I) Up date workman Group insurance policy covering all the labour who are going to work at WTPS site is to be submitted along with technical bid. J) Up date valid labour license from the Asstt. Labour Commissioner, Nadiad is to be submitted along with technical bid. L) For fulfillment of all the Labour laws, liabilities before starting of the contract work, contractor should give the assurance/indemnify bond on non judicial stamp paper of Rs. 100/- to GSECL, WTPS or as per the tender amount. M) Contractor shall have to submit the tender in two parts i.e. (I) Technical bid (II) Price bid the date of the price Bid opening shall be informed to the technically qualified bidder separately. N) Copy of past orders executed for similar work either at GEB/GSECL/NTPC or other Electricity Board. O) Bank solvency certificate 20% estimated value of nationalized bank. P) List of tools and tackles and technical personnel. Q) Party shall have to produce the Service tax registration certificate. R) Tenderers should download the tender documents from the website Tender documents will not be issued in physical form from this office and submit the same as per instruction therein by RPAD only. 8 Annexure A Subject: Removing of old vibrating screen and installation of new complete vibrating screen 3A in primary crusher house at coal handling plant Wanakbori TPS. General terms and condition: (1) All tool-tackles, pulling lifting equipments, slings, rope, scaffolding, oxygen/acetylene gases, good quality general purpose welding electrode, etc are to be arranged by the party. (2) The contractor have to follow all safety rules and regulation strictly and have to keep fire buckets, water bucket etc. with them during cutting/welding activities and the contractor shall be fully responsible for any damage/injury of GSECL equipments or their labour during executing the work. (3) The contractor has to follow all labour laws directive by Government time to time. (4) The fork lift / crane / wheel loader will be issued free of cost by GSECL for loading/unloading for heavy materials, if available. (5) The contractor has to use their own welding/grinding machine but power supply to welding/grinding machine and temporary lighting etc will be issued free of cost by GSECL. (6) The required materials shown in schedule-a will be issued free of cost by GSECL. (7) Looking to plant emergency the contractor has to work round the clock and no work is to be left half done. The contractor has to keep skilled and well conversant working team during execution of work and they have to submit daily report to site in charge on their letter pad. (8) There is no fixed schedule for outage so contractor has to remain present within 08 to 10hrs.with their working team to commence work when call is given from site in charge. (9) The validity of contract is 11 months from the date of placement of order. (10) All removed scraps is to be credited to GSECL main store and for this contractor has to arrange their own camel cart/tractor etc, for transportation but only crane will be issued free of cost for loading/unloading purpose. (11) The quantities are shown approximate but the payment will made as per actual work done. (12) The contractor has o pay 5% of order value as security deposit and same will be refunded back after satisfactory completion of work. (13) The rates are exclusive of service tax. Service tax at prevailing rate, if applicable, will be paid by GSECL extra on production of paid evidence/challan. (14) Serviceable/repaired materials are to be used from site store no MR./CR. Is requires. (15) The actual time of replacement of complete vibrating screen -3A is 20 days from date of commencement. Scope of work : Replacement / installation of complete vibrating screen 3A of primary crusher house. Following Involved activities are to be carried by contractor for above subjected work. - To shift complete vibrating screen unit from GSECL main Store/site store to location. - To shift power winch and jugar prepare for material lifting and old material lowering down form vibrating screen floor to ground floor. - To dismantling vibrating screen bearing housing, bearing, drive shaft and shaft cover and v- belt pulley. - To dismantling vibrating screen coal receiving feed box and primary crusher Hood, four spring pedestals,, pivoted motor base and shift a side. - To cutting/removing top and bottom deck worn out I beams and flats. - To dismantling/cutting/removing vibrating screen live frame, shifting and lowering down on ground floor. - To lift complete vibrating screen unit with supporting springs, spring pedestals, perforated plates deck for the top deck, screen cloth panel of HCHT steel wire for the bottom deck, feed box, pivoted motor based with drive and driven pulleys & set of v belts on vibrating screen floor. - Erection of spring pedestals & supporting springs in existing structure, if any modification is require same is to be carried out by the party. - Erection complete vibrating screen unit on spring pedestal, to provide perforated plates deck for the top deck, coal receiving feed box and primary crusher hood, pivoted motor base. - To assemble drive pulley on motor and driven v belt pulley on shaft and provide v belts on new pivoted motor base. - Trial after completion of the work will be taken and if any correction or site requirement needs party has to attend for smooth running of vibrating screen. After completion of the above said work trial will be taken and if any correction or site requirement needs party has to attend the same for smooth running of vibrating screen -3A Old removed drive shaft, bearings, bearing housing, v- belt pulley belts etc. and jugar material are to be shift from location and to crediting in site store. WANAKBORI TPS Name of work: Removing of old vibrating screen and installation of new complete vibrating screen 3A in primary crusher house at coal handling plant Wanakbori TPS. GENERAL TERMS AND CONDITIONS OF CONTRACT: 1. Contract means the documents forming tender and the subsequent agreement that may be entered in to. 2. Work or Works means: Removing of old vibrating screen and installation of new complete vibrating screen 3A in primary crusher house at coal handling plant Wanakbori TPS.. 3. Contractor means a firm or an individual undertaking these works or offers the rates for this work. 4. The general rules and regulations of the GSECL for tender and contract for works will apply to the extent of the same and not modified herein. The contractor is deemed to have gone through and considered to be fully aware of the conditions mentioned therein. 5.Earnest Money Deposit: Tender should be submitted along with Earnest Money Deposit (EMD) at the rate of one percentage (1 %)of estimated cost of the tender, without which tender is liable to be rejected. 6. Security Deposit: Successful bidder shall have to pay Security Deposit (SD) equivalent to 5% of the ordered value. Out of this SD, 2.5% should be paid in cash or demand draft of scheduled bank payable at Wanakbori TPS within seven days of acceptance of order, and balance 2.5% of the SD will be recovered from first two RA Bills or provide bank Guarantee for the same form any Nationalize Bank. Failure to deposit the SD will entail forfeiture of EMD and the contract shall be treated as terminated. The contractor shall not be allowed to start the work if SD is not paid before the stipulated period. Any loss to the GSECL due to late start of work because of late payment SD shall be the contractor s liability. 7.The amount of Security Deposit will be refunded after the satisfactory completion of the contract after certification by the concerned Suptd. Engineer (MC) and after deducting any dues of the GSECL. 8.The sublet or to transfer the contract without prior approval of the GSECL shall be treated as breach of contract and it shall be punishable by forfeiting the SD as well as termination of contract. 9.The GSECL reserves the right to forfeit the SD in case of any breach of contract and in case of disputes. The decision of Chief Engineer, Wanakbori TPS shall be final, binding and acceptable to the contractor. If the contractor fails to start the work as stipulated the EMD and the SD shall be forfeited. 10.The monthly payment to the labourers must be paid before 10 th day of succeeding month in the presence of Labour Welfare Officer, Wanakbori TPS. A copy of the same must be submitted along with monthly RA Bill, duly certified by the Labour Welfare Officer. The certificate should contain details of average no. of labour deployed, total wages / salaries paid and overtime amount separately. (11) Submission of the bill by the contractor: Bills shall be submitted by the contractor for each month on or before the date fixed by the Site In charge, for all works, executed in the previous month and the Site In charge shall take or cause to be taken the requisite measurement for the purpose or having the same verified and the claim so far as it is admissible, shall be adjusted, if possible, within ten days from the presentation of the bills. If the contractor does not submit the bill, within the time fixed, as aforesaid, the Site In charge may depute a subordinate to measure up the said work in the presence of the contractor or his duly authorized agent, whose counter signature in the measurement list shall be sufficient warrant and the Site In charge may prepare a bill from such list which shall be binding on the contractor in all respect. Along with the R.A. Bill, the contractor should submit material Account wherever applicable, proof of payment of provident fund and other statutory dues, certificate issued by I.R.O. / L.W.O certifying average number of labour deployed during the month and total amount of wages and salaries paid to labour. The R.A. Bills along with the supporting documents will be paid within 30 days. (12) Income Tax:-Income tax will be deducted at source from each bill as per statutory requirements. (13) The GSECL will be entitled to deduct directly from the bills to be paid to the contractor any sum or sums payable by the contractor and which sum/sums the GSECL is required to pay as a principal employer on account of contractor s default in respect of all liabilities referred to in above clauses. (14) (a) No sales tax, professional tax or any other taxes, cess or levy, excise duty, octroi, royalty or other duties will be payable by the GSECL against this contract. (b) Service tax at the rate prevalent during period of execution of contract and if applicable will be reimbursed on production of certified copy of registration number and paid Challan for payment of service tax from time to time. (15) The quantities mentioned in the Schedule-B are approximate only and may vary widely. The contractor shall be paid for the actual works carried out at the rates quoted by him. (16) The 2% as per Sections 57A and 57B GST Act shall be deducted from the contractor s bills. (17) Documents required to be submitted by the Bidders: a) Experience Certificates: At the time of submitting the tender, the contractor shall attach experience certificate(s) of having carried out such/similar type of work either in GSECL or in any other organization. b) Special Tools & Tackles: The bidder shall have to submit along with the offer, the details of minimum tools, tackles & equipment in possession relevant to the job.

10 c) Provident Fund Code Number: The contractor shall have to submit along with the offer the details of PF code Number from appropriate authorities, without which the offer is liable to be ignored. d) Solvency: The contractor shall have to submit a copy of the solvency certificate of minimum 20% of the estimated cost of the tender of any Nationalized bank The offer without Solvency certificate is liable to be rejected. e) Audited Annual Accounts: The contractor shall have to attach along with the tender last three years audited annual accounts (i.e. Profit and Loss account statement and Balance sheet), if the tender estimated value is Rs lacs or more for one year contract and Rs Crore or more for two years contract, otherwise the offer will be liable to be rejected. f) Partnership Deed/Memorandum of Association & Articles of Association: If the contractor is not a sole proprietor, then the contractor shall have to furnish a copy of the Partnership Deed along with the offer. In case of a Company, the M/A & A/A is required to be submitted without which the offer is likely to be ignored. The contractor shall also submit power of Attorney. g) Labour License for Labour Contract: The contractor on getting the work order but before starting the work shall have to furnish the copy of Labour License under the Contract Labour (R&A) from the appropriate authorities, without which the contract order is liable to be terminated. (18) Compensation for the Delay: The time allowed for carrying out the work as entered in the tender shall be strictly observed by the contractor and shall be reckoned from the date on which the order to commence work is given to the contractor. The work shall throughout the stipulated period of contract be proceeded with all due diligence (time being deemed to be the essence of contract) and the contractor shall pay, as compensation, an amount equal to one percent or such smaller amounts, as the Competent Authority (whose decision in writing shall be final) may decide of the amount of the contracted cost of whole work as shown by the tender for every day that the work remains un-commenced or unfinished after the proper dates. Provided always that the total amount of compensation, to be paid under the provisions of the clause, shall not exceed 10 percent of the contracted cost of the work as shown in tender. (19) Wages to be paid, time of payment, etc., by the contractor: The payment shall be disbursed in presence of the GSECL representative during the working hours in the factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GSECL. Any default will result in cancellation of contract forthwith or else the contractor shall be punishable to the extent of Rs.100/- per day by way of fine. The contractor shall give his telephone number, address to the GSECL, so that in case of labour unrest etc., the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present throughout the working hours. It is absolutely necessary that the contractor either himself and/or a fully authorized representative having full power or authority concerning the contract shall have to remain present at Wanakbori TPS. He must also contact Exe. Engineer (Fuel) daily at hours, so than necessary instruction can be passed on to him. Also, he must be available during working hours (general shift) and during outage of plant at any time, so that he can be immediately contacted for any emergency work. The contractor and/or his authorized representative shall not leave Wanakbori TPS without specific permission from the Exe. Engineer (Fuel). If the period of absence from Wanakbori TPS is more than three days, an alternative arrangement shall be made and to be informed to the sectional head in writing. (20) Labour Laws: The labour laws applicable and amended from time to time have to be followed scrupulously. A few of them for information are as under: 20.1 Person below the age of eighteen years shall not be employed for the works No female worker shall be employed in the night shift between 19:00 hrs. and 06:00 hrs Contractor shall maintain a valid labour license under the Contract Labour (Regulation & Abolition) Act for employing necessary manpower to be required by him. In the absence of such license, the contract shall be liable to be terminated without assigning any reasons thereof The contractor shall, at his own expense, comply with all labour laws and keep the Board indemnified in respect thereof. Some of the major liabilities under various labour and industrial laws, which the contractor shall comply with are as under: (b) Payment of contribution of employees (contract labour) as well as employer s (contractor s) contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administration charges, inspection charges, etc., at the rates applicable from time to time by the Government of Gujarat / Government of India or other statutory authorities. (c) Payment of deposit in respect of each contract labour at the rate as revised by the Government from time to time with the Office of the Commissioner of Labour as per the Contract Labour (R&A) Act. (d) License fee as prescribed under the Contract Labour (R&A) Act and rules framed therein, depending upon the number of workers employed by the contractor. (e) Paid leave facility and wages as per the provision of the Factories Act at the rate of one day for every 20 days of working. (f) Identity cards as prescribed under the Factories Act or by the Thermal power station with photograph affixed thereon, for identification. (g) Payment of retrenchment compensation, notice pay and other liabilities as per Industrial Disputes Act Any payment to the contractor s employees arising out of any claim or disputes under the Industrial Disputes Act or any other labour laws. (h) Payment of compensation in case of accident injury, under Workmen s Compensation Act. (i) Provision of crèche if the female labour employed is more than 30. (j) Maternity leave as per the provision of the Maternity Benefits Act. The above are some of the major liabilities of the contractor in addition to other liabilities prescribed under the various labour laws in force from time to time by the statutory authorities, like State Government / Government of India, which the contractor shall have to comply with.

11 (21) Provident Fund and Family Pension Scheme: The contractor shall submit along with his bill (month- wise) a statement regarding deductions against Employees Provident Fund (EPF) and Family Pension Scheme (FPS) in respect of each concerned employee at the rate of 12%, or at the rates made applicable by the government from to time, of wages. The contractor s contribution and the worker s contribution towards PF and FPS shall be deposited by the contractor with the Regional Provident Fund Commissioner, Ahemdabad, or to the authority prescribed under the Act along with the other charges. (22) Deposit Linked Insurance Scheme: The contractor shall have to deposit 0.50% (half percent) or the rate applicable from time to time of the wages in respect of employees who are members of the PF, as the contribution to the Deposit Linked Insurance Scheme, with the Regional Provident Fund Commissioner, Ahemdabad. (23) Liability towards Gratuity: The contractor shall deposit 15 days salary at the rate of last drawn salary for every completed one year of service for each worker for the liability of gratuity. (24) Minimum Wages Act: The contractor shall pay prevailing minimum wages as applicable from time to time to the labourers engaged by him as per the minimum wages Act, in presence of the GSECL officer or representative. (25) E.S.I. Act.: The contractors shall comply with the provisions of E.S.I. Act wherever applicable as per the prevailing provisions of the Act and as amended from time to time. (26) Administrative Charges: Administrative charges for maintaining Provident Fund account shall be deposited by the contractor with the Regional Provident Fund Commissioner, Ahemdabad, at the rates applicable. (27) Paid Leave Facility: Paid leave facility at the rate of one day for every twenty days of actual work by the contract labour shall be provided by the contractor to his workers. He shall maintain leave records/verified and approved/certified by the authorized officer of the GSECL. (28) Safety: The contractor shall strictly observe all safety rules and provide safety equipment to the contract labourers as per the Factories Act, 1948, and whatever amendments made from time to time to avoid any chance of accident. The contractor shall strictly observe all instructions of Safety Officer and Factory Inspector to avoid any chance of accident. The contractor has to provide safety articles to his contract labour as per the nature of work they have to perform in the contract. A certificate in this regard has to be obtained from Safety Officer then the detailed work order will be issued. (29) Workmen s Compensation Fund and Employer s Liability Insurance: Insurance shall be affected for all the contract employees engaged in the performance of this contract. If any of the work is sublet after due permission in writing from the Board, the contractor shall require the sub contractor to provide workmen s compensation and employer s liability insurance for the later employees, unless such employees are covered under the contractor s insurance. It shall be the liability of contractor for employees of his sub-contractor. (30) Compliance to Security Matters: The power station being a restricted / prohibited area, all the formalities as required by the Security and Vigilance staff of GSECL should be complied with, to whom the contractor should contact. (31) Submission of Returns & Maintenance of Records: The contractor shall submit the returns under the Contract Labour Act, Payment of Bonus Act, and Payment of Gratuity Act etc. and shall have to maintain all up-to date records/registers in respect his employees as prescribed under various Labour Laws and produce the same as and when demanded by GSECL s appropriate authorities. (32) Execution of Agreement: The successful bidder (contractor) will have to enter into an agreement with the GSECL and the cost of the stamp paper will be borne by the contractor. The contractor will also have to execute indemnity bond on required value of stamp paper as per GSECL s rules. The cost of stamp paper for indemnity bond will be borne by the contractor. (33) Contractor to Indemnify the GSECL: The contractor shall indemnify and keep indemnified the GSECL and every member, officer and employees of the GSECL including Site In charge and his staff, against all actions, proceedings, claims, demands, costs and expenses whatsoever arising out of or in connection with the matters referred in above clauses and elsewhere and against all actions, claims, demands, costs and expenses which may be made against the GSECL, by any workman/employee of the contractor or sub-contractor or any other person under any laws, rules or regulations having the force of law, including, but not limited to, claims against the owner under Workmen s Compensation Act, The GSECL shall not be liable for or in respect of or in consequence of any accident or injury to any workman or other person in the employment of the contractor. The contractor shall indemnify and keep indemnified the GSECL against all such damages and compensation and against all claims, demands, proceeding costs, charges and expenses whatsoever in respect thereof or in relation there to. The contractor shall also indemnify GSECL in all respect against any liability due to breach of legal provisions contained in any of the Labour Laws. (34) The contractor must be maintaining regular labour record and should be paying all acquired benefits to labour force and contractor should obtain certificates to this effect from Labour Commissioner. (35) Any other rules and regulations, conditions etc. that are in force at present and that may be framed by the GSECL from time to time in connection with the contract will be binding and acceptable to the contractor. (36) Because of this contract, the GSECL shall not accept any additional labour liabilities than stated above. (37) The contractor will make arrangements at his own cost to insure all men, materials and equipment employed for this work. The GSECL will not be responsible for any loss or damage either to the contractor s personnel or his equipment. (38) Dispute, if any, taking place between the contractor and labourers must be intimated to Labour Welfare Officer, Wanakbori TPS, immediately. (39) The contractor must insure all the labourers before starting the works. (40) Any casualty will also have to be borne by the contractor for the period the contract continues. (41) The contractor shall not engage any sub-contractor without written prior permission of the Chief Engineer or the authorized officer of the GSECL. In no case the GSECL will be liable in any manner regarding any liability in respect of any contract labourers engage by the sub-contractor and the liability of such contract labourers will solely rest with the principal contractor. (42) The contractor shall deploy with the adequate number of experienced staff at site for daily supervision and for maintenance of various registers and records required under the law and contract. No payment by the GSECL for supervision shall be admissible.

12 (43) Staff Discipline: It is the responsibility of the contractor to ensure that his employees maintain strict discipline as regards security, methods of safe working etc., and not to cause any hindrance to smooth running of power station or in execution of duties by GSECL staff. Any lapse in this regard will be viewed seriously and contract is liable to be terminated. If any of his staff is found unsuitable or not behaving properly, the contractor shall have to remove him from the work-site on demand by GSECL. The contractor shall have to strictly observe the rules and conditions specified in the enclosed works contract booklet of the GSECL, which are not modified hereunder. To keep harmonious Industrial Relations amongst contract labourers is the sole responsibility of the contractor. Any breach of the same will be viewed seriously. (44) Arbitration: { A } All question, dispute or differences whatsoever which may at any time arise between the parties to this agreement touching the agreement or subject matter thereof, arising out or in relation thee to and whether as to construction or otherwise shall be referred to the decision of the sole Arbitrator, appointed by the chairman & MD,GSECL for that purpose, who shall be retired High Court Judge or a retired District and Sessions Judge, and the decision of the said Arbitrator shall be final and binding upon the parties, Reference to the Arbitrator shall be governed by the provisions of the Arbitration and conciliation act-1996 as amended from time to time and rules made there under. The Arbitration proceeding shall be conducted at HO, GSECL, Vadodara or at such place as the sole Arbitrator may be determined. The award of sole Arbitrator shall be final be final and binding upon the parties { B } All question, dispute or differences whatsoever which may at any time arise between the parties to this contract in connection with the contract or any matter arising out of or in relation thereto shall be referred to the Gujarat Public Works Contract Dispute Arbitration Tribunal as per the provision of the Gujarat Public Works Contract Dispute Arbitration Tribunal act-1992 In case where divisible orders for supply and works are placed instead of indivisible supply and works order, the arbitration clause for such divisible supply order shall be incorporated as per Sr. A and for divisible work order the Arbitration clause shall be as per Sr no- B above. (45) Labour Escalation: The contractor shall pay minimum wages to his labourers as per the Minimum Wages Act, 1948 and rules therein, as applicable from time to time, in pursuance to the State government notification. The concerned contractor, after making such payment to his labourers, shall submit the details of the payment with the certification of Labour Welfare Officer / Industrial Relations Officer. However, no labour escalation or any type of escalation. will be payable by GSECL to the contractor as this is a firm price contract through out the period of contract. (46) The GSECL reserves the right to terminate this contract at any time during its currency without giving notice of termination or any reason thereof. (47) Time Limit: The validity of contract is 18 months from the date of commencement but if there is saving in quantities or work is not taken on hand due to non availability of shutdown, the contact will be extended for further 06 months with same rates, terms and condition of contract, however the individual shut down time for each item is as under. (48) The contract will remain in effect for the period of 18 months from the date of commencement of contract. GSECL at any time during the tenure of the contract may terminate the same at its sole discretion without assigning any reason, if it is observed that obligations under this contract are not performed up to the satisfaction of GSECL. The contractor will, however, not be entitled for any compensation for such premature termination of contract. (49) In case of default, the work will be got done through other agency / agencies at the risk and cost of the original contractor, and the GSECL shall be entitled to recover such expenses from defaulting contractor by such methods as deemed fit. The contractor shall not, however, be entitled to terminate the contract or stop works undertaken by him before expiry of the contract period / extended period due to any reason whatsoever. (50) Under the contract, the contractor should either himself be present at the site or should nominate persons in writing, who must be available at site and who should be authorized to take decisions about the works and receive the instructions from Site In charge of the work at any time. In absence of any responsible man of contractor at the time of any emergency, adhoc decision of Site In charge will be binding on the contractor. (51) The contractor is bound to execute the work for any item as per the instruction of the Site In charge. On refusal to do so, the work will be carried out at the risk and cost of contractor by using the contractor s tools and tackles, for which no compensation whatsoever shall be payable to the contractor. (52) If any immovable articles/tools/equipment will be found stolen from the working place, the contractor would be held responsible and cost will be recovered from his bill. (53) For any conflict and ambiguity, the decision of the Chief Engineer (C&O) shall be final and binding on the contractor. Tender received after last date and time of acceptance will not be considered. (54) The contractor shall quote only certain percentage of rates above or below the estimated rates, i.e., contractor should quote either, say A% above the estimate or B% below the estimate or all the items. The contractor should not quote different percentage for different items. Tenders received with different percentage rates for different items shall be liable to be rejected. The contractor should quote only percentage higher/lower in figures as well as in words in Schedule-B. In case of not mentioning clearly above/below the estimate, the Board shall consider the quoted percentage below the estimate and the contractor must have to honor this, failing which suitable actions may be taken, considering this as dishonor and/or summary rejection of offer without assigning any reason thereof as deemed fit by Chief Engineer. The rate quoted should be inclusive of all taxes and expenses, if any. Nothing will be paid extra as a part of contract unless & until, it is specified in the tender documents by GSECL. (55) The rates quoted shall be firm and valid for 180 days for acceptance from the date of opening.

13 (56) The contractor, if desired, can see the plant and site on any working day and during working hours with permission of the Chief Engineer. (57) Conditional tender is liable to be rejected withdrawal or insertion of conditions unilaterally after opening of tenders will not be permitted unless it is so desired by the GSECL. (58) Chief Engineer (C&O), Wanakbori TPS, reserves the right to reject any or all tenders without assigning any reasons thereof. (59) Before starting the work, the contractor should contract Industrial Relation Officer/ Labour Welfare Officer for all formalities and obtaining the gate passes of his labourers and for other formalities. (60) Office correspondence will be carried out in English language, and if at any time to facilitate the contractor, Gujarati translation may be furnished, if deemed fit. The English version will be the correct one and the same only will held good for legal matters. (61) The contractor should intimate to the office the name and address of authorized and responsible representatives, so that our field officers can contact them when required in connection with the execution of the said works. 14 CIRCULAR - I The following are the major obligations to be fulfilled by the Contractors as per the Contract Labor (R&A) Act 1970 and rule mentioned there under: 1. License to be obtained before starting the Work where number of contract laborers in ten or more. 2. Payment to contract laborers has to be made in presence of IRO/LWO. Wages rates for contract laborers are applicable as per the terms and conditions of the license. The contractor shall have to pay wages to workers as notified by Government of Gujarat., from time to time 3. Every contractor shall have to maintain the muster roll and wages register in respect of his contract labor. 4. Every contractor is required to issue employment card, wages slip and attendance card to their laborers. 5. The contractor has to maintain the register No. 13 containing details of contract labors employed by him. 6. Earned leave register/ card as per the Factories Act. And Rules. 7. Other registers required under Contract Labor Rules and the Factories Act. And Rules. 8. Every contractor shall have to obtain insurance policy in respect of the contract labors engaged by him to cover them under workmen s Compensation Act. 9. To send half yearly return to licensing officer as per Rule 82 (1) as per schedule time. 10. Before starting the work as per the contract awarded to him, he should make arrangement to enter into the agreement in the prescribed format on the stamp paper as applicable. Before fulfilling the above requirement the contractor is instructed not to start the work. The responsibility will be on his head in case he fails. 11. Contractor should posses separate P.F. code on their firm, name otherwise their offer may must be considered. All the contractors are informed to adhere to the rules and regulations applicable to them, particularly in respect of the laborers engaged by them, the contractor not fulfilling the obligations will not be allowed or continue with work/ not be held qualified to carry out the work at TA-Thasra Dist. - Kheda Power Station. 16 GENERAL RULES AND DIRECTIONS FOR THE GUIDENCE OF CONTRACTOR Notwithstanding anything contained to the contrary in the specification or tenders in subsequent exchange of correspondence, the conditions of contract shall be binding on the contractor and any change or variations expressed or implied, however made in the said conditions shall not be valid or operative unless expressly sanctioned by the GSECL. The contractor shall be deemed to have fully informed himself and to have special knowledge of the provisions of the conditions of contract herein contained. 1. All works proposed to be executed by the contract shall be noticed in one of the English and one of the vernacular local daily newspapers, stating the work to be carried of as well as the date of submitting and opening tenders and time allotted in carrying out the work. also the amount of earnest money to be deposited with the tender and the security deposit to be deposited by the successful tenderer and the percentage, if any, to be deducted from bills. 2. Copies of specifications, design, drawings, estimated rates, scheduled rates and any other documents required in connection with the work which will be signed by the Engineer-in-Charge for the purpose of identifications shall be open for inspections by the contractors at the office of the Executive Engineer during office hours. 3. Whether the works are proposed to be executed according to the specifications recommended by the contractor and approved by a competent authority on behalf of the Gujarat State Electricity Corporation Ltd., such specifications with designs and drawings shall form part of the accepted tender. 4. The tenderers and receipts for payments made on account of any work, when executed by a firm should be signed by all the partners except where the contractors are described in their tender as a firm, in which case the receipt shall be signed in the name of firm including the partners or some other person having authority to do so. 5. The tenderer at shall fill up the usual form stating at what percentage above or below rates specified, he is willing to under take the work. Only one rate or such percentage on all the estimated rates or schedule rates shall be mentioned. 6. Tenderer which propose any alternation in the work specified in the form in invitation to tender or in the time allowed for carrying out the works or which contain any other conditions of any sort, will be liable to rejection. 7. No single tender shall include more than one work, but contractors who wish to tender, for two or more works, shall submit a separate tender for each work. Tender shall have the name and the number of the works, of which they pertain, be super scribed on the envelope. 8. The Engineer-in-charge or his duly authorized assistant will open tenders in the presence of any intending contractors who may be present at the time and will enter the amount of the several tenders in a comparative statement in a suitable form. In the event of a tender being accepted, the contractor shall there upon, for the purpose of identification, sign copies of the specifications and other documents. In the event of tender being rejected, the officer (Engineer-in-charge) shall authorize the paying officer concerned to refund the amount of the earnest money deposited to the contractor making the tender on his giving a receipt for the return of the money. 9. The officer, competent to dispose off the tenders, shall have the right of rejecting all or any of the tenders, without assigning any reasons thereof. 10. No receipt for any payment alleged to have been made by contractor in regard to any matter relating to tender of the contract shall be valid of binding on the GSECL unless it is signed by the Engineer-in-charge. 11. The memorandum of work to be tendered for and the schedule of materials to be supplied by the Gujarat State Electricity Corporation Ltd. and their rates shall be filled in and completed by the office of the Engineerin-charge before the tender form is issued if a form issued, to an intending tenderer has not been so filled in and uncompleted he shall request the said office to have this done, before the completes and delivery his tender. 12. All works shall be measured, meet by standard measure and according to rules are custom and usual in the use in the Gujarat State Electricity Corporation Ltd., and no proposal to adopt alternative method will be accepted, the Engineer-in-charge decision as to what is the usual method in use in the Gujarat State Electricity Corporation Ltd. shall be final. 13. Every contractor shall, except the registered contractor on the approved list of the GSECL, produced, along with the tender a solvency certificate from the collector of the District within which he resides, of a banker s certificate of his financial stability, if he fails to produce such a certificate his tender will not be considered. 14. All corrections and addition or pasted slips should be initialed. 15. Tenderer shall be deemed to have full knowledge of relevant documents, site conditions etc. whether inspected or not by him. 16. Submissions of tender by a contractor implies that he has read the instructions and condition of contract herein contained and has made himself aware of the scopes and specifications of the work to be done and conditions and rates at which stores materials etc. will be issued to him and local conditions and other factors bearing on the execution of the work. 17. Under no circumstances shall any contractor be entitled to claim enhanced rates for any item of contract without prior sanction of the competent authority. 18. These rules and directions shall form part of the contract.
