Any tender received without EMD and/or tender fee, will be out rightly rejected. The tender documents are to be submitted in two parts namely 1. Techno-Commercial bid (Schedule-A) and 2. Price bid (Schedule-B ) in two separate covers duly sealed and super scribing each cover accordingly along with the tender number. Sealed cover of both the Bids (i.e. Techno-commercial Bid & Price Bid) along with EMD and tender fee cover should be submitted simultaneously in a Single Sealed cover super scribing Tender No. and date of opening the tender. Only the Techno-Commercial bid shall be opened on the date as mentioned in the presence of those bidders who wish to be present. If the Authorized Representative is likely to be present then he must submit the authorization letter/identity of the representing company at the time of opening of Bids and this is compulsory. Tender is invited for the works of Providing & fixing of PVC vinyl flooring in control room at SLDC,Gotri 2. The details of works to be executed is mentioned in Schedule `B (Enclosed herewith) 3. The work shall have to be executed as per the instruction of Engineer in charge. 4. The work is to be carried out at SLDC, Gotri at the below mentioned address. Office of Chief Engineer State Load Despatch Centre, GETCO, 132 KV GOTRI S/S Compound, Nr. TB Hospital, Gotri Road, Vadodara The contractor is supposed to carry out the whole work including all necessary labors and also make arrangement for required tools & tackles, machines / equipments etc at his own cost as per requirement & as directed by EIC. 6. There should be no damage done in existing wiring a in control room & should be maintained in good condition. 7. The sample for PVC vinyl flooring should be approved first with EIC. 8. While removing the old flooring utmost care should be taken so that existing equipment is not damaged. The scrap should either be destroyed or thrown away at appropriate location as per directives of EIC. 9. Labors timings must be adjusted in consultation with Engineer-In Charge. 10. The rates quoted shall be on firm price basis & no price variation etc. will be payable on any thing till completion of contract. 11. The rates quoted should be valid for 01(ONE) month. 12. The rate should be for F.O.R. destination, nothing will be paid extra. 13. The rates quoted should be inclusive of all taxes as applicable and the same are to be shown separately in the bill raised for payment. 14. Taxes, duties etc. as applicable will be deducted from the bills as per rules. 15. The rates should be submitted duly filled in as per Schedule B in sealed cover super scribed thereon Providing & fixing of PVC vinyl flooring in control room at SLDC,Gotri.. The sealed quotations should reach this office by R.P.A.D. or speed post only latest by 14:00 Hrs on 07/11/2015. The tender will be opened on same day at Hrs. The contractor should have to maintain the quality of work & also the timing of workers throughout the contract period failing which the contract will be liable to be cancelled without giving any notice at the risk and cost of the contractor. 17. The undersigned reserves the rights to reject any or all the quotations or to accept any quotation without assigning any reason thereof. 18. The undersigned reserves the right for any addition, alteration in the items as per actual site condition and requirement. 19. The contractor shall give day to day update for the ongoing works. 20. The Company reserves the right to terminate the contract at any time without assigning any reason. The contractor shall not be entitled to any compensation on such termination of contract. 21. If contractor fails to execute the order successfully, for a stipulated time limit & as per requirement the order will be got completed through other agency at the risk and cost of contractor. (Difference if any due to higher rate, will be recovered from the contractor.) 22. Contract may be extended for further one year as per company s rules, if agreed mutually by both sides at same rates, terms and conditions of contract. 23. No tools, tackles nor their maintenance and manpower for execution of order will be provided by GETCO, SLDC. 24. In case of accident to the workers at the time of working or during execution of contract the whole and sole responsibility will be of contractor for paying compensation or damages to the persons, involved as per law of Act, and the Company i.e. GETCO will not be responsible for any claim or any other actions on this account. 25. The contractor shall follow all rules and regulations pertaining to the works/workers etc. scrupulously. Any consequences arising due to non-observance of any such rules shall be to the account of the Contractor. 26. The contractor will have to fulfill the conditions of contract labour (Regulation abolition) Act. 27. The contractor shall abide by the provision of all labour laws and contract labour (Regulation & abolition Act, 1970) and the rules framed there under. The contractor shall have to obtain the license under above act if employing person as contract laborers, as per provision of prevailing rules & regulations. The person employed shall not be age less than 18 years and more than 50 years. Necessary PF registration and proof for age shall be provided by them. 28. The contractor shall ensure that either himself or representative on his behalf is deputed by him to keep in touch with Engineer in charge with regard to detailing of the work progress or any changes required thereof. 29. In case of any dispute or any discrepancy, the decision of Chief Engineer, SLDC, GETCO Gotri, Vadodara will be final and binding to the contractor. 30. General Terms & Conditions: Conditions here under are applicable in addition to the terms and conditions mentioned in Booklet TENDER AND CONTRACT OF WORKS available for reference at the Office of C.E. (SLDC) GETCO, Gotri. Wherever the terms and conditions enumerated in the booklet TENDER AND CONTRACT OF WORKS conflict with those stated herein the later shall prevail over the former. 7 31. Agreement: As per Company s rules, contractor will have to enter in to an agreement on non judicial stamp paper of Rs. 100/- with the company in prescribed format before commencement of work. The cost of stamp fees shall be borne by the contractor. 32. Commencement: Contract will start working from the date of receipt of order and/or as per directive of Engineer In-charge. The contract will remain in force for 01 (ONE) month from date of commencement. 33. Terms of Payment: No advances shall be paid. The bill in triplicate should be forwarded to concerned engineer. After certification by concerned Engineer regarding works as per terms of A/T / Contract, verifying the copy of bills, and submission of advance stamp receipt, the payment on monthly basis will be made by running account bill on actual executed quantity by A/c Payee cheque only. Income-Tax (if any) will be deducted at source from R.A.Bill, as per prevailing rules at the time of payment.bidder has to submit proof of service tax and PF paid to concerned authority alongwith bid. 34. EMD: 1% of the estimated cost is required to be paid except who are registered and exempted from paying the EMD, as Earnest Money Deposit along with tender by Demand Draft drawn on any Nationalized Bank in favour of Gujarat Energy Transmission Corporation Ltd. SLDC payable at Baroda only Tender will not be considered without EMD. 35. Security Deposit: 5 % of order value is to be paid, except who are registered and exempted from paying the Security Deposit, by Demand Draft drawn in favour of Gujarat Energy Transmission Corporation Ltd.-SLDC Payable at Baroda only (on Nationalized bank), on acceptance of tender as, Security Deposit. The same shall be refunded on completion of work successfully and on receipt of NOC from E I C i.e. after completion of Twelve months or on its termination by the Company due to its own reasons. No interest shall be paid by the Company on security deposit. Earnest Money Deposit (EMD) received along with the quotation can also be converted into security deposit in the event of awarding the contract to a successful bidder. The same will be refunded within one month to all non-successful bidders without any interest. The Company reserves the right to recover any dues, outstanding against the contractors from the bills due for payment on security deposit against any order/s placed by the GETCO towards any loss caused to the Company owing to negligence or default of the contractor, his servants or agents. The refund shall be done only on production of No Objection Certificate of concerned officer. 36. The Full amount of the Earnest Money Deposit paid shall stand forfeited if the full amount of specified Security Deposit is not paid in specified time by the successful bidder and the order will stand cancelled at the risk and cost of successful bidder.( except those bidders who are registered and exempted from paying the EMD & Security Deposit.) 37. INSURANCE: The contractor shall have to make an arrangement at his own cost by insuring all materials and equipment obtained by him for the works and labour also. The GETCO will not be responsible for any loss of damages to your personnel equipment. 38. PENALTY: Seal & signature of Bidder Page 7

8 (1) The works should be commenced immediately from the date of receipt of the order failing which penalty at the rate ½% per week not exceeding 10% of contract value will be imposed. 39. Taxes & Duties: No Sales / Professional or any other Taxes (except service Tax) or levy excise, octroi, toll tax, royalty or other duty will be payable by the company against this contract. All royalties, sales tax, toll tax and any other taxes including works contract tax in respect of this contract and also any statutory variation in future towards above mentioned taxes shall be payable by the contractor and GETCO will not entertain any claim whatsoever in this respect GETCO will not under take any liability / responsibility of works contract tax becomes applicable to this contract, the same will be to the contractor s account. 40. Service Tax : Service Tax is paid extra as applicable on date of bill and same will be reimbursed on production of documentary evidence, for payment made. 41. Water Supply: Water supply at one point will be provided by SLDC, GETCO, Gotri with in premises. 42. Electric Power Supply: SLDC Gotri, GETCO will give the electric power connection at one nearest possible point and other arrangement to take the power to the site is to be arranged by the contractor at his cost. 43. Unsatisfactory Progress of Work: If the work is found not satisfactory or not progressing according to schedule given by the company, the GETCO may take any action as may be deemed fit to see that the work is completed in time at contractor risk and cost. 44. The validity of the quotation shall be 120 days from the date of opening of tender. 45. Conditional Tender will not be accepted. 46. No extra cost will be paid for any transportation. 47. Bidder has to submit following documents with bid 1. PF registration. 2. Experience certificate/past orders. 3. Pan card 4. Service tax no 48. Bidder shall sign page by page and submit. No additions /alterations will be accepted. Any quotation violating this condition will be out rightly rejected. 9 ANNEXURE II (On non judicial stamp paper of Rs.100/-) CONTRACT AGREEMENT This agreement is made at BARODA the day of in the Christian year Two Thousand Thirteen between M/S ( herein after referred to as THE CONTRACTOR which expression shall unless excluded by or repugnant to the contract includes its successors or permitted assigns)of the one part and the Gujarat Energy Transmission Corporation Ltd having their Head Office at Sardar Patel Vidyut Bhavan, Race Course, BARODA (herein after called THE COMPANY which expression shall unless excluded by or repugnant to the contract includes its successors or permitted assigns) of the other part. WHEREAS the aforesaid Company has accepted the tender of the aforesaid contractor for as per Companys order No. herein after called THE WORKS and more particularly described enumerated or referred to in the specification, terms and condition prescribed in the order letter, covering letter and other letters and schedule of price which for the purpose of identification have been signed by Shri on behalf of the contractor and by on behalf of the Company a list whereof is made out in the schedule hereunder written and all of which said documents are deemed to form part of this contract and included in expression THE WORKS wherever herein used, upon the terms and subject to the conditions hereafter mentioned. AND WHWEREAS THE COMPANY has accepted the tender of contract for the contractors for the construction of the said works for the sum of Rs. ( Rupees ) upon the terms and subject to the conditions herein mentioned. NOW THIS AGREEMENT WITNESSES AND IT IS HEREBY AGREED AND DECLARED THAT : - 1. The contractor shall do and perform all works and things in this contract mentioned described or which are implied therein or there from respectively or are reasonably necessary for the completion of the works as mentioned and at the terms, conditions and stipulations contained in this contract, and in consideration of the due provision, execution, construction and completion of the works agreed to by the contractors as aforesaid, the Company doth hereby covenant with contractor to pay all the sums of money as and when they become due and payable to the contractors under the provisions of the contract. Such payments to be made at such times and manner as is provided by the contract. 2. The conditions and covenants stipulated herein before in this contract are subject to and without prejudice to the rights of The Company to enforce penalty for delays and / or any other rights whatsoever including the right to reject and cancel on default or breach by the contractors of the conditions and the covenants and stipulated in the general conditions, specifications, forms, or tender schedule, drawing etc. attached with the Company s Order No.. The contract value, extent of supply delivery dates, specifications, and other relevant matters may be altered by mutual agreement and if so altered shall not be deemed or construed to mean or apply to affect or other terms and conditions of the contract and the general conditions and the contract so altered or revised shall be in and shall always be deemed to have been subject to and without prejudice to the said stipulation.
