Earnest Money :- Rs. 1,92,000/- a) Rs. One Lakhs Ninety Two Thousand only in the form of Fixed Deposit Receipt in the name of Executive Engineer Maharashtra Jeevan Pradhikaran Water Management Division, Nagpur from any Nationalized Bank Or Schedule Bank of minimum Six Months period from the date prescribed for submission of tender. b) The earnest money shall be refunded in the case of tenders whose tender are not accepted, except for first three lowest offer. Earnest money of other two lowest bidders and successful bidder will be refunded after completion of contract documents And payment of security deposit. c) Certificate of exemption from payment of earnest money deposit issue by public works department or any other authorities will not be accepted instead of earnest money deposit. 4) SECURITY DEPOSIT a) The security deposit at 4% of estimated cost put to tender or accepted cost whichever is higher, will have to be deposited by the successful contractor. I) Initial Security Deposit 2% of estimated cost or accepted tender cost whichever is higher in the form of fixed Deposit Receipt or Bank Guarantee.( Not less than 18 months ) II) Deductions through R.A.Bills Balance 2% amount will be recovered through each running bill at 5% of the gross amount of R.A. Bill to the extent that total required security deposit is to be recovered.

9 9 b) Additional Security Deposit If the accepted offer of the contract is below 10% of the cost put to tender, the additional security deposit shall be furnished by the agency as below before issue of work order. This security deposit is in addition to initial security deposit. i) Offer up to 10% below : Initial 2% of cost put to tender + 2% from RA Bill (i.e. no additional security deposits) ii) Offer more than 10% below : Initial security charges 4% + 2% from RA Bill to 15% below iii) Offer more than 15% below : Initial security deposit 6% + 2% from RA bill The initial Security Deposit and additional security deposit may be in the form of Fixed Deposit Receipt or Bank Guarantee issued by a Nationalized/Scheduled Bank in the name of ''Executive Engineer Maharashtra Jeevan Pradhikaran Water Management Division, Amravati'' and shall be for a minimum period of 18 months and shall be extended suitably if the work is not completed within the time limit. If the Bank Guarantee is submitted for initial security Deposit, then it will be entire responsibility of the contractor for the extension of Bank Guarantee till completion of work. 5. STAMP DUTY The contractor shall bear the revenue stamp duty on total security deposit of the agreement and Additional Security Deposit (payable as per tender condition), as per the Indian Stamp duty (1985) (latest revision) provision applicable during contract period. 6. TIME OF COMPLETION 18 (Eighteen) Calendar months, including Monsoon. This will be counted from the date of issue of the work order. 7. PRE-QUALIFICATION Pre-qualification Documents are available at free of cost, on the MJP portal of e- Tendering web site of Govt. of Maharashtra for aspiring bidders to download from to The bidders have to prepare and upload filled in / scanned documents regarding Pre- Qualification online on or before up to 14:00 hrs on web site. Scanned copy of following documents shall be uploaded to fulfill prequalification criteria. These documents need to be digitally signed by individual

10 10 contractor s digital signature and uploaded during online pre-qualification preparation stage. 8. PRE-QUALIFICATION CRITERIA a) The contractor shall have successfully completed & commissioned the following mentioned works with Government/Semi Government/ Municipal Corporation or any other Government organization. 1) The Contractor shall have successfully completed the work of Providing, lowering, laying jointing and testing of pipe line works for HDPE pipe minimum 75 mm dia and above, length 10 Km. required. However out of which minimum 100 mm dia of HDPE pipe and 470 M minimum length required. 2) The Contractor shall have successfully completed the work of construction of R.C.C. ESR or other similar water retaining structure and must have executed at least one such work having not less than 1.7 lakh lit. Capacity of own design under single tender. 3) The Contractor shall have successfully completed the work of operation and maintenance of water supply scheme for the period of minimum 6 months. 4) Experience certificates to the effect of having successfully completed and commissioned the said works within the stipulated period of the contract from the officer not below the rank of Executive Engineer and countersigned by Superintending Engineer or equivalent officer shall be produced for prequalification. Apart from the above experience certificates following documents are to be submitted online. 5) The firm shall to produce the Document of VAT Registration No. OR Tin No. 6) The firm shall produce the document of PAN No. 7) Copy of registration with MJP in Class-II (Civil) and above The validity of registration should be valid at least up to the last date of submission of tender, then only pre-qualification application will be

11 11 considered. It is necessary to renew the registration before issue of work order. 8) The list of work in hand in MJP, with the date of work orders and the current status of these works. The contractor having more than 7 work in hand excluding 3 works costing less than Rs. 2 cores with MJP, shall not be considered for prequalification. However the works completed 80 % of cost & further progress held up due to reasons for which contractor is not responsible such as land acquisition problem, non availability of electricity, non availability of funds, floods, earth quake, or public agitation. This shall be certified by the Superintending Engineer. Contractor shall ensure that information furnished in the document at Sr. No.8 above, is correct, failing which contractor shall be liable for disqualification. 9. Contractor shall have his bidding capacity not less than Rs Lakh per year which should be worked out by the formula given below. BID CAPACITY:- Bidding capacity of contract for completion of work will be decided by the following formula:- Bidding Capacity = ( 3 x N x A - B) Where A = Max. Value of Civil Engineering works executed in any year during the last five year upgraded to present year (i.e. tender accepting year) by adding 10% per year for execution of the year N = No. of years prescribed for completion o f work for which tender are invited (For this project 2 Years) B = Value of existing commitment of ongoing work to be completed during the next N years. 12 A Note:- Since all the data is pertaining to the contractors own performance the contractors are required to provide its bidding capacity for this work by furnishing the calculations and supporting documents to prove it contents. He has to upload scan copies of supporting documents to prove Bid Capacity online. If support document are not found uploaded, bid capacity will not be taken into account which will result in disqualification for this tender. 1. The statement showing the value of existing commitments of ongoing works during N year for each of works in the list should be counter signed by the Engineer-in-charge not below the rank of an Executive Engineer. Also has to upload scan copies of these Certificates. The firm shall produce all the experience certificates towards the proof of the above experience duly certified by the officer not below the rank of Superintending Engineer or equivalent officer of any other organization The above ten documents need to be submitted separately online in a folder provided for pre-qualification. 10. COLLABORATION AND JOINT VENTURE : a) COLLABORATION: The contractor who is interested to have blank tender form and if he is not having experience of particular sub-work, then he is allowed to have collaboration with other agency or contractor registered with Maharashtra Jeevan Pradhikaran, who has an experience of the particular sub-work. And contractor with whom above collaboration is done shall be responsible for successful completion of the works. However it will be the responsibility of the principal contractor to get the work done. Moreover with whom collaboration is made will only be binding to carry out the work to the effect of principal contractor & should submit an agreement on Rs.100/- stamp paper duly Notarized at the time of pre-qualification of bidder.

13 13 b) JOINT VENTURE: The contractor who is interested to have blank tender form and if he do not have necessary experience of particular sub work / sub works then he is allowed to have Joint Venture with another agency OR contractor. If there is Joint Venture, the same shall be in appropriate format. And it shall be clearly mentioned in the agreement that both the contractor will be jointly and severally responsible for the successful completion of works included in the tender with all test and trial for full tender period. It is necessary to enclose the registration certificate of Joint Venture firm with the Registrar of the Partnership Firm or the receipt of payment made to Registrar of the Partnership Firm on account of fees toward Joint Venture firms. Then only pre-qualification application will be considered. In the case of Joint Venture the contractor having higher class of registration will only be considered. Chief Engineer, Maharashtra Jeevan Pradhikaran, Water Management, Thane will be the final authority for deciding eligibility for pre-qualification. 11. COST OF BLANK TENDER FORM a) Rs. 5250/- per set (Rs.5000/-+5% VAT). Cost of Blank Tender form will be accepted only by Demand Draft of Nationalised/Scheduled Bank payable at Nagpur in the name of ''Executive Engineer, Maharashtra Jeevan Pradhikaran Water Management Division, Nagpur''. b) Blank Tender documents will not be sold by this office. Interested contractors have to download tender documents from the website. Blank tender form will not be sent by post. c) Cost of blank tender form shall not be accepted in the form of cash or cheque. The cost of the tender documents will not be refunded under any circumstances. 12. ISSUE OF BLANK TENDER FORM The blank tender forms will have to be downloaded, only by the bidders who have been pre-qualified by the Chief Engineer Engineer,Maharashtra Jeevan Pradhikaran Water Management,Thane from the web site from to The contractors have to prepare & upload Pre-qualification Document online on or before schedule date and again submit (encryption/ decryption) on schedule period. The same procedure should be repeated for main Tender document.

14 PRE-TENDER CONFERENCE a) Pre-Tender conference is open to all prospective tenderers who are pre qualified for this work and will be held on 07/01/2013 at hours in the office of the Chief Engineer, Maharashtra Jeevan Pradhikaran Water Management, Thane where in the prospective tenderers will have opportunity to obtain clarifications regarding the work and the tender conditions. b) The prospective tenderers are free to ask for any additional information or clarification either in writing or orally and the reply to the same will be given in writing and this clarification referred to as common set of conditions, shall also be common and applicable to all tenderers. The minutes of this meeting along with the letters of tenderers will form the part and parcel of the tender documents. 14. VALIDITY OF THE OFFER 120 days from the date of opening of tender 15. SUBMISSION OF TENDER 17.1 The interested contractors / bidders will have to make online payment (using credit card/debit card/net banking) of Rs.1038/- (including service tax) per bid per tender to online service provider of e-tendering system at the time of entering online Bid Submission stage of the tender schedule 17.2 The two envelopes No. 1 and 2 shall be digitally sealed and signed and submitted online as per the online tender schedule The date and time for online submission of envelopes shall strictly apply in all cases. The tenderers should ensure that their tender is prepared online before the expiry of the scheduled date and time and then submitted online before the expiry of the scheduled date and time. offers not submitted online will not be entertained.

15 If for any reason, any interested bidder fails to complete any of online stages during the complete tender cycle, department shall not be responsible and any grievance regarding that shall not be entertained. 18. The pipes supplied by the contractor as per tender which are to be exempted from excise duty (without excise duty) the necessary project Authority Certificate (PAC) shall be obtained and submitted by the contractor at his own responsibility from the competent Authority. 19. OPENING OF TENDER The tenders will be opened on the date specified in the tender Notice in the presence of the intending bidders or their authorized representative to whom they may choose to remain present along with the copy of the original documents submitted for Pre Qualification. Following procedure will be adopted for opening of the tender. Envelope No. I First of all, Envelope No. 1 of the Tenderers will be opened online through e-tendering procedure to verify its contents as per requirements. Scanned copies of following documents shall be in Envelope No. 1. (1) Earnest Money Deposit Receipt as explained above. (2) Minutes of pre-bid meeting duly signed by contractor. (3) Copy of Pre-qualification letter (4) Declaration of Contractor in prescribed format. If the various documents contained in this Envelope do not meet the requirements of the MJP, as stated above a note will be recorded accordingly by the Tender opening authority and the Envelope No. II of such tenderers will not be considered for further action and the same will be rejected. Envelope No. II 19. This envelope shall be opened online through E-Tendering procedure immediately after opening of envelope No. 1 only, if the contents of Envelope No. 1 are found to be acceptable to the MJP. The tendered rate shall then be read out by the tender opening authority. The tender shall upload in envelope II online page of the tender on which offer is quoted. a) Though the tender are invited for whole work the work order will be given for first phase after the acceptance of tender. After completion of the works of first phase, work order for II nd phase will be given. After the completion of the

16 16 scheme & its trial run, the contractor has to run the scheme for one Year period. b) The payment of work done will be made as per availability of funds for this scheme. c) Right to reject any or all tenders without assigning any reason thereof is reserved by the competent authority of M.J.P. whose decision will be final and legally binding on all the tenderers. d) Tender with stipulations for settlement of a dispute by reference to Arbitration will not be entertained. 20. Prebid Minutes : Minutes of pre-bid meeting shall be sent to contractors physically. However being part and parcel of main tender, contractor has to upload these minutes and submit alongwith main tender online, without which his bid shall be treated as incomplete and shall be rejected. 21. INCOME TAX The income tax shall be deducted at 2.3 % or as applicable including surcharge from time to time from each R.A. bill and shall be remitted to Income Tax Office by the department. 22. VALUE ADDED TAX The value added tax shall be deducted at 2% from the contractor or at appropriate rate as may be determined by the sale tax department from time to time on basis of actual work done by the contractor from each R.A. bill and shall be remitted to sales tax department. No payment on account of reimbursement of value added tax will be made to contractor by Maharashtra Jeevan Pradhikaran.

17 CONDITION RELATING TO INSURANCE Contractor shall take out necessary insurance policy / policies so as to provide adequate insurance cover for execution of the awarded contract work from the Director of insurance, Maharashtra State Mumbai 51, only. Its postal address for correspondence is 264-1St floor, MHADA, Opposite Kala Nagar, Bandra (East), Mumbai-51 (Tel. No / Fax / ). Insurance policy / policies taken out from any other company will not be accepted. However if the contractor desires to effect insurance with the local office of any insurance company, the same should be under the co-insurance cum servicing arrangement approved by the Director of Insurance. The policy taken out by the contractor is not on co-insurance basis (G.I.F. 60% and Insurance Company 40%). The same will not be accepted and amount of premium calculated by Director of Insurance will be recovered directly from the amount payable to the contractor for the executed contract work which may be noted. 24. The contractor shall study the guidelines regarding e-tendering to get clarify e- tendering procedure. 25. 19 19 Guidelines to Contractors Regarding Government of Maharashtra e-tendering system 1. Registration of the Contractors: The Contractors registered with Maharashtra Jeevan Pradhikaran in relevant Categories and Classes are eligible to participate in Open Tenders processed by Maharashtra. Jeevan Pradhikaran Contractors are required to get enrolled on the Portal & sub portal http- ://mjp.maharastra.etender.in and get and empanelled in relevant sub portal. After submitting their enrollment request online, the enrollment shall be required to be approved by the Representative of the Service Provider. After the approval of enrollment, the Contractors shall have to apply for empanelment online which shall be required to be approved by the Nominated Authority of Maharashtra/Department. Only after the approval in the relevant Category / Class, the Contractor shall be able to participate in the Open Tenders online. Open Tenders in which eligible Contractors may enroll on the Portal in registered category shall be able to participate in such Tenders. The online Enrollment of such Contractors shall be required to be approved by the Representative of the Service Provider. The approval of enrollment of Contractors is done by the Representative of the Service Provider upon submission of mandatory documents by the Contractors. The Contractors may obtain the list and formats of required documents from the Nodal Officer of e-tendering System for Government of Maharashtra / Service Provider. 2. Obtaining a Class II Digital Signature Certificate: The Bids required to be submitted online should be signed electronically with a Class II Digital Signature Certificate to establish the identity of the Bidder bidding online. These Digital Certificates are issued by an approved Certifying Authority, authorized by the Controller of Certifying Authorities, Government of India. A Digital Signature Certificate may be used in the name of Authorized Representative of the Organization. A Digital Certificate is issued upon receipt of mandatory identity proofs. Only upon the receipt of the required documents, a Digital Signature Certificate can be issued. Bid for a particular Tender may be submitted only using the Digital Signature Certificate, which is used to encrypt the data and sign the hash during the stage of Bid Preparation and Hash Submission. In case, during the process of a particular Tender, the Authorized User looser his / her Digital Signature Certificate (i.e. due to virus attack, hardware problem, operating system problem); he / she may not be able to submit the Bid online. Hence, the Authorized User is advised to back up his

20 20 / her Digital Signature Certificate and keep the copies at safe place under proper security to be used in case of emergencies. In case of online tendering, if the Digital Signature Certificate issued to the Authorized User of a Firm is used for signing and submitting a Bid, it will be considered equivalent to a no objection certificate / power of attorney to that User. The Digital Signature Certificate should be obtained by the Authorized User enrolling on the behalf of the Firm on the e-tendering System for Government of Maharashtra. Unless the Digital Signature Certificate is revoked, it will be assumed to represent adequate authority of the Authority User to bid on behalf of the Firm for the Tenders processed by the Maharashtra as per Information Technology Act The Digital Signature of this Authorized User will be binding on the Firm. It shall be the responsibility of Partners of the Firm to inform the Certifying Authority or Sub Certifying Authority, if the Authorized User changes, and apply for a fresh Digital Signature Certificate. The procedure for application of a Digital Signature Certificate will remain the same for the new Authorized User. The same procedure holds true for the Authorized Users in a Private / Public Limited Company. In this case, the Authorization Certificate will have to be signed by the Directors of the Company. (process of procuring Digital Certificate will take minimum 4/5 days) 3. Set up of Computer System: In order to operate on the e-tendering System for Government of Maharashtra. the User s Computer System is required to be set up. A Help File on setting up of the Computer System can be obtained from the Service Provider or downloaded from the Home Page of the Portal The Bidders may refer e_tendering Tool Kit available online to perform their online activities as mentioned below. In case of any query he may contact Help Desk for the same. 4. Online Viewing of Detailed Notice Inviting Tenders: The Contractors can view the detailed Notice Inviting Tenders and the detailed Time Schedule (Key Dates) for all the Tenders processed by Maharashtra using the E_Tendering System for Government of Maharashtra on 5. Online Purchase / Download of Tender Documents: The Tender documents can be purchased / downloaded by registered and eligible Contractors from the e-tendering System for Government of Maharashtra available on 6. Submission of Bid Seal (Hash) of Online Bids:

21 21 Submission of Bids will be preceded by submission of the digitally signed Bid Seals (Hashes) as stated in the Tender Time Schedule (Key Dates) In the detailed Tender. 7. Generation of Super Hash: After the expiry of the time of submission of digitally signed Bid Seals (Hashes) by the Contractors has lapsed, the Bid round will be closed and a digitally signed Super Hash will be generated by the Authorised Officers of Maharashtra Jeevan Pradhikaran. This is equivalent to sealing of the Tender Box. 8. Decryption and Re-encryption Online Bids: Contractors have to decrypt their Bids and immediately re-encrypt their Bids online and upload the relevant Documents for which they generated the respective Hashes during the Bid Preparation and Hash Submission stage after the generation of Super Hash within the date and time as stated in the Notice Inviting Tenders (Key Dates). The Bids of only the Contractors who have submitted their Bid Seals (Hashes) within the stipulated time, as per the Tender Time Schedule (Key Dates), will be accepted by the e-tendering System for Government of Maharashtra. A Contractor who has not submit his Bid Seals (Hashes) within the stipulated time will not be allowed to submit his Bid. For submitting the Bids online, the contractors/bidders are required to make online payment using the electronic payments gateway service Bid Submission Fee Rs /- The different modes of electronic payments available on the e- tendering portal. 9 Submission of Earnest Money Deposit: Contractors have to submit the Earnest Money Deposit in a Sealed Physical Envelope and the same should reach the Office of the concerned Official before the last Date and Time as Stated in Tender Documents. Contractors are required to keep their Earnest Money Deposit ready as the details of the Earnest Money Deposit instrument are required to be entered during the Bid Preparation and Hash Submission stage. The details of the Earnest Money Deposit shall be verified during the Tender Opening event and only those Contractors whose online Earnest Money Deposit details shall be found matching with the physical Earnest Money Deposit instrument shall be short listed for opening of other envelopes. 10. Opening of Electronic Bids: As per Tender / Prequalification Documents for details. 11. Key Dates: The Contractors are strictly advised to follow the Dates and Times as indicated in the Time Schedule in the Notice Inviting Tender for each Tender. All the

General Rules and Directions for the Guidance of Contractors 1. All works proposed to be executed by contract shall be notified in a form of invitation to tender pasted on a board hung up in the office of the Executive Engineer and signed by the Executive Engineer. This form will state the work to be carried out as well as the date for submitting and opening the tenders and the time allowed for carrying out the work, also the amount of earnest money to be deposited with the tender and the amount of the security deposit by the successful tendered and the percentage, if any, to be deducted form bills it will also state whether refund of quarry fees, royalties, dues and ground rents will be granted. Copies of the specifications, Designs and drawings, estimated rates, scheduled rates and any other documents required in connection shall be signed by the Executive Engineer for the purpose of identification and shall also be open for inspection by contractors at the office of the Executive Engineer during office hours. Where the works are proposed to be executed by the contractor according to the specifications recommended and approved by a competent authority on behalf of the Maharashtra Jeevan Pradhikaran, such specifications with designs and drawings shall form part of the accepted tender.

In the event of the tender being submitted by a firm, it must be signed separately by each partner thereof, and in the event of the absence of any partner, it shall be signed on his behalf by a person holding power of attorney authorizing him to do so i. The contractor shall pay along with the tender the sum of Rs (Rs. One Lakh Ninety Two Thousand Only) as and by way of earnest money. The contractor may pay the said amount by forwarding along with the tender Term Deposit Receipt for the like amount of any Scheduled Bank and duly endorsed in the name of Executive Engineer for the said amount. The said amount of earnest money shall not carry any interest whatsoever. ii. iii. iv. In the event of his tender being accepted, subject to the provisions of subclause (iii) below, a) The said amount of earnest money shall be appropriated towards the amounts of security deposits payable by him as stated under General Conditions of contract. If, after submitting the tender, the contractor withdraws his offer or modifies the same, or if, after the acceptance of his tender the contractor fails or neglects to furnish the balance of security deposits, without prejudice to any other rights and power of the MJP here under or in law, MJP shall be entitled to forfeit the full amount of the earnest money deposited by him. In the event of his tender not being accepted, the amount of earnest money deposited by the contractor shall, unless it is prior thereto forfeited under the provisions of sub-clause (iii) above, be refunded to him passing receipts therefore. 3. Receipts for payments made on account of any work, when executed by a firm should also be signed by all the partners except where the contractors are described in their tender as firm, in which case the receipt shall be signed in the name of the firm by one of the partners, or by some other person having authority to give effectual receipts for the firm. 4. Any person who submits a tender shall fill up the usual printed form, stating at what percentage above or below the rates specified in

26 26 Schedule-B [Memorandum showing items of work to be carried out ] he is willing to undertake the work. Only one rate of such percentage on all the estimated rates, Scheduled rates shall be named. Tenders, which propose any alteration in the works specified in the said form of invitation to tender, or in the time allowed for carrying out the work, or which contain any other condition, of any sort will be liable to rejection. No printed forms of tender shall include a tender for more than one work, but if contractor who wish to tender for two or more works, shall submit a separate tender for each. Tenders shall have the name and number of the works to which they refer, written outside the envelope. 5. The competent authority shall open tenders in the presence of any intending contractors who have submitted tenders or their representatives who may be present at the time, and he will enter the amounts of the several tenders in a comparative statement in a suitable form. In the event of a tender being accepted, the contractor shall for the purpose of identification, sign copies of the specifications and other documents mentioned in Rule 1. In the event of tender being rejected, the Competent Officer shall authorised the Bank Officer concerned to refund the amount of the earnest money deposited, to the contractor, making the tender, on his giving a receipt for the refund of the money. 6. Competent authority is the final authority to reject all or any of the tenders. 7. No receipt for any payment alleged to have been made by a contractor in regard to any matter relating to this tender or the contract shall be valid and binding on MJP unless it is signed by the Executive Engineer. 8. The memorandum of work to be tendered for and the Schedule of materials to be supplied by the MJP (herein before and after called as MJP or Pradhikaran for brevity) and their rates shall be filled in and completed by the office of the Executive Engineer before the tender form is issued. If a form issued to an intending tenderer has not been so filled in and completed, he shall request the said office to have this done before he completes and delivers his tender.

27 27 9. All work shall be measured net by standard measure and according to the rules and customs of the MJP and without reference to any local custom. 10. Under no circumstance shall any contractor be entitled to claim enhanced rates for items in this contract. 11. Every unregistered contractor shall produce along with his tender certificate of registration as approved contractor in the appropriate class and renewal of such registration with date of expiry. 12. All corrections and additions or pasted slips should be initialed. 13. The measurements of work will be taken according to the usual methods in use in the MJP and no proposals to adopt alternative methods will be accepted. The Executive Engineer s decision as to what is the usual method in use in the MJP will be final. 14. A tendering Contractor shall furnish a declaration along with the tender showing all works for which he has already entered into contract and the value of the work that remains to be executed in each case on the date of submitting the tender. Such certificate shall be in the proforma attached in the tender documents. 15. In view of the difficult position regarding the availability of foreign exchange no foreign exchange would be released by the MJP for the purchase of plant and machinery or any other purpose for the execution of the work contracted for. 16. The contractor will have to construct shed for storing controlled and valuable materials issued to him under Schedule A of the agreement at or brought him on work site at work site, having double locking arrangement. The materials will be taken for use in the presence of the MJP person. No materials will be allowed to be removed from the site of works without written permission of the engineer in charge. 17. Successful tenderer will have to produce to the satisfaction of the accepting authority a valid and current license issued in this favour

28 28 under the provision of Contract Labour Regulation and Abolition Act, 1973 before starting work failing which acceptance of the tender will be liable for withdrawal and earnest money / Security Deposit will be forfeited to the MJP. 18. The contractor shall comply with the provisions of the Apprentice Act 1961 and the rules and orders issued there under from time to time. The contract shall also be liable, for any pecuniary liability arising on account of any violation by him of the provisions of the Act. 19. As per clause 6 of B 1 form extension of time limit will be governed. If contractor fails to apply for extension of time limit as per clause 6 to keep the tender alive MJP will grant the extension considering the progress of work and in the light of clause As per government Resolution Price Variation Clause is not applicable to this tender. 21. Rates are inclusive of all taxes such as VAT, Services Tax, Cess General Tax etc. 22. Contractor shall be deemed to have examined the work and site conditions including labour, the general and specials conditions, specifications and drawings and shall be deemed to have visited the work site and to have fully informed himself regarding the local conditions and carried out his own investigations to arrive at rates quoted in the tender. There shall be no corrections or overwriting and if any that shall be dully initialed by Contractor himself. Note : The Commercial offer must be filled online using individual s digital certificate.
