial Bid will be opened and considered for evaluation. g) Contract Performance Guarantee- The successful bidder has to furnish a Bank Guarantee/FDR from a scheduled Bank towards contract performance, equivalent to 5% (Five) of the contract value with an appropriate validity period (including maintenance period of one year in addition to the completion period of the work envisaged), within 20 days from the date of letter of Award (LOA). The BG shall be furnished in the prescribed format only. 3

4 h) The bidder should have satisfactorily completed one Over Head tank work of not less than 400 cum capacity with height not less than 15m either in State/Central Department or Government undertakings in the last five years (i.e to ) under a single contract. Certificate to that extent shall be issued by the competent authority not below the rank of Chief Engineer in case of KPCL/RPCL works and not below the rank of Executive Engineer in case of other Government organization and the same is to be uploaded in the technical-bid. i) The bidder out of the past five financial years (i.e to ) should have a minimum annual financial turnover of not less than `642.00Lakhs at least in any two financial years. Audited balance sheets and profit and loss account sheets shall be furnished duly certified by the Chartered Accountant. j) The contractor should fill up the form for declaration of method of payment of service tax uploaded along with the tender document and scanned copy should be uploaded in the technical bid. Tenders without the above filled up[with tick( ) mark] form will be rejected. k) Scanned copy of filled up Appendix-II (Schedule of equipments) under Section 10 in Volume I. l) Scanned copy of filled up Appendix-III (Schedule of Rates for labours) under Section 10 in Volume I. COVER-II (Financial bid) Tender Schedule-B (Price Bid). 08. The original documents should be produced for verification at any stage of tender process as and when sought for, failing which, the bids are liable for disqualification. 09. Rates shall be quoted in Tender Schedule-B (Financial Bid) in the website itself. 10. For those tenderers whose Technical bids satisfy the pre-qualification requirement criteria and eligibility criteria, only their financial Bids will be opened. 11. The tender shall be valid for 180 days from the date of submission of tenders. 12. The tender document is part and parcel of the agreement. 13. Conditional tenders will not be accepted. 4

5 14. RPCL reserves the right to verify any information/documents furnished by the tenderer, should the circumstances so warrant. In case the information or the documents furnished are found to be incorrect/false or invalid, then the EMD furnished by such tenderer shall be forfeited. The registration of such tenderer shall also be cancelled. 15. Right to reject any or all the tenders without assigning any reasons rests with the accepting authority. 16. The successful bidders shall give an undertaking that they would abide by the provisions of the Employee s Provident Fund Act. 17. The contractor shall obtain Insurance coverage for all the workers working in the site area. 18. Bids with stipulation for settlement of disputes by reference to arbitration are not acceptable. 19. The contractor shall quote his rates inclusive of all applicable taxes (including service tax), levies, duties and Cess, Building worker welfare Cess (if applicable) etc., as per the latest G.O.K. and Government of India prevailing as on the date of submission. The contractor should fill up the form for declaration of method of payment of service tax uploaded along with the tender document and scanned copy should be uploaded in the technical bid. Tenders without the above filled up form will be rejected. 20. The contractor shall quote his rates inclusive of PF as per the applicable rates as issued by the PF Department from time to time and if any variations occur, it shall be paid/refunded by / to the Corporation against the documentary evidence. 21. RPCL shall recover the income tax, work contract tax, VAT etc., at the prevailing applicable rates. 22. The bidder should maintain register of labour deployed and wages paid for the workers and shall produce the documents whenever called for by the competent authority and remittance towards PF shall commensurate with the labour component for the work involved. 23. Contractor should have independent PF Code. The Contractor shall remit PF of labourers to contractors permanent PF code Number only and not to the RPCL PF Sub Code. 24. In case the dates notified above be declared as holiday, the immediate next working day shall be reckoned. 25. Before entering into agreement with the Corporation, the successful tenderer/ bidder shall furnish a bank guarantee towards Contract Performance equivalent to 5% of their contract value from any nationalized bank/schedule bank in the approved format as per the conditions in the tender and valid till completion of the contract period including maintenance period of 12 (Twelve) months. 26. If the contractor makes any alterations in the conditions of the contract or puts any condition of his own, such tenders are liable for rejection. 5
