Technical Bid with earnest money and Price Bid should be in different sealed covers superscripted Technical Bid and Price Bid respectively. The two bids together should be put in a sealed cover superscripted and addressed to the Commissioner, Jalandhar Division, Jalandhar, Punjab. 1. Tender document with detailed tender notice & terms & conditions can also be downloaded from website Firms, who downloads the tender document shall have to submit the cost of tender document(rs. 500/-) by a separate demand draft besides their EMD, while submitting their bids(tenders). Else, their tenders shall not be accepted. Although all efforts to update the website shall be made in time, however, all bidders, who have downloaded the tender document from the website, must inform Commissioner, Jalandhar Division, Jalandhar, Punjab about their desire to bid, providing their addresses, so that any addendum/ communication could be sent to them also. Failure to indicate their intention of bidding to Commissioner, Jalandhar Division may deprive them of ongoing communications and clarifications from Commissioner, Jalandhar Division. The tenderer shall be required to deposit Earnest Money as mentioned above only in the shape of Demand Draft from any schedule bank of India issued in the name of the firm duly pledged in favour of Commissioner, Jalandhar Division, Jalandhar, Punjab. No tender will be accepted without Earnest Money. 14. It is the responsibility of the tenderer to ensure that their tender reach to the office at the address given, by the due date and time. The tender received after due date and time will be out right rejected. Tender Document will neither be supplied nor entertained by post/ courier. But however tender document downloaded from internet is valid if it is accompanied with the cost of tender paper as mentioned in NIT at the time of receipt of the same. 15. Price Bid of only those tenderer would be opened who qualified the Technical Bid. 16. The tenderer shall keep his offer valid for 120 days and have no right whatsoever to withdraw or modify the same in any way during this period. If he do so, the Earnest Money paid by him shall be forfeited without any notice. 17. Special care should be taken to write the rate in figures as well as in words only in such a way that any interpolation is not possible. 18. Overwriting on document is not allowed, cutting if any, should be supported by signatures. 19. Suppliers should carefully read the technical specification before submitting their tenders. 20. Testing and commissioning of the equipment purchased is to be done by supplier or by the 3 rd party before the consignee or their authorised representative. 21. The authority reserve the right to accept or reject full or part of order to any supplier with reasons whatsoever and that will be conclusive and binding to the tenderer. 22. Acceptance of the lowest quoted rate is not binding. Tenders will be evaluated taking all the aspect into consideration. 23. The supplier shall supply the detailed documents about the technical manual and operational manual of the equipments. 24. If the due date fixed for receiving the tender or opening the tender is declared as holiday the tenders will be received/ opened at the same timing on next working day. 25. All dispute under this contract are subjected to Jalandhar city Jurisdiction only. 26 Final rate including all types of Taxes, Freight, VAT, Insurance, Transportation anywhere in Punjab etc. payable by the Government should clearly be stated giving detailed break-up of the price. Terms such as as applicable etc. should not be used but a fixed and firm price should be quoted otherwise tender will be rejected. 27. Tenderer should submit his tender on original letter head only and every page of document should be signed and stamped by the participant. 28. The selected supplier should be in position to supply the equipments within one month from the date of issue of the Purchase Order. 29. Expected warranty period is minimum one year. 30. (I) Tenderer should have experience and successful completion of supply of average 25% of Life Jacket during last two financial years. (II) Capability with respect to personnel, equipments and manufacturing facility may also be taken into consideration while taking decisions. (III) Tenderer should submit relevant documents regarding above and copy of audited Profit and Loss account and balance sheet for last three years with their Technical Bid. 31. The tenderer should submit the comparative chart of their product with specification given by this office, and additional features if there are any, it may be shown separately. 32. Tenderer should submit authorisation letter of original manufacturer. 33. EMD Refund:-a. The Earnest Money Deposited with the tender of Technically disqualified tenderer shall be refunded along with the sealed Price Bid. b. The Earnest Money of the unsuccessful tenderer will be returned to them at the earliest after expiry of the final bid validity. c. The Earnest Money of the successful tenderer will be returned after expiry of warranty period. d. No Interest will be paid for the period money is kept with the department. 34. a. 0.5% on delayed period per day on cost of delayed supply subject to maximum 10% of agreemented amount will be imposed for the material not supplied within the delivery period. 3 b. Normally no extension of the schedule delivery or completion date will be considered except where events constituting force majeure as provided in the contract have occurred. 35. The quantity tendered can be increase/ decrease/ dropped as per requirements at the time of placing the order. 36. The specification of the equipments is attached. 37. The firms should have adequate experience of supplying the similar Life Jackets to any Govt./ Semi Govt. or Public Sector Undertaking for last two years. 38. 4 TECHNICAL SPECIFICATIONS OF LIFE JACKETS _Weight : LIFE JACKETS should have weight of kgs _LIFE JACKETS should be comfortable to wear within a period of 1 minute without assistance, guidance or prior demonstration, capable of being worn in only one way and allows the wearer to jump into the water from a height without injury. _Dimension : length 132 cms/ width 67 cms. _It should have sufficient buoyancy to lift the mouth of an unconscious wearer not less than 120 mm clear of the water as per latest MSC 200 (80) Regulations. _Jackets should show no loss of buoyancy after immersion in water for 24 hours. _The materials used for the covers, tapes and seams of the LIFE JACKETS should be tested at Government approved laboratories to establish that they are rot proof, colour fast and resistant to teterioration from exposure to sunlight and are not unduly affected by sea water, oil or fungal attack. _LIFE JACKETS should meet the strength- Body strength and shoulder strength test prescribed in SOLAS, MSC 200 (80) Regulations, where in a load of 90 kgs is attached for a period of 30 minutes. _LIFE JACKETS should be fitted with approved Retro reflective Tape 2 x4 at nine strategic points for immediate visibility. _LIFE JACKETS should have tapes for fastening. _LIFE JACKETS should be capable of supporting a weight of 14.5 kgs for 24 hours without any effect on the lifebuoy. _LIFE JACKETS should show no deterioration after immersion in Diesel oil for 24 hours without any effect on the lifebuoy. _LIFE JACKETS should not sustain buring or continue melting after being totally enveloped in a fire for a period of 2 seconds. _LIFE JACKETS should come with a MMD Approved Life Jacket flashing light which meets the latest regulations as per MSC 200 (80). _Manufacturer should be ISO certified company maintaining high quality standards. _LIFE JACKETS should be tested, inspected, stamped and approved by the Mercantile Marine Department, for conformance to MSC 200 (80) of SOLAS. Rate : The rate should be quoted as per N.I.T. for destination inclusive of all taxes, Excise duty, Punjab VAT, Loading, unloading, transportation and other charges, if any, all-complete. It should be quoted both in figures and words as well. Any discrepancy found in figures and words, the rate quoted in words will be finally considered. 3. Consignee : Commissioner, Jalandhar Division, Jalandhar, Punjab state. 4. Paying Authority : Same as above 5. Destination : Headquarter of Commissioner, Jalandhar Division mentioned at sl.no.-3 above. 6. Earnest Money/ Security Money : Earnest Money Rs.. as mentioned in N.I.T. must be enclosed alongwith the Technical Bid. The tender without Earnest Money/ Less Earnest Money will be treated as NON RESPONSIVE. 7. Validity of rate : The tender will not be considered unless the rates 8. Time of completion and supply of materials are kept open till 120 days from the date of tender. : The full quantity of materials under Purchase Order must be completed within one month from the date of issue of P.O.. 9. In case of default, or even failure to supply the material as per supply schedule agreed upon by the Tenderer the department reserve the right to take recourse to any/all of the following clauses: Page 9 of 14

10 (1)Recover from the supplier liquidated damage at the rate of 0.5% on delayed period per day on cost of delayed supplied subjected to max. 10% will be imposed for machines not supplied within the delivery period (2)Make good the deficiencies (3)Forefeit the Earnest Money/Performance Guarantee. (4)Levy a suitable penalty. (5)Cancelled the P.O. 10. Payment : 100% payment shall be made to the supplier through bank draft for actual quantity received at destination in satisfactory condition, after verification of the quantity and quality by the consignee and successful test of Life Jacket which will be done by supplier/ technical team or by the 3 rd party before the consignee or their authorised representative. 11. Quantity of Materials : The quantity of Life Jackets as mentioned in B.O.Q. may be increased or decreased for which no claim will be entertained. : Attested Photo Copy of up to Income Tax Clearance 12. Income Tax certificates and PAN should attached with the tender. 13. The Tender received after due date and time will be outright rejected. Tender document will neither be supplied nor entertained by post/ Courier. But However tender document unloaded from internet is valid if it is accompanied with the cost of Tender paper (non refundable) as mentioned in NIT at the time of receipt of the same. 14. In case of any dispute or difference of opinion regarding interpretation of specification and if any other clause in respect of order, the matter will be referred to the concerned Engineer-incharge for arbitration and his decision shall be binding and final in all such matter. 15. No price variation will be entertained. 16. The rate including all taxes should be quoted in B.O.Q. (Price-Bid) in figures and words. The tender with rate quoted on separate paper is liable to be considered NON RESPONSIVE. However break up of rates (rates and taxes applicable) should be given in separate sheet. Page 10 of 14

11 17. The Authority reserves the right to accept or reject full or part of order to any supplier with reasons whatsoever and that will be conclusive and binding to the Tenderers. 18. All the pages of tender document must be signed and stamped by the tenderer and all the photocopies of documents submitted alongwith the tender should be attested by a gazzeted officer otherwise the tender will be rejected. 19. Vague & conditional tender is liable to be rejected. 20. Life Jackets below required specification or defective would have to be replaced by the supplier at his own cost to the consignee. 21. The evaluation of the bid will be made on the basis of rate, experience, performance, Physical stock, capability & financial position of the tenderer. Supporting documents to be attached. 22. Ordinarily, supply order will be awarded to the lowest evaluated bidder whose bid has been found to be responsive and who is eligible and qualified to supply the required material satisfactorily as per the terms and condition of the tender. However, where the lowest acceptable bidder against urgent requirement is not in a position to supply the full quantity required, the remaining quantity as far as possible, may be ordered from the next higher responsive bidder at the rate offered by the lowest responsive bidder. 23 Normally no extensions of the scheduled delivery or completion date will be considered except where events constituting force majeure as provided in the contract have occurred. 24.
