X) In case of joint venture of Foreign and Indian partner, the Indian Partners should be registered contractor with Public Works Department, Government of Maharashtra. XI) Separate information in respect of each firm (entered into joint venture) should be submitted in proforma 8 on page No.21. In case of joint venture the sponsoring firm has to submit complete information and identify the lead firm. It would be necessary for the joint venture to establish to the satisfaction of the department that the venture has been made practical workable and legally enforceable arrangements amongst the parties have been made and that responsibilities regarding the execution and financial arrangements have been clearly laid down and assigned that the individual parties to whom such responsibilities etc. assigned are capable in their individual capacity to discharge them completely and satisfactorily and involvement for the entire period of execution as well as a leading role in control and direction on the resources of the entire joint venture An independently pre qualified firm, joint venture consortia may, during the tender period, strengthen its capacity by subsequent incorporation of another pre qualified firm or joint venture to form new joint venture amongst themselves but should seek approval of the department not later than 15 days prior to bid opening. Bidders may be pre qualified independently or in a joint venture but they will be allowed to submit only one bid. 3.2 Contents of tenders documents. The prospective tenderers are free to ask for any additional information or clarification either in writing or orally concerning the work, and the reply to the same will be given by the Executive Engineer in writing and this clarification referred to as common set of conditions / deviations (C.S.D.) shall form part of tender documents and which will also be common and applicable to all tenderers. The point/points if any, raised in writing and / or verbally by the contractor in pre tender conference and not finding place in C.S.D. issued after the pre-bid conference, is/are deemed rejected. In such case the provision in NIT shall prevail. No individual correspondence shall be made thereafter with the contractor The tender submitted by the tenderer shall be based on the clarification additional facility offered (if any) by the Department, and this tender shall be unconditional. Conditional tenders will be summarily REJECTED All tenderers are cautioned that tenders containing any deviation from the contractual terms and conditions, specifications or other requirements and conditional tenders will be treated as non-responsive. 3.4 Manner of Preparation & Submission of tender and its accompaniments Both the Tenders (Technical as well as Commercial) shall have to be prepared and subsequently submitted online only. Tenders not submitted online will not be entertained.the tenderer shall submit the tender and documents in two digitally sealed envelopes as below: Online Bid preparation stage:- In Bid Preparation stage, bidders get access to Online Technical and Commercial Envelopes where they require uploading documents related to technical eligibility criteria and quote commercial offer for the work / item in respective online envelopes ENVELOPE NO. 1 (FOR TECHNICAL BID - DOCUMENTS) Following documents should be uploaded in Online Technical Envelope (T1) in PDF format, if required can be zipped as well and then uploaded. The scan copy of Earnest Money Deposit (EMD) to be paid shall be in the form of Demand Draft / Term Deposit receipt of Rs.3,76,000/- or valid certificate of exemption for payment of Earnest Money for value of Rs. 5,00,000/- (copy duly attested by gazetted officer of P.W.D. / irrigation Department.) 2. The scan copy of Certificate of Registered Contractor with the Government of Maharashtra P.W.D. in appropriate class as may be applicable in original or attested copy thereof duly attested by a Gazetted Officer of P.W.D. or Irrigation Department. Or 5 year old company with at least 3 works undertaken in Government / semi government. 3. The scan copy of Sales Tax Registration Certificate in Form II, Rule 4 (1) as provided by Maharashtra State, Sales Tax Act, (Maharashtra Act No. XXVI of The Maharashtra Sales Tax on transfer of property in Goods involved in execution of works contract (Rsenacted Act, 1989) from the Sales Tax Department of Maharashtra State. (In original or a copy duly attested by a Gazetted Officer. 4. The scan copy of list of Machinery and plants proposed to be used for carrying out this work. (From No. 3 Page No. 16 ) 5. The scan copy of Proof of appointment of employees including technical personnel by way of valid Professional Tax Registration certificate in form PTR/under section (I) or section 5 of Maharashtra Sales Tax on Professional, Trade, Calling and employment Act, 1975, rule 3(2) from the Professional Tax Officer of the concerned District in Maharashtra. The Professional Tax Clearance Certificate with list of employees duly attached by Professional Tax Officer shall be enclosed. 6. The scan copy of Undertaking of Contractor that he had studied all tender documents, and conditions in tender. 7. The scan copy of details of work done in all classes of civil Engineering / dredging works during last three years with the value of unfinished work (Information to be given in Form No.1, Page No.14 ) and should be supported by work done certificate signed by the Authority with whom the contractor has executed the work.) 8. The scan copy of details of similar type of work i.e. work involving removing silt, sand, clay and soil of all sorts in tidal conditions in Sea coastal area. (Information to be given in proforma of Form No.2, Page No. 15) and should be supported by work done certificate signed by the Authority with whom the contractor has executed the work.) 9. The scan copy of details of list of works in hand and works tendered for (information to be given in proforma of Form No.4, Page No 17) and should be supported by true copy of work order. 10..The scan copy of details of Technical Personnel on the rolls of the tenderer. (Information to be given in proforma of Form No.5, on Page No 18 ) 11. The scan copy of abstract of work done in all classes of Civil Engineering Construction / dredging Work during last three years.(information to be given in proforma of Form No. 6, Page No. 19) 12.. The scan copy of details of similar item of work carried out any one year. (Information to be given in form no. 7 Page no. 20) 13. The scan copy of certified copy of Partnership Deed and Power of Attorney, in case of a firm tendering for work. (True copy attested by a Gazetted Officer) 14. The scan copy of an up to date Audit balance sheet along with profit and loss Account verified by a chartered Accountant, True copy of Acknowledge of the latest income tax return filed duly attested by a Gazetted officer of public works Department or irrigation and power department. The scan copy of degree / Diploma Certificate of technical persons, work done certificate, similar type of work done certificate, machinary document, or all such other document, which are to be submitted in support of form no. 1 to 14 are to be strictly arrange POST QUALIFICATION CRITERIA (A) to qualify for award of the contract each tenderer in his name should have: (a) (b) (c) Achieved an average annual financial turnover (in all classes of Civil Engineering construction / dredging works only.) of Rs. 5,64,35,000/- ( Rs. five crore sixty four lac thirty five Thousund Only) or more in the last three years at price level of (Information to be given in proforma of Form No. 1 on Page 14) Satisfactorily completed (from start to finish), as a prime contractor, at least one similar type work of value not less than Rs. 2,25,74,000/- ( Rs. Availability of at least following own or leased key equipment for this work. i) Dredger (Grab or cutter section) = 1 Number ii) Spud Pontoon (200 T) = 1 Number iii) Barge (150 M3) = 2 Number IV) Tug Boat (400 T) = 1 Number v) Ferry Boat (15 T) = 1 Number NOTE (1): NOTE (2): NOTE (3): NOTE (4): Financial turnover and cost of completed works of previous years shall be given linear weightage of 10% per year on rupee value to bring them at price level = 100% = 110% = 121% The necessary certificates as mentioned in post qualification criteria from Sr. No.(a) to (c) are required to be obtained from the officer not below the rank of Executive Engineer. A copy of these certificates duly attested by a Gazetted officer from PWD or Irrigation Department shall be attached in Envelope No.1 only. In absence of these certificates Envelope No.2 (Financial Bid) shall not be opened. Signature of the officer checking / issuing requisite certificate should bear the name of concerned officer. (Form No. 1 to 7 on pages 14 to 20.) All these Forms shall be filled in and signed properly. NOTE (5): The abstract of information of work done in all classes of civil Engineering Construction works (as per Form 1) during last three years shall be given in form 6 in the proforma enclosed on page (B) The tenderers who meet the minimum qualification criteria as per para will be qualified only if their available bid capacity is more than the total estimated value of the work.. The available bid capacity will be calculated and declared along with the supporting documents and it should be submitted along with Tender Envelope number 1. The bid capacity will be calculated as per formula below. Assessed Available Bid Capacity = (A x N x 2) B Where, A = Maximum value of civil Engineering works executed in any one year during the last three years (updated to level) taking into account the completed as well as works in progress. N = No. of years prescribed for completion of the works for which tenders are invited. B = Value at price level of existing commitments and ongoing works to be completed during the year. NOTE: 1. The statements showing the value of existing commitments and ongoing works as well as the stipulated period of completion remaining for each of the works listed should be countersigned by the officer not below the rank of Executive Engineer. 2. The Assessed Available Bid Capacity should be calculated and declared along with supporting documents signed by an Officer not below the rank of Executive Engineer and should be submitted in Envelope No.1 3. Even though the tenderer meets the above qualifying criteria he is subject to be disqualified if he has made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements; and / or has a record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion of work, litigation history or financial failures etc ENVELOPE NO. 2 (FINANCIAL BID) All financial offers must be prepared online (An online form will be provided for this purpose in Online Commercial Envelope (C1), during Online Bid Preparation stage). The second envelope shall contain only the main tender. A tender submitted without this would be considered as invalid. He should not quote his offer any where directly or indirectly in Envelope No.1. The contractor shall quote for the work as per details given in the main tender and also based on the detail set of conditions issued/ Additional stipulations made by the Department as informed to him by a letter from Chief Executive Officer Maharashtra Maritime Board, Mumbai. Note: During Online Bid Preparation stage, bidders are allowed to make any changes or modifications in the bid data uploaded by them in Technical (T1) as well as Commercial (C1) envelope. Once a bidder successfully completes the Bid Preparation stage (by generating the Hash Values for T1 and C1), system won t allow him/her to make any further changes or modifications in the bid data. 3.5 ONLINE SUBMISSION OF TENDER:- The date and time for receipt of envelope Containing tender shall strictly apply in all cases. In this stage, bidders who have successfully completed their Bid Preparation stage are required to transfer the data, already uploaded by them during Bid Preparation stage, from their custody to department s custody. Note: During this stage, bidders won t have any right to make any kind of changes or editing into technical as well as commercial data. 3.6 OPENING OF TENDERS: The tenders that are submitted online successfully shall be opened online as per the date and time given in detailed tender schedule (if possible), through e-tendering procedure only in the presence of bidders. Tenders shall be opened either in the presence of bidders or it s duly authorised representatives. The bidder representatives who are present shall sign a register evidencing their attendance. Only one representative per applicant shall be permitted to be present at the time of opening the tender ENVELOPE NO. 1:- First of all, Technical Envelope of the tenderer will be opened online through e-tendering procedure to verify its contents as per requirements. At the time of opening of technical bid the tenderer should bring all the original documents that have been uploaded in the Online Technical Envelope (T1) so that same can be verified at the time of opening of technical bid. If the tenderer fails to produce the original documents at the time of opening of technical bid then the decision of the committee taken on the basis of document uploaded will be final and binding on the tenderer. If the various documents contained in this envelope do not meet the requirements of the Department, a note will be recorded accordingly by the tender opening authority and the said tenderer s Envelope No.2 will not be considered for further action and the same will be recorded. Decision of the tender opening authority shall be final in this regard. The commercial tenders shall not be opened till the completion of evaluation of technical tenders. The commercial Tenders of only technically qualified Bidders as mentioned above will be opened ENVELOPE NO. 2 :- (Financial Bid) This envelope shall be opened online as per the date and time given in detailed tender schedule (if possible), through e-tendering procedure only, This envelope shall be opened immediately after opening of Envelope No.1, only if contents of Envelope No.1 are found to be acceptable to the Department; the tenderer rate in Schedule B or percentage above / below the estimated rates shall then be read out. 3.7 EARNEST MONEY: The tender should be a accompanied by the earnest money deposit (EMD) of Rs.3,76,000/- to be paid in the form of (1) Demand Draft issued by any nationalized/scheduled Bank payable at Mumbai in the favour of Chief Executive Officer, Maharashtra Maritime Board Indian Mercantile chamber, 3rd floor, Ballard Estate Mumbai (2) Term Deposit receipt issued by schedule/ nationalized bank or valid EMD exemption certificate. The earnest money will be refunded in due course in case of tenderers whose tenders are not accepted. In case of successful tenderer, the Earnest money will be refunded after recovering initial security deposit and completion of contract documents by the Tenderer. The amount of Earnest Money will be forfeited to Maharashtra Maritime Board in case the successful contractor does not pay the amount of initial security deposit within specified time limit. Earnest Money of the unsuccessful tenderers will be refundable on their application only after an intimation of rejection of their tender is sent to them or on the expiry of the validity period whichever is earlier. TERMS FOR EARNEST MONEY DEPOSIT PAYMENT :- The Earnest Money Deposit to be paid at the time of submitting tender (envelope No.1) Shall be in the following manner (1) demand Draft issued by any nationalized / schedule bank payable at Mumbai in favour of Chief Executive Officer, Maharashtra Maritime Board Mumbai. or (2) Term Deposit receipt valid for a period of 1 Year from the last date of submission of tender issued by schedule / nationalized bank and endorsed in the name of Chief Executive Officer Maharashtra Maritime Board Mumbai. or (3) valid E.M.D. Exemption certificate duly attested by gazetted Officer of P.W.D. Earnest Money exemption certificate shall not be accepted in lieu of Earnest Money indicated elsewhere in the N.I.T. except in case of those tenderer who have obtained Earnest Money Exemption certificate after payment of Rs 5.00 lakh to their registration authorities. In case of joint venture the Earnest Money exemption 3.8 SECURITY DEPOSIT: The successful tenderer shall have to pay half the security deposit in the form of Demand Draft Drawn at any Nationalized Bank / schedule Bank payable at Mumbai in favour of The Chief Executive Officer Maharashtra Maritime Board, Mumbai. Balance Security Deposit will be recoverable through the bills at the percentage as shown in item(s) of the Memorandum in printed B-1 form or as may be decided by the Chief Executive Officer during course of execution of the work looking to the position and circumstances that may prevail, whose orders will be final and binding on the contractor. The security deposit for the due performance of the contract shall be as detailed in the Tender Documents elsewhere. Fifty percent of the security deposit will have to be deposited within ten days (including Government holidays) of the acceptance of the tender and the remaining fifty percent will be recovered from the Running Bills at the rate as specified in the tender form, on the cost of work as per C.S.R. prevailing at the time of acceptance of tender. Amount of total security deposit to be paid shall be 4 % of the work cost, work out of CSR for the year for the respective District. In the Event of failure of the successful tenderer to pay initial security deposit in due course ( unless Extended in writing by Executive Engineer Maharashtra Maritime Board, Mumbai.) from the date of receipt of notice of acceptance of his tender, the amount of earnest money shall be fortified with Maharashtra Maritime Board, Mumbai and acceptance of his tender shall be considered withdrawn; except that in the event of notice of acceptance of the tender not being issued within 90 days of the date of opening of envelop No. 2 ( financial bid ). The acceptance of tender may be intimated to the tenderer telephonically or otherwise and either by the officer competent to accept the tender or any authority in the department and such intimation shall be deemed to be an intimation of acceptance of the tender given by the authority to accept the tender. 3.9 TIME LIMIT: The work is to be completed within time limit as specified in the Notice Inviting Tender which shall be reckoned from the date of written order of commencing the work and shall be inclusive of monsoon period TENDER RATE: No alteration in the form of tender and the schedule of tender and no additions in the scope of special stipulation will be permitted. Rates quoted for the tender shall be taken as applicable to all leads and lifts TENDER UNITS: The tenderers should particularly note the unit mentioned in the Schedule B on which the rates are based. No change in the units shall be allowed. In the case of difference between the rates written in figures and in words, the correct rate will be the one, which is lower of the two. 15 Dy.Engg ACCEPTANCE OF TENDER: Acceptance of tender will rest with the Chief Executive Officer Maharashtra Maritime Board, Mumbai. Indian Mercantile chamber, 3rd floor, Ballard Estate Mumbai who reserves the right to reject any or all tenders without assigning any reason thereof. The tenderer whose tender is accepted will have to enter in to a regular B-1 agreement within 10 days of being notified to do so. In case failure on the part of Tenderer to sign the agreement within the stipulated time, the earnest money paid by him shall stand forfeited to the Maharashtra Maritime Board and the offer of the tenderer shall be considered as withdrawn by him CONDITIONAL TENDER: The tenders which do not fulfill the condition of the notification and the general rules and directions for the guidance to contractor in the agreement form or are incomplete in any respect are likely to be rejected without assigning any reason thereof. (a) The Tenderers shall be presumed to have carefully examined the drawings, conditions and specifications of the work and have fully acquainted themselves with all details of the site, the conditions of rock and its joints, pattern, river, weather characteristics, labour conditions and in general with all the necessary information and data pertaining to the work, prior to tendering for the work. (b) The data whatsoever supplied by the Department along with the tender document are meant to serve only as guide to the tenderers while tendering and the Department accepts no responsibility whatsoever either for the accuracy of data or for their comprehensiveness. (c) The quarries for extraction of metal, murum etc. provided in the sanctioned estimates are as per survey conducted by the Department. The contractor should however examine these quarries and see whether full quantity of materials required for execution of the work strictly as per specification are available in these sources before quoting the rates. In case the materials are not available due to reasons whatsoever, the contractor will have to bring the materials from any other sources with no extra cost to Maharashtra Maritime Board. The rates quoted, should therefore be for all leads and lifts from wherever the materials are brought at site of work and inclusive of royalty to be paid to the revenue Department by the Contractor POWER OF ATTORNEY: If the tenderers are a firm or company, they should in their forwarding letter mention the names of all the partners together with the name of the person who holds the power of Attorney authorizing him to conduct all transactions on behalf of the body, along with the tender The tenderer may, in the forwarding letter, mention any points he may wish to make clear but right is reserved to reject the same or the whole of the tenders if the same become conditional tender thereby The contractor or the firms tendering for the work shall inform the Department if they appoint their authorised Agent on the work Due to non-availability of foreign exchange, no foreign exchange will be released by the Department for the purchase of plants and Machinery for the work by the Contractor Any dues arising out of contract will be recovered from the contractor as arrears of Land Revenue if not paid amicably.
