On over, it should be distinctly indicated as Bid against Specification No SKTD/T/18/10 Technical and Price bid filled and sealed in to two separate covers marked Price Bid & Technical Bid. The same should be put in separate sealed envelope and marked as above. 2. The tenders may be sent by Registered Post / Speed Post only as to reach this office on or before 15/07/2010up to 15:00 hours. Due care should be taken to see that the tenders sent by post are posted well in advance to ensure the delivery by the prescribed date or even earlier. Tenders which are received late after due date of receipt will not be considered. 3. The tenderer who offers the lowest in percentage (%) i.e. lowest total amount will be awarded / recommended for placement of order. Item wise lowest % / value will not be considered for placement of order. 4. Failure to furnish full and complete details or furnishing vague information will make the tender liable for rejection. The tenderer is at full liberty to give information about his capacity and establishment to execute the work / contract. 5. The offer should be valid for a minimum period of 180 days from the date of opening of Tender. 6. The Technical Bid shall be opened on 15/07/2010at 16:00 hours in the office of Executive Engineer (Tr.), GUJARAT ENERGY TRANSMISSION CORPORATION LTD, Transmission Division, SAVARKUNDLA (if possible). 7. 5 5 GUJARATENERGYTRANSMISSIONCORPORATION LIMITED TRANSMISSION Division : SAVARKUNDLA SECTION II 01 VALIDITY: The rates for the work quoted by the contractor will be valid for the period of SIX MONTHS from the date of opening of the tenders. 02 PAYMENT OF SECURITY DEPOSIT: The contractor will have to pay the security deposit at 5%of the order value.on placing the order 2.5% will have to be paid in cash or Demand draft drawn in fever of GUJARAT ENERGY TRANSMISSIONCORPORATION LTD. Within seven days from the date of the issue of work order and remaining 2.5% will be recovered from first two running bills. 03 SIGNING OF AGREEMENT: The contractor will have to sign agreement as per GETCO s rule, in the prescribed Performa of the GETCO. The cost of the required stamp paper will have to be born by the contractor. 04 PAYMENT OF BILLS : Normally one R,A Bill will be paid every Month. However looking to the progress of the work it will be reviewed mull way. The 90% cost of the work done will be paid to the contractor on his presentation of R.A. Bills along with giving the material account and singing the joint measurement of the work done with our D.E.(TR/Const.) concerned. The bill should be submitted to the D.E.(TR/Const.) concerned with a copy to the E.E.(TR/Const.) concern. The final bill will be prepared by our D.E.(TR/Const.) concerned within about fortnight from the date of completion of the work by the contractor. The Contractor have to submit the final bill with complete material account of the work contract to enable the D.E.(TR/Const.) for submission to E.E.(TR/Const.) for passing and payment thereof. 05 DEPARTURE FROM SPECIFICATION AND DRAWINGS : Should be tenderer wish to depart from the specification in any respect, they should draw attention to such departure giving his reasons thereof, and should get approve the case. However, in case of any clarification the decision of Engineer-in-charge will be final and binding. 06 AVAILABILITY OF MATERIALS AND IDLE LABOUR CHARGES : Most of the materials are readily available and arrangements are made to procure the rest. However, the contractor should be prepared to carry out the work as and when the materials are received. No idle labour arises due to want of any materials will be allowed. However, this idle period will be counted for the period of assessing the limit for completing of work as mentioned in the work order. 07 Board does not accept any responsibility as regards to factory acts or any other acts. Rules or regulations that have to be observed by the contractor for carrying out the work. 08 The contract will be governed by the General condition of works contract of the GETCO. A copy of booklet will be available along with the tender, the contractor is deemed to have studied the same thoroughly before filling up the tenders. 09 ACCOUNTING OF BOARD S MATERIALS: The contractor will be fully answerable and responsible for all the materials issued to him for the work by the GETCO for any theft, loss or pilferage and shall have to submit the account for the final bill. If the loss referred to above is not made good before the preparation of the final bill, the cost of the materials will be recovered from the final bill as per the rules of the GETCO.

6 6 10 PROGRESS OF WORK AND PENALTY : If it is found that the work is unsatisfactory or not progressing as per schedule, then any action be taken by the GETCO as may be deemed fit to see that work is completed at the risk and cost of contractor. If the work is not completed within the schedule period ½% penalty per week of the balance value of the work subject to the maximum of 10% will be levied. 11 SPECIAL CONDITIONS OF THE CONTRACT : (a) The undersigned reserve the rights to reject any or all the tenders without assigning any reasons thereof. (b) The tenderer should furnish the tender along with the details of past experience of such erection works handled by him. (c) The tenderer will abide by and fulfill all the terms and provisions of the tenderer and contract for work s as applicable and in case of any default there to the GETCO shall forfeit the deposit etc. and the money due in respect of completion of works through other agency on failure of tenderer to complete the work as required in the order. 12 BANK GAURANTEE OR SOLVENCY CERTIFICATE : The successful contractor will have to produce Bank Guarantee or solvency certificate at the value 20% of the contract value and shall have to execute the agreement on the stamp paper as may be required as per the rules of GETCO in force. 13 SPECIAL CONDITION OF CONTRACT : (a) Should this tender be accepted, I / We hereby agree to abide by and fulfill all the terms and conditions of the Tender contract for work s as applicable and in default (b) thereof to forfeit and pay GETCO the same sum of money due. The full value of the Earnest Money Deposit paid herewith should be absolutely forfeited by the GETCO. Should I / We not deposit the full amount of specified security deposit. 14 GAURANTEE : The tenderer have to give guarantee for the doubletree operation of the equipment / line for the period of one year from the date completion commissioning for the work attended by them. 15. TIME LIMIT : The work will have to be completed within the time limit specified in the tenders and tender have to complete the same within the time limit only. The time is the essence of this contract, the same will have to be adhered to the tenderer otherwise the penalty as per the GETCO s rules will be recovered which should be noted. 16 TERMS AND CONDICTIONS REGARDING INDUSTRIAL LAW AND RELATED MATTERS TO BE INCORPORATED IN THE TENDER DOCUMENTS. 1. WAGES TO BE PAID IN TIME BY THE CONTRACTOR. The contractor shall pay minimum of Rs per day or as may be specified here after or rates fixed under the minimum wages act whichever is higher. The wages of every contract labour employed by him under this contract shall be paid by him before the expiry of 7 days of the last day of the month in respect of which the wages are payable i.e. wages of a month have to be paid by him before the first week of the next month. The payment shall be disbursed in the presence of Management representative during the work hours in factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GETCO. Any default will result in cancellation of the contract forth with or else the contractor shall be punishable to the extent of Rs. 100 fine per each day. 2. The contractor shall give his telephone number and address to the GETCO so that incase of labour trouble etc. the contractor can be contacted the contractor shall arrange to have his office the factory premises and the contractor keep himself present through the working hours. 3. LABOURS LAWS : (a) Person below the age of 18 years shall not be employed for this work. (b) No female worker shall be employed in the night shift between 7p.m. to 6a.m. (c) Contractor shall maintain a valid labour lenience under the contractor Labour ( Relation and abolition) Act for employing necessary manpower to required by him in the absence of such license the contract shall be liable to be terminated without aligning any reasons thereof. (d) The contractor shall at his own expenses comply with all labour laws and keep the GETCO indemnified in respect thereof. Some of the major liabilities under various labours and industrial laws which the contractor shall comply which are as under.

7 7 (1) Payment of contribution by way of employer s contribution towards provident payment fund Family Pension Scheme, Deposit Scheme deposit liked Insurance Scheme administrative charges etc. at the rates made applicable from time to time by Government of Gujarat / Government of India or other statutory authority. (2) Payment of deposit in respect of each contract labour at the rates of Rs. 30/- with the office of the Commissioner of the labours per the contract labour (Regulation and Abolition Act) (3) License fee as prescribed under the contract Labour (Regulation and Abolition) Act rules formed there under depending upon the number of workmen employee be the contractor. (4) Paid leave facility and wages as per the provision of the factories Act and the rate of one day for every 20 days of working. (5) Identity cards as prescribed under the factories Act. with photo affixed there to the same for identification. (6) Payment of retrenchment compensation Notice pay other liabilities as per industrial disputes Act any payment to the contractor s employees arising out of any claim of disputes under the industrial Disputes Act 1947 or any other labour laws. (7) Payment of compensation in case of accidental injury. (8) Provision of charge if the female labours employed are more than 30 members. (9) Maternity leaves as per the provision of the Maternity benefit Act. 4. PROVIDENT FUND AND FAMILY PENSION SCHEME : The contractor shall submit along with his bill (month wise) statement regarding deduction against employees provident fund and family pension scheme in respect of each concerned employee provident and family pension scheme at the rate of Rs % (or at the rate made applicable by the Government form time to time) of the wages the contractor s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with Regional provident Fund Commissioner, Ahmedabad. 5. DEPOSIT LINED INSURANCE SHCEME : The contractor shall have deposit ½% of the wages in respect of a employees who is a member of the Provident Fund as the contribution to the deposit link insurance scheme with Regional Provident Fund Commissioner, Ahmedabad. 6. ADMINISTRATIVE CHARGES : Administrative charges for maintaining Provident Fund Administrative A/c shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad at the rate applicable. 7. PAID LEAVE FACILITY : Paid leave facility at the rate of one day for every twenty days worked by the contractor labour shall be provided by the contractor to his workers. He shall maintain leave Record, Leave cards for individual labourer which shall be duty verified and approved / certified by the authorized officer of the GETCO. 8. Workmen s Compensation Fund and Employer s Liabilities Insurance. The contractor shall cover all his employees under workmen s compensation Fund and under the liability insurance. 8. The contractor shall employ adequate number of experienced staff at site for daily supervision and for maintenance of various registers and records required under the law and contract. No payment for supervision shall be admissible under the law and contract. No payment for supervision shall be admissible. 9. CONTRACT TO INDEMNITY THE BOARD : The contractor shall identify the GETCO and every member office and employees of GETCO also Engineer-In-Charge and his staff against all actions proceeding claims, demands costs and expenses what so arising out of or in connection with the matter referred in here in above elsewhere and against all actions proceedings claims demands cost and expenses which may be made against the GETCO of Government for or in respect of or for manse of his obligation under the contract documents. The GETCO shall not be liable for or in respect of or in consequence of any accident or injury to any workmen or other person in the employment of any accident or injury to any workmen or other person in the employment of the contractor or sub-contractor and the contractor shall indemnity any keep indemnified the GETCO against all such damage and compensation so ever in respect thereof or in relation thereof. 10. WORKMENS COMPENSATION AND EMPLOYER INSURANCE :

8 8 Insurance shall be effected or all the contractor s employee engaged in the performance of this contract if any of the work is subject the contractor shall require the subcontractor to provide workmen s compensation and employee. Liability Insurance for the letter s employees unless employee are covered under the contractor s insurance. 12. The GETCO reserves the right to terminate this rate contract at any time during its tendency without giving notice of termination or any reasons thereof. 13. The GETCO will be entitled to deduct directly from the bills to be paid to the contractor any sums payable by you and which sums the GETCO is required to pay as a principal employer on account of your default in respect of all liabilities referred to in above clause. 9 9 GUJARAT ENERGY TRANSMISSION CORPORATION LIMITED TRANSMISSION DIVISION : SAVARKUNDLA SECTION - III Following credentials shall be submitted with the technical bid with the for pre-qualification 1 Contractor should produce evidence of having experience in executing similar nature of jobs of not less than 60 % of tender amount and or quantity in a single contract along with the documentary evidence, preferably photo copy of orders secured from GETCO and satisfactory completion certificate from respective department. 2 Latest bank solvency certificate from any nationalized bank for a sum of Minimum 20% of estimated cost. 3 Separate provident fund code number towards registration of your firm with Regional P.F. Commissioner. 4 Contractor should submit evidence as a register contractor in appropriate class With GETCO. 5 The details of tools and tackles, owned and available for using in this work. 6 Contractor should produce audited copy of the Balance sheet with profit and loss account of last three Years. 7. Attested copy of Power of Attorney, if any, for signing the bid documents. 8. Evidence of IS material used carrying out said work and it must be approved by EIC. Executive Engineer (TR),

10 10 GUJARAT ENERGY TRANSMISSION CORPORATION LIMITED TRANSMISSION DIVISION : SAVARKUNDLA SECTION IV TECHNICAL TERMS, CONDITIONS & SPECIFICATIONS 1. The contractor has to arrange for fabrication at free of cost & follow all labour laws i.e. rules safety rules, insurance rules, GETCO rules at his risk & cost. 2. The contractor has to co-operator fully with Engineer-in-charge for stub strengthening work & any other items which are not conveniently included in the specification but requires for completing the JOB. 3. Wooden charcoal, salt, black cotton soil, G.I. Pipe counter poise type earthing G.I. Strip. G.I. Wire, Nut & bolts lugs etc. required for earthing shall be procured by the contractor as per specification. 4. The quantum of work as mentioned in Estimate / Schedule- B is tentative and it can very differ as per site condition. The payment shall be made only on actual work executed or order quantity which ever is less. 5. The contractor has to remain in close day to day contact with Engineer-in-charge of work who in turn shall issued detailed instruction for the commencement of the work. 6. The contractor will be solely and fully responsible for any accident / damage either to equipments or any human being during the time of execution of work. 7. Prior intimation in writing for starting the job will be given by GETCO for the work. 8. Contractor will have to make his own arrangement for all tolls, tackles, wire ropes etc. for the work. 9. The contractor will have to complete entire job as per directive & instruction of Engineerin-charge. If he fails to do so entire work will be carried out at contractor s risk & cost. 10. The tender shall be issued only to the experience contractor who has completed such job of similar nature and magnitude satisfactorily in time. However, issuance of blank tender will not qualifies the tenderer to offer the bid. 11. After completion of the work, all surplus materials issued by the GETCO shall be returned by you to the respective store centre the GETCO as per instruction of Engineer-in-charge at your cost. 12. Specification in any items mentioned in tender are subject to change without any prior notice and binding to the contractor. 13. If the work is required to be carried out during fix outage if required then the contractor has to deploy adequate manpower, material, tolls etc. well advance and has to complete the entire work during this specific outage period only failing to which GETCO shall be at liberally to deduct the amount of revenue loss due to prolong outage. 14. If required by GETCO, you shall have to provide free to & fro traveling facility to our Engineer or staff for the work. 15. The tender include all minor accessories & items of work which may not have been specifically mentioned in the specification / schedule. But are essential for completion of the contractor will not be eligible for any extra payment in respect of such minor accessories and item of work. 16. The contractor has to carry out all the works in accordance with revised & rates provisions under I.E. Rules Acts & rules made there under & as per instruction of Engineer-in-charge. 17. The tender shall be issued only to capable contractors and must have experience of such type of work amounting Rs. 5 Lacs & completed satisfactory. 18. Contractor has to co-ordinate E.I.C. for planning of outage & work schedule thereof, so as to complete all the planned work in outages, contractor has to deploy adequate manpower accordingly. 19. Any delay causing extension of outages shall be contractor s responsibility & appropriate amount (in terms of rupees) as decided by concern Ex. Engineer(TR) shall be recovered from contractor s bill as a penalty. 20. Any excess work done beyond specification & drawing shall be at contractor s risk & cost. 21. No tools, tackles, manpower, crane facilities etc. will be provided by the GETCO. 22. The contractor has to deploy minimum 8 to 10 labors daily failing to which GETCO Shall deduct Rs. 1,000=00 per day from the bill. 23. The bidder shall specifically note that GETCO will not pay any extra amount towards any type of claim except for the description indicated in Schedule- B. The party has to carry out all other / additional required activities / work as desired by E.I.C. which is not

11 11 mentioned in Schedule, but required to be completed as per the site condition & for this work not extra payment shall be made by GETCO. 24. It will be the bidder sole responsibility for stub strengthening work in all respect as per the specifications & as per the instruction of E.I.C. 25. In addition to the general of the construction particular attention shall be paid to the final finish and every effort shall be made to have the entire work completed with standard of workmanship by the contractor. 26. SPECIAL TOOLS: No special tools and tackles such as compression joint machine, jointing dies, comalong clamps dynamo meter etc. shall be given by GETCO without charging any rent for the same if available conventionally with the GETCO otherwise the same will be arranged by the contractor if required. The contractor is responsible for damages and maintenance. 27. Progress of work: if it is found that the work is unsatisfactory or not progressing as per the program, any action taken by the GETCO, as may be deemed fit, to see that the work is completed as required by the GETCO would be at eh risk and cost of the contractor. If the work is not completed within time limit, the penalty of 1% of the contract value will be levied, unless time extension as granted for valid reasons by the competent authority. 28. The contractor shall co-operate with the GETCO in recording measurement etc. as expeditiously as possible and he shall fulfill the all the requirements which are necessary to finalize the accounts on the basis of its records and pay him such amount as if found due to him together with the amount of security deposit. If any remaining payable to him after deduction there from the amount due by him to the GETCO. The GETCO shall not entertain further claim from thereafter. 29. In case of any farmer s objection, contractor has to mobilize his all efforts to clear the objection in consultation with GETCO authority. No extra charge will be paid for such efforts. 30. The contractor shall not refuse to execute this work order at any time & it will be his sole responsibility to execute & complete this work as per the instruction of Engineer-incharge. 31. It will be bidder sole responsibility for carrying out stub strengthening work in all respect. Above terms & conditions are part and partial of tender will be observed strictly.
