The EXECUTIVE ENGINEER (CHP) MECHANICAL/RPCL invites sealed tenders from eligible tenderers for the work of Loading, Internal Transportation and Unloading of Coal from Stock yards at YTPS to ERH -1 and 2 at Coal Handling Plant, YTPS as detailed in the table given below under Clause No Tender documents may be downloaded from Government of Karnataka e-procurement website under login for Contractors: After login to Contractors, Please scroll down to the right side bottom to see List of tenders, please click there to find the details of NIT and download copy of the tender. The tender can be downloaded in the portal as per prescribed date and time published in the portal. Only interested Contractors who wish to participate should remit online transaction fee for tender after registering in the portal. The transaction fee is non-refundable. 03. Tenders must be accompanied by Earnest Money Deposit (EMD) which should be paid online through e-procurement portal using any of the following payment modes. a) Credit Card, b) Direct Debit, c) National Electronic Fund Transfer (NEFT), d) Over the Counter (OTC) (only through designated branches of Axis Bank). 04. Tenders must be electronically submitted (online through Internet) within the date and time published in e-procurement portal. First Cover Tenders will be opened at prescribed time and date in the e-procurement portal, in the presence of the Tenderers who wish to attend at the Office of the EXECUTIVE ENGINEER (CHP) MECHANICAL/RPCL YERAMARUS, Raichur District. 05. Earnest Money Deposit: Earnest Money Deposit of Rs. 1, 33, which should be paid online through e-procurement portal for the tender shall be in any of the above payment modes indicated under Clause

Up to 18:30 hour on :00 hour hour (Subject to intimation) ELIGIBILITY CRITERIA 1) Any individual/reputed contractor is eligible to apply. 2) No Joint Venture/Consortium is permissible. 3) Tenders shall not be under declaration of ineligibility for corrupt and fraudulent practices issued by the Government of Karnataka Government of India. 4) None of the contracts of the tenderer should have been terminated/force closed on account of his default in KPCL, RPCL or elsewhere during last ten years. 5) The bidder should have following documents; a) Income tax PAN. b) Goods and Service tax registration certificate In case the bidder does not have the certificates of KGST clearance, K-GST Registration, Independent PF code, if the work is awarded to him, the same has to be produced at the time of entering in to agreement with RPCL-YTPS. Minimum Pre-Qualification Requirements: The intending bidder shall satisfy the following Pre-Qualifying Requirements: a. The agency should have past experience in carrying out works of loading, internal transportation and unloading of coal/coal lumps/boulders inside the coal handling plant area and having executed work, amounting to Rs lakhs and above in any one year, during current/ previous four years. The bidder shall submit documentary 2

3 evidence in the form of copy of work orders or LOI copies and also furnish the corresponding work done certificate. b. The bidder shall have an average annual turnover of Rs lakh and above during any TWO year of the last five financial years ( , , , & ). P&L statement and Annual financial statements or reports duly certified by the chartered accountant shall be submitted. 01. (TECHNICAL BID) a) The declaration by the bidder that none of his contracts have been terminated or force-closed on account of his default in KPCL, RPCL or elsewhere during lastten years. b) 1) Income tax PAN 2) Goods and Service tax registration certificate. c) Declaration that bidder s offer has no conditions contravening the commercial conditions of the bid. d) Declaration by the bidder for studied the site conditions, labour conditions and read the bid documents and related matters carefully and diligently. Also furnished the e) Documentary evidence for pre-qualifying requirements. TENDER SCHEDULE-B (PRICE BID): 02. (FINANCIAL BID) 01. The original documents should be produced for verification at any stage of tender process as and when sought for, failing which, the bids are liable for disqualification. 02. Rates shall be quoted inclusive of G.S.T in the website portal itself. Rates quoted in the e-portal shall be considered for evaluation of prices. 03. For those tenderers whose Technical bids satisfy the pre-qualification requirement criteria and eligibility criteria, only their Financial Bids will be opened. 04. The tender shall be valid for 180 days from the date of submission of tenders. 05. The tender document is part and parcel of the agreement. 06. Conditional tenders will not be accepted. 07. YTPS-RPCL reserves the right to verify any information/documents furnished by the tenderer, should the circumstances so warrant. Right to reject any or all the tenders without assigning any reasons rests with the accepting authority. 08. The successful bidders shall give an undertaking that they would abide by the provisions of the Employee s Provident Fund Act. 09. The contractor shall obtain Insurance coverage for all the workers working in the area. 10. The contractor shall quote his rates Inclusive of Goods and Service Tax. 3

4 11. The contractor shall quote his rates inclusive of PF as per the applicable rates as issued by the PF Department from time to time and if any variations occur, it shall be paid/refunded by / to the Corporation against the documentary evidence. 12. The bidder should maintain register of labour deployed and wages paid for the workers and shall produce the documents whenever called for by the competent authority and remittance towards PF shall commensurate with the labour component for the work involved. 13. Contractor should have independent PF Code. The Contractor shall remit PF of labourers to contractors permanent PF code Number only. 14. The tender work of 9,000 trips internal coal transportation fixed for a period of Six months. Work may not be continuous, operated as and when required based on coal requirement at bunkers and the coal stock in YTPS coal stock yard. However for every clearance of work, assured quantity of trips will be 750 numbers. 15. In case feeding activity stopped for long duration, due to unforeseen reason in the system as well as unit end, RPCL have right to short closed the awarded contract. 16. In case Main YTPS O&M work order placed, the tender called for subject work will be treated cancelled from effective date of main O&M contract. 17. In case the dates notified above are declared as holiday, the immediate next working day shall be reckoned. 18. Before entering into agreement with the Corporation, the successful tenderer/bidder shall furnish an F.D.R/bank guarantee towards Contract Performance equivalent to 5 % of their contract value from any nationalized bank/schedule bank in the approved format as per the conditions in the tender and valid till completion of the contract period. 19. If the contractor makes any alterations in the conditions of the contract or puts any condition of his own, such tenders are liable for rejection. 20. 5 ANNEXURE I GENERAL TERMS AND CONDITIONS 1. Tenders from Contractors, who do not have sufficient experience in executing similar transportation works, as per PQR, will not be considered. However, the decision of the undersigned shall be final and binding on all. 2. Rates quoted in schedule should be final. The quoted rates should include G.S.T and include PF and other levies. 3. EMD of the rejected Tenderers shall be returned only after finalization of the tender. The EMD shall carry no interest. 4. Work Division -The said work will be monitored/ Executed from Executive Engineer (CHP) Mechanical, YTPS-RPCL 5. Billing and Payment: A. Billing: Contractor shall submit the R.A bill for the work of Loading, Internal Transportation and Unloading of Coal from Stock Yard at YTPS to ERH-1 and 2in quadruplicate to Executive Engineer (CHP) Mechanical, RPCL, Yermarus. Bill shall be submitted along with required documents. B. Payment Terms: 100% Payment will be made within 30 days from date of submission of bill. Agency shall provide PAN Number to RPCL. Income-tax and other applicable taxes if any shall be deducted at source at the prescribed rates as per the statutory levies / taxes in force at the time of payment of the bills. Necessary certificates of tax deducted at source shall be issued / furnished by RPCL to the agency. 6. Agreement: The successful tenderer shall attend the office of the ExecutiveEngineer(MECHANICAL)/RPCL YERAMARUS, RAICHUR on the date(s) fixed by intimation, for executing the agreement etc. 7. Security deposit: The successful tenderer should deposit within 20 days from the date of issue of work order, a security deposit in the form of DD/FDR/BG drawn in favour of General Manager(Finance), RPCL, Bangalore, on any Nationalized Bank, for an amount equivalent to 5% of the contract amount; (plus additional security for unbalanced tenders). This Deposit shall not carry any interest. 8. Security deposit shall be refunded after Two month from the date of payment of final Bill subject to clearance of all dues. 9. The rate(s) offered shall be firm and no variation shall be allowed in cost / labour/materials or any other factor/s affecting the process or services. 10. RPCL will be extended the contract period, till completion of contract schedule quantitydepending on the performance of the contractor and requirement of coal trips. 11. Acceptance of the lowest or any tender is not binding on the Corporation. The Corporation reserves the right to reject any or all tenders without assigning any reason. 12. The submission of tender by Contractor implies that he has read the contract schedules, conditions of contract and has understood the scope and specifications of the work to be done and availability of the quantities of the materials and laborers required. Sufficient 5

6 loaders, trucks should be deployed in such a way that, the work has to be attended, in a short notice for continuous feeding of coal to Unit - 1 and 2bunkers. 13. The Contractor shall pay statutory taxes levied by the State Government and City/ Municipal Corporations/ Local Bodies, etc.; and also royalty if any due to the Government of Karnataka at the prevailing rates during the contract period. 14. Income tax at prevailing rates and any other statutory recoveries shall be recovered from the bills. 15. The contract shall obtain Goods and Service Tax Certificate from the Commercial tax/service tax department of Karnataka State/ GOI before executing the agreement. 16. The contractor shall be governed by the factory act, minimum wages act, EPF act, workmen s compensation act, contractor s labour act and other relevant acts and rules as applicable to the labourers employed by him. 17. No part of the contract shall be sublet without written permission of the Executive Engineer CHP [Mechanical] YTPS, RPCL, nor is any transfer made by Power of Attorney. 18. The Contractor shall be responsible for all accidents to the labour employed by him. 19. Any loss or damage to Corporation's property, due to negligence of the labourers employed by him, shall be made good as assessed by the Executive Engineer. 20. The Contractor shall obtain a license from the appropriate Authority under Labour (Regulation and Abolition) Act for undertaking the work and for engaging the workmen. Such license shall be got renewed from time to time. 21. The tenderer should obey all the security rules of the RPCL-YTPS and labour rules in vogue. 22. The Contractor shall notify the wage period and the place and time of disbursement to the workmen engaged on the work as per the Payment of wages Act and Contract Labour (Regulation and Abolition) Act and a copy thereof sent to the Corporation. 23. Contractor shall provide Welfare facilities as envisaged under the Contract Labour (Regulation and Abolition) Act and other Rules applicable. 24. The Contractor shall pay compensation to his workmen in case of accidents, as per the Workmen s Compensation Act. To facilitate prompt payment, the Contractor shall obtain an insurance policy for the works to cover labourersdeployed and submit to the Executive Engineer concerned. 25. Any accident shall be brought to the notice of the Executive Engineer concerned and the Contractor shall comply with instructions issued in this behalf by the Corporation. The Contractor shall comply with the provisions of relevant acts and rules as applicable. 26. The Contractor shall remit installments of PF (employees and employers contributions) in respect of his workmen to the PF Authorities and submit the proof of payment to the Executive Engineer along with the Bill. Otherwise Bill will not be accepted. M/s. RPCL shall reimburse to the contractor the actual amount of PF remitted by him to the concerned authorities, as per the PF statement paid at prevailing rates. The quoted price shall be including PF amount. 27. The Contractor shall maintain all Registers and Documents as envisaged in Contract Labour (Regulation and Abolition) Act and Rules made thereunder. He shall also send a monthly 6

7 statement of workers engaged by him classified according to the skill and strength to the Executive Engineer. He shall also allow verification of Registers and Documents maintained by the Personnel Officer of the Executive Wing of the Corporation in addition to the inspecting staff of the Government. 28. The Corporation reserves the right to reduce or extend the contract or also may terminate the contract at its discretion. 29. Any or all disputes shall be settled by the Chief Engineer(Mechanical) YTPS/RPCL, Yermarus & his decision shall be final and binding on all the concerned. 30. The contract is liable for termination within three days notice if the work carried out by the Contractor is not satisfactory. EMD and Security Deposit shall also be forfeited. 31. The Contractor shall not be entitled to any loss or damage in case the contract is to be suspended for some time due to any equipment break-down or shut down of the Unit/s for one reason or the other and for which he is not entitled for any compensation. 32. The Contractor shall keep the area of work neat and tidy. The contractor or his authorized Representative shall be available for supervision of the work. The supervisor shall co-ordinate with concerned site YTPS-RPCL site engineers for execution of work as per requirement during Unit 1 generation activity. 33. The e-portal schedule B rates inclusive of G.S.T, will be considered for evaluation of price bid. The Contractor shall, if directed by the Executive Engineer, dismiss or discontinue from the work any person employed for misconduct or incompetence. Such person shall not be employed again on the works without the written permission of the Executive Engineer. 34. In the event of death or insolvency or insanity or imprisonment of the Contractor, the Corporation can terminate the contract by a Notice in writing pasted at the place of work. The corporation is not liable for the payment of compensation wages to the labourers employed by the contractor. Also, his legal heir, if an eligible registered contractor and willing, can execute and complete the work at the accepted rates irrespective of the cost of the work. 35. No child labour shall be engaged. 36. The contractor s employees have proper supervision on assigned work in shift at YTPS/RPCL premises. Maintained the equipment s healthiness for continuous operation to achieve the target quantity. 37. It is the responsibility of the contractor to provide necessary safety equipments and to ensure usage of the same by the workers wherever necessary. During loading, internal coal transportation and unloading from stock yard to ERH 1 and 2, trucks are not supposed to over speed. Speed limit to be maintained. 38. The Contractor primarily is responsible for all accidents to all the labour employed by him. 39. No overtime claims will be entertained by the Corporation. 40. The Contractor should be ready to take up the assigned work within short notice, at any time. It will be the responsibility of the contractor to mobilize the machinery immediately, within a short notice period. The total responsibility to carry out the work is fixed with the contractor. 7

8 41. Procedure for operation: a. For every start obtain siteclearance, however minimum 750 trips will be assured for internal logistics work from contract schedule quantity. b. Feeding process may not be a continuous, and shall be operated as and when required based on coal requirement at bunkers and coal stock in YTPS coal stock yard, hence agency shall adhere to the contract condition and nature of work. c. The period of contract estimated for SIX monthsor completion of 9000Trips, depending upon the site condition. d. Any long suspension in the system operation more than 15 days, agency will be informed in advance to stop the work, or contract may be short closed depending on site situation. 42. Idle charge for the subject work is not applicable, in case transportation stopped abruptly in a particular day, when the work is in progress. Agency shall bear the idle charges. 9 SCOPE OF WORK INTERNAL COAL TRANSPORT FROM YARD TO ERH-1 and 2 1. Loading coal from coal stock at YTPS coal yard No: 1, 2, 3 & 4 by loader/excavator. 2. Transport the coal to near ERH-1 and 2, feed point of conveyor -11 and Operations of trucks/pay loaders are solely on agency's scope, including DOPL. 4. The diesel price variation [upward/downward] clause will not be applicable to above work. 5. Approximate lead from coal yards to ERH ranging from 0.5 to 2.0 km, approximate 3000MT coal is to be transported on daily basis from stock yard to ERH-1 and 2, as per requirement, quantity may vary on either side. 6. Clearance for start of internal logistic, depending on yard ground stock and requirement at ERH-1 and 2 for feeding to unit bunkers. Coal to be transported to ERH 1 and 2, subject to requirement. 7. Supervision during execution and any other emergency works required for coal filling operation. 8. Deployment of labour round the clock at loading point and at ERH-1 and 2 for monitoring the loading, unloading and movement of coal from stock yards to ERH 1and During internal coal transport, every day one coal trip of each truck should be weighed for Empty and Loaded weight at YTPS weigh bridge and same shall be submitted to RPCL authority along with monthly coal trips statement for reference to calculate the approximate internal coal movement quantity from YTPS stock yard to ERH-1and The contractor s employees should have proper supervision on assigned work in shift at YTPS/RPCL premises. 11. Maintain the equipment s healthiness for continuous operation to achieve the target trips, approximately, 215 trips/day or more. 12. It is the responsibility of the contractor to provide necessary safety equipments and to ensure usage of the same by the workers wherever necessary. 13. During internal coal transportation from stock yard to ERH 1and 2, trucks are not supposed to over speed. Speed limit to be maintained. 14.
