1 COMPETITION RULES Office du Tourisme et des Congrès de Paris (Paris Tourist and Convention Office) ARTICLE 1. IDENTITY OF THE ORGANISER CONCEPTORY, a simplified joint-stock company with capital of 50,000 euros, with its head office in PARIS, 20 ème, 17 rue Pelleport, registered in the Paris Trade and Companies Register under number , hereinafter "Conceptory" or "the Organising Company". ARTICLE 2. OPERATION OF THE CAMPAIGN Conceptory is organising a competition on behalf of its client, Office du Tourisme et des Congrès de Paris, which has its head office at 25 rue des Pyramides Paris. The competition will be run on the Paris Tourist Office's "Paris je t aime" Facebook page. The Campaign will run from 24/10/2016 to midnight on 10/11/2016. This free competition with no obligation to make a purchase is restricted to residents of the following countries: Germany, Italy, UK, Portugal, Spain, Belgium, Switzerland, Luxembourg, Netherlands, Denmark, Norway, Sweden, Finland, Greece, Croatia, Austria, Hungary, Romania, Albania, Bulgaria, United States and Canada. However, members of staff of the Office du Tourisme et des Congrès de Paris, as well as their families, including partners, and more generally anyone directly or indirectly involved in implementing this Campaign, are excluded from taking part. Any entrant under the age of 18 must have prior consent from a parent or guardian to take part in the competition and agree to these rules. The Organising Company may ask any entrant under the age of 18 to provide evidence of such consent and, where necessary, disqualify any entrant who cannot provide evidence of such consent. To take part, entrants must go to the Paris Tourist Office's "Paris je t aime" Facebook page or on a dedicated landing page : pariscabarets.parisinfo.com, work through the page and answer the various questions to find out which cabaret they are. Once they have a profile, they will be entered into the prize draw and they will be 4 winners. They will therefore need to have access to the Internet. There is a limit of one entry per person for the Campaign. Any missing or inaccurate information regarding an entrant will render that entrant's entry in the Campaign null and void. ARTICLE 3. SELECTION OF WINNERS Winners will be selected by means of a prize draw. Entrants who attempt to take part through means such as entry bots, automated entry programs, using information and addresses that do not belong to them and more generally any means that do not comply with the principle of each entrant having an equal chance of winning will be automatically disqualified. Winners will be notified personally by the Office du Tourisme et des Congrès de Paris by an and/or on social media (Facebook, Twitter, Instagram). The information provided by people who wish to take part will be sent to the Organising Company. Only one prize will be allowed per household for the duration of the competition, a household being all the people living under the same roof. The Organising Company reserves the right to carry out any checks it deems necessary for the application of this Article. ARTICLE 4. ACCEPTANCE OF THE RULES Taking part in the Campaign implies the entrant's acceptance of these rules in their entirety. There may be no disputes in relation to the operation of the Campaign. Any issue involving the application or interpretation of these rules that may cause a problem will be dealt with by Conceptory, with no option for appeal. In the event of disagreement regarding the authenticity of the response(s) received, it is the entrant's responsibility to prove the alleged falsification.
2 ARTICLE 5. DESCRIPTION AND VALUE OF PRIZES The following prizes are on offer: Paradis Latin Prize (for 2 person) : - "Star" Dinner Show: Starter, Main, Dessert, ½ Bottle of Bordeaux Wine + ¼ Bottle of Champagne and Paradis Latin show Value: Night in a 4* hotel in the 5th arrondissement of Paris for 2 person Crazy Horse Prize 2 (for 2 person) - Show at the Crazy Horse including ½ bottle of champagne Value: Dinner before or afterwards at Chez Francis, a luxury brasserie opposite the Eiffel Tower Value: Night at the Prince de Galles hotel with breakfast Value: 850 Lido Prize (for 2 person) - CHAMPS ELYSEES including : dinner - 1/2 bottle of champagne per person - "Paris Merveilles" Value: Night at the 5* Hotel VERNET, including breakfast at the hotel
3 Moulin Rouge Prize (for 2 person) - Féerie dinner show,including : dinner + ½ bottle of champagne + Féerie show - night for 2 at the Mercure Montmartre hotel with breakfast Value: 300 Plus : ARTICLE 6. AWARDING OF PRIZES As part of the Campaign, the prizes listed in Article 5 will be allocated to the winners as follows: by means of a prize draw at the end of the competition for the people who took part in the quiz. Each of the winners drawn will receive one prize. Awarding of prizes: Prizes are awarded strictly to the person named and may not, therefore, be transferred to another person. The Organising Company will contact the winners within a week of the end date of the competition, i.e. by 17 November, to inform them of the terms and date of the presentation of their prize. The winners will have 40 calendar days from the date given by the Organising Company to confirm their win. The deadline for confirmation of prizes is 22 December. After that deadline, winners will no longer be able to claim their prizes. The Organising Company may not be held liable as a result of a change to an entrant's contact details, following participation in the competition, of which the Organising Company has not been informed. The prizes on offer may not give rise to any dispute of any kind whatsoever on the part of the winners, and they may not be exchanged for cash or replaced or exchanged for any reason whatsoever. In the event of force majeure, or if required by circumstances, the Paris Tourist Office reserves the right to replace the prizes won with prizes of equal or greater value. ARTICLE 7. PERSONAL DATA The winners authorise all checks on their identities and their telephone, postal and contact details. All information communicated by entrants to Conceptory may be sent to Conceptory's partners and to the Office du Tourisme et des Congrès de Paris for marketing purposes or for use in promotional materials (website, newsletter, Facebook page etc.) if the entrant has given consent by ticking the relevant box. The information collected may be processed electronically in order for the entrant to take part in the competition and possibly for commercial purposes (where the entrant opts in). Under no circumstances will this information be sent to Facebook.
4 Under French Law no of 6 January 1978 regarding information technology, files and civil liberties, entrants have the right to oppose (Art. 26 of the Law), access (Art. 34 to 38 of the Law) and correct and delete (Art. 36 of the Law) data relating to them. Entrants may exercise this right by sending a written request to Conceptory at the following address: claire@conceptory.fr, or by post to Conceptory 17, rue Pelleport ARTICLE 8. INTELLECTUAL PROPERTY RIGHTS In accordance with the laws governing literary and artistic property rights and related rights, reproduction and representation of any or all of the elements that make up the competition are strictly prohibited. All brands and/or logos used are registered trademarks. ARTICLE 9. AGREEMENT IN RELATION TO PROOF Except in the case of obvious errors, it is agreed that information from Conceptory's competition systems will have probative value in any dispute regarding connecting elements and the electronic processing of the aforementioned information relating to the competition. ARTICLE 10. LIMITATION OF LIABILITY Taking part in the Campaign involves connecting to the Internet and sending your selected response electronically. Conceptory accepts no liability in the event that network access is poor or unavailable and entrants are unable to take part in the Campaign as a result. Furthermore, Conceptory may not be held liable for any event not attributable to it, such as any delay in the distribution of prizes, or for cases of force majeure likely to disrupt, alter and/or nullify the Campaign. Facebook is not managing or promoting the competition in any way and cannot under any circumstances be held liable in the event of any problems with the competition, whatever they may be, for any reason whatsoever. It accepts no liability of any kind with regard to entrants for any fraud that may be committed. ARTICLE 11. PUBLICATION OF WINNERS' NAMES Winners' and entrants' details will be used in accordance with the provisions of French Law no on information technology and civil liberties of 6 January Winners of the Campaign give permission for their first names and surnames to be mentioned in any televised, online or paper medium used by Conceptory, without receipt of any remuneration, right or benefit other than allocation of their prizes. ARTICLE 12. CONSULTATION OF THE RULES These rules have been filed at the office of Florence Houtart, Officer of the Court, 119 avenue Gambetta , Paris. The rules will be sent free of charge to anyone who sends a written request to CONCEPTORY, 17 rue Pelleport, Paris 20 e. The postage costs incurred in sending the request for the rules will be reimbursed on request, based on the French post office's current rate for second-class post (based on a weight of 20 g). The request must be made within 30 days of the end of the competition to CONCEPTORY, 17 rue Pelleport, Paris 20 e. Only one reimbursement of costs may be provided per person (same account, same first name, same surname, same address, same bank details). Requests for reimbursement of postage costs cannot be honoured unless the conditions listed above are fulfilled. Requests for reimbursement made by or telephone will not be accepted. ARTICLE 13. REIMBURSEMENT OF INTERNET CONNECTION COSTS The costs incurred by competition entrants may be reimbursed upon receipt of a written request by the Organising Company. This request must be posted no later than 30 days after the competition closes and must specify your name and postal address, details of a post office or bank account in your name and the subject of the request. The cost of the stamp used to send the request for reimbursement of the cost of taking part will be reimbursed on request at the current second-class rate for a 20-g letter. The cost of the telephone communication used to access the website and the time spent taking part in the competition will be reimbursed at a fixed rate and will be limited to one connection per entrant,
5 based on an average connection time of 5 minutes at a fixed cost of 0.05 euro per minute including tax, i.e. a fixed-rate reimbursement of 0.25 euro including tax. Entrants who have a fixed-rate subscription and who therefore did not incur any costs when they entered the competition may not claim any reimbursement. Reimbursements will be paid by bank transfer or cheque. ARTICLE 14. APPLICABLE LAW AND JURISDICTION These rules are subject to French law. Any disagreement arising from their existence, interpretation or execution will be subject to the jurisdiction of the Tribunal de Grande Instance de Paris. The complaint must be made within 30 days of the end of the competition to CONCEPTORY, 17 rue Pelleport, Paris 20 e ; otherwise, it will not be taken into consideration. ARTICLE 15. FORCE MAJEURE The Organising Company reserves the right, particularly if there is a compelling reason, to cut short, extend or cancel this competition and/or competition session, in whole or in part, if required by circumstances. It may not be held liable for doing so. These changes may, however, be communicated in advance by all appropriate means, including the Organising Company's website. The Organising Company reserves the right to suspend participation in the competition temporarily if it, or any web host it may use, can no longer guarantee continuity of the service required to run the competition. In the event of force majeure, an unforeseeable event or exceptional circumstances (fire, flood, natural disaster, intrusion, cyberattack, strike, questions about the financial and technical stability of the competition, breakdown or freezing of telecommunication networks, damage caused by viruses that cannot be eradicated by the existing security measures on the market, legal, regulatory or public policy obligations imposed by the competent authorities that substantially modify these competition rules, or any other event of force majeure or unforeseeable circumstances in the sense of Article 1148 of the French Civil Code), even if said event or circumstances are its own responsibility (subject to it acting in good faith), the Organising Company may, at any time, bring all or part of the competition to an end. This competition will be cancelled in the event of force majeure, and entrants and winners will not be entitled to claim any compensation in this regard. Drawn up in Paris, 13/10/2016
