FOR Sealed competitive tenders on percentage rate basis in B-1 form for the following works from registered contractors or firms in appropriate Class with Maharashtra Jeevan Pradhikaran and who have experience of similar works in the organization, so as to reach in the office of Executive Engineer. MJP. PMC. Division Pune-1. mentioned in Item No.10 given below on or before dated up to Hrs. 1. NAME OF WORK Designing,Providing,and Execution of MHASWAD Water Supply Scheme under MSNA Programme Consumer Survey,Water Auidit,Energy Auidit,Flow Meters,Hydraulic Modeling, Making GIS for Water Supply, including required Software and Hardware etc 2. ESTIMATED COST PUT TO TENDER. - Rs EARNEST MONEY DEPOSIT. Rs i) Earnest money deposit of Rs should be paid in cash or in the ii) shape of term deposit receipt of any nationalised or schuduled bank by demand draft in the name of Executive Engineer MJP.PMC. Division Pune-1 This earnest money amount shall not carry any interest whatsoever. The earnest money will be refunded in the case of tenders whose tenders are not accepted, only after completion of all formalities in respect of the accepted tender or in the case of successful tenders, the earnest money will be refunded after completion of contract documents and payment of security deposit.

A) SECURITY DEPOSIT Total security deposit will be 5.00% on the total cost put to tender. iii) Initial 2.5% Security Deposit on the total cost of put to tender to be paid in cash or by D.D. drawn in the name of Executive Engineer MJP.PMC. Division Pune-1 I) (if earnest money deposit is converted in to security deposit in case of successful tenderer, additional security deposit will be 2.5%) or in the form of Bank Guarantee of any scheduled or Nationalized Bank in the form specified for a minimum period of two years extendable up to at least one year after commissioning of work by the successful tenderer at the time of signing of agreement or approval of tender. In case the Guarantee is submitted for initial security deposit, it will be the entire responsibility of the Contractor for extension of the same till above period II) Remaining 2.5% security deposit on the cost of sanctioned tender will be recovered through R.A. Bills. Iii) 75% of Security Deposit will be refunded after 6 months from date of final bill passing & remaining 25% of security deposit shall be refunded after expiry of the defect liability period as stipulated in the contract. iv) Security deposit to be recovered in case the offer quoted is below and the cost put to tender is as under. This should be done before acceptance of the tender. Tender quoted up to 10% below 2 Tender quoted from 10% to 15% below 2.5% of cost put to tender in initial stage + 2.5% through R.A. Bills 5% of cost put to tender in initial stage + 2.5% through R.A. Bills 3 Tender quoted more than 15% below 7.5% of cost put to tender in initial stage + 2.5% through R.A.Bills.

12 STAMP DUTY. Stamp duty at 2% of total security deposit will have to be paid on the date of agreement to be in the form of adhesive stamps, & 3% stamp duty if security deposit is paid in form of cash. The stamp duty to be affixed on stamp paper of Rs. 100/- stamp paper cost will have to be borne by the Contractor. 6. TIME OF COMPLETION. 12 (Twelve) calendar months from the date of issue of work order (including monsoon season) for Providing & constructing all works including testing and trial run period of three months. 7 PREQUALIFICATION CONDITIONS FOR REFORM WORK :- 1) Tenderer should have experience of similar type of works 2) Tenderer should have experience in water audit or tenderer should have joint venture or consortium with the agency who has experience of simliar work as below a) Minimum at least one town of C Class ULB or higher catagery. 3) Tenderer should have experience of energy Audit or tenderer should have joint venture or consortium with the agency that who has experience of similar works. 4) Tenderer should have experience in preparation of hydraulic model for distribution system of a city / town including demand assessment by using water Gems/water cad or equivalent software OR Tenderer should have joint venture or consortium with the agency that who has experience in preparation of hydraulic model for distribution system including demand assessment by using water Gems/water cad or equivalent software.

13 5) Tenderer should have experience in preparation of managing, creating and analyzing GIS data for one ULB by using ARC GIS or equivalent software. OR Tenderer should have joint venture or consortium with the agency that who has experience in preparation of managing, creating and analyzing GIS data for one ULB by using ARC GIS or equivalent software. 6) Tenderer should have experience in supply and installation of electromagnetic flow meter not less than 100 mm dia OR Tenderer should have joint venture or consortium with the agency having experience in supply and installation of electromagnetic flow meter no less than 100 mm dia 7) Tenderer should have experience of supply and installation of billing software and Maintenance/ support to billing software OR Tenderer should have joint venture or consortium with agency that who has the experience in O & M billing,collection of water tax with proven application software 8) Tenderer should have experience in conducting consumer survey of town or he should have joint venture or consortium with an agency who has experience in conducting consumer survey for water supply. 9) Main Contractor / bidder should have minimum experience certificate of at least Five sub work (as mentioned in Sr. No.2 to 8 above) and will be allowed for joint venture / consortium for remaining two sub works 10) Tenderar or bidder should have minimum turn over equal to or more than amount put to tender in last three years. The agency should submit the

14 necessary certificate from the chartered Accountant. 11) Tenderer and consortium partner should submit experience certificate duly signed not below the rank of Executive Engineer / Chief Engineer. 12) Tenderer should submit VAT registration certificate. 8 ISSUE OF BLANK TENDER FORMS.. The blank tender forms will be issued on cash payment of Rs.5,000/- (Rs. Five thousand only)+rs 200 VAT per set at in the office of Executive Engineer MJP.PMC Div. Pune-1 from.22/01/2013 To 11/02/ 2013 during To PM on working days. Tender fees once paid will not be refunded. If blank tender forms are required by post, then Rs. 1000/- shall be payable extra than basic price. The Executive Engineer MJP.PMC.Div. Pune-1 does not take any responsibility for any delay / failure due to postal registered delivery Tender forms will be issued to those contractors who are Pre-qualified by the Executive Engineer MJP PMC Div. Pune.-1 The tender documents will not be issued to those contractors who do not produce such documents. Similarly, contractors having adverse reputation will not be issued the tender forms. 9 RIGHT TO MODIFY THE TENDER DOCUMENTS. The right is reserved to revise or to amend the contract documents prior to the date of submission of tender or the receipt of the tender or to extend the date said above. Such revision, amendments or extension, if any, shall be communicated to all concerned in the form of corrigendum or by notice in the press as may be considered suitable. 10 PRE-TENDER CONFERENCE a) Pre tender conference is open to pre-qualified tenderers only and will be held on dated ----/ 01/.2013 at hours in the office of the Executive Engineer MJP. PMC. Div. Pune-1 b) The tenderers are free to ask for any additional information or clarification either in writing or orally and the reply to the same will be given in writing and this clarification referred to as common set of conditions, shall form

15 part and parcel of the tender document and shall be applicable to all tenderers. c) The tender submitted by tenderer shall be based on the clarifications, additional facilities issued (if any) by the MJP PMC Division Pune and this tender shall be unconditional. Conditional tenders will be summarily rejected. 11 DATE, TIME AND PLACE OF SUBMISSION OF TENDER. The last date for submission of sealed tender forms is ---- / /2013 up to Hrs. in the Office of the Executive Engineer MJP.PMC. Div.Pune MANNER OF SUBMISSION OF TENDER AND ITS ACCOMPANIMENTS. The tender shall be submitted in sealed Envelops as stated below. (A) Envelop No. 1 The first envelope clearly marked as Envelope No. 1 and Name of Work shall contain the following documents: a) Earnest money deposit receipt b) Certificate of registration in appropriate class. c) In case of partnership firms, certified copy of registered partnership deed and Power of Attorney to sign the tender documents and other proceedings pertaining to the work tendered. d) Letter of pre-qualification.from the appropriate authority. e) In case of conditional pre-qualification, additional documents as may be prescribed in pre-qualification. f) List of machinery and plants immediately available with the tenderer for use on this work and list of machinery proposed to be utilized on this work but not immediately available and the manner in which manner it is proposed to be procured. The condition, cost and location of machinery shall be indicated.

16 g) Details of works of similar type and magnitude carried out by the contractor with full details of cost of work, time taken for execution duly certified by the Executive Engineer of the organization. h) Details of Technical persons in the rolls of the tenderer giving qualification of each of them. i) Details of other works tendered for and in hand with value of work unfinished on the last date of submission of tender. The certificate from the Head of office under whom the works are in progress should be enclosed. j) Documents for full-filling eligibility criteria as mentioned above. k Every tenderer shall furnish along with the tender, information regarding the Income Tax and valid Income Tax clearance certificate. l) Sale Tax /VAT / Work contract Tax clearance certificate. All above documents should be enclosed in the in Envelope No-. 1. these documents are not completed or not found satisfactory, Envelope No-2 will not be opened. (B) Envelop No. 2 The B1 Form shall contain only the main tender including the common set of conditions/ stipulations issued by the MJP.PMC. Div. Pune after the pre tender conference, duly signed by the contractor. The tenderer should quote his offer, on printed B-1 form and Recapitulation sheet of the tender as percentage above / below / at par of estimated cost, at appropriate page of tender documents to be submitted in envelop 2. He should not quote his offer anywhere in envelop 1 on paper submission directly or indirectly. The tenderer shall quote his offer for the work as per details given in the main tender and also based on additional conditions / stipulations furnished by the department after pre-tender conference. The tender shall be unconditional.

17 C) Submission of Tender The two sealed envelopes No. 1 and No. 2 shall be put in one common cover and sealed. This sealed cover shall be marked on the left hand top corner as MHASWAD Water Supply Scheme,Under MSNA, Programme ( Reform Works ) Tal - Man, Dist - Satara The full name and address of the tenderer and the name of the authorised agent delivering the sealed cover containing the tender shall be written on the bottom left hand corner 13 VALIDITY OF OFFERS. 120 days (one hundred twenty days) from the prescribed date of submission of tenders. 14 DATE, TIME AND PLACE OF OPENING OF SEALED TENDERS. The sealed tenders will be opened in the office Executive Engineer MJP.PMC. Div. Pune-1 dated on ---- /. /.2013 at hours, if possible, in the presence of tenderers or their authorized representative, who wish to remain present. 15. MANNER OF OPENING OF TENDERS. The tenders will be opened on the date and place specified in the tender, if possible, in the presence of intending tenderer or their authorized representative, who may choose to remain present. Following procedure will be adopted for opening of tender. The tenderer or his representative attending the tender opening shall carry valid original power of Attorney

18 Envelop No 1 First of all, Envelope No. 1 of the tender will be opened to verify its contents as per requirements. If the various documents contained in this envelope do not meet the requirements of the MJP.PMC. Div. Pune-1 a note will be recorded accordingly by the tender opening authority, and the said renderer s Envelope No. 2 will not be considered for further action, but the same will be recorded. Envelop No 2 After opening of Envelope No. 1, if contents of Envelope No. 1 are found to be acceptable to the MJP.PMC. Div. Pune-1 then only this Envelope No. 2 shall be opened immediately. The tendered rates in Schedule B as percentage above / below the estimated rates put to tender shall then be read out. 16 RIGHT RESERVED / ACCEPTANCE OF TENDER / Right to reject any or all tenders without assigning any reason thereof is reserved by the Executive Engineer MJP.PMC. Div.Pune-1 and decision will be final and legally binding on the tenderers.. Conditional tender will be outright rejected. 17. INSURANCE. Contractor shall take out necessary insurance policy/policies so as to provide adequate insurance cover of execution of the awarded contract work from the Director of Insurance, Maharashtra State, Mumbai only. Insurance policy/policies taken out from any other company will not be accepted, however, if the same should be under the co-insurance cum servicing arrangements approved by the Director of Insurance. If the policy taken out by the contractors is not on coinsurance basis (G.I.F. 60% and Insurance Company 40%) the same will not be accepted and amount of premium calculated by the Director of Insurance will be recovered directly from the amount payable to the contractors for the executed contract work which may be noted. will be final and legally binding on the tenderers.. Conditional tender will be outright rejected. 18 APPOINTMENT OF ARBITRATOR. Arbitrator will not be appointed. In case of any dispute, the decision given by the Executive Engineer MJP.PMC. Div. Pune-1 will be final. If at all the contractor goes in court, in the interest of work, the process of getting work done from another contractor will be in continuation. 19. OFFER INCLUSIVE ALL TAXES The tenderer should quote his offer inclusive of all taxes, duties, octroi, service tax,royalty, Excise duty, works contract tax including all taxes as per the Act amended from time to time. 20 SPECIAL CONDITION / CLAUSE MHASWAD Municipal Council has appointed a Project Management Consultant (PMC.) for Supervising / Monitoring works under this contract, the contractor shall be liable to execute the work under the supervision of PMC with consultation of MHASWAD Municipal Council. All decisions regarding the work, in such cases, shall be taken by the PMC and MHASWAD Municipal Council will binding on the contractor. 21 ADDITIONAL CONDITIONS: a) BAR CHART.

20 1) The successful agency will have to submit the Bar Chart duly filled, before the execution of the work. The variation upto 10% in the time schedule given in the Bar Chart will be considered. If it is more than 10%, penal action as per N.I.T will be taken b) INCENTIVE 1) No insensitive will be granted in any case c) DEFECT LIABILITY PERIOD:- 1) 24 month from date of completion of test and trial of work as shall be recorded in Measurement Book d) MOBILISATION ADVANCE:- 1) No mobilization advance shall be granted in any case. e) ESCALATION CHARGES:- 1) No escalation charges will be given under this contract. 2) Payment shall be made on availability of funds by MHASWAD Municipal Council 3) In case of any dispute enforcement of this agreement decision of Executive Engineer MJP.PMC.
