GRANTEE: (See individual authrizatin letter) 2. PURPOSE AND LIMITATION: a. This special permit authrizes the transprtatin in cmmerce f the materials described in paragraph 6 belw in specially designed cntainers by private mtr vehicle withut placards. This special permit prvides n relief frm the Hazardus Materials Regulatins (HMR) ther than as specifically stated herein. The mst recent revisin supersedes all previus revisins. b. The safety analyses perfrmed in develpment f this special permit nly cnsidered the hazards and risks assciated with transprtatin in cmmerce. c. Unless therwise stated herein, this special permit cnsists f the special permit authrizatin letter issued t the grantee tgether with this dcument. 3. REGULATORY SYSTEM AFFECTED: 49 CFR Parts 106, 107 and REGULATIONS FROM WHICH EXEMPTED: 49 CFR in that placarding is nt required, except as specified herein. 5. BASIS: This special permit is based n the applicatin f United Phsphrus Inc. dated July 28, 2016, submitted in accrdance with and the public prceeding theren.

SAFETY CONTROL MEASURES: a. PACKAGING Packagings must meet the specificatins and cnfiguratins as described in the United Phsphrus, Inc. applicatin n file with the Office f Hazardus Materials Exemptins and Apprvals and the fllwing: (1) Packagings cntaining aluminum phsphide pesticides cnsist f inner aluminum canisters with a capacity f 1.5 kg r less further packed in an uter 4G bx. The cmpleted bx may nt cntain ver 21 kg f hazardus material; r (2) Packaging cntaining magnesium phsphide plates shall be individual fil puches. Each package measures apprximately 5.9 inches by 9.45 inches and ¼ inch thick and weighs 117 grams. Up t 60 individual packages may be placed in a UN1A2 drum. (3) Inner canisters r puches must be adequately cushined against mvement within the uter packaging. b. OPERATIONAL CONTROLS (1) A single mtr vehicle may nt cntain mre than 21 kilgrams f aluminum phsphide pesticides r magnesium phsphide r cmbinatin theref. (2) Packages must be stwed within metal bxes r metal cmpartments within each mtr vehicle. 8. SPECIAL PROVISIONS: a. Distributrs fr United Phsphrus, Inc. and licensed pest cntrl peratrs using United Phsphrus Inc. s

A current cpy f this special permit must be maintained at each facility where the package is ffered r reffered fr transprtatin. c. Each inner and uter package must be labeled POISON and DANGEROUS WHEN WET. The inner packages may be labeled in accrdance with (f), which authrizes labels cnfrming t specificatins in the UN Recmmendatins. (The Recmmendatins permit packages with dimensins that cannt accmmdate the required 4 x4 label t use smaller labels, see ). Vehicles transprting these packages need nt display the DANGEROUS WHEN WET placards. d. The utside f each package must be marked DOT-SP e. Drivers must have been instructed as t necessary safeguards and prper prcedures in the event f unusual delay, fire r accident. f. The use f exceptins fr materials f trade under is prhibited under the terms and cnditins f this special permit. 9. MODES OF TRANSPORTATION AUTHORIZED: Mtr vehicle nly (private carrier). 10. MODAL REQUIREMENTS: A current cpy f this special permit must be carried abard each mtr vehicle used t transprt packages cvered by this special permit. 11. COMPLIANCE: Failure by a persn t cmply with any f the fllwing may result in suspensin r revcatin f this special permit and penalties prescribed by the Federal hazardus materials transprtatin law, 49 U.S.C et seq: All terms and cnditins prescribed in this special permit and the Hazardus Materials Regulatins, 49 CFR Parts Persns perating under the terms f this special permit must cmply with the security plan requirement in Subpart I f Part 172 f the HMR, when applicable.

Under Title VII f the Safe, Accuntable, Flexible, Efficient Transprtatin Equity Act: A Legacy fr Users (SAFETEA-LU) The Hazardus Materials Safety and Security Reauthrizatin Act f 2005 (Pub. L ), 119 Stat (August 10, 2005), amended the Federal hazardus materials transprtatin law by changing the term exemptin t special permit and authrizes a special permit t be granted up t tw years fr new special permits and up t fur years fr renewals. 12. REPORTING REQUIREMENTS: Shipments r peratins cnducted under this special permit are subject t the Hazardus Materials Incident Reprting requirements specified in 49 CFR Immediate ntice f certain hazardus materials incidents, and Detailed hazardus materials incident reprts. In additin, the grantee(s) f this special permit must ntify the Assciate Administratr fr Hazardus Materials Safety, in writing, f any incident invlving a package, shipment r peratin cnducted under terms f this special permit.
