3 The Bidders are required to download the Tender Forms for the above items online and also submit their Bids for these items online ONLY (except for Tender Form Fees, which shall be received manually). Manual Bids for these items shall not be considered in any circumstances. Earnest Money Deposit shall be submitted at the above Office before the expiry of Decryption and Re-encryption (Online Bid Submission) stage of the Tender. The online Tenders of those Bidders whose Earnest Money Deposit is not received within the prescribed time limit shall not be considered. The various activities required to be executed by the Bidders to submit their online Bids for these items are time and date locked. The Bidders are requested to execute all the activities related to their bids within the prescribed time limits (key dates) for each stage. Bidders participating in the online tendering process are required to pay Rs. 1,038/- (Rupees One Thousand Thirty Eight only) towards service charges. The amount is required to be paid online using Credit Cards / Debit Cards / Cash Cards. As per Information technology Act 2000, the Bidders are required to sign the bid data using Class II / Class III Digital Certificate. The Bidders may procure the Digital Certificate in the name of the authorized representative of the Organization at the earliest. 5 Annexure No I Terms & Conditions 1) Successful tenderer shall collect the waste hypo solution from all ESIS hospitals in Maharashtra State on as & where is basis. 2) Hypo solution in all ESIS hospitals will be sold at single & common rate & hence tenderer will have to quote single & common rate only for purchase of hypo solution in all ESIS hospitals. 3) The tenderer will have to collect hypo solution through his own containers & at his own cost from the location within six weeks after receiving orders of the Office of the Commissioner, ESI Scheme, Panchdeep Bhavan, 6 th floor, N. M. Joshi Marg Lower Parel, Mumbai-13. 4) Only those tenderers who have obtained consent for operation from Maharashtra Pollution Control Board will be considered for tender. 5) Successful tenderer will be allotted the specified quantity of hypo solution which tenderer is allowed to operate as per Maharashtra Pollution Control Board. In case of situation where quantity exceeds the permissible limits prescribed by MPCB other tenderers will be called for negotiations and if they are willing to match with the highest quoted rates then only they will be considered for allocation. In such situation tender committee will be final authority to decide the hospitals and quantity of hypo solution stock to be allocated to tenderer for collection of waste hypo solution. 6) In case of equal rates, first preference will be given to those who are registered with any of following institutions for extraction of silver from waste xray film developer (Hypo solution) - a) All Government & Semi Government institutions under Government Of Maharashtra & Zilla Parishads in Maharashtra & fully owned undertakings of any State Government & Government Of India b) Director General of Supplies & Disposals, New Delhi (D.G.S. & D) but having factory in Maharashtra 5

6 c) Small scale industrial units (S.S.I.) registered with Director of Industries, Maharashtra. d) S.S.I units registered with National Small Industries Corporation (N.S...I.C.) & Small Industries Service Institute of Government of India ( S.I.S.I) e) Tenderer registered with Central Store Purchasing Officer(CSPO) of Directorate of Industries, Maharashtra 7) If there are equal rates even after sorting as mentioned in condition no. 6 then past experience will be given preference. 8) Payment Clause - The successful tenderer will have to make 100 per cent payment to the concerned E.S.I.S. Institutions before collecting the waste hypo solution. 9) Validity of tender -The Tender will be kept open for acceptance up to 6 months ( Six months) from the date of opening of Commercial Envelope C1. 10) Quotation of rate should be strictly in Rupees/Liter of solution. 11) All the copies of Certificates attached with the tender should be duly attested by any Gazzetted officer. 12) Tender Form Fee - Tenderer will have to pay Rs.3,000/- (Rupees Three thousand only) in lieu of tender form fee in the form of demand draft of any nationalized bank drawn in favor of Commissioner, ESI scheme Mumbai. Bidders are requested to submit their Tender form fee at Desk 4 of the above given ESIS address before Tender closing date i.e. 19th June ) EMD - Tenderer will have to pay E.M.D. of Rs.1,50,000/- ( Rupees One lac Fifty Thousand only) in the form of demand draft drawn from any nationalized bank in favor of Commissioner ESI Scheme, Mumbai. Tenderers who are registered to institutions as per mentioned in Sr. No. 6 will be exempted from EMD. Bidders are requested to submit their EMD at Desk 4 of the above given ESIS address before Tender closing date i.e. 19th June ) Security Deposit - Successful Tenderer will have to pay security deposit of amount approximately 5% of total cost of hypo solution 6

7 alloted to tenderer. The amount to be paid will be informed through Tender Acceptance Letter which will be issued by this office. The security deposit is to be paid in the form of Demand Draft drawn from any Nationalized Bank in favor of Commissioner ESI Scheme, Mumbai. Tenderer will have to pay security deposit within 7 days (seven) after receiving of tender acceptance letter. Order to collect hypo solution from hospitals will be issued only after payment of security deposit to this office. Successful tenderers who are registered to institutions as per mentioned in Sr. No. 6 above will be given concession as per prevailing government rules. 15)The EMD of Successful tenderers will be released only on payment of security deposit. 16)The Security deposit will be released only after submission of No objection certificate ( NOC) issued by Medical Superintendents of ESIS hospitals, 17) The EMD & Security deposit will be forfeited in the event of lapse on tenderer's part at any stage of tender procedure and the same will be deposited to the account of Governer of Maharashtra. 18)The decision of grant of extension for execution of order will remain with the tender committee & late fee of 2% per week will be levied. No such extension will be granted for more than 5 wks at any cost. 19)Market rate of Silver on the date of opening of Commercial Envelope C1 will be taken into consideration for determining the base price for sale of hypo solution. 20) Envelope T1 (Technical Bid) will require technical bid to be filled up online by the bidders. Similarly, Envelope C1 (Commercial Bid) will require commercial bid to be filled up online by the bidders. 21)Last date of Preparation of E-Tender- The online Tender should be filled online before the expiry Date and Time of Bid Preparation. 22)Date of Opening Envelope T1 & C1 will be opened as per the key dates of tender opening mentioned in the tender schedule. 7

8 23)Commissioner, E.S.I.Scheme, Mumbai, Maharashtra State, reserves the right to reject any or all the tenders without assigning any reason. 24)Commissioner, E.S.I.Scheme, Maharashtra State, Mumbai reserves the right to call off the complete tender procedure if such a situation arise without assigning any reason.
