Cheryl Branch Backgrund: The Ls Angeles City Planning Cmmissin cnducted a public hearing n Octber 8, 2015 regarding a request fr a Cnditinal Use Permit (CUP) t allw the peratin, use and maintenance f a Crrectinal Institutin fr inmates and parlees transitining back int sciety. The existing vacant tw stry structure will huse 140 (125 existing beds) beds and several administrative ffices. The cmplex is lcated n a 19,025 square ft parcel f land with 9 n -site parking spaces in the [Q] C2-1VL zne. A brief histry f the subject site is as fllws: 1982, Ry Evans, prperty wner purchased the 1730 W. Vernn Ave. prperty and began perating the prperty as the Bridge Back Residential Reentry Center thrugh funding frm the State f Califrnia. It first served as a 77-bed facility and was later upgraded t a 125-bed facility. 2009, Bridge Back reentry prgram lst its funding. Frm 2009 t 2013 the prperty remained vacant. Nvember 2013 a temprarily lease t MJB Transitinal Husing was executed t perate a Ls Angeles Winter Shelter prgram. Residents f the prgram were hused at the shelter frm 3:00 pm t 6:00 am every day. The prgram residents were released int the cmmunity frm 6:00 am t 3:00 pm. In Nvember 2014, MJB ended its lease. Public Hearing: On Octber 8, 2015, the Ls Angeles City Planning Cmmissin heard testimny frm residents, Planning Department staff and the applicant s representatives stating the benefits f the prpsed crrectinal institutin. Thse ppsing the prject iterated t the Planning Cmmissin the majr prblems that currently exist in the cmmunity. And mre specifically, that the prpsed lcatin is nt cnsistent with the intent f the existing Suth Central Cmmunity Plan;

4 : Appeal Justificatin Objective 2-l, T cnserve and strengthen viable cmmercial develpment. Plicies Prtect cmmercially planned/zned areas frm encrachment by residential nly develpment. The Suth Central Cmmunity Plan advcates gals, bjectives, plicies and prgrams that implement desired gals, ne such prgram require that a decisin-maker, make a finding that any prpsed residential nly develpment in a cmmercial area is cmpatible in scale, character and design with adjacent cmmercial develpment. That finding was nt made by the City Planning Cmmissin. At the cnclusin f public testimny, the Planning Cmmissin unanimusly apprved the applicant s request fr cnditinal use. On Octber 28, 2015 the Determinatin Letter was issued. The Subject Appeal: The appellant is aggrieved by the entire decisin made by the City Planning Cmmissin and emphatically believes this cmmissin has erred in its decisin t grant the cnditinal use permit. The subject site is lcated in an ecnmically depressed area f Suth Ls Angeles. It is an area inundated with criminal activity in excess f the City s average. 5 Appeal Justificatin - ', 1 ' v \C i.,* ;jb nt :.u-j.it I; f»" > r~ K 31 f1 One f many Liqur Stres I believe that the residents f Suth Ls Angeles subscribed t the ntin that transitinal halfway facilities are better placed in light industrial zned areas and/r in buildings that are far remved frm surrunding lw density residential and viable cmmercial ndes. This is a sentiment shared by the prpsed new Suth Ls Angeles Cmmunity Plan in that, it utlines a visin fr the lng term physical develpments, ecnmic revitalizatin, and cmmunity enhancements f Suth Ls Angeles and set frth actins t achieve the cmmunity s visin. Of the 13 majr east-west crridrs and the 19 nrth- suth crridrs, bth Vernn and Western crridrs have undergne transitin in recent decades due t factrs such as pr ecnmic cnditins and civil unrest, and as a result many businesses have mved ut f the area. In their wake they have left behind a prliferatin f mini-shpping malls and an vercncentratin f certain nuisance uses, including liqur stres, check cashing facilities, recycling centers, and drive thrugh fast fd establishments. The ppsitin t this develpment strngly supprts the Suth Ls Angeles Cmmunity Plan s -Land Use Gal #73: Plicy 13.1, prtect cmmercially planned and zned Neighbrhd Cmmercial area frm excessive encrachment by lw intensity nncmmercial uses; and Limit Incmpatible Uses; maintain the neighbrhd feel f areas designated Neighbrhd Cmmercial by limiting uses that impact the built envirnment, reduce walkability and cntain incmpatible peratins that spill ver int the residential neighbrhds. In cnclusin, I recmmend that the Planning and Land Use Management Cmmittee supprt ur cmmunity s request f verturning f the City Planning Cmmissin s decisin and deny the request fr a Cnditinal Use Permit t allw a Crrectinal Institutin n prperty lcated at 1730 W. Vernn Avenue in the City f Ls Angeles. The cmmunity f Suth Ls Angeles
