3 GUJARAT ENERGY TRANSMISSION CORPORATION LIMITED, TRANSMISSION CIRCLE, JAMNAGAR. GENERAL CONDITIONS OF CONTRACT: 1. Tenders are invited for hiring of closed body diesel driven Jeep of the model April-2008 & onwards for EE (Testing), Circle Office, GETCO, Jamnagar. Tender shall be submitted in sealed covers along with two demand drafts for the amount of EMD & Tender fee as mentioned in tender notice drawn on any scheduled bank payable at Jamnagar in favor of Gujarat Energy Transmission Corporation Limited. 2. The touring journey covers the area generally within Gujarat State and as per the instructions of the Officer. 3. The conditions will be applicable in addition to those mentioned in Booklet Tender and Contract of Works available for reference at the office of Superintending Engineer (TR) Jamnagar. 4. The rates quoted shall be on annual rate contract basis. Thus, rates quoted shall remain valid for complete period of Twelve months from date of commencement of execution of order. The rates must be inclusive of the salary of driver, cost of fuel, oil and other consumables, wear & tear of tyres & tubes and maintenance charges including material cost to keep the vehicle in full working and smooth running condition. The undersigned reserves right for extending contract by three months without obtaining any confirmation and for a period of 12 months. The contract can be terminated at any time without assigning any reason at any time. The contractor(s) shall not be entitled to any compensation for such termination. 5. The rates shall include all taxes, levies pertaining to vehicles of the class specified herein in the Schedule B including but not limited to fuel taxes, levies, salary and perks to the driver, charges levied by the Govt., / Private bodies, CPF to the driver, etc. in force from time to time during the period of contract. 6. The contractor will have to fulfill the condition of contract labour regulation abolition Act-1970 and furnish the records failing which payment will not be made. 7. Vehicle will have to be sent along with well-experienced, well-dressed driver having good manners with necessary tools and tackles to meet the normal breakdown while on road. The driver sent with the vehicle shall have valid license for driving issued not after 2005 and Taxi badge. The driver shall be well versed with R.T.O. rules. The driver shall be preferably below the age of 40 yrs. & never above 55 yrs. The lodging and boarding of driver shall have to be borne by the owner.

4 8. The driver shall drive the vehicle only in accordance with the clear directives of Officer- In-charge and as per the RTO rules. In case, if driving found rough, contractor shall have to replace the driver with good one immediately. 9. The driver should be provided with enough money to cover the cost of diesel, repairs and incidental expenditure while in journey. 10. The hired vehicle must not be allowed to use in other offices or private journey or personal use of owner. 11. No tools, tackles and manpower for execution of order will be provided by GETCO. 12. During day and night (24 hours) vehicle with driver must be available in office premises of Testing unit, Sat Rasta, Jamnagar. 13. The GETCO may give advance intimation for requirement of vehicle in emergency during odd hours also. The contractor shall have to provide the vehicle immediately failing which vehicle shall be hired from market and difference in expenditure will be recovered from the contractor. 14. The contractor will be required to maintain Log Book as per the standard format which will record the journeys performed by the GETCO officer. The log book when closed or at the end of the contract, should be handed over to the GETCO for its record. 15. The vehicle should be up to date and diesel driven only, with good upholstery covered with clean covers, comfortable seating arrangement and shall be washed at regular intervals of a week. Vehicle shall always be kept neat and clean. 16. Contract may be extended further for 12 months on mutual agreement. 17. During the period of maintenance / breakdown of the vehicle etc, when the vehicle can not be sent, the contractor will have to send another closed body diesel driven vehicle of same class or higher class and model year. In case of failure to meet this condition, another vehicle will be hired by the GETCO from the market at the prevailing market rates and difference of amount paid, if any, shall be recovered from the contractor s bill. 18. No advance for hiring of vehicle shall be paid. The bill in triplicate should be forwarded to concerned engineer and payment will be made by A/c payee cheque only. Income-Tax (if any) will be deducted at source from R.A.Bill as per rules. 19. Challans for opening and closing Kilometers reading and kilometers traveled should be got certified any duly signed by the officers traveling the vehicle. In absence of these requirements the bill will not be paid. 20. Nothing will be paid extra during utilisation of vehicle on Sunday or Holiday on account of salary and wages, overtime of driver. If possible, only one weekly off on Sunday or any convenient day will be given.

5 21. In case of accident to the vehicle, the whole and sole responsibility lies with vehicle owner for payment of compensation or damages to the persons or any other payment, involved as per law or Act and the GETCO will not be responsible for any claim on this account. 22. The contractor shall follow all rules and regulations pertaining to the vehicle and its running/working such as RTO, traffic, etc. scrupulously. Any consequences arising due to non-observance of any such rules shall be to the account of the contractor. 23. At any time during the period of the contract, if services of the contractor found unsatisfactory, GETCO shall have discretionary power to cancel the order in accordance with the clause no.4 above. 24. If contractor fails to execute the order successfully, the order will be got completed through other agency (and if required to pay higher rate in that case difference of rate will be recovered from the contractor.) at the risk & cost of existing contractor. 25. In case of any dispute or any discrepancy, the decision of Superintending Engineer, Transmission Circle, Jamnagar will be final and binding to the contractor. 26. Head Quarter of vehicle will be Transmission Circle Office, Jamnagar and journey kilometers will be considered from Head Quarters to Head Quarters. However when any officer is picked up / dropped the journey Km. will commence from first pick up / last drop. 27. If contractor fails to provide the vehicle on any day, as per contract, penalty of Rs.800/- per day will be recovered from the current R.A.Bill over and above the actual expense incurred for any other vehicle used. 28. Agreement: As per GETCO s rules, contractor will have to enter into an agreement on Stamp paper of Rs. 100/- with the GETCO in prescribed format before execution of work. The cost of stamp fees shall be borne by the contractor. 29. The contractor will have to execute an indemnity bond on stamp paper of Rs. 100/- at his cost before commencement of order stating that for any accidents or damages to the contractor s staff/equipments or any other persons/vehicle, GETCO shall not be responsible, for any such occurrence, in any way. 30. Contract will start from the date of commencement order and the contract will be in force for twelve months. 31. The tenderers must quote prices on the basis of rates of Diesel prevailing on the 15th day prior to the due date of opening of tender. Please submit the prevailing Govt. approved diesel price list of I.O.C. with tender copy. 32. Formula for considering price variation: No price variation will be payable on cost of oil/tyres, tubes etc. Only changes in price of diesel will be paid.

6 33. For every one-rupee rise/fall in the price of Diesel per litre, following adjustment will be given. 34. Diesel driven vehicle 10 paisa (increase / decrease in rate) per Kilometer or any fraction thereof for Kilometers travelled by the vehicle during the month will be paid. 35. Rs. 2550/- is required to be paid against Earnest Money Deposit along with tender form by demand draft in favour of Gujarat Energy Transmission Corporation Limited only. 36. The superintending Engineer (TR) Jamnagar reserves the right to reject any or all the tenders without assigning any reasons thereof. 37. The 5% of tender value is required to be paid in cash or by Demand Draft in favour of Gujarat Energy Transmission Corporation Limited on acceptance of tender as security deposit within 10 days or else EMD will be forfeited 38. Vehicle supplied should be comprehensively insured. Attested copy of insurance policy should be submitted to this office before placement of order. Insurance for driver should also be arranged by the contractor and attested copy of the same should be submitted to this office. 39. The validity of the tender shall be six months from the date of opening of tender. 40. Conditional tender will not be accepted. 41. The contractor is bound to furnish his rate justification in the form of rate analysis, if asked. 42. The contractor bidding for the work must have vehicle registered in the name of bidder. Failing to produce such proof EMD/SD paid by the contractor will be forfeited. 43. All road tolls / bridge tolls shall be reimbursed on production of proof of payment along with monthly RA bills. 44. Service tax will be reimbursed as applicable only against submission of documentary proof of payment of service tax. 45. 7 GENERAL CONDITIONS OF CONTRACT. The contractor shall be required to supply diesel driven closed body jeep having Taxi passing from RTO of the models of April-2008 and onwards strictly in accordance with the specification laid down in the tender documents. Any vehicle not confirming to the said specifications shall not be accepted. The vehicles intended to the placed for hiring must have the following documents completed in all respects and produced to Engineer for verifying: i. Insurance certificate covering period up-to-date. ii. Registration certificate book with tax paid up-to-date. iii. Fitness Certificate. iv. Road permits. v. Any other documents relevant relating to hiring of vehicle. vi. Registration as TAXI. vii. PAN No. with Xerox copy duly attached. The contractor shall make his own arrangements for the Boarding and lodging of his drivers, agents and servants. The vehicles when in service shall have to be parked at the GETCO s premises or as near as the work site is possible. The contractor shall ensure that representative on his behalf is deputed by him to keep in touch with the Engineer in Charge with regard to detailing of vehicles, providing arrangements for substitutes in case of any vehicles going off road looking after to general need of vehicle. The contractor shall also make his own arrangements for refueling, repairs and maintenance of his vehicle and provide other vehicle during maintenance or repair period with all abovementioned conditions. The contractor must follow all the rules, regulations and enactments of the labour laws relating to engagements of persons / driver by him. The vehicle once inspected and approved by the Engineer for hire shall not be changed or substituted by the contractor except on orders from the Engineer or on becoming defective/off road due to accident, breakdown, etc. In such an event, the contractor shall given immediate intimation to the Engineer. Where a change of vehicle is likely to last for more than one week prior approval of the Engineer in - Charge shall be obtained. The speedometers of the vehicles must be maintained with full accuracy and in working condition/order at all times. Any defect noticed therein must be rectified immediately within a period of maximum two days. Till such time, the meter starts working; the KMs. of journeys for various places shall be decided by the users/engineers. If required Engineer in Charge may

8 ask for calibration of meter at third party Govt. approved testing laboratory. All implications for any such tests will be to the Contractor s account. No interest shall be paid by the GETCO on Security deposit. Earnest Money Deposit (EMD) received along with the tender shall also be converted into security deposit in the event of awarding the contract to a successful party. Tender fee paid for purpose of tender papers is non-refundable. The security deposit shall be refunded to successful tenderer only after satisfactory completion of the contract or on its termination by the GETCO due to its own reasons. The GETCO reserves the right to recover any dues, outstanding against the contractors, from the Security Deposit or towards any loss caused to the GETCO owing to negligence or default of the contractor, his servants or agents. The refund shall be done only on production of No Objection Certificates of all concerned Officers. The rates quoted by the Tenderer in the schedule of rates must include all charges of every type such as fuel, taxes (except service tax), levies maintenance/repairs, driver or contractors servant/agent wages, etc. over & above all applicable taxes are to be separately shown in the Bid. The contractor shall provide standby vehicle(s) to ensure prompt substitute arrangements should any hired vehicle go off road. In case any vehicle remains absent or fails to report for duty or a vehicle if provided, as a substitute is not in an acceptable condition, the GETCO shall recover penalty at the rate hereinafter specified. And in case of an unacceptance of substituted vehicle, any journey covered by it may also be disallowed apart from recovering penalty as if the vehicle is absent. GETCO shall have right to hire vehicle from other agency at the risk and cost of contractor in case of default, in the opinion of the Engineer in Charge. SUPERINTENDING ENGINEER (TR) GETCO, JAMNAGAR

Tenderer should quote rates in figures and words in above column which shall be inclusive of all charges, taxes, or any other state/national levies pertaining to vehicle class specified herein. c. The contractor quoting for the tender shall be deemed to have gone through general terms & conditions of work/contract booklet and same will be treated as binding on him. d. If there be any discrepancy between the rates/amount quoted in figures & words, the lowest rates/amount shall be considered. e. Item no. 2 shown above will be executed only if required. Contractor shall not claim any thing extra, if an item 2 is not executed. f. Service tax applicable as per prevailing Govt. laws will be paid extra on production of proof of payment of the same.
