1 American Express Australia Limited Be a Points Millionaire Competition Terms and Conditions 1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions. 2. The Promoter is American Express Australia Limited (ABN ) of 12 Shelley Street Sydney NSW 2000 ( Promoter ). 3. The competition commences on Monday 15 August 2016 at 09:00 (AEST) and concludes on Sunday 11 September 2016 at 23:59 (AEST) ( Promotion Period ). Eligibility 4. Eligible Entrants must be: a. Over the age of 18 years; b. Residents of Australia; and c. The Primary Card holder of an American Express Card issued by American Express Australia Limited, and whose account(s) are in good standing. Exclusions apply to American Express Corporate Cards and American Express Business Cards. 5. Supplementary Card Members and any Bank issued American Express Cards are ineligible to enter. 6. Employees and their immediate families of the Promoter, Salmat Digital Pty Limited, or CX Agency Lavender Pty. Ltd., and their associated agencies and companies are not eligible to enter. How to Enter 7. To enter the draw Eligible Entrants must, during the Promotion Period go to and enter their first name, last name, phone number and e- mail address as required on the competition entry form. Eligible Entrants can only submit one entry via the registration page. 8. Once the Eligible Entrant has submitted their entry via the registration page, they will have the option to also enter via Facebook, Instagram and/or Twitter for additional entries to the competition. Entry via each social channel equals one additional entry into the draw. Eligible Entrants can only enter once via each social channel. a. If entering via Facebook, Eligible Entrants must download a photo from the competition entry page and post it to the American Express Facebook page using the campaign hashtag #AmexMillions. b. If entering via Twitter, Eligible Entrants must download a photo from the competition entry page and post it to their Twitter profile using the campaign hashtag #AmexMillions. c. If entering via Instagram, Eligible Entrants must download a photo from the competition entry page and post it to their Instagram profile using the campaign hashtag #AmexMillions. 9. For clarification there are a maximum number of 4 entries per Eligible Entrant, if they choose to enter via every available entry mechanism. 10. 2 11. Entries must be received during the Promotion Period. Entries made outside the Promotion Period will not be accepted. The time of entry will in each case be the time online entry is received by the Promoter s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason. 12. Any entry that is made on behalf of an Entrant by a third party will be invalid. 13. The cost of accessing the promotional website will be dependent on the entrant s individual Internet Service Provider. PRIZE AND DRAW 14. There will be four (4) prize winners. Four (4) Eligible Entrant s entries will be randomly drawn to receive 1 million points, (equivalent to up to $27,875). The exact value of the prize is dependent on the winner s rewards program. Points cannot be converted into cash. 15. The total prize is valued up to AUD $111, 500 (including GST). The exact value of the prize is dependent on the winners rewards program. Points cannot be converted into cash. 16. The draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, Tuesday 20 September 2016 at 14:30 (AEST). 17. The winner will be notified in writing within two (2) business days of the draw. American Express will send a direct message to the winner on the social media platform or e- mail address they selected to enter. The Winner must call American Express on the details provided on the direct message and their entry will be validated based on a. the winner is the true owner of the address or social media profile used to enter the competition; b. the winner is the Primary Card holder of an eligible American Express Card; and c. the winner s account is in good standing. 18. Once a winning entry is validated over the phone, 1 million points will be credited to the winner s account within 10 business days. 19. The points classification credited to the winner s account will depend on the Card and rewards program that the winner is enrolled in: a. 1 million Membership Rewards points will be awarded if the winner holds a Card enrolled in the Membership Rewards program. b. 1 million Qantas Points will be awarded if the winner holds an American Express Qantas Card or if the winner is enrolled in the Qantas Direct program. c. 1 million Velocity Points will be awarded if the winner holds an American Express Velocity Card. 20. The winners initial, surname and state of residence will be published in the Public Notices section of The Australian newspaper on Friday 14 October Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat Digital, Level 2, 116 Miller St, North Sydney NSW 2060 on Tuesday 20 December 2016 at 14:30 (AEDT). 3 regarding the Competition result. GENERAL CONDITIONS 23. The prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be entirely forfeited by the winner. No cash or other compensation will not be awarded in lieu of that element of the prize. 24. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to the accepting of the prize. 25. The Promoter reserves the right to request that the winner provides proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. The suitability and verification of such proof is at the sole discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 26. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner s entry is of a type described in this clause. 27. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including but not limited to any injury or damage to participants or any other person s computer related to or resulting from participation in or down-loading any materials in this competition. 28. It is a condition of acceptance of the prize that the winning Eligible Entrant s American Express Card account must be current, not in default and in good standing, during the Promotion Period and at the time of notification that they have won. 29. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to any written regulatory direction or as required by law. 30. It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 31. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize. 32. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner s image and/or voice, as recorded, photographed or filmed during the winner s participation in the prize to appear in connection with the Promoter (including its related companies) or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee, payment or other compensation for such use. 33. 4 printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date. 34. Should an entrant s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation. 36. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter s legal rights to recover damages or other compensation from such an offender are reserved. 45. The Promoter, Salmat Digital and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available. 46. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction or as required by law. PRIVACY CONSENT. 47. To provide this competition, the Promoter needs to collect personal information about the entrant. If the entrant does not provide the information requested, the Promoter may not be able to provide the entrant with the competition entry. The entrant agrees that subject to the Privacy Act, the Promoter or their agents may do the following: a. Transfer personal information confidentially to the Promoter s related companies or organisations that provide services in relation to this competition. Disclose entrants' personal information to State and Territory lottery departments; c. Publish winners' names as required under the relevant lottery legislation; and d. Use the winner's personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the winner otherwise notifies the Promoter at time of accepting the prize.
